AN ORDINANCE ALLOWING FOR DIRECT LEGISLATION BY THE PEOPLE THROUGH THE INITIATIVE AND REFERENDUM; ADOPTING AS COUNTY 3-7 AND ITS AMENDMENTS THERETO; AND ESTABLISHING THE EFFECTIVE REQUIREMENTS THOSE REQUIREMENTS SET OUT IN IDAHO CODE SECTION DATE HEREOF. BE IT ORDAINED BY THE OF FREMONT COUNTY, IDAHO, AS FOLLOWS:. The people of Fremont County, Idaho hereby have the rght of drect county legslaton through the ntatve and referendum. 2. The people's rght of drect legslaton by ntatve and referendum shall be governed by the requrements set out n Idaho Code 3-7'!, and any amendments thereto, whch s hereby adopted as the governng procedure for such drect legslaton. 3. 3 ORDINANCE NO ct 7~ Q & AN ORDINANCE CLOSING CERTAIN PORTIONS OF FREMONT COUNTY AND JEFFERSON COUNTY TO HUMAN ENTRY DURING CERTAIN SPECIFIED SEASONAL CLOSURE DATES; ALLOWING FOR CERTAIN EXCEPTIONS TO HUMAN ENTRY; PROVIDING FOR CONFLICTS WITH EXISTING ORDINANCES; AND, ESTABLISHING THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE BOARDS OF COUNTY COMMISSIONERS OF FREMONT AND JEFFERSON COUNTY, AS FOLLOWS:. Closure. All lands and roadways wthn the boundares of dentfed on the attached Map, whch s attached hereto and made a part hereof, are hereby closed to any and all human entry durng the below prescrbed seasonal perods, except as otherwse provded n Secton 2, below: A. All lands and roadways wthn the boundares dentfed on the attached map whch are North of the Egn-Hamer Road are closed to human entry from January through Aprl 30; B. All lands and roadways wthn the boundares dentfed on the attached map whch are South of the Egn-Hamer Road are closed to human entry from January through March 3; C. The Taylor Well Road wthn the boundares dentfed on the attached map s closed to human entry from January through Aprl Exceptons. The followng exceptons to the closures set out above are hereby recognzed: A. All those persons wth specfc authorzaton from the countes; all those persons partcpatng n emergency or search and rescue operatons, and all those persons partcpatng n necessary agency admnstraton; B. The Red Road shall reman legally open to motorzed vehcles untl snow condtons physcally preclude normal vehcle traffc, and s thereafter open to snow machnes traffc; C. Lands admnstered by the BLM shall be open to grazng permttees authorzed to graze on those lands whle carng for and otherwse controllng ther lvestock, or whle mantanng exstng range mprovement structures necessary for lvestock control. D. Prvate lands shall be opened to the owners or ther agents who are on those lands whle carng for and otherwse ORDINANCE

The Egn-Hamer Road shall be open year round, unless closed pursuant to agreement wth the BLM. 3. Conflct of Laws. Ths ordnance shall supplant and take the place of pror Fremont County Ordnance No. 87-3, and Jefferson County Ordnance No. 35. However, n the event the Egn - Hamer Road s closed at any tme n the future pursuant to agreement wth the BLM, sad Fremont County Ordnance No and Jefferson County Ordnance No. 35 shall be renstated n ther entrety. 4. Effectve Date. Ths ordnance shall be n full force and effect, from and after ts passage and publcaton, all as provded by law..
