1 OFFICIAL PROCEEDINGS DUNN COUNTY BOARD OF COUNTY COMMISSIONERS January 16, 2019 MEMBERS PRESENT: Commissioners Pelton, Kleeman, Dukart, Marsh and Hauck OTHERS PRESENT: Road Superintendent Mike Zimmerman, Del Olson, Darin Schaeffer, Jeremy Wood, Riley Rohde, Bob Procive, Dessie Calihou, Mike Brost, Dominic Hauck, Stephanie Davis, States Attorney and Sandy Rohde/Acting Secretary. Chairman Pelton called the meeting to order at 9:00 a.m. Motion by Commissioner Kleeman, seconded by Commissioner Dukart to approve agenda with the additions. All members voted aye, and the motion carried. Motion by Commissioner Dukart, seconded by Commissioner Hauck to approve the January 2 nd, 2019 Commission minutes. All members voted aye, and the motion carried. 1 st - Jeremy Wood, Northern Plains Engineering appeared to report on the projects his firm is working on. Rebsom Bridge Replacement-Construction is suspended for the season and the roadway/bridge is open to traffic. Gartner Road-Construction is complete. 101 st Ave (19 th St to 16 th St)-Construction is complete except for punch list. 104 th Ave SW (from ND 22 to 4 th St NW)-Working on easements with landowners, a March bid opening is anticipated with construction in th Ave NW (from 5 th St NW to 9 th St NW)-Working on easements with landowners, a March bid opening is anticipated with construction in th St. NW (from 119 th Ave NW to 114 th Ave NW) & 114 th Ave NW (from 5 th St NW to 6 th St NW)-working with Landowners on project and easements, a March bid opening is anticipated with construction in th Street (East of ND 22)-Meeting with Landowners to discuss project and obtain easements. Engineer estimate, traffic count is complete, coordinating with utility companies on potential adjustments/relocation. A March or April bid opening is anticipated. 8 th St. Slide and 119 th Ave-Meeting with Landowners and discussion the project and obtaining easements. A March or April bid opening is anticipated. Dunn Center South (from ND 200 to 11st. South) - Working on finishing the design and preparing easement exhibits, construction is expected in Little Missouri Bay Campground-Plans are complete and will be reviewing the plans with Carie Boster and submitting the plans to Corps of Engineers. 2 nd -Darin Schaeffer, Bartlett & West appeared to report on the projects his firm is working on. Wannemacher Road- Final Pay Request #4 of 23, was submitted for approval. Motion by Commissioner Dukart seconded by Commissioner Kleeman to pay the request #4 of 23, All members voted aye, and the motion carried. 2 nd Street NW-submitted final estimate to Northern Improvement and waiting for approval. 15 th Street SW-waiting on closeout items from Baranko. 98 th Ave SW and 19 th Street-preliminary drawings have been drafted showing options for the intersection of 19 th Street SW and 98 th Ave SW. Motion by Commissioner Dukart, seconded by Commissioner Hauck to offer the 55mph design to Mr. John Sickler for his approval. All members voted aye, and the motion carried. Manning Street Improvements-Darin Schaeffer discussed options for drainage. New Hradec Street Improvements-Specific Authorization 15 is presented for signature, with a 90 day turnaround. Bob Procive Surveyor Interstate Engineering-went over projects they are working on in Dominic Hauck appeared to discuss maintenance of the first half mile of the section line road located between the S2 of section and Motion by Commissioner Hauck, seconded by Commissioner Kleeman to allow Hauck to improve the first half mile of the section line between sections 2 & and the county will provide scoria and blade the road. All members voted aye, and the motion carried. Del Olson, Assistant Road Superintendent appeared to report on the road department and what projects are currently being worked on. Break

2 Denise Brew, Emergency Manager appeared to discuss the replacement for Donna Scott who was on the Southwest Crib Committee. Motion by Commissioner Hauck seconded by Commissioner Dukart to appoint Craig Pelton. All members voted aye, and the motion carried. Denise Brew also submitted a copy of the signed Hazardous Materials Response Procedure Plan that was approved by the LEPC. The Regional Mitigation Hazardous Waste Plan is to being update and KLJ is contracted to do the update. Presented an update on a recent oil spill in the County s ROW, Denise Brew would like direction on who is required to clean up the spill. Motion by Commissioner Hauck seconded by Commissioner Dukart to have Brew hire a company to clean up the spill. All members voted aye, and the motion carried. Dessie Calihou, Human Resource appeared to discuss the Learning Management System training. Motion by Commissioner Dukart seconded by Commissioner Marsh to approve Dessie Calihou to move forward with the training. All members voted aye, and the motion carried. Dessie Calihou updated the Commissioners on the Appreciation Diner that will be held January 25 th, 2019 and the wellness program. Sandy Rohde, Code Administrator appeared on behalf of the CUP applications that were recommended for approval at the January Zoning Hearing. Motion by Commissioner Kleeman, seconded by Commissioner Dukart to approve the following applications: Chad Miller or Phil Olson of Dickinson ND, has filed a Conditional Use Permit for Fuel Storage as an Accessory Industrial Use located in the Five Diamonds Subdivision Block 2 Lot l. The property is zoned Rural Development and owned by Robinson Property Holdings, LLC. Amos Buehner of Dunn Center ND, has filed a Conditional Use Permit for a Water Depot with 2 ponds and up to 10 Frac Tanks located in the SW4 of section The property is zoned Rural Preservation and owned by Austin Buehner. Amos Buehner of Dunn Center ND, has filed a Conditional Use Permit to amend his Conditional Use Permit to add a Holding Pond located in the NE4 of section The Property is zoned Rural Preservation and owned by Kevin Buehner. All voted aye, and the motion carried. Sandy Rohde, Code Administrator appeared on behalf of Crew Housing fees, Rohde would like to have the crew housing fees for Target Logistics and Nabors back to the 10% total fees as both facilities do not have any occupants. Motion by commissioner Kleeman and seconded by Commissioner Marsh to reduce Target Logistics and Nabors crew fees. All voted aye, and the motion carried. Portfolio Reports: Sheriff: Sheriff Kuhn appeared to discuss updated budget and plans for the department. SW Corrections-Commissioner Dukart update the Commission on SW Corrections Facilities. Building projects-new Courthouse addition anticipated to be complete by March 11 th, 2019 with the exception of Landscaping. Airport Authority-plans are underway to build a new terminal in Nicole Carlson-Tax Director appeared to report on the High Performance Leadership Training she completed. Commissioner Dukart encourage Dunn County to send two or three employees to participate in the training that will be starting in April. Motion by Commissioner Dukart seconded by Commissioner Hauck to have 3 more Dunn County employees to participate in the course. All voted aye, and the motion carried. Greg Benz County Agent s Reported on the upcoming trainings and workshops. Melissa Pavlicek, VSO officer appeared to report on the VSO. Melissa Pavlicek will be done on the January 23 rd, Dessie Calihou, Human Resources will work on posting the position which is currently hours per week. Motion by Commissioner Hauck, seconded by Commissioner Marsh to approve the Utility permit. All voted aye, and the motion carried. Mike Zimmerman, appeared to report on the Road Department. Gravel procurement easements plan of Action are being worked on and working with the Engineering Companies on the easements needed for projects. Butler invited 7 people from Dunn Country go to see the Plant and Mike Zimmerman is working on evaluations for the Road employees. Commissioner Dukart updated the board on the Bills coming forth and the legislative comments for the session at the capital.
