1 OFFICIAL PROCEEDINGS DUNN COUNTY BOARD OF COUNTY COMMISSIONERS August 15 th, 2018 MEMBERS PRESENT: Commissioners Kleemann, Scott and Dukart and Hauck OTHERS PRESENT: Auditor Dolezal, HR Director Calihou, Road Superintendent Zimmerman, Darin Schaeffer and Jeremy Wood. The meeting was called order by Chairman Scott at 9:00 a.m. Sandy Rohde, Code Administrator appeared to report that Renewable Resources has met all requirements of the State Department of Environmental Health and has completed cleanup at their facility North of Killdeer Engineer Darin Schaeffer appeared to report on Bartlett & West s road projects. Andy Hancock, Oneok Gas Plant Manager appeared to discuss the secondary emergency access to the plant while construction is underway. Oneok has been unsuccessful in securing permission from landowners. Commissioner Dukart will reach out to the landowners. Jeremy Wood, Northern Plains Engineering appeared to report on the projects his firm is working on. Discussed the 30 th St. SW project (Dunn/Stark County line). Engineer Wood recommended an agreement with Stark County on the project. Motion by Commissioner Dukart, seconded by Commissioner Hauck, to enter into a Memorandum of Agreement with Stark County, naming them as the project lead and have them draft the MOA. All voted aye, and the motion carried. Motion by Commissioner Hauck, seconded by Commissioner Kleemann, to accept the findings of the State Health Department that Renewable Resources has met all requirements and Dunn County can release their building permit. All voted aye, and the motion carried. At 9:30 a.m., the following bids were opened for the 2 nd St. NW project: Northern Improvement Compay $1,420, Central specialties, Inc. $1,478, The engineers estimate $1,194, Engineer Schaeffer will tabulate the bids and report back to the Commission with his recommendation. Motion by Commissioner Kleemann, seconded by Commissioner Pelton, to approve the American Legion, Post 46 Special Liquor Permit for an event at the Rodeo Arena on September 16 th. All voted aye, and the motion carried. Assistant Road Superintendent, Del Olson appeared to report on the road department. Forty-five miles of road have been re-graveled this summer. Discussed Monte Schmalz s dam and erosion problem. Superintendent Zimmerman and Del Olson will visit with Mr. Schmalz. Discussed McKenzie County s plan to make improvements to Charlie Bob Creek Road. The consensus of the Commission is to improve the 1/10 th mile in Dunn County to tie into the McKenzie County project. The Commission was in agreement to cost share Mag Chloride on 30 th St. SW with Stark County. Motion by Commissioner Dukart, seconded by Commissioner Kleemann, to approve the utility permits. All voted aye, and the motion carried.

2 At 10:00 a.m. the following bids were opened for the Rebsom Bridge Project: Swingen Construction $572, Industrial Builders, Inc. $603, The engineer s estimate is $420,000. Engineer Wood will review the bids and report back to the Commission with his recommendation. Recess Chairman Scott informed the Commission that she is working on setting up a committee and meeting date To look at options for continued operation and community support for the High Plains Community Center. Mark Reisner, Roosevelt-Custer Regional Council and Ken Davis will be invited to participate along with County, City, Community members and the Fair Board. Engineer Schaeffer reported to the Commission that the bid tabulation checked out and recommended Northern Improvement Company s bid for approval on the 2 nd St NW Project. Motion by Commissioner Dukart, seconded by Commissioner Pelton, to accept Northern Improvement s bid of $1,420, All voted aye, and the motion carried. Chief Deputy Ron McCloud appeared to request that Dunn County send a letter to the BLM in support of Wylie Bice s bridge staying in place as an access for emergency services. The Sheriff s Department has used the bridge a number of times and Mr. Bice has been very cooperative of the bridge being used for emergency services. Motion by Commissioner Dukart, seconded by Commissioner Pelton, to send a letter to the BLM stating the County s support for the Bice Bridge staying in place for the continued use for emergency services. All voted aye, and the motion carried. Engineer Wood, reported back with bid tabulations on the Rebsom Bridge. The tabulation checked out, but is much higher than expected. Engineer Wood recommend tabling to look further into the price or to not award the bid. The Commission also discussed a possible option of putting in a low water crossing. Motion by Commissioner Hauck, seconded by Commissioner Dukart, to table awarding the Rebsom Bridge bid. All voted aye, and the motion carried. Scott Koterba, representing PetroShale US, Inc., appeared to request a section line encroachment for the Thunder Cloud well pad located in Section on the Ft. Berthold Indian Reservation. Motion by Commissioner Hauck, seconded by Commissioner Kleemann to grant the encroachment. All voted aye, and the motion carried. Motion by Commissioner Kleemann, seconded by Commissioner Pelton, to appoint Cliff Ferebee to the Southwest Region Reap Board. All voted aye, and the motion carried. Portfolio Reports: SWMCCC: Nothing to report Human Resources: Working on performance evaluations for department heads and setting up for the Health Fair. Director Calihou informed the Commission that she has set up a wellness committee with employees from various departments. Sheriff: Ron McCloud is acting Chief Deputy. Building Projects: The Courthouse project is running under budget approximately $750,000. Discussed selling cabinetry from the remodel and de-commissioned vehicles with the Kubik farm auction on October 6 th, in exchange for use of the road department parking lot. Airport Authority: Nothing new to report. Motion by Commissioner Hauck, seconded by Commissioner Dukart, to appoint Commissioner Pelton as Dunn County s delegate to the NDACO Conference. All voted aye, and the motion carried. Greg Benz, Extension Agent appeared to report on the Extension Office. Achievement days went well. Discussed the FCW Agent position and it was noted that the Commission agreed to fund the position full time at

3 It s June 20 th meeting. Commissioner Hauck and Commissioner Kleemann will discuss the County s wishes with Jim Gray, NDSU Extension/West District Director. Auditor Dolezal presented the preliminary 2019 county budget for the Commission s consideration before The formal hearing date. The Commission proposed the following: Earmark $4,000,000 for a new shop for Infrastructure improvement Reduce Sheriff s annual salary by 10% Increase Facility Manager s annual salary by $3000 Set starting annual salary for States Attorney $70,000 with idea that it can go up after six months. Motion by Commissioner Dukart, seconded by Commissioner Pelton, to approve the proposed preliminary budget with the aforementioned proposals and set the budget hearing for September 19 th at 10:00 a.m. Upon roll call vote, all voted aye, and the motion carried.
