1 OFFICIAL PROCEEDINGS KINGSBURY COUNTY BOARD OF COUNTY COMMISSIONERS De Smet, South Dakota March 8, 2016 The Kingsbury County Board of County Commissioners met Tuesday, March 8, 2016 at 8:30 AM in the County Commissioners meeting room in the Courthouse with Commissioners Roger Lee, Shelley Nelson, Roger Walls, Delmer Wolkow and Joe Jensen present. Chairman Lee presided. APPROVE AGENDA Jensen moved and Wolkow seconded to approve the agenda as updated. All present voting aye, motion APPROVE MINUTES Nelson moved and Walls seconded to approve the minutes of the February 16, 2016 meeting as presented. All present voting aye, motion HIGHWAY Dave Sorenson, Hwy Supt met with the Board to discuss road issues. Bid Letting Pursuant to Notice of Call for Sealed Bids as published in the official newspapers of the County, bids have been received by the County Auditor for furnishing Kingsbury County with the following items: Item 1, Road Oil; Item 2, Asphalt Hot Mix; Item 3, Gravel Crushing; Item 4, Fuel; Item 5, Pea Rock; Item 6, Pea Rock Hauling. Following are bidders, accepted bids and award of contract for various items. All bids, accepted and rejected, are available for inspection at the County Auditor s Office during normal working hours. Item 1 Two bids were received for road oil. Bidders were JEBRO and Flinthills Resources. Nelson moved and Jensen seconded to accept the low bid from JEBRO at $429 per ton for MC3000 and $574 per ton for MC s. All present voting aye, motion Item 2 Four bids were received for asphalt hot mix. Bidders were Bowes Construction, McLaughlin Schultz, Commercial Asphalt and Asphalt Paving. Jensen moved and Wolkow seconded to acknowledge Bowes Construction with the lowest bid but to accept all bids for the asphalt hot mix because the highway department uses various plants depending on the location they are working at in the county and availability of mix at the plants. All present voting aye, motion Item 3 Four bids were received for gravel crushing. Bidders were Bowes Construction, Rechnagel Construction, Brownlee Construction and Sterzinger Crushing. Walls moved and Wolkow seconded to award the

2 contract to Rechnagel Construction for the low bid of $1.71/ton. All present voting aye, motion Item 4 Two bids were received for gas and fuel. The bidders were Stern Oil Company and Cole Petroleum. Jensen moved and Nelson seconded to accept the bid from Cole Petroleum for $1.7144/gallon for #1 Diesel Fuel, $1.3966/gallon for #2 Diesel Fuel and $1.5337/gallon for Unleaded Ethanol Blend. All present voting aye, motion Item 5 One bid was received for pea rock. Walls moved and Wolkow seconded to accept the bid from LG Everest for pea rock at $6.45/ ton. All present voting aye, motion Item 6 One bid was received for pea rock hauling. Wolkow moved and Nelson seconded to accept the bid from Prairie States for pea rock hauling at $.139/ ton. All present voting aye, motion Bridge Inspection Agreement Walls moved and Jensen seconded to authorize accept the bridge inspection agreement and to allow Chairman to sign the agreement. All present voting aye, motion Travel Expenses Nelson moved and Walls seconded to approve travel expenses for the Highway Supt. to attend the Shortcourse Meeting in Oacoma on March 23-25, All present voting aye, motion Wolkow moved and Jensen seconded to approve travel expenses for the asphalt conference April 6-7, 2016 in Pierre. All present voting aye, motion RECORDING OF PLAT Wolkow moved and Nelson seconded to pass Resolution # to approve the recording of the following plat. All present voting aye, motion RESOLUTION # Plat of DeJong First Addition in the Southwest Quarter of Section 32, Township 110 North, Range 58 West of the 5 th P.M., Kingsbury County, South Dakota. DIRECTOR OF EQUALIZATION Tammy Anderson, DOE met with the Board to discuss equalization. The dates of April have been set aside as dates to hear appeals. Travel Request Walls moved and Jensen seconded to approve a travel request for the DOE to conference in Spearfish on May 23-27, All present voting aye, motion

3 Commissioner Jensen left the meeting at 9:55 AM. LEASE OF COUNTY OWNED PROPERTY Pursuant to notice published in the official newspapers of the county, a Public Auction was held for the lease of County Owned Agriculture Land at 9:30 AM in the County Commissioners meeting room. Chad Dylla, Shawn Geyer, and John Blackford were present. Successful bidder for the South 5 acres more or less of Outlot 3 in was Shawn Geyer with a bid of $ per annum for 3 years. Successful bidder for the 100 acres more or less in the NE ¼ was Chad Dylla with a bid of $ per annum for three years. Successful bidder for the Cropland in SW ¼ NE ¼, NE ¼ NE ¼, and NW ¼ NE ¼ of Section (23.3 acres) was John Blachford with a bid of $2350 per annum for three years. Nelson moved and Walls seconded to accept the bids from Shawn Geyer, Chad Dylla, and John Blachford, and authorized the Chairman to sign the lease agreements on behalf of Kingsbury County. All present voting aye, motion ACCEPT REPORTS The Register of Deeds, Sheriff and Director of Equalization office reports for the month of February were reviewed by the Board. Walls moved and Wolkow seconded that the Auditor s report with the Treasurer as of the close of business February 29, 2016 be accepted and placed in the Auditor s office for review. TRAVEL REQUEST Wolkow moved and Walls seconded to approve the travel request of Gregg Gass, State s Attorney, to attend the annual conference in Deadwood on May 5-6, All present voting aye, motion EXECUTIVE SESSION Nelson moved and Wolkow seconded to adjourn from regular session and move into executive session at 10:39 AM with Gregg Gass, State s Attorney, for contract negotiations and pending litigation. All present voting aye, motion Wolkow and Nelson seconded to adjourn from executive session and go back into regular session at 11:15 AM. All present voting aye, motion ANNUAL REPORT Amy Wilkinson, Auditor, presented the 2015 annual report to the Board. Walls moved and Nelson seconded to accept the 2015 annual report and place on file in the Auditor s office for review. All present voting aye, motion EXECUTIVE SESSION Wolkow moved and Walls seconded to adjourn from regular session and move into executive session at 12:06 PM for personnel and pending litigation. All present voting aye, motion
