1 OFFICIAL PROCEEDINGS DUNN COUNTY BOARD OF COUNTY COMMISSIONERS December 17, 2014 MEMBERS PRESENT: Commissioners Dukart, Scott, Pelton, Hauck and Kleemann OTHERS PRESENT: Tracey Dolezal, Ross Sundeen, Jeremy Wood, Fil Askerlund, Darrin Schaefer, and Dave Leftwich. The meeting was called to order by Chairman Hauck at 9:00 a.m. Discussed bringing in a couple of Architect s to interview about possible plans and design for courthouse expansion. Jeremy Wood, Northern Plains Engineering, appeared to report on the projects his firm is working on. A February 2015 bid opening is planned for the Houghton, Gas Plant/Tank Battery, 28 th St SW extension and 95 th Ave SW North of Highway 200. A spring 2015 bid opening is anticipated on the following road projects: Dunn Center South to 11 th St SW Kovash Road Phase II Intersection of 106 th Ave and 25 th St SW The Kisse Bridge Replacement and Killdeer Mountain Road Emergency Relief (ER) project are scheduled to bid with NDDOT in spring Fil Askerlund, Epic Engineering, appeared to report on the South Heart Road. Askerlund will check with NRCS design and cost share to move dam that backs up into the right ofway on the project. The Commission was in agreement to have cable barriers installed along the South Heart Road Project where slope regulations indicate. Darin Schaefer, Bartlett & West, appeared to report on the projects his firm is working on. The public input meeting was held on December 16 th and was well received. Preliminary comments indicate a grading plan with some type of road surfacing will likely be advanced. Coordination with current elevation data collected by Bartlett & West and the DOT on their Highway 22 project through Manning will be conducted in order to address potential drainage relief. Steve Langley, Houston Engineering, appeared to update the County on the Highway 200 survey progress east of Killdeer to Highway 8 at Halliday. The anticipated date for survey completion is March 15 th.
2 Board appointments were discussed and the following appointments were made upon a motion by Commissioner Scott and 2 nd by Commissioner Dukart: Social Service Board: Pastor Rachel Simonson JDA: Reappointments -Robert Kleemann and David Perhus New appointments - Janice Isaak, Melissa Benz, Dan Aichele Lisa Guenther, Clerk of Court/Recorder appeared to request matching funding for a court facilities grant. The grant would require 25% County match for a judge s bench and jury box. Motion by Commissioner Dukart, 2 nd by Commissioner Scott, to support the grant and provide the 25% match. All voted aye, and the motion carried. Motion by Commissioner Dukart, 2 nd by Commissioner Kleemann, to approve the utility permits. All voted aye and the motion carried. Human Resources Director, Denise Giffin appeared to discuss vacation accrual for employees. Social Services administrative rules state that employees can roll over 240 hours and continue to accrue vacation. In order to be consistent and treat all county employees equally, Giffin recommended that the County Vacation Accrual Policy follow the state social services administrative rules. Motion by Commissioner Dukart, 2 nd by Commission Kleemann, to rescind the Vacation Policy contained in the Dunn County Employee Handbook issued on June 1, 2014 and the Vacation Accrual Resolution/Policy dated July 16, 2014 and adopt the new Vacation Rollover and Accrual Process Resolution/Policy proposed by the HR Director. Upon roll call vote, all voted aye, and the motion carried. Director Giffin discussed the Tax Director s Office. Bonnie Bell has accepted Deputy Tax position and will start January 5 th, Discussed expectations, training and work that must be completed in the coming year. HR Director Giffin proposed Auditor Dolezal be named Tax Director and also hire a second person as a temporary for six months to bring the office and projects up to speed. Dolezal will train and supervise the department personnel. Motion by Commissioner Dukart, 2 nd by Commissioner Scott, to approve the recommendations and the appointments as follows: Tax Director: Tracey Dolezal Planning & Zoning Code Administrator: Sandy Rohde Human Resources: Denise Giffin Emergency Manager: Denise Brew Coroner: Kirk Roll All voted aye, and the motion carried. KLJ Engineer, Justin Hyndeman, appeared to update the Commission on the Little Knife Stream Restoration and to present the report that will be sent to the EPA. Motion by Commissioner Dukart, 2 nd by Commissioner Scott, to accept the report. All voted aye, and the motion carried.
3 Also appearing to introduce themselves on behalf of KLJ were Nici Meyer, Jennie Krause. Jessica Clifton, newly appointed Stark County Veteran s Service Officer, appeared to introduce herself and to inform the Commission that she plans to continue to have office hours in the JDA Office in Killdeer twice a month for now. If there is enough interest she may be increasing the amount of time available in Killdeer. Kirk Roll, Coroner submitted information on a power lift cot for the coroner vehicle. Motion by Commissioner Kleemann, 2 nd by Commissioner Pelton, to purchase a power cot for the Coroner. All voted aye, and the motion carried. Sheriff Coker appeared to discuss the need for housing for employees. Also discussed was emergency assistance for indigent individuals in the county over the winter. The Commission suggested Sheriff Coker, Social Services and Churches get together to discuss and put together a plan for emergency/immediate need for individuals. Sandy Rohde, Code Administrator, appeared and presented the following Planning & Zoning applications that were approved at the December 9 th hearing: 1. Shane Dolezal will appear on behalf of his Violation to Dunn County s Land Development Code and his Conditional Use Permit. The violation is mining within the required setback distance of 300 feet of the adjacent property on the east. The mine is located in the W2 of section and owned by Shane Dolezal. 2. John Reiss of Killdeer ND filed a Conditional Use Permit for his renewal of his RV Park for 24 hookups; this is a renewal of his previous Conditional Use Permit that is located in the NW4SW4 of section on Lot 1 JR Industrial Park. The property is zoned Rural Development and owned by John Reiss. 3. Russell G. Kubik of Grand Forks, ND filed a Conditional Use Permit for Truck Parking at a Salt Water Disposal with no more than 20 trucks located in the SW4 of section adjacent to a Saltwater Disposal. The property is zoned Rural Preservation and owned by George Kubik Irrevocable Trust. 4. Gary Myers of Killdeer, ND filed a Conditional Use Permit for a Commercial Sign located on Lot 8 Block 3 Northridge Subdivision lying in section The property is zoned Rural Development and owned by Polar Service Center. 5. Curtis Olson of Nisswa, MN filed a Conditional Use Permit for a 4 to 5 bedroom Mobile Home for Temporary Housing located on Lots 1-4 Block 1 Joyhaven 3 rd Subdivision lying in the NE4 section The property is zoned Rural Development and owned by Curtis Olson. 6. Gabe Schell of Bismarck ND, representing KLJ on behalf of NDDOT filed a Conditional Use Permit for a 33 Acre Borrow pit located in the N2 of section The property is zoned Rural Preservation and owned by Dean and Carleen Dvorak. 7. Gabe Schell of Bismarck ND, representing KLJ on behalf of NDDOT filed a Conditional Use Permit for a 16 Acre Borrow pit located in the NE4 of section The property is zoned Rural Preservation and owned by Ted & Reann Kautzman.

Gabe Schell of Bismarck ND, representing KLJ on behalf of NDDOT filed a Conditional Use Permit for a 40 Acre Borrow pit located in the NW4NE4 of section The property is zoned Rural Preservation and owned by Sherman & Pamela Biffert. Motion to approve the applications by Commissioner Dukart and 2 nd by Commissioner Kleemann. All voted aye, and the motion carried. Rohde presented the second reading of the amendments from November Motion by Commissioner Dukart, 2 nd by Commissioner Scott, to approve the 2 nd reading of the Land Development Code Amendments. All voted aye, and the motion carried. Subdivision Regulation Amendments: Rohde presented the Subdivision Regulation Amendments for a first reading. Motion by Commisioner Scott, 2 nd by Commissioner Dukart, to approve the recommendations for the Subdivision regulations with the added statement, excluding residential subdivisions as a requirement for landscaping. Upon roll call vote, all voted aye, and the motion carried. Mike Zimmerman and Del Olson appeared to report on the Road Department. They will work on grant application for the Wierson Road and safety project on 106 th & 25 th St SW. Safety Projects are awarded on a 90/10 share. Rumble strips, sign upgrades. Zimmerman recommended that we do not go with lighted intersections at this time as it is to costly to supply power for the lights. Consensus of the Commission was to just do rumble strips and sign upgrades for safety grant. It was noted that the Housing Authority would like a Commissioner on the Board. Commissioner Kleemann will attend as a representative of the County at the meetings. The Commission asked Zimmerman to get prices for overhead crane for the Manning shop and bring back for discussion. Zimmerman will also look into a wet sweeper for the new shop. Zimmerman informed the Commission that he will advertise for 2015 Soil Stabilization, Crushing, and Rental bids to be opened at the February 4th meeting. Janet Wanek, Home Extension Agent, appeared to report on the Extension Office. Beef Day will be on Jan 14 th. The 4-H breakfast will be on February 8 th. Deanna Varner, Deputy Auditor/Treasurer appeared and presented the Pledge of Assets for the banks the county does business with. 1 st International Bank and Trust American Bank Center The Union Bank
