1 FILLMORE CITY COUNCIL MEETING February 5, 2019 Minutes of the regular meeting of the Fillmore City Council held February 5, 2019 in the Council Chambers of the Fillmore City Building. Notice of the time and place of the meeting was posted on the Utah State Public Notice website, the Fillmore City website, the Council Chambers, the City Office bulletin board, and the President Millard Fillmore Library. Notice was also provided to the Chronicle- Progress, radio station KMTI and each member of the governing body on February 1, Those present were: Mayor: Michael D. Holt Council: Kami Dearden Attorney: Richard Waddingham Ian E. Adams Staff: Kevin Orton Eric R. Jenson Jeffrey D. Mitchell Dennis W. Alldredge Others: Dan Rowley, Matt Ward, Howard Quackenbush, Wayne Jackson, Shane Brunson, Madison Owen, Taylor Ottley, Abe Johnson, Craig Grose, and Donna Starley. 6:30 p.m. Welcome and Pledge of Allegiance Mayor Holt ADMINISTRATIVE BUSINESS Minutes MOTION: To accept the minutes from the January 15, 2019 council meeting as corrected. By: Councilmember Mitchell Purchase Orders Purchase Order # for $10,000 payable to Airport Development Group for an airport layout plan update. This is the first of three payments for a total project cost of $30,000. Utah Division of Aeronautics is funding this project. MOTION: To approve purchase order # By: Councilmember Mitchell Second: Councilmember Adams Bills Payroll MOTION: To approve the January 31, 2019 payroll and payment of bills listed on the invoice register dated January 16, 2019 February 5, By: Councilmember Adams Second: Councilmember Mitchell

2 Licenses and Permits Building Permit Application #19-02 for Brook Leatham at 360 South 100 East for a garage roof repair. Business License BL-1901, The Red Brick Nest. Business description includes e- commerce/fashion. Business License BL-1902, Peak Performance Chiropractic and Sports Rehab Center. Business description includes chiropractic care, acupuncture, nutritional products, spine rehab and physical therapy. Business License BL-1903, Iceberg Drive Inn. Business description includes restaurant. Business License BL-1904, Fillmore Feed and Farm Supply. Business description includes retail sales. Business License BL-1905, Head to Toe Salon (Emily Frisby). Business description includes nails technician. PUBLIC COMMENT No comments. COMMUNICATIONS AND REQUESTS Fire Department Report Chief Shane Brunson In December there was a serious hazmat semi fire on Interstate 15 where the Fillmore Fire Department assisted the Kanosh and Meadow departments. The fire department has a 25 person roster and right now there are 17 volunteer fire fighters. There will be a hazmat training next month and Chief Brunson hopes to have 6 fire fighters attend and receive their hazmat certifications. Chief Brunson is excited to be the new fire chief and the council commended the department for their good work. Millard County Commission Report Commissioner Wayne Jackson Millard County is working to avoid the State imposing centrally assessed property valuation for the county. Six County Association of Governments is on Millard County s side of this issue. Millard County is also opposed to a house bill that allows for water banking. There is a concern of other communities on the east side of the Pahvant Mountain range trying to take Millard County s water from the Sevier River and bank it on their side. Commissioner Jackson is now the board member over low-income housing for Six County Association of Governments. The city will no longer set landfill fees; Millard County will set them. There are not enough horse racing events to cover the cost of maintaining and preparing the horse track. The county is waiting to see what happens with the horse track before moving forward with the soccer fields.

3 Request for Funding to Attend Freedoms Foundation at Valley Forge Madison Owen Madison is the only student from Millard High School to attend Freedoms Foundation this year. Millard High school will be honored at the luncheon that the students attend before the trip. During her trip to Pennsylvania, she will learn more about U.S. history and government. Madison will also meet other students from around the country. She is excited to attend and loves to learn and travel. She will report to the council upon her return and is willing to help with the Celebrations Committee. MOTION: To approve $ donation to Freedom Foundations for Madison Owen to attend this year. By: Councilmember Alldredge Request for Funding to Attend Junior National Young Leaders Conference in Washington D.C Santana DeHerrera Santana was nominated by his school teachers to attend the conference. It will help him benefit in school, college, career and community. The conference is an interactive workshop that helps with setting goals, teamwork, problem solving, and communication skills. Santana will be exploring Washington D.C. and be visiting historic sites where he will learn about our nation s history and leaders. He will also report to the council upon his return. MOTION: To approve $ donation to Junior National Young Leaders Conference for Santana DeHerrera to attend this year. By: Councilmember Alldredge Request for Funding to Support the Old Capitol Arts and Living History and Story Telling Festivals Abe Johnson Mr. Johnson is pleased at the progress of the festival over the years and much of it is due to the generous support of Fillmore City. Last year was the first year of the Story Telling Festival and it was a success with more than 3,300 people attending. MOTION: To approve $12,000 for the 2019 Old Capitol Arts & Living History Festival and $1,000 for the Old Capitol Storytelling Festival. By: Councilmember Jenson Second: Councilmember Adams

4 BUSINESS Ratify Approval of Agreement Between Urban Planning International with Fillmore City for General Plan Update Services MOTION: To ratify the approval of the agreement between Urban Planning International with Fillmore City for General Plan update in the amount of $15,000. By: Councilmember Mitchell Second: Councilmember Adams Gerald Hackwell Simple Lot Subdivision Located at Approximately 190 East 400 South The division will create two parcels. One lot will be approximately two acres and the other approximately six acres. MOTION: To approve the simple lot subdivision for Gerald Hackwell By: Councilmember Adams Preliminary Plat Map for Sage Meadows Subdivision, Phase 1 Located at Approximately 800 South Highway 99 Phase 1 of 4 of the subdivision includes forming six lots, five of which are buildable lots and one that may be deeded to the Millard School District. MOTION: To approve the preliminary plat map for Dr s Quackenbush and Grose By: Councilmember Alldredge Second: Councilmember Mitchell COUNCIL REPORTS Councilmember Jenson No report Councilmember Mitchell No report Councilmember Dearden Library The windows in the library are old and need to be replaced.

5 The princess party was a success again this year with approximately 200 children in attendance. A State grant in the amount of $12,500 was awarded to the library. Those funds will go towards building a STEAM (Science, Technology, Engineering, Art, and Mathematics) lab to include a 3-D printer. Other Dr. Anderson (Veterinarian) expressed appreciation to the city staff, particularly Barbara Emmett, (via Councilmember Dearden) on the great work they do in assisting with the monthly dog vaccinations. Dr. Anderson also informed Councilmember Dearden that according to State and Federal law, rabies vaccinations can only be administered by a licensed veterinarian. Councilmember Adams Justice Court The Justice Court was significantly busier in January compared to December. There were 68 criminal cases filed in the year There were 20 already filed for the month of January, Judge Probert and Justice Court Clerk Jamie Walton are pleased with the building alterations that were recently completed. They enhance court security and fulfill State requirements. Planning & Zoning Councilmember Adams is impressed with Urban Planning International and the progress they have made in working on the city s general plan update. Councilmember Alldredge Water In consideration of possibly installing a reservoir up the canyon east of Fillmore, depending on how it is done, there is a possibility that it would cause issues with the city s water storage. A reservoir cannot be placed on top of any natural spring or aquifer. Attorney Waddingham Attorney Waddingham is following the State legislature and the bills that affect cities. He updated the council with information on those changes and will keep them up to date on the changes throughout the month. Mayor Holt There has been a significant problem over the last few weeks with dogs and their owners. On several occasions owners cannot be reached to find out what they want done with their dogs that are caught and placed in the pound. Work will be expedited in terms of completing the power loop on the south end of the city. There is a need for 3-phase power for businesses that plan to build in the area. Closed Executive Session MOTION: To go into a closed executive session at 7:58 p.m. to discuss the character, professional competency, or physical or mental health of an individual. Those asked to attend the closed session in addition to

6 Mayor Holt and all councilmembers were Attorney Waddingham and Recorder Orton. Councilmembers Alldredge, Adams, Mitchell, Dearden and Jenson all voted yes. By: Councilmember Adams Second: Councilmember Mitchell The council returned to open session at 8:13 p.m. Councilmember Mitchell was asked by a local farmer if the city would be willing to irrigate his fields with sewer pond water. That is only allowed where the city owns the property and it is then leased to the farmer. Only the water from the final-stage pond can be used for this purpose. The city is awaiting a response from the State in terms of what needs to be done with the sewer lagoons to achieve ph requirements.
