1 OFFICIAL PROCEEDINGS DUNN COUNTY BOARD OF COUNTY COMMISSIONERS December 19, 2018 MEMBERS PRESENT: Commissioners Pelton, Kleeman, Dukart, Marsh and Hauck OTHERS PRESENT : Auditor Dolezal, Road Superintendent Zimmerman, Del Olson, Darin Schaeffer, Jeremy Wood, Riley Rohde, Bob Procive, and Sandy Rohde/Acting Secretary. Chairman Pelton called the meeting to order at 9:00 a.m. Motion by Commissioner Dukart, seconded by Commissioner Kleeman to approve the agenda with the additions. All members voted aye, and the motion carried. Motion by Commissioner Hauck, seconded by Commissioner Marsh to approve the December 5 th, 2018 Commission minutes. All members voted aye, and the motion carried. Bob Procive, Interstate Engineering appeared to update the Commission on the 15 th Street project. Darin Schaeffer, Bartlett & West appeared to report on the projects his firm is working on. 15 th Street SW-waiting on paperwork from Baranko to generate a final estimate for approval, the project came in approximately 250,000 under budget. Wannemacher Road- waiting for paperwork for contract closeout and once received will generate a final estimate for approval, the project came in approximately 100,000 under budget. The consensus of the Commission is to proceed with moving forward with 98 th Ave south between 16 th street and 22 nd street. 2 nd Street NW- waiting on paperwork from Northern Improvement, once received will generate a final estimate for approval. Project came in approximately 80,000 under budget. 19 th Street-Mike Zimmerman will meet with John Sickler, January 2 nd, 2019 at 10:00am to discuss the Right of Way acquisition. Jeremy Wood, Northern Plains Engineering appeared to report on the projects his firm is working on. Rebsom Bridge: Project suspended for the season, construction will resume in spring. Gartner Road construction is completed. 101 st Ave (19 th to 16 th )-Constructed is completed except for punch list items. 104 th Ave SW (from ND 22 to 4 th St SW) working on obtaining easement and a February 20 th bid opening has tentatively been scheduled. 111 th Ave NW (from 5 th St. NW to 9 th St. NW)-working with utility companies on potential adjustments/relocations. A March 6 th bid open has tentatively been scheduled. 5 th St. NW (from 119 th Ave NW to 114 th Ave NW & 114 th Ave NW (from 5 th St NW to 6 th St NW)- Construction is expected in 2019, a March 20 th bid open has tentatively been scheduled. 30 th Street (East of ND 22)-Engineer estimate for grading project and the traffic count have been completed. Coordinating with utility companies on potential adjustments/relocation, a March 20 th bid open has tentatively been scheduled. 8 th St. Slide and 119 th Ave. Clean out of 1 st dugout is completed. Construction is expected in 2019, an April 3 rd bid opening has been scheduled. Jeremy Wood will be meeting with Gary Terres on site, December 20 th at 10:00 am to show him the design. Motion by Commissioner Dukart, seconded by Commissioner Marsh to table the raising of the culvert concerning the Schwartz/Schwenk issue. All members voted aye, and the motion carried. Dunn Center South (from ND 200 to 11 th St. S.)-Working on finishing design and preparing easement exhibits, construction is expected in 2020 Little Missouri Bay Campground-Working on plans for road network and Campsite for Phase 1 of Campground. Plans will be review prior to submitting to Corp of Engineers. Discussion was held on having the Dunn County Road Superintendent and Commissioner /Road portfolio holder do final inspections of completed roads with the Engineering Firm that has completed the project.

2 Commissioner Hauck discussed the Temporary easement with Mike Buresh slide. Commissioner Hauck recommended that the county pay for 11 acres for Motion by Commissioner Dukart, seconded by Commissioner Hauck to pay Mike Buresh for 11 acres of the slide for All members voted aye, and the motion carried Del Olson, Assistant Road Superintendent appeared to report on the road department and what projects are currently working on. Discussion was held on roads in Manning and New Hradec. Motion by Commissioner Hauck, seconded by Commissioner Marsh to have Darren Schaeffer from Bartlett and West look into the road issues in Manning and New Hradec. All members voted aye, and the motion carried. Mike Zimmerman-reported on the property that is for sale located in Northridge Industrial Park north of Killdeer that would possibly work for Killdeer s Road Department. Commissioner Hauck also reported that he had received information on property in Halliday for sale that would possibly work for Halliday s Road Department. No action was taken on this as Commissioner Hauck recommended that the county decided which direction they will be going in the future for the Killdeer and Halliday shops. Mike Zimmerman and Daryl Dukart reported on the WDEA meeting they attended in Watford City. Break Jeff Trlica with RimRock Oil & Gas appeared to request approval for a section line encroachment for the Existing Skunk Creek H & 9H3 and the Skunk Creek HA, 9H3A, 9H3B, 16H, 16H3, 16HA, 16H3U and 1HU located in the NW4SW4 of section 10-T148-R93. Motion by Commission Dukart, seconded by Commissioner Hauck to approve the section line encroachment. All voted aye and the motion carried. Ron Mc Cloud appeared on behalf of citizens of Dunn County concerning engine brakes from truck traffic. McCloud would recommend that the county come up with a noise ordinance for engine brakes. Motion by Commissioner Dukart, seconded by Commissioner Hauck to table this discussion to work with States Attorney Elect Stephanie Davis and Sheriff Kuhn on moving forward with the ordinance. All members voted aye, and the motion carried. Denise Brew-Emergency Manager appeared to update the Commission on the EMPG, FEMA 2013, LEOP, LEPC, and reported that the Hazardous Material Response Plan has been completed. Denise Brew has also sent out Mutual Aid agreements to surrounding Counties to be signed, and she is working on updating the LEPC member list. Motion by Commission Kleeman, seconded by Commissioner Dukart, to approve the following portfolio assignments for 2019: Roads/Gravel-Scoria Commissioners Hauck and Marsh Sheriff Commissioners Pelton and Dukart SW Corrections Commissioner Dukart Human Resources Commissioners Hauck and Kleeman Social Services Commissioners Pelton and Kleeman Building Projects Commissioners Dukart and Marsh Airport Authority Commissioners Hauck and Kleeman Emergency Management Commissioners Pelton and Kleeman (Kleeman PIO) County Agent Commissioners Kleeman and Hauck Park Board Commissioners Dukart and Marsh Commissioners Pelton and Kleeman will complete current Building project. Upon roll call vote, all voted aye and the motion carried. Motion by Commissioner Hauck, seconded by Commissioner Dukart, to appoint the following County Officials for 2019: Nicole Carlson Tax Director Sandy Rohde Code Administrator and 911 Coordinator Dessie Calihou Human Resources Denise Brew Emergency Management Melissa Pavlicek Veteran s Service Officer Kirk Roll Coroner

3 Upon roll call vote, all voted aye and the motion carried. Motion by Commissioner Dukart, seconded by Commissioner Kleeman, to re-appoint Scott Lazorenko to the Water Resource Board. All voted aye, and the motion carried. Motion by Commissioner Hauck, seconded by Commissioner Kleeman to re-appoint Lorin Dvirnak, and Glen Eckelberg to the Planning Commission. All voted aye, and the motion carried. Motion by Commissioner Dukart, seconded by Commissioner Kleeman to appoint Commissioner Marsh to the Planning Commission. All voted aye, and the motion carried. Motion by Commissioner Hauck, seconded by Commissioner Marsh to re-appoint James Mousseau to the Airport Authority Board. All voted aye, and the motion carried. Motion by Commissioner Dukart, seconded by Commissioner Marsh to re-appoint Cliff Ferebee and Commissioner Kleeman to the Weed Control Board. All voted aye, and the motion carried. Motion by Commissioner Hauck, seconded by Commissioner Dukart to re-appoint Julie Karey and Candice Benz to the Social Services Board. All voted aye, and the motion carried. Motion by Commissioner Dukart, seconded by Commissioner Kleeman to re-appoint Denise Brew as the Southwest District Health Representative. All voted aye, and the motion carried. Motion by Commissioner Hauck, seconded by Commissioner Marsh to re-appoint Commissioner Dukart as the Badlands Human Service Center Representative. All voted aye, and the motion carried. Motion by Commissioner Kleeman, seconded by Commissioner Dukart to re-appoint Casey Gjermundson to the School District Reorganization Committee. All voted aye, and the motion carried. Motion by Commissioner Dukart, seconded Hauck to appoint Ryan Schleppenbach and Commissioner Marsh to the Dunn County Housing Authority. All voted aye, and the motion carried. Motion by Commissioner Kleeman, seconded by Commissioner Hauck to re-appoint Carie Praus, Tom Benz and Sandy Rohde to the Job Development Authority Board. All voted aye, and the motion carried. Motion by Commissioner Dukart, seconded by Commissioner Kleeman to appoint Stephanie Davis Elect States Attorney to the School District Tuition Appeals Committee. All voted aye, and the motion carried. Greg Benz County Agent s Reported that the Extension office will be holding its Open house on The National Youth Summit will be held January 10 th, 2019 in Washington DC. Pesticides days have been set for Manning and Halliday and Benz went over other event dates that have been scheduled. Dessie Calihou Human Resources, that the deadline date to enroll in the sick date bank is January 12 th, 2019 and Calihou also handed out the 2019 Payroll and Holiday Calendar. Motion by Commissioner Hauck, seconded by Commissioner Kleeman, to approve the following 2019 Beer and Liquor Licenses: Dunn County Golf Association, Killdeer, ND Ken Danks, Skunk Bay, Mandaree, ND Farmers Union Oil d/b/a Western Choice Cooperative, Manning, ND Stephen Todd II, The Doghouse, Manning, ND New Hradec catholic Workman, New Hradec, ND Upon roll call vote, all voted aye, and the motion carried Commissioner s reviewed the Financial Report, the General Fund Account balance is approximately 37 million dollars. Auditor Tracey Dolezal recommended that the Commission move 1 million dollars to the Unorganized Township Fund, and 7 million dollars to the Road & Bridge Fund. Motion by Commissioner Hauck, seconded by Commissioner Dukart to move 1 Million dollars to the Unorganized Township Fund and 7 million dollars to the Road & Fund. All voted aye, and the motion carried.

4 Motion by Commissioner Dukart, seconded by Commissioner Kleeman to have Tracey Dolezal and Wil Albrecht look into buying covers for the corners of the TV s and the post in the hallway. All voted aye, and the motion carried. Discussion was held on the Veterans Service contract with Stark County. Motion by Commissioner Dukart, seconded by Commissioner Kleeman to discontinue the cost share with Stark County Veteran Service Officer. All voted aye, and the motion carried.
