SECTON DEFNTONS 30 NTERPRETATON For the purpose of ths ordnance certan terms and words used heren shall be nterpreted or defned as follows: Words used n the present tense shall nclude the future. Words used n the sngular shall nclude the plural. The wordperson ncludes a corporaton as well as an ndvdual. The word lot ncludes the word(pot or parcel. The term shall s always mandatory. The word used or occuped as appled to any land or buldng shall be construed to nclude the words ntended, arranged,. or desgned to be used or occuped. The word buldng ncludes the word structure. 302 MEANNG OF WORDS Unless otherwse expressly stated, the followng words shall, for the purpose of ths Ordnance, have the meanng heren ndcated.. ACCESSORY BULDNG: Abuldng subordnate. fa, to the man buldng and used for purposes CUStomarly ncdental to those of the man buldng. 2. BULDNG LNE: The lne of that face of the buldng nearest the front lne of the lot. Ths face ncludes porches but does not nclude steps. 3. COMMERCAL: Engagng nabusness, enterprse, actvty, or other undertakng for proft. 4. ESSENTAL SERVCE: The erecton, constructon,alteraton or mantenance of publc utltes, muncpal departments or commssons of facltes, ncludng buldngs necessaryfor the furnshng of adequate servces for the publc health, safety or general welfare. 5. FAMLY: Anynumber of ndvduals lvng and cookng together as a sngle housekeepng unt, as dstngushed froma group occupyng a board - ng house. 6.- FRONT YARD: Theopen space extendng across the entre wdth of the lot between the front lne of the buldng lne and the street rght-of- way. 7. HEGHT: The heght of abuldng shall be measured from the mean level of the ground surroundng the buldng to a pont mdway between the hghest and the lowest ponts of the roof, provdng that chmneys, spres, towers, tanks, and smlar projectons shall not be ncluded n calculatng the heght. 8. LOT: The parcel of landon whch amanbuldng and any accessory buldngs are placed, together wth the requred open spaces. 9. MULTPLE DWELLNG: A buldng desgned for 2 3

SDE YARD: The requredopen space extendng from the sde of any buldng along the sde lot lne throughout the entre depthof the yard. Any lot lne not a rear lne or a front lne shall be deemed as a sde lne. 5. STREET LNE: The lne defnng the edge of the legal wdth of a dedcated street rght-of-way. 9. TRALER: Any lcensed or unlcensed pece of moble equpment desgned or constructed to be towed or pulled by a motor vehcle. 20. TRALER (HOUSE OR MOBLEHOME): Any lcensed or unlcensed traler or other vehcle desgned or used for lvng or sleepng purposes regardless of whether the wheels are attached or unattached, or a permanent or sem-permanent foundaton s constructed underneath or any structure of a permanent or sem-permanent nature s attached thereto. SECTON V ZONNG DSTRCTS 40 ESTABLSHMENT OF DSTRCTS For the purpose of applyng the provsons of ths ordnance, the Townshp of Whte, Pennsylvana, s hereby dvded nto the followng Zonng Dstrcts:. The boundares of these Dstrcts are hereby establshed as shownonthe map enttled "Offcal Zonng Ordnance Map"onfe nthe offce oftle zonng offcer, whchmap wth all explanatory matter thereon shall be deemed to accompany, be, and s hereby made a part of ths Ordnance. The Offcal Zonng Ordnance Map shall carry the sgnature of the Charman and the Townshp Secretary certfyng that t s the true map adopted bythe Board of Supervsors. All amendments shallbe dentfed on the map and smlarly certfed. 2. The boundares between Dstrcts are, unless otherwse ndcated, ether the centerlnes of streets or such lnes extended, or parallel lnes thereto, or other physcal boundares, and delneatons.. Where. streets, property lnes, or other physcal boundares and delneatons are not applcable, boundares shall be determnedby scale shown on the Offcal Zonng Map. SECTON V PARKNG AND-LOADNG- REQUREMENTS 60 LOADNG REQUREMENTS n all zonng dstrcts covered by ths Ordnance, the loadng and unloadng of trucks and all other vehcles shal be conducted n such a manner that no part of sadtruckor vehcle or the operatons of the loadng or unloadng shall extend onto the, adjacent sdewalk or roadway, or n any other manner hnder ormpede the use thereof. 602 PARKNG REQUREMENTS Off- street parkng facltes shall be provded n the varous ndvdual zonng dstrcts as are requred by the specfc artcles, on zonng dstrcts n Secton V Ths secton s not ntended to regulate parkng, but s ntended to regulate the provson of off-street parkng nthe nterest of the safety and general welfare of the communty. 9

GENERAL RESDENTAL DSTRCTS SGNS 70 APPLCATON Sgns may be erected and mantaned only when n complance wth the provsons of ths artcle and any and all other ordnances and regulatons of the Townshp of Whte, Pennsylvana, relatng to the erecton, alterton or mantenance of sgns and smlar devces. 702 PERMTTED USES Sgns maybe erectedfor the followng purposes and no other. '.. R- RESDENTAL DSTRCTS a. Sgns advertsng the sale, rental or development of property; sgns ndcatng the locaton and drecton of premses; sgns erected by churches, schools or- other smlar nsttutons provded the area of the sgn does not exceed twelve square feet (2 sq. ft. ) b. Small announcement or professonal sgns desgnatng professonal offces such as those of a surgeon, attorney, engneer, archtect, or smlar professonal person, provded such sgn or announcement does not exceed two square feet (2 sq. ft. ) n area. c. The bottom-most part of sgns shall not exceedthe heght of two feet (2') above ground level. d. Sgns shall be located a mnmum dstance of four feet (4') fromthe street rght-of- way. t.. '. f., a. Sgns, parkng areas and buldngs may be llumnatedprovdng the use of such llum- ~ naton does not confuse, blnd, or dstract vehcle operators onthehghways or streets adjacent to the ste. 4. NDUSTRAL DSTRCTS a. The provsons for the erecton of sgns n C- and C-2 Dstrcts shall also apply n "" ndustral Dstrcts. 703 CONDTON AND MANTENANCE n addton to the other requrements of ths Artcle, every sgn referred to heren must be constructed of durable materals, kept n good condton and repar, and not allowed to become dlapdated. Each sgn shall be removed when the crcumstances leadng to ts e- recton no longer apply. 0

8 704 PURPOSE OF SGN USED naddton to the other requrements of ths Artcle, no sgns or other advertsng dsplays shall be permtted except those specfcally pertanng to the use of the property on whch they are located. Further, all lghtng and llumnaton of sgns shall conform to regulatons regardng hazards to traffc. 705 BLLBOARDS Bllboards are prohbted n all dstrcts. SECTON V SUPPLEMENTARY REGULATONS The provsons of ths Ordnance shall be subject to such exceptons, addtons or modfcatons as heren provded by the followng supplementary regulatons. 80 ESSENTAL SERVCES Essental servces, as defned n ths Ordnance, shallbe permtted n all dstrcts, subject to restrctons approved by the Plannng Commsson wth respect to use, desgn, yard area, setback and heght. 802 DWELLNGS ON SMALL LOTS Notwthstandng the lmtatons mposed by any other provsons of the Ordnance, the Board of Adjustment may permt erecton of a dwellng on any lot, (n a dstrct where permtted by ths Ordnance) separately owned or under contract of sale and contanng, at the tme of the passage of ths Ordnance, an area or a wdth smaller than that requred for a sngle famly dwellng. nno case shallanytype of structure be permtted wthn fve feet (5') of a lot lne n any resdental dstrct. 803 TRALER CAMPS No traler camps are permtted wthn the lmts of the Townshp. No exceptons shall be made except. by amendment of ths Ordnance. 804 HOUSE TRALERS No lcensed or unlcensed house traler and no unlcensed vehcle of any type may be used for lvng quarters n any Dstrct. The removal of wheelsand the provson of foundatons or utltes suppled to such traler or vehcle does not consttute apermanent structure and permt occupancyunder anyprovson of ths Ordnance. No exceptons shall be made except by a- mendment of ths Ordnance. 805, STORAGE No lot or premses shallbe used as a garbage dump, or a dead anmal renderng plant. No manure, rubbsh, or mscellaneous refuse maybe storedn the open wthn any Dstrct where the same may be construed as a menace to publc health or safety. No exceptons shall be made except by amendment of ths Ordnance. - ~~ FENCES AND HEDGES Fences and hedges or other plantngs shall notbe locatedat street corners so as to nterfere wth vson clearance across the corner lots. The heght of such objects s restrcted to three feet wthn a trangular area formed by the ntersectng street lnes and a lne jonng ponts on the street lnes and equdstant from the pont of ntersecton. Ths dstance shall be 30 feet fromthecorner. nno case shall any fence or smlar structurebe permtted between the street rght-of-way and the front buldng lne n any resdental dstrct, - SECTON X NONCONFORMNG USES 90 WHEN PERMTTED Subject to the provsons of ths secton, a use of buldng or land exstng at the tme of the enactment of ths Ordnance may be contnued even though such 2 3

9 use does not conform wth the provsons of these regulatons for the dstrct n whch t s located. 902 UNSAFE STRUCTURE Nothng n ths Ordnance shall prevent the strengthenng or restorng to a safe condton of any porton of a buldng or structure declared unsafe by aproper authorty. 903 ALTERATONS A nonconformng buldng or structure may be altered, mproved or reconstructed provded such work s not to an extent exceedng n aggregate cost ffty per cent (50%) of the far market value of the buldng or structure unless the buldng or structure s changed to a conformng use..-*-.%-,.-.-** ~ ;$w~.g; RESTO ~XS;L:~+P Nothng n ths Ordnance shall prevent the reconstructon, reparng, rebuldng and contnued use of any nonconformng buldng or structure damaged by fre, collapse, exploson or Act of God subsequent to the date of ths Ordnance wheren the expense of such work does not exceed ffty per cent (500/0) of the far market value of the buldng or structure at the tme such damage occurred. 905 EXTENSON A nonconformng use shall not be extended, but the extenson of a lawful use to any porton of a nonconformng buldng or structure whch exsted pror to the enactment of the Ordnance shall not be deemed the extenson of such nonconformng use. 906 CHANGES No nonconformng buldng, structure, or use shall be changed to another nonconformng use CONSTRUCTON APPROVED PROR TO ORDNANCE Nothng heren contaned shall requre any change n plans, constructon or desgnated use of a buldng or structure for whch a buldng permt has been ssued and the constructon of whch shall have been dlgently prosecuted wthn two (2) months of the date of such permt, and the ground story framework of whch shall Le-- ---_ T-L-J --2&L:- c,.,, Lav. c UGGU CUAL~AGLGU W~LUALA ~.vu& (4) ---+he C* ef -- +he ---- Afp ---- of the permt, and whch entre buldng shall be completed accordng to such plans as fled wthn one () year from the date of ths Ordnance. 908 ABANDONMENT A nonconformng use of a buldng or land whch has been abandoned shall not thereafter be returned to such nonconformng use. A nonconformng use shall be consdered abandoned as follows:._ - l.-wken tke ntent-of the owner to dscontnue the use s apparent; 2. Whenthe characterstc equpment and furnshngs of the nonconformng use have been removedfromthepremses and have not been replaced by smlar equpment wthn nnety (90) days, unless other facts show ntenton to resurne the nonconformng use: 3. When a nonconformng use has been dscontnued for a perod of sx (6) months: 4. Whenthas been replaced by a conformng use; or * 5. When t has been changed to another use under permt from the Board of Adjustment. 4 5

10 909 UNLAWFUL USE NOT AUTHORZED Nothng n ths Ordnance shall be nterpreted as authorzaton for or approval of the contnuance of the use of a structure or premses n volaton of zonng regulatonsn effect at the tme of the effectve date of ths Ordnance. 90 DSTRCT CHANGES Whenever the boundares of a dstrct shall be changed so as to transfer an area from one dstrct to another dstrct of a dfferent classfcaton, the foregong provsons shall apply to any nonconformng uses ex stng theren. SECTON X ADMNSTRATVE AND ENFORCEMENT 00 ADMNSTRATVE The zonng offcer shall admnster- and enforce ths Ordnance, ncludng the recevng of applcatons, the nspecton of premses and the ssung of buldng permts. No buldng permt or certfcate of occupancy shallbe ssued by sad offcer except where the provsons of ths Ordnance have been compled wth. The zonng offcer shallbe apponted by the Board of Super - vsors of the Townshp of Whte, Pennsylvana. 002 BULDNG PERMT REQURED. Nobuldng or structure shall be erected, added to, or structurally altereduntl a permt thereforehas been ssued by the zonng offcer. All applcatons for such permts shallbe n accordance wth the requrements of ths Ordnance, and, unless upon wrtten order of the Board of Adjustments, no such buldng permt or certfcate of occupancy shall be ssued for any buldng where sad constructon, addton or -... alteraton for use thereof would be n volatonof any of the provsons of ths Ordnance. 2. Matter Accompanyng Applcatons: There shall be submtted wth all applcatons for buldng permts two copes of a layout or plot plan drawn to scale showng the actualdmensons of the lot to be bult upon, the exact sze and locaton of the buldng on the lot and accessory buldngs to be erected, and other such nformaton as may be necessary to determne and provde for the enforcement of ths Ordnance Fee: Onecopyof suchlayout or plot plan shall be returned when approved by the zonng offcer together wth the permt t > the applcant upon a payment of a fee as determned by the Board of - super~-s~rs.- ~ CERTFCATE OF OCCUPANCY No land shallbe occupedor used and no buldng hereafter erected, altered, or extended shall be used or changed n use untl a certfcate of occupancy shall have been ssued by the zonng offcer statng that the premses or proposed use thereof comples wththe provsons of ths Ordnanc e. No nonconformng use shall be mantaned, renewed, changed or extended wthout acertfcate of occupancy havng frst been ssued by the zonng offcer for such use. The zonng offcer shall mantan a record of all certfcates and copes shall be furnshed, upon request, to any person havng a propretary or tenancy nterest n the buldng erected. 6 7

11 4. No permt for excavaton, or erecton, or altertonof, or repar to anybuldng shall be ssued untl an applcaton has been made for a certfcate of occupancy. SECTON X BOARD OF ZONNG ADJUSTMENT 0 CREATON, APPONTMENT AND ORGANZATON A Board of Zonng Adjustment s hereby created. Sadboard shall consst of three members apponted by the Board of Supervsors. The ntal terms of the frst threemembers shallbe as follows: one shall serve untl the frst Monday of January followng the adopton of ths Ordnance; one untl the frst Monday of the second January followng the adopton of ths Ordnance; and the other untl the frst Monday of the thrd January follow - ng the adopton of ths Ordnance. Ther- successors shall serve for a term of three years. Any vacancy shallbeflled for the unexpred term only, The members of the Board shall be removed for cause by the appontng author;+yupon wrtten charges and after publc hearng. The Board shall organze and elect a Charman and a secretary from ts membershp, and shall prescrbe rules for the conduct of ts affars n accordance wth applcable law. 02 POWERS AND DUTES. TheBoard of Zonng Adjustment shall hear and decde appeals from and revew any order, re-.. qurement, decson or determnaton made by the Zonng Offcer n the Admnstraton of ths Ordnance. 2. TheBoard of Zonng Adjustment shall hear and decde all matters referred to t or upon whch t s requred to pass under ths Ordnance , 3. The Board of Zonng Adjustments may ssue specal permts for any of the uses for whch ths Ordnance requres the obtanng of such permts. n grantng any specal permt, the Board shall prescrbe any condtons that t deems to be necessary to or desrable for the publc nterests. No specalpermt shallbe granted by the Board of Zonng Adjustment unless t fnds that the use for whch such permt s sought wll not be njurous to the neghborhood or otherwse detrmental to the publc welfare and wll be n harmonywth the general purpose of ths Ordnanc e. 4. TheBoard of Zonng Adjustments may adapt or vary the strct applcaton of any requrements of ths Ordnance n the case of rregular, narrow, shallow or steep lots, or other physcal condtons whereby such strct applcaton would result n practcal dffculty or unnecessary hardshp that would deprve the owner of the reasonable use of the land or buldng nvolved, but n no other case. a. No such varance n the strct applcaton of any provson of ths Ordnance shallbe grantedby the Board of Zonng Adjustment unless t fnds that there are specal crcumstances or condtons whch are such that the strct applcaton of the provsons of ths Ordnance would deprve the applcant of the reasonable use of land or buldngs. b. The grantng of any varance shall be n harmony wth the general purpose and ntent of ths Ordnance, and shall not be n- 9

12 jurous to the neghborhood or otherwse detrmental to the publc welfare. 03 PROCEDURE The procedure of the Board shall be governed by the provsons of applcable laws of the Commonwealth of Pennsylvana, and such rules, not nconsstent therewth, as the Board may adopt. n general, the procedurefor appeal from acton of the Zonng Offcer shall be as follows:. The Board may adjourn any hearng for the purpose of revewng such data as may be pertnent to theproblem nvolved and to request nterpretatons of sad data by a representatve of the Plannng Com- - msson The Board shall decde each appeal wthna reasonable tme, and notce thereof shall be gven to all partes n nterest. The Board' s decson shall be mmedately fled n ts offce and be a publc record. n the exercse of ts functons upon such appeals or upon exceptons, the Board may n conformty wth law reverse or affrm, wholly or partly, or modfy the order requrement, decson or determnaton appealedfrom, or make such order, requrement decson, or determnaton as n ts opnon ought to be made. 2. The appellant shall, at the tme of flng hs appeal, pay the enforcng offcer a fee of ten dollars ($0.00) to defray, or help defray, the cost of the requred advertsng. 6. Any person aggreved by any decson ofthe Board or any Townshp offcer affected thereby may appeal therefrom wthn thrty (30) days to the Court of Common Pleas as provded by law Each appeal shall be tredon ts merts at a publc hearng.
