1 Minutes Hurley City Council Regular Meeting Monday, December 11, 2017 The Hurley City Council met for their regularly meeting at City Hall on Monday, December 11, Mayor Linda Nelson called the meeting to order at 7:00pm. Present at roll call: Council members Tom Nelson, George Osterloo, Kelly Jorgensen, Lester Jahnig, Eric Petersen and Duane Jorgensen. Also present were City Clerk Tracy Hummel, Finance Officer Marcy Hillman, and Maintenance Supervisor Terry Johnson. Visitors in attendance were Deputy Sheriff John Roman, Attorney Gary Ward; arriving later were Alan Flyger and Keith Jorgensen. Agenda Approved Motion D. Jorgensen, 2 nd Jahnig to approve the agenda for the December 11, 2017 regular city council meeting. Roll: all votes aye; motion carries. With the arrival of Alan Flyger and Keith Jorgensen, Motion D. Jorgensen, 2 nd by Jahnig to amend the approved agenda to include these visitors who were inadvertently left off the original agenda. Roll: all votes aye; motion carries. Approve Minutes Motion K. Jorgensen, 2 nd Petersen to approve the minutes of the November 13, 2017 regular meeting. Roll: all votes aye; motion carries. Old Business There was nothing new regarding the lighting project for Center Avenue. Cemetery land was discussed. D. Jorgensen had met with Bondesen to negotiate a price for land to expand the cemetery. Jorgensen reported that until all the property Bondesen owns that is within city limits is annexed out of the city, no further discussions would be held regarding the purchase of the land. Motion D. Jorgensen, 2 nd by Osterloo to move to have the remaining property of Bondesen to be annexed out to Hurley Township. Roll: all votes aye; motion carries. Public Meeting Motion Jahnig, 2 nd by Osterloo to approve the request to vacate streets brought before the council by Gary Ward on behalf of Jim Bondesen, representing the Olive Sanborn estate. Roll: all votes aye; motion carries. RESOLUTION NO WHEREAS, a written petition has been presented to the City signed by the owner of the property adjoining Park Boulevard and Illinois Street in Hurley and requesting the vacation of a part of each of said streets; AND WHEREAS a public hearing has been held on said petition after notice of said hearing as required by statute;

3 AND WHEREAS, the City Council finds that good cause exists for vacation based upon the facts and reasons set out in said petition; AND WHEREAS, the City Council deems it advisable and in the best interest of the municipality to vacate the requested parts of said streets; NOW, THEREFORE, BE IT RESOLVED that the petition requesting the vacation of the parts of the streets described as: a) That portion of Park Boulevard lying between Outlot 25 on the west side thereof and the W1/2 of Outlot 24 on the east side thereof running from the northern boundary of Block 42, as extended, then northerly to 283 rd Street. b) That portion of Illinois Street lying between Outlot E and W1/2 of Outlot 24 on the north side thereof and Block 42 on the south side thereof running from the western boundary of the W1/2 of Outlot 24, as extended, then westerly to Iowa Street is granted and that the described parts of said streets are hereby vacated. Dated this 11th day of December, Motion K. Jorgensen, 2 nd by Jahnig to approve the request to vacate streets brought before the council by Ron Loe. Roll: all votes aye; motion carries. RESOLUTION NO WHEREAS, a written petition has been presented to the City signed by the owner of the property adjoining Center Avenue, Sioux Street, Dakota Street and Main Street in Hurley and requesting the vacation of a part of each of said streets; AND WHEREAS a public hearing has been held on said petition after notice of said hearing as required by statute; AND WHEREAS, the City Council finds that good cause exists for vacation based upon the facts and reasons set out in said petition; AND WHEREAS, the City Council deems it advisable and in the best interest of the municipality to vacate the requested parts of said streets; NOW, THEREFORE, BE IT RESOLVED that the petition requesting the vacation of the parts of the streets described as: a) That portion of Sioux Street lying between Lots 12, 19, 20 and 21 of Block 16 to the west; and Lot 1 of Block 56 to the east; and Outlot J which abuts that portion of Sioux Street to the east and south. b) That portion of Dakota Street lying east of Outlot A of Wagner s Subdivision; and north of Outlot J and south of Lot 19 in Block 16. c) That alley that runs east/west to the south of Lots 1-12 of Block 16; that is north of Lot 13 and Lot 21 of Block 16; and runs between Lots 1-6 of Block 56 to the north and Outlot J to the south. d) That portion of alley that runs north/south between Lots of Block 16 to the west; and Lots of Block 16 to the east is granted and that the described parts of said streets are hereby vacated.

4 Dated this 11 th day of December, Old Business (cont d) Progress regarding the installation of water meters was discussed. If you have not yet called to have your new meter installed, please contact City Hall at at your earliest convenience. All residents are required to have the new meter installed. There were no building permits to discuss. Motion Jahnig, 2 nd by D. Jorgensen to approve the 2 nd reading of Ordinance , Water Sewer Rates. Roll: all votes aye; motion carries. ORDINANCE # AN ORDINANCE OF THE CITY OF HURLEY, SD, AMENDING THE REVISED MUNICIPAL ORDINANCES OF THE CITY BY AMENDING CHAPTER 8.01, WATER PROVISIONS, SECTION , RATES FOR WATER SERVICE. Be it resolved by the Hurley City Council for Hurley, South Dakota, to set the water and sewer rates for all residential, commercial and industrial users as such: Water User Fee: $ $3.00 per 1,000 gallons of water used; and Sewer User Fee: $ $5.00 per 1,000 gallons of water used; and Sewer Debt Fee: $20.00 flat rate Technology Fee: $1.00 flat rate And be it further resolved that these water and sewer rates will go into effect January 1, 2018, for the bills mailed January 2, 2018 and due January 15, 2018, covering water used between November 25, 2017 and December 24, Adopted this 11 th day of December, Flooring at City Hall was not discussed as there was no information to present at this time. New Business Motion Nelson, 2 nd by K. Jorgensen to refund additional deposits paid by residents who have had their water turned off for non-payment in the past. Roll: all votes aye; motion carries. It was discussed to have Brandon Beck get certified for water. Motion Jahnig 2 nd by K. Jorgensen to approve the 1 st reading of Ordinance , Supplemental Budget for Roll: all votes aye; motion carries. Maintenance Supervisor Johnson gave specs on two dump trucks he had looked at. One was a 1989 Ford automatic with approximately 200,000 miles, 2 axle chassis being sold by Turner County at Weiman s Auction. We would need to add a box and plumbing for approximately $10,000. The other unit was an International with the 3 rd axle, a decent cab, but needing tires, windshield, dashboard and floor; this unit was being sold by a farmer for $14,000. Motion Jahnig, 2 nd by K. Jorgensen to approve bidding up to $2,000 on the dump truck chassis being offered by Weiman Auction. Roll: all votes aye; motion carries. D. Jorgensen said he would contact Weiman and submit the bid. Johnson mentioned that the generator had gone out during a recent power outage. He has called to have it repaired if under $500.00, if over they will call for prior approval.

5 Alan Flyger and Keith Jorgensen appeared before the council to discuss future housing development in relation to water/sewer. Council advised that when property gets developed for residences it is up to the developer to the utilities, streets, curb and gutter and sidewalks. There was also clarification that any residence within city limits cannot have a septic system, they must be on the public sewer system. Motion Jahnig, 2 nd by Osterloo to sign the Animal Control contract for Roll: all votes aye; motion carries. Motion Jahnig, 2 nd by K. Jorgensen to sign the Law Enforcement contract for Roll: all votes aye; motion carries. Adjourn There being no further business to discuss, Motion D. Jorgensen, 2 nd Petersen to adjourn the meeting at 8:51pm. Vote: all aye; motion carries. There will be a special meeting held on Tuesday, December 19 th, 2017, 5:30pm at City Hall.
