(c) lf nsurance s nvolved n the acton, the nsurance carrer shall send a representatve of the nsured party, who s not such carrer s outsde counsel, who has full authorty to settle up to the amount of the plantffs last demand or the polcy lmts, whchever s less, wthout further consultaton. (d) lf a party has knowlede of the exstence of a len, such as workers compensaton, medcal lens, or other subroated lens, then that party shall ve notce of the date, tme and place of the Medaton Conference to the len holder. 3. MDIATION PROCSS: Medaton s a process n whch a neutral and mpartal thrd party, the medator, acts to encourae and facltate the resoluton of a dspute wthout prescrbn what t should be. lt s an nfonnal and non-adversaral process wth the objectve of helpn the partes to communcate constructvely and to voluntarly reach ther own mutually acceptable resoluton of the ssues n dspute. A medator does not makle rulns, or ve leal advce, or mpose any settlement on the partes. The medator has no power to ether compel or enforce settlement areements.

MDIATION STATMNTS AND SUMMARIS: No less than 72 hours pror to the Medaton Conference, each party shall fumsh to the Medator, wth a copy to all counsel nvolved, a statement outlnn the party s poston, the ssues nvolved, the latest settlement neotatons and desnatn the persons who wll appear at the Medaton Conference. Partes and counsel may attach other documents to the medaton statement, whch they wsh the,. medator to revew. These statements should not be Hled wth the Court. Any party may communcate, throuh counsel, wth the Medator at any tme reardn the conference.
