1 STATE OF TEXAS ) ) COMMISSIONER COURT COUNTY OF PARKER ) BE IT KNOWN that on the 10 th day of February 2014, the Honorable Commissioners Court of Parker County, Texas, convened in regular session hereof in the commissioners courtroom on the first floor of the Parker County Courthouse, One Courthouse Square, Weatherford, Texas, for the following purpose, to wit: The meeting was called to order by County Judge Riley at 9:01 a.m. Judge Riley stated all members of court were present except for Commissioner Renfro. Pledge of Allegiance to the United States Flag was led by Commissioner Craig Peacock. Pledge of Allegiance to the Texas Flag was led by Commissioner George Conley. Interdepartmental Transfers of Equipment and Inventory Reports-None Submitted Motion was made by JUDGE RILEY and second by COMMISSIONER PEACOCK to approve the above listed consent agenda. 2. UPDATE ON TRANSPORTATION BOND IMPLEMENTATION: (a) Approve and Execute Change Order #5 NO ACTION (b) Approve and Execute Change Order #6 David Payne, Construction Manager with Freese & Nichols presented information to the court as per attached. Motion was made by COMMISSIONER RENFRO and second by COMMISSIONER CONLEY to approve Change Order #6 for Project 4.04 Aledo Trail. 5. NOTIFICATION: (a) Precinct 4 on Private Property to Clear Road Commissioner Renfro notified the court Precinct 4 will be on private property, clearing fence row for drainage and visibility as per memorandum agreement and shape bar ditches located approximately 1896 and 1900 block of Airport Road, Aledo in Parker County. NO ACTION 6. PLACE INTO MINUTES: (a) Execute Contract for Azle Public Library (b) Execute Contract with Pecan Valley MHMR Motion was made by JUDGE RILEY and second by COMMISSIONER WALDEN to place the contracts referred to in 6.a and 6.b into the minutes as presented.

REVIEW AND EXECUTE: (a) Execute the Kofile Preservation Sales Order Motion was made by JUDGE RILEY and second by COMMISSIONER WALDEN for the county judge to review the Kofile Preservation Sales order and authorize the county judge to sign. (b) Special Warranty Deed from Thomas Haynes Motion was made by COMMISSIONER WALDEN and second by COMMISSIONER PEACOCK to approve the Special Warranty Deed from Thomas Haynes for property located off Harmony Road in Precinct 3. (c) Contract with Parker County Soil and Water Conservation District Motion was made by JUDGE RILEY and second by COMMISSIONER PEACOCK for the county judge to review and execute the contract with Parker County Soil and Water Conservation District. Discussion 8. PRESENTATION: (a) Tarrant Regional Water District Presentation Jim Lane, Tarrant Regional Water District Director, introduced members Wayne Owen and Dan Buhman to deliver the power point presentation. James Hotopp, Water/Waste Water and Engineering Director for the City of Weatherford commented on the dredging of Lake Weatherford. NO ACTION 3. PLATS: (a) Preliminary Plat for Durant s Tin Top Subdivision

4 4 Leslie Coufal, Plat Coordinator, County Attorney s office presented information to the court. Motion was made by COMMISSIONER WALDEN and second by COMMISSIONER PEACOCK to approve the Preliminary Plat for a subdivision to be known as Durant s Tin Top Subdivision located on the corner of Bethel Road and New Tin Top in Precinct 3. (b) Revision of Lots 40 & 41 in Highland Hills Addition Leslie Coufal, Plat Coordinator, County Attorney s office presented information to the court. Motion was made by COMMISSIONER PEACOCK and second by COMMISSIONER WALDEN to begin the revision process of Lots 40 & 41 in a subdivision known as Highland Hills Addition located on the corner of Hereford Road and Dry Creek Road in Precinct 2. (c) Revision of Lots 3 & 4 in Stephens Bluff, Phase 2 Leslie Coufal, Plat Coordinator, County Attorney s office presented information to the court. Motion was made by COMMISSIONER WALDEN and second by COMMISSIONER PEACOCK to begin the revision process combining Lots 3 & 4 in a subdivision known as Stephens Bluff, Phase 2 located on Brazos Bluff Lane in Precinct APPROVAL: (a) New Deputy Position for Courthouse Security Motion was made by COMMISSIONER CONLEY and second by COMMISSIONER WALDEN to approve a new deputy position for Courthouse Security. (b) Accept $ Donation to the Sheriff s Office Motion was made by COMMISSIONER WALDEN and second by COMMISSIONER PEACOCK to accept a One Hundred ($100.00) donation to the Sheriff s Office for use by Animal Control.

5 5 (c) Approve Liquidated Damages from Jay Mills Construction Company David Payne, Construction Manager with Freese & Nichols, presented information to the court regarding the damages sustained beyond the completion date on Project 3.01B, Ric Williamson Memorial Highway Phase IV. Discussion Motion was made by COMMISSIONER WALDEN and second by COMMISSIONER PEACOCK to approve liquidated damages in the amount of Twenty-Two Thousand Dollars ($22,000.00) paid to Parker County from Jay Mills Construction Company as recommended by Freese & Nichols and authorize the release of the net retainage. (d) Waive a Posting in JP3 Motion was made by JUDGE RILEY and second by COMMISSIONER CONLEY to waive the job posting in Justice of the Peace 3. (e) Contract with Destiny Software for Server Hosting Tricia Radford, I.T. Director presented information to the court regarding the Agenda Quick program. Motion was made by JUDGE RILEY and second by COMMISSIONER PEACOCK to authorize contracting with Destiny Software for server hosting at the install rate of Twelve Hundred Fifty Dollars ($1,250.00) and an annual cost of Four Hundred Dollars ($400.00) per month with the County Attorney to review contract prior to signature. 9. EXECUTIVE SESSION: The Parker County Commissioners Court met in CLOSED SESSION at 10:03 a.m. with County Attorney John Forrest to discuss to wit: a. Real Estate for county purposes, In accordance with Section of the Texas Government Code. b. Personnel, In accordance with Section of the Texas Government Code: ESD Board Appointments Interviews

6 6 The meeting reconvened in OPEN SESSION at 10:29 a.m. a. Real Estate: NO ACTION b. Personnel: Motion was made by COMMISSIONER PEACOCK and second by COMMISSIONER WALDEN to reappoint Jason Williams and Cynthia J. Goodwin to ESD #8 Board for a 2 year term. Motion was made by COMMISSIONER WALDEN and second by COMMISSIONER PEACOCK to reappoint Diane Rhodes, Art Garrett, and Donna Tillman to ESD #6 Board. 10. ADJOURNMENT: Motion was made by JUDGE RILEY and second by COMMISSIONER CONLEY to adjourn the meeting at 10:30 a.m. The meeting adjourned at 10:30 a.m.
