1 OFFICIAL PROCEEDINGS DUNN COUNTY BOARD OF COUNTY COMMISSIONERS December 20, 2017 Notes MEMBERS PRESENT: Commissioners Scott, Pelton, and Hauck. Commissioner Dukart appeared via conference call. OTHERS PRESENT: Auditor Dolezal, States Attorney Merriman, Road Superintendent Zimmerman, Del Olson, Jeremy Wood and Darin Schaeffer. Chairman Hauck called the meeting to order at 9:00 a.m. Chairman Hauck announced that the commission s reorganization and portfolio assignments will be done at the January 3rd meeting when the full commission is present. Road Superintendent Zimmerman and Del Olson appeared to report on the road department. The project management review by DOT on the Killdeer Mountain ER Project went well with no major omissions. Discussed the estimated cost for the addition and updates to the Halliday Shop. Motion by Commissioner Pelton, seconded by Commissioner Dukart, to contract with JLG as architect on the project and proceed with a Construction Manager at Risk (CMAR). Upon roll call vote, all voted aye, and the motion carried. Discussed permits for temporary water lines in county right of way. States Attorney Merriman will review the draft before a decision is made. Darin Schaeffer, Bartlett & West, appeared to report on the projects his firm is working on. Design on the 15 th St. and 91 St Ave SW project is approximately 70% complete. 2 nd St. NW survey data is complete and compiling data for design. Jeremy Wood, Northern Plains Engineering appeared to thank the commission for the opportunity to work with Dunn County. Discussed sublease with Martin Construction for gravel from the James Perhus gravel pit. Commissioner Scott worked with States Attorney Merriman to draft the agreement for an estimated fifteen thousand yards of modified class 13 gravel. Dunn County will not pay for any reject gravel. Motion by Commissioner Dukart, seconded by Commissioner Pelton, to approve payment of 10,000 yards from the 2017 budget. All members voted aye, and the motion carried. Discussed Pavlicek gravel lease. The county will improve the section line for a pit road but not to build it up or maintain it as a county road.
2 By consensus, the commission agreed not to lease gravel in northern Stark County at this time as there is an adequate supply of gravel in southern Dunn County. By consensus the commission agreed to haul 50,000 60,000 yards of gravel from the Schmalz pit and stockpile in the eastern part of county this winter as weather permits. Motion by Commissioner Scott, seconded by commissioner Pelton, to approve the following 2018 Beer and Liquor Licenses: Dunn County Golf Association, Killdeer, ND Ken Danks, Skunk Bay, Mandaree, ND Farmers Union Oil d/b/a Western Choice Cooperative, Manning, ND Forrest Nash, The Doghouse, Manning, ND J & J Investments, LLC, McKenzie Bay New Hradec Catholic Workmen, New Hradec, ND Upon roll call vote, all voted aye, and the motion carried. Dessie Calihou, HR Director, appeared to report on the sick bank policy. Motion by Commissioner Scott, seconded by Commissioner Pelton, to table until the Jan 3 rd meeting in order to discuss when the full board is present. The motion carried. It was agreed that for the time being employees will not lose their accrued hours as of January 1 st, By consensus, the commission set Friday, January 19 th as the date for the employee training event At the HPCC. Melissa Pavlicek, Social Services Director appeared to report on Social Services and the Veteran s Services. Foster Care: four children Child Protection: Eleven open cases Christmas for Kids: 129 children received gifts Food Baskets: Approximately $2000 worth of food purchased Deb Krebs was hired as Administrative Assistant, and started work on December 19 th. The new Social Worker will begin on Jan 2 rd. The Veteran s office will hold an open house at the HPCC in January. Janet Wanek, County Extension Service appeared to report on the Extension Office. Two candidates were interviewed for the Agricultural Agent. An offer for the position has not been made yet. Motion by Commissioner Dukart, seconded by Commissioner Pelton, to approve the following applications: 1. Craig Dvirnak of Killdeer ND, filed a Conditional Use Permit for a Temporary Water Pumping Station piped to wells located on the SE4 of section The property is zoned Rural Preservation and owned by Craig Dvirnak. 2. Willard Stickel or Daniel Stamness of Dickinson ND, filed a Conditional Use Permit for an up to a 40 Communication Tower located in the NE4 of section The property is zoned Rural Preservation and owned by Kim and Ann Knutson. 3. Willard Stickel or Daniel Stamness of Dickinson ND, filed a Conditional Use Permit for an up to a 40 Communication Tower located in the SW4 of section The property is zoned Rural Preservation and owned by North Dakota Department of Trust Lands. 4. Willard Stickel or Daniel Stamness of Dickinson ND, filed a Conditional Use Permit for an up to a 40 Communication Tower located in the SW4 of section The property is zoned Municipality and owned by Mikal and Kelli Schollmeyer. 5. 6 All voted aye, and the motion carried. Administrator Rohde presented the First reading for an amendment to the ordinance for the approval of temporary water pumping stations. Motion by Commissioner Scott, seconded by Commissioner Dukart, to approve the first reading. All voted aye, and the motion carried. The Medical Marijuana amendments were tabled by the Planning Commission until the Sheriff s Office can meet with them and provide input. Administrator Rohde noted that the Planning Commission meetings will be held at 6:00 p.m. January through April.
