1 * Roll Call Number Agenda tem.?l DATE November 9,2009 APPROVAL OF CONTRACT AND BOND AND PERMSSON TO SUBLET ON POLCE ACADEMY HV AC UPGRADE $ 92, BE T RESOLVED BY THE CTY COUNCL OF THE CTY OF DES MONES, OWA: That the contract and bond, n the amount of $92,470.00, executed by Brockway Mechancal & Roofng Company, nc., Mark J. Brockway, Presdent & CEO, 5805 Enterprse Drve, Grmes, la, 50 dated November 9, 2009, for the constructon of the followng mprovement: Polce Academy HV AC Upgrade, The mprovement ncludes the replacement of two exstng roof top unts (RTU) wth sx new unts. The nstallaton of the new unts necesstates the replacement of the acoustcal lay-n celng n the man hallway. The work wl be performed at the Des Mones Polce Academy at 433 E. Army Post Road, Des Mones, owa the same to be performed n accordance wth the plans and specfcatons whch have been heretofore approved by ths Councl, be and the same are hereby approved, subject to recept of the contract, bond, and certfcate of nsurance acceptable to the Engneerng and Legal Departments. The attached "Contractor's Antcpated DBE/TSB Utlzaton" shows the Contractor's efforts to solct DBE/TSB Partcpaton n accordance wth the Dsadvantaged Busness Enterprse/Targeted Small Busness (DBE/TSB) Program. BE T FURTHER RESOLVED: That the Mayor be and s hereby authorzed and drected to execute sad contract on behalf of the Cty of Des Mones, subject to recept of the contract, bond, and certfcate of nsurance acceptable to the Engneerng and Legal Departments, and the Cty Clerk, be and s hereby authorzed and drected to attest to same. No contract shall be deemed to exst between the Cty of Des Mones and sad Bdder untl sad contract has been executed by the Bdder, and shall have been approved by ths Councl and executed by the Mayor and attested to by the Cty Clerk. BE T FURTHER RESOLVED: That after sad contract has been executed by the Mayor, the Cty Clerk be and s hereby authorzed and drected to return the Contractor's bd securty. BE T FURTHER RESOLVED: That the attached Permsson to Sublet form, from sad Contractor requestng permsson to sublet desgnated tems, be and s hereby approved, subject to recept of the contract, bond, and certfcate of nsurance acceptable to the Engneerng and Legal Departments; and each subcontractor s hereby granted permsson to work on sad mprovement
