1 The regular meeting of the Boyle County Fiscal Court was held on the 24 th day of April, 2018 at 10:00 a.m. Members present at the meeting were: Patty Burke John Caywood Jack Hendricks Dickie Mayes Phil Sammons Judge Harold McKinney Magistrate Donnie Coffman was absent from the meeting. Others present at the meeting were County Treasurer Mary Conley, County Clerk Trille Bottom, County Attorney Lynne Dean, Public Works Director Duane Campbell, Sheriff Derek Robbins, Jailer Barry Harmon, IT Director Bill Nichols, Circuit Clerk Cortney Shewmaker, Shannon Greene, Jacob Pankey, Brad Ellis, Steve Cline, Jennifer Kirchner, Jamey Gay, Gary Chidester, Steve Hunter, Christopher Herron, Tom Ellis, Hal Goode, Roger Trent, Mark Morgan, Mary Beth Touchstone, Chad Holderman, Parrie Kay Herring, Kate Clevenger, Christie Sharp, Derrick Collins, Crystal McPherson, Ruby Cline-Eaton, and Ben Kleppinger. Judge McKinney called the meeting to order. Magistrate Caywood gave the invocation. Perrie Kay Herring, a student from Kentucky School for the Deaf, led the Court in the Pledge of Allegiance. Judge McKinney made the motion to bestow the title of Honorary Magistrate upon Miss Herring. Magistrate Burke seconded the motion. The motion passed with all members voting in favor. Magistrate Sammons made the motion to approve the Fiscal Court Minutes from the April 10 th regular meeting. Magistrate Burke seconded the motion. The motion passed with all members voting in favor. Judge McKinney presented the Donate Life proclamation. April is National Donate Life Month. There are currently 118,000 people on the national waiting list. The Proclamation will be recorded in Miscellaneous book 12, page 314 in the Boyle County Clerk s Office. Crystal McPherson discussed Family Services Association. Family Services Association provides residents of Boyle County with emergency financial assistance. March 2018 has been a very busy month with water and electric bill increases. From July 2017 to February 2018, there have been 158 case management clients. Of those case management clients referred out, 70% did not return for assistance. For those that did receive emergency financial assistance, 85% did not return. There have been 611 unduplicated household bills paid. Judge McKinney discussed the reappointment of Ron Pemberton to the Ethics Commission Board. Mr. Pemberton is a joint appointment with the City of Junction City. Magistrate Sammons made the motion to reappoint Ron Pemberton to the Ethics Commission Board. Magistrate Caywood Mr. Pemberton s appointment will end June 30, Magistrate Hendricks discussed the Park Ad Hoc Committee update. Magistrate Hendricks disagrees with the addendum to the Park Ad Hoc February 12 th minutes. The committee recommended budgeting $100, for upgrades. Judge McKinney presented the ARC/HIPPA Privacy Agreement Amendment and the ARC/HIPPA Security Agreement Amendment. Magistrate Sammons made the motion to approve both amendments and authorize Judge McKinney to sign all appropriate documentation. Magistrate Mayes The Court acknowledged the Boyle County Clerk s st Quarter Report. Magistrate Sammons commented on how fortunate the Court was to have County Clerk Trille Bottom s dedication and smiling face. The Court acknowledged the Boyle County Sheriff s st Quarter Report.

2 Magistrate Sammons stated that the same can be said for Sheriff Derek Robbins as County Clerk Trille Bottom. Judge McKinney presented the Waste Tire Grant for fiscal year Magistrate Caywood made the motion to approve applying for the Waste Tire Grant and authorize Judge McKinney or Solid Waste Director Donna Fechter to sign all appropriate documentation. Magistrate Burke Public Works Director Duane Campbell, requested permission to advertise for salt bids. Magistrate Mayes made the motion to approve advertising for salt bids. Magistrate Hendricks Public Works Director Duane Campbell discussed the insurance settlement for the dump truck that was involved in an accident. The insurance valued the truck at $24,775.00, with the $5, deductible, the insurance will generate a check for $19, to the Fiscal Court. Magistrate Caywood made the motion to approve the insurance settlement. Magistrate Sammons seconded the Public Works Director Duane Campbell presented the Bridge Bid recommendations. McDermott Street Bridge caved in and was approved for emergency State funds. Triple C Contractor was the lowest bid on the McDermott Street Bridge. Magistrate Mayes made the motion to approve Triple C Contractor for the McDermott Street Bridge. Magistrate Sammons seconded the motion. The motion passed with all members voting in favor. Public Works Director Duane Campbell recommended Ford Contracting Inc. to build the bridge on Cream Ridge Road. Magistrate Hendricks made the motion to approve Ford Contracting Inc. Magistrate Sammons Public Works Director Duane Campbell recommended The Allen Company is recommended to build the bridge on Daugherty Road. Magistrate Caywood made the motion to approve The Allen Company. Magistrate Hendricks seconded the motion. The motion passed with all members voting in favor. Public Works Director Duane Campbell discussed the Courthouse sewage ejection pump. A pump in the basement of the Courthouse is not working. The pump services the utility sinks on all floors. Magistrate Sammons made the motion to approve Taylor Plumbing to replace the ¾ horse power grinder pump. Magistrate Burke seconded the motion. The motion passed with all members voting in favor. Treasurer Mary Conley will apply to Administrative Office of the Courts for approval of their share of the cost before starting the project. Public Works Director Duane Campbell presented the Bridge Agreement and Resolution for the Cream Ridge and Daugherty Road Bridges. This will allow the County to pay 20% and the State to pay 80% up to $80, There will still be $39, available for another bridge repair. Magistrate Mayes made the motion to approve the agreement and the resolution. Magistrate Sammons Public Works Director Duane Campbell presented the McDermott Emergency Bridge Replacement Fund. The project was approved for $33, Magistrate Hendricks made the motion to approve the McDermott Emergency Bridge Replacement Fund and authorize Judge McKinney to sign any appropriate paper work. Magistrate Mayes seconded the motion. The motion passed with all members voting in favor. Magistrate Burke discussed the Finance Committee update. The County budget has been completed. The budget comes in at $20,938, Health Insurance claims are down. Magistrate Burke made a motion to approve the committee update. Magistrate Mayes seconded the There will be a Department Head Meeting to discuss the Health Fair. Magistrate Sammons is dissatisfied with the Health Fair and is not sure if it is needed. The health risk assessment is paid for by the health insurance fund. Judge McKinney doesn t think it is wasted money and it is to the benefit of the employees.

3 Magistrate Caywood discussed the EMS Committee update. There is a truck with a diesel exhaust fluid issue. Medical dispatch is going well. The physical condition of EMS employees was discussed. Magistrate Caywood made a motion to approve the committee update. Magistrate Sammons Magistrate Hendricks discussed the Parks Committee update. There has been minor vandalism at the park. The suspects are on video camera. The City of Danville would like the County to pay ½ of the $50, water bill for Millennium Park and Bunny Davis Center. There seems to be several water leaks at Millennium Park that have been there for years. The City has known about the leaks but feels it would cost more to fix them. The baseball fields are 80% complete. Magistrate Hendricks made a motion to approve the committee update. Magistrate Sammons seconded the motion. The motion passed with all members voting in favor Magistrate Caywood discussed the Sheriff Committee update. A preliminary plan for an active school shooter was discussed. There will be more meetings with school officials and first responders. Magistrate Caywood made a motion to approve the committee update. Magistrate Sammons The Court acknowledged the March 2018 Fiscal Court Financial Statement. Treasurer Mary Conley informed the Court that the cash balance is down $344, from this time last year. Judge McKinney discussed the Highway 2168 Connector Trail Amendment. The trail will now go on the south side of the road. There is no increase in the total amount of funding and the archeology cost is included. The Amendment allows the transfer of money from the construction fund to the design fund. Phase 1 and phase 2 of the archeology will be done at the same time. Magistrate Sammons made the motion to approve the amended agreement. Magistrate Hendricks seconded the The Court acknowledged the Fiscal Court Budget. Appropriations are at last year s level. The possible full increase in retirement is used. Judge McKinney presented the 2019 Monthly Compensation Order. The annual salary will be set for Deputy Judge Executive $5,683.94, Coroner $20,000.00, Deputy Coroner $6,000.00, Magistrates $8, and Constable $0.The maximum number of full time personnel for the jail is 39 and 4 part time. The cut in full time personnel for the jail is due to the Sheriff s office providing transportation. Judge McKinney moved from the chair to approve the Monthly Compensation Order. The motion failed for lack of second. Magistrate Hendricks believes there are 41 full time employees. The transport officer has more duties then just transporting inmates to Court. The Joint Jail made the decision before the Jail Committee had a chance to discuss the cutting of personnel. Magistrate Caywood recommended, as a result of the Sheriff s Committee meeting, that the Sheriff not transport prisoners from the Detention Center to the Courthouse. Magistrate Sammons seconded the motion. Sheriff Derek Robbins explained he didn t want the added responsibility of jail transports. He agreed to transport to and from the jail to help out and be a team player. His office already has to transport mental detention orders from surrounding counties that come to the local hospital. Sheriff Robbins understands what the KRS states but feels that some of the KRS is outdated. Sheriff Robbins will comply with the Fiscal Court motion. The Sheriff s Office will receive the prisoners at the Courthouse doors and take responsibility of them in the Courthouse. This will free the Transport Officer to go back to the jail and resume other duties during Court sessions. The contract with Mercer County does say the Joint Jail Committee are administers of the jail. The Joint Jail Committee considers the budget and makes recommendations to the Courts. Judge McKinney made a call for the vote. The motion passed with all members voting in favor. Sheriff Robbins currently has no policy for receiving and caring for inmates. Sheriff Robbins will meet with Jailer Barry Harmon and bring the policy to the Court in two weeks. County Attorney Lynne Dean suggested Sheriff Robbins speak to the Judges to answer any questions they may have. Magistrate Sammons made the motion to approve the Order Fixing Monthly Compensation and to set the number of full time jail employees at 40. Magistrate Hendricks seconded the motion. The motion passed with all members voting in favor.

4 Jailer Barry Harmon discussed the Joint Jail update. Jailer Barry Harmon has spoken with the jail consultant and feels more inmates could go into the Shepherds House program. County Attorney Lynne Dean stated that data received from the jail was incorrect. Many people on the jail s list for Shepherds House program are not in jail for only contempt. Magistrate Caywood asked about home incarceration. County Attorney Dean stated home incarceration is being used in some cases usually as part of bond. Jailer Barry Harmon informed the Court that the state has accepted the fire system plans. A test was done of the fire system and it failed on the phone line part. AT&T fixed the problem and the fire system is now working. The final test will be done soon. Judge McKinney and Treasurer Mary Conley discussed the Joint Jail/Boyle Jail Budget. The Substance Abuse Program Grant (4510) pays for the State inmates treatment and corresponds with expense account The Commonwealth of Kentucky pays a State Allotment (4533) for housing State inmates to both Boyle and Mercer Counties. There are medical payments ( ) paid by the State for inmates medical bills. The budgeted number of inmates for controlled intake will be 28 per day, for Class D will be 30 per day, and for Class C will be 28 per day. The total budget is $5,084, for a 1.6 % increase. The budget is based on Boyle County Contributing 65% and Mercer County contributing 35%. The expense sheet shows the jail employee count set at 40 full time and 4 part time. The Inmate Medical Contract ( ) is increasing 3%. The Food Service Provider ( ) is not finalized. Magistrate Sammons made the motion to approve the Joint Jail/Boyle Jail Budget with changes to salaries and benefits for an additional employee. Magistrate Sammons Magistrate Mayes made the motion to approve requesting proposals for Fiscal Court Audit. Magistrate Caywood There is a bill to John Hambel that is a reimbursement for a tablet. County Treasurer Mary Conley requested a transfer from the General Fund to the Joint Jail account in the amount of $32, and an additional $97, to Joint Jail.
