1 SPINK COUNTY COMMISSION PROCEEDINGS REDFIELD, SOUTH DAKOTA The Spink County Board of Commissioners met at 8:30 AM on Tuesday, December 6, 2016, at the Spink County Courthouse. Present were Commissioners Dave Albrecht, Jeff Albrecht, Craig Johnson, Pat Kramp and Cindy Schultz. Chairman Dave Albrecht opened the meeting with the Pledge of Allegiance. ADOPT AGENDA Motion was made by J. Albrecht, seconded by Schultz, to adopt the agenda with the addition of, surplus DAV van. All members voted aye. Motion carried. MINUTES APPROVED Motion was made by Kramp, seconded by Johnson, to approve the minutes of the November 10, 2016 Commission meeting. All members voted aye. Motion carried. CORRESPONDENCE SD Dept. of Environment & Natural Resources Re: Camrose Colony Revised Swine Manure Management System Plans & Specs Review SDHDA Re:Notice of Entry of Order Reducing Redemption Period Robert R. Nelson, Avera Attorney, Re: Admission of Service Chairman Albrecht, signed the admission of service. LIQUOR LICENSE RENEWALS Motion was made by Schultz, seconded by Kramp, to approve the renewal of the Retail (on-sale) liquor license for the renewal year 2017 for Pheasant Phun Inc. All members voted aye. Motion carried. EMERGENCY MANAGER/STATE & LOCAL AGREEMENT Motion was made by Johnson, seconded by J. Albrecht, to sign the 2016 Emergency Management State and Local Agreement Amendment #2, which awards Spink County with $5, for essential county emergency management expenses. All members voted aye. Motion carried. COMMUNITY HEALTH SERVICES CONTRACT Motion was made by Kramp, seconded by Schultz, to renew the contract with SD Department of Health for Community Health Nursing Services at the cost of $6,180 annually, beginning January 1, 2017 and ending December 31, All members voted aye. Motion carried. STATES ATTORNEY Vic Fischbach, States Attorney, gave an update of activities. HIGHWAY SUPERINTENDENT Jeff Haessig, Highway Superintendent, gave an update of activities, and requested to: advertise a notice to bidders; purchase a loader off Minnesota State s bid; and purchase of semi-tractor off Brown County s bid. BID NOTICE Motion was made by Schultz, seconded by Kramp, to advertise for bids County Road 18(174 th St) 10 mile(between 386th-374th Ave) Overlay Project. All members voted aye. Motion carried. BIDS ACCEPTED Motion was made by Johnson, seconded by J. Albrecht, to purchase a 2016 John Deere 644K Loader for $247,445 off the Minnesota State Bid to be delivered and paid for in 2017 pending appropriation of funds in the 2017 budget. All members voted aye. Motion carried. Motion was made by J. Albrecht, seconded by Schultz, to accept Brown County s low bid from Sheehan Mack Sales & Equip., Aberdeen, SD, for a new current model 2017 Mack Tandem Axle Semi Tractor with electronic shifted manual transmission for $112,650 to be delivered and paid for in 2017 pending appropriation of funds in the 2017 budget. All members voted aye. Motion carried. SHERIFF Kevin Schurch, Sheriff, filed a prisoner housing agreement and requested to: change a start date of a new fulltime employee; and to purchase PBT supplies. PERSONNEL Motion was made by Johnson, seconded by Kramp, to approve moving the full-time start date of Jenna Appel, Deputy Sheriff, from 1/1/2017(previous action taken 9/20/16) to 12/26/2016. 2 QUOTE Motion was made by Schultz, seconded by J. Albrecht, to approve the purchase of 10,000 personal breath test tubes from Intoximeters in the amount of $1300. All members voted aye. Motion carried. PRISONER HOUSING AGREEMENT Motion was made by Kramp, seconded by Johnson, to approve agreements with Charles Mix County for housing prisoners at the Charles Mix County Law Enforcement Center at $50.00 per prisoner housing day; effective on January 1, 2017 through December 31, All members voted aye. Motion carried. VSO/SURPLUS Gordon Richard, VSO, requested to surplus and sell the old DAV van. Motion was made by Johnson, seconded by Kramp, to surplus the 2008 Ford Taurus X VIN# 1FMDK05W58GA36788 and to sell it by sealed bid, with a minimum bid of $3,000, for the bid opening to be held 12/29/16, and for the proceeds from the sale to be given to the DAV van account currently held by the VFW. All members voted aye. Motion carried. DRAINAGE At 9:44 AM a motion was made by Kramp, seconded by Schultz, to recess as a Board of Commissioners and convene as a County Drainage Board. All members voted aye. Motion carried. The Board of County Commissioners reconvened at 10:51 AM after having adjourned as the Planning and Zoning Board. EXECUTIVE SESSION/PERSONNEL/FMLA LEAVE At 10:54AM a motion was made by Kramp, seconded by Schultz, to enter into executive session to discuss personnel with Theresa Hodges, Auditor, Ann Bottum, Deputy Auditor, and Suzanne Smith, Commissioner District 4-elect, present. All members voted aye. Motion carried. Chairman Dave Albrecht declared the Board out of executive session at 10:56 AM, with the following action taken: Motion was made by J. Albrecht, seconded by Schultz, to grant leave to an individual according to the specifications required under the Family Medical Leave Act. All members voted aye. Motion carried. PERSONNEL Theresa Hodges, Auditor, stated a Federal Judge has put on hold indefinitely the changes to the US Dept. of Labor s overtime rule and salary exemptions. Motion was made by J. Albrecht, seconded by Johnson, to suspend the changes to the Spink County personnel policy adopted 11/10/16, that were adopted to address the federal mandates, until a final ruling is issued. 3 members voted aye; 2 members voted nay. Motion carried. NECOG Motion was made by J. Albrecht, seconded by Kramp, to approve the 2017 Joint Cooperative Agreement between Spink County and the Northeast Council of Governments for their assistance in applying for funding opportunities, with a local share cost of $9, All members voted aye. Motion carried. SALARIES 2017 Motion was made by Johnson, seconded by Kramp, to give all employees except Commissioners a 3% raise effective 12/26/16. 4 members voted aye; 1 member voted nay. Motion carried. CASH & CONTINGENCY TRANSFERS Motion was made by Kramp, seconded by J. Albrecht, to make the following transfers from the Commissioners Contingency Budget to the various county budgets: Budget Contingency Transfers: 6, Information Technology/Offsite backup Dept. of Social Services/Postage Developmentally Disabled All members voted aye. Motion carried. COURTHOUSE PARKING LOT PROJECT SCOPE Randy Hoscheid, Pierce and Harris Engineering, presented a surface elevation diagram of the land surrounding the courthouse on the west side and addressed the drainage of runoff from the courthouse roof out to the west curb. Also presented was a layout plan for parking lot surface area and sidewalk that would be replaced, to address the parking lot run off draining to the east curb into the storm sewer system rather than the current drain, that will be filled in, that drains into the sanitary sewer system. Mike Siebrecht, Maintenance Supervisor, was also present. Motion was made by Kramp, seconded by Schultz, to approve the scope of the plans as presented. All members voted aye. Motion carried. SPINK COUNTY TRANSIT Theresa Hodges, Auditor, stated a response to the SDDOT review has been submitted and SCT is currently awaiting a response. Spink County Commission - December 6,
