Box 9000, Drawer J150 Bartow, Florda (863) jnelson@jud10.flcourts.org PURPOSE: The purpose of ths Request for Qualfcatons (heren referred to as RFQ ) s to request qualfcatons from court reportng frms (herenafter referred to as Respondent ) nterested n provdng stenographc court reportng servces funded at publc expense for court proceedngs n the Tenth Judcal Crcut of Florda begnnng on or about July 1, The Tenth Judcal Crcut s comprsed of Hardee, Hghlands and Polk Countes. It s the Tenth Judcal Crcut Court s ntent to utlze ts own employees to provde the majorty of court reportng servces and to establsh a contractual relatonshp wth a stenographc court reportng frm, or frms, to provde servces n certan specfc areas. Respondents may submt responses for the provson of stenographc court reporters, as outlned n the Scope of Servces and the Rate/Fee Schedule below, n Crcut Court n Hardee, Hghlands or Polk Countes, or any part or combnaton thereof. Ths

2 RFQ s for the provson of contractual servces mentoned heren. The Court may award multple contracts pursuant to ths RFQ. DEFINITIONS: The term RFQ as used heren means Request for Qualfcatons. The term AOC as used n ths RFQ means the Admnstratve Offce of the Court. The term Court as used n ths RFQ means the Tenth Judcal Crcut Court of Florda. The term Contractor as used n ths RFQ means a successful Respondent who has entered nto a contractual relatonshp wth the Court. The term Hardee County means the Hardee County Courthouse n Wauchula, Florda, and any other place wthn Hardee County where judcal proceedngs may take place. The term Hghlands County means the Hghlands County Courthouse n Sebrng, Florda, and any other place wthn Hghlands County where judcal proceedngs may take place. The term Polk County means the court facltes n Bartow, Florda; Lakeland, Florda; Wnter Haven, Florda; and any other place wthn Polk County where judcal proceedngs may take place. The term CART as used n ths RFQ means Communcaton Access Realtme Translaton and s defned by the Natonal Court Reporters Assocaton as the nstant translaton of the spoken word nto Englsh text usng a stenotype machne, notebook computer and realtme software. The text appears on a computer montor or other dsplay. The term Respondent as used n ths RFQ means an ndvdual or frm submttng a response to ths RFQ outlnng ts qualfcatons to provde stenographc court reportng servces. SCOPE OF SERVICES: 1. The AOC for the Tenth Judcal Crcut Court of Florda s acceptng wrtten qualfcatons from qualfed vendors to provde stenographc court reportng servces n Hardee, Hghlands and Polk Countes, Florda, pursuant to Florda Rule of Judcal Admnstraton 2.535, Tenth Judcal Crcut Admnstratve Order (or as may be amended, modfed, or superseded), and any other applcable Florda statute(s), court rule(s), or admnstratve order(s) that pertan to court reportng servces. 2. The servce perod wll commence on or about July 1, 2018, and wll be for three (3) years, wth the opton of one contract renewal for a perod of up to three (3) addtonal years, as further explaned below n Number 2 of the General Condtons Secton. 3 3. The servce delvery soluton may nclude one or more methods of recordng and transcrpton of the court record for varous court dvsons and proceedngs. 4. Furnsh all labor, necessary stenographc equpment, and all other necessary equpment to provde stenographc court reportng servces. 5. The Court reserves the sole rght to determne a Respondent s ablty to perform n accordance wth the specfcatons, terms, and condtons of ths RFQ. 6. Contracts wll be awarded to Respondent s for the provson of stenographc court reportng servces n the followng court proceedngs n the Tenth Judcal Crcut: - Crcut Court Crmnal (specfcally all frst and second degree felony jury trals and all matters relatng to captal cases where the death penalty s beng sought); and - Crcut Court Juvenle (specfcally all Termnaton of Parental Rghts trals and all waver of parental notfcaton of aborton hearngs); and - Any proceedngs requrng Communcaton Access Realtme Translaton (herenafter CART ) that are requred to be translated by the Amercans wth Dsabltes Act (herenafter ADA ); and - Other proceedngs as drected by the Court. Respondent(s) may submt a Response to ths RFQ to provde for servces n the abovereferenced areas n whole, n part, or any combnaton thereof. The chef judge may desgnate any judcal proceedng to be electroncally recorded n leu of a stenographc court reporter. 7. The awarded contractor(s) shall further agree to provde the followng: - Transcrpts that comply wth Florda Rule of Judcal Admnstraton 2.535, and all other applcable Florda Rules of Court and admnstratve orders; and - Retenton of notes, records, and transcrpts n accordance wth requrements of Rule 2.430, Florda Rules of Judcal Admnstraton; and - A verbatm record of legal proceedngs and accurate translatons and/or transcrpts n a format acceptable to the Tenth Judcal Crcut Court and the Florda Supreme Court; and - Tmely dstrbuton of requested transcrpts; and - Careful mantenance of fles and records as requred by the Florda Rules of Judcal Admnstraton or law; and - Complance wth Florda Rule of Judcal Admnstraton 2.420, regardng publc access to and protecton of judcal branch records; and - Any and all other requrements of the RFQ and specfcatons. 8. Respondent s solely responsble for readng and completely understandng the requrements and the specfcatons of the tems or servces heren and the followng to nclude, but not be lmted to, state and federal laws, rules, and admnstratve order of the Supreme Court of Page 3 of 15

4 Florda and the Tenth Judcal Crcut Court, as currently n effect or as may be amended. 9. The awarded contractor(s) shall be responsble for ensurng complance wth the State of Florda publc records laws. 10. Pursuant to Florda Rule of Judcal Admnstraton 2.535(d), the chef judge of the Court shall be the owner of all the records and electronc records reported or produced for the Court by the contractor(s). 11. Proceedngs wll take place n court facltes located n Bartow, Lakeland, Wnter Haven, Sebrng, and Wauchula, Florda, and any other place or faclty wthn the crcut where judcal proceedngs may take place. 12. The court reporter servces Contract or any porton thereof shall not be assgned, subcontracted, or transferred except as allowed n the RFQ specfcatons, response thereto, and the awarded Contract wthout the pror express wrtten consent of the Court. 13. The Court n no way mples or guarantees any mnmum expendture or number of cases as part of ths RFQ or any resultant Contract. 14. As specfed n ths RFQ, the Respondent(s) s requred to furnsh qualfed court reporters, staffng, management, admnstratve and supervsory control as necessary, equpment, computer equpment, prnters and paper. Computer equpment shall nclude real-tme capablty. 15. The awarded contractor(s) are responsble for supplyng ts own equpment for proceedngs covered under the resultant Contract wth no addtonal costs to the Court or the State of Florda, ncludng connectng cables and any other equpment needed for real-tme reportng n accordance wth Supreme Court gudelnes. The Court wll only provde equpment for the judge and defendant(s). The attorneys wll provde ther own equpment. 16. The awarded contractor(s) shall provde a wrtten statstcal report to the Senor Court Operatons Consultant n care of the AOC no later than tenth (10th) of each month for the servces provded durng the precedng month. The report wll nclude, but not necessarly be lmted to: quantty and type of proceedngs covered durng the reportng perod; number of pages, by type of proceedng transcrbed; case numbers and dates for each proceedng; and other nformaton as requested. MINIMUM QUALIFICATIONS: 1. Respondent s must meet the followng mnmum qualfcatons: A. Respondent shall have engaged n the provson of stenographc court reportng servces for a mnmum of the last three years. Page 4 of 15

5 B. Respondent shall currently employ or contract wth, or demonstrate the ablty to employ or contract wth, at least one stenographc court reporter. C. If Respondent(s) Response ncludes a provson to provde court reportng servces for CART, then Respondent shall currently employ, or demonstrate the ablty to employ, at least one experenced real-tme stenographc court reporter wth related hardware, not lmted to counsel tables and the judge s bench, and software to suffcently meet the requrements of the Supreme Court for Captal Cases and the ADA. The reporter shall have CRR certfcaton. D. Respondent shall have the ablty to provde transcrpts on dsks (DVD or CD), e-mal, floppes, flash drves, other electronc meda, and as condensed transcrpts. E. Respondent shall have the ablty to transmt transcrpts electroncally as set forth n Florda Rule of Judcal Admnstraton Stenographc court reportng staff shall meet the followng mnmum qualfcatons: A. Reporters shall be profcent n readng, wrtng, and speakng the Englsh language, and shall have extensve knowledge of legal termnology; court practces and procedures; transcrpt preparaton; and professonal responsblty. B. Shall comply wth state standards f the State of Florda mplements certfcaton requrements for crcut court reporter, and f mplemented, shall mantan the requred certfcaton(s) at ther own expense. C. Have at least 3 years of verfable stenographc court reportng experence, ncludng at least 2 years of courtroom experence as determned by the Crcut. D. Be a Computer-Aded Transcrpt (CAT) reporter f scheduled for real-tme stenographc court reportng. E. Shall use steno-machnes provded by the Respondent that are capable of accommodatng computer-aded transcrpton (CAT) f scheduled for real-tme stenographc court reportng. F. Possess a certfcate n stenographc court reportng from an accredted stenographc court reportng school or college, or demonstrate, through at least 5 letters of recommendaton from judges and/or attorneys, of experence and abltes to perform dutes. G. Possess a certfcate of profcency or Regstered Professonal Reporter (RPR) or a Certfcate of Mert from the Natonal Shorthand Reporters Assocaton. H. Shall be capable of translatng, edtng, and producng typed transcrpts as needed, havng full responsblty for techncal accuracy. Page 5 of 15

6 I. Shall be capable of producng accurate transcrpts consstent wth establshed standards of accuracy. J. Shall be sklled, knowledgeable, and dedcated to achevng and mantanng a hgh level of professonalsm. K. Shall be Notares Publc. COMPENSATION: 1. Respondent(s) that are awarded a contract pursuant to ths RFQ must agree to and wll be compensated pursuant to the Rate/Fee Schedule set forth n Secton A through Secton I, below: A. Transcrpt Fees: Transcrpt for trals, TPRs, all day proceedngs and appeals: orgnal and two (2) copes at $7.00 per transcrpt page n desgnated format. Other transcrpts: orgnal and one (1) copy at $6.00 per transcrpt page n desgnated format. Expedted transcrpts (weekend and holdays excluded): 72 hours at $7.50 per transcrpt page n desgnated format; 48 hours at $8.50 per transcrpt page n desgnated format; 24 hours at $9.50 per transcrpt page n desgnated format; Daly at $10.50 per transcrpt page n desgnated format; and Addtonal copy at $2.00 per transcrpt page n desgnated format. B. In-Court Per Dem Appearance Fees (stenographc): Crmnal trals (Crcut Court): From 8:00 a.m. to 5:00 p.m., the Court Reporter shall be compensated at the rate of: $60.00 per hour. From 7:00 a.m. to 7:59 a.m. and 5:01 p.m. to 8:59 p.m., the Court Reporter shall be compensated at the rate of $90.00 per hour. From 9:00 p.m. to 6:59 a.m., the Court Reporter shall be compensated at the rate of $ per hour. Juvenle dependency TPR trals: From 8:00 a.m. to 5:00 p.m., the Court Reporter shall be compensated at the rate of: $60.00 per hour. From 7:00 a.m. to 7:59 a.m. and 5:01 p.m. to 8:59 p.m., the Court Reporter shall be Page 6 of 15

7 compensated at the rate of: $90.00 per hour. From 9:00 p.m. to 6:59 a.m., the Court Reporter shall be compensated at the rate of $ per hour. Other proceedngs: From 8:00 a.m. to 5:00 p.m., the Court Reporter shall be compensated at the rate of: $60.00 per hour. From 7:00 a.m. to 7:59 a.m. and 5:01 p.m. to 8:59 p.m., the Court Reporter shall be compensated at the rate of: $90.00 per hour. From 9:00 p.m. to 6:59 a.m., the Court Reporter shall be compensated at the rate of $ per hour. C. CART Servces for the Deaf/HOH, provded under ADA: Transcrpts: No transcrpts provded wth CART servces. Not a verbatm record, and CART reporter s not the reporter of record. Fees for reporter of record are a separate charge. Per dem appearance fee: $ per hour for CART; One-tme $30.00 preparaton fee. Respondent s responsble for montor hook-up for CART recpent. D. Rough ASCII: Per dem appearance fee: $75.00 per hour; One-tme $30.00 preparaton fee. Per page: $1.25 per 24-lne page of rough ASCII. Orderng of rough ASCII requres guaranteed purchase of orgnal and one (1) copy of fnal transcrpt at above-lsted transcrpt fee schedule. E. Real-Tme Hookup (nteractve real-tme): Per dem appearance fee: $ per hour per hookup; One-tme $30.00 preparaton fee. 8 of fnal transcrpt at above-lsted transcrpt fee schedule. Orderng party of real-tme hookup wll provde ts own equpment. The Court Reporter wll provde the hookup cable only. Orderng party s responsble for troubleshootng real-tme hookup. F. General Provsons Pertanng to Appearance Fees Lsted above n Sectons B-E: Mnmum per dem appearance fee: At a mnmum, the Court Reporter shall be compensated for: Two (2) consecutve hours of appearance tme for the mornng sesson (.e., before the lunch break); and One (1) hour of appearance tme for the afternoon sesson (.e., after the lunch break). If the contractor s appearance tme does not begn untl the afternoon sesson, then the contractor wll be compensated, at a mnmum, for two (2) consecutve hours of appearance tme for the afternoon sesson. Change n Physcal Locaton for Court Proceedngs: If court reportng servces are requested for court proceedngs held at multple courthouse facltes or other locatons where court proceedngs are held, then the Court Reporter shall be compensated per day, at a mnmum, for two (2) consecutve hours of appearance tme at the frst locaton and one (1) hour of appearance tme at each addtonal locaton. For example, f mental health hearngs begn at Lakeland Regonal Health, then proceed to Wnter Haven Hosptal (BayCare), and Bartow Regonal Medcal Center (BayCare), the Court Reporter shall be compensated for a mnmum of two (2) hours at Lakeland Regonal Health (BayCare), one (1) hour at Wnter Haven Hosptal (BayCare), and one (1) hour at Bartow Regonal Medcal Center (BayCare). All per dem appearance rates shall be rounded up to the next half hour after the mnmum per dem appearance fee(s) has been met. Unless otherwse provded, the followng overtme rates wll apply for all stenographc court reportng servces: Servces provded from 7:00 a.m to 7:59 a.m. wll be compensated at 1.5 tmes the regular per dem rates. Servces provded from 5:01 p.m. to 8:59 p.m. wll be compensated at 1.5 tmes the regular per dem rates. Double tme rates wll apply after 9:00 p.m. untl 6:59 a.m. on weekdays, and all day on weekends and court holdays. v When a court reporter s ordered by a presdng judge to stand-by status, that tme may be blled as n-court tme. Stand-by means when the court proceedng has been completed, but the presdng judge has asked the court reporter to reman for possble Page 8 of 15

9 further proceedngs. v Names from case fle may be provded to the Court Reporter no less than one week pror to any scheduled real-tme proceedng, to buld job dctonary. v Contractor(s) wll not be compensated for travel tme or lunch break. v Court Reporter shall be compensated for mleage from the Court Reporter s home address or ther employer s address, whchever s closer, to the court faclty at whch stenographc court reportng servces are to be provded at publc expense. Mleage shall be based on the Florda Department of Transportaton s offcal hghway mleage. G. Other Court Reportng Servces: Electronc delvery of transcrpt (DVD, CD, e-mal, floppes, flash drves, or other electronc meda): $25.00 per transcrpt or volume of transcrpt (n addton to the perpage rate). Word ndces: blled at the per page rate of the transcrpt. Postage: Mnmum $6.00 per malng OR actual cost of postage or shppng fees, whchever s greater. Copy of recept must accompany nvoces for any charges other than the mnmum $6.00 cost. H. Hourly Rate for Travel Outsde of Crcut: Expenses for out-of-crcut proceedngs and/or change of venue cases wll be subject to the travel rates establshed n Secton I (below) ttled Rembursement for Travel Expenses and must be pre-approved by the Court s Admnstratve Servces Department. Court Reporter shall be compensated for mleage from the Court Reporter s home address or ther employer s address, whchever s closer, to the court faclty at whch stenographc court reportng servces are to be provded at publc expense. Mleage shall be based on the Florda Department of Transportaton s offcal hghway mleage. Travel tme s not compensable. I. Rembursement for Travel Expenses: Rembursement for travel expenses wll be blled as applcable under , Florda Statutes and must be submtted on the State Court System Voucher for Rembursement of Travel Expenses form that s found at The Court Reporter must nclude an nvoce number on the State of Florda Voucher for Rembursement of Travel form (herenafter Travel Voucher ). 10 number must end wth the letter T. The remanng characters makng up the nvoce number on the Travel Voucher must match the nvoce number on the Court Reporter s correspondng unform nvoce for the same tme perod. For example, f the unform nvoce number s 1234, then the correspondng Travel Voucher nvoce number would be 1234T or 1234-T. Addtonally, each day of travel lsted on the Travel Voucher must nclude the tme that travel begns and ends each day. The terms and condtons descrbed as State of Florda Travel Informaton at are ncorporated heren as f fully rected n ths RFQ except to the extent that any of those terms or condtons are n conflct wth ths RFQ. 2. The Court s performance and oblgaton to pay for servces outlned n ths RFQ or any resultant Contract are contngent upon the avalablty of State funds lawfully approprated to fulfll the requrements of ths RFQ or any resultant Contract. The Court s performance and oblgaton to pay for servces outlned n ths RFQ or any resultant Contract are also contngent upon fnal spendng approval from the Chef Justce of the Florda Supreme Court. 3. The Court may request addtonal court reportng servces under ths Agreement at any tme. The contractor(s) wll be compensated for such addtonal servces as mutually agreed by the partes, n wrtng. GENERAL CONDITIONS: 1. The Tenth Judcal Crcut Court reserves the rght to award one or more contracts to provde the requred servces to qualfed responders, as deemed to be n ts best nterest. The awarded contractor(s) may not currently be an employee of any agency or branch of the State of Florda. Any awarded contractor(s) shall provde the servces requred heren strctly under a contractual relatonshp and s not, nor shall be, construed to be an employee of the Court, the Florda State Court System, or the State of Florda. Pror to sgnng any resultng contract(s), the contractor must regster to do busness wth the State wth the Department of Fnancal Servces and sgn up for electronc depost. 2. Pror to commencng work, the successful Respondent(s) wll be requred to sgn a wrtten contract ncorporatng the specfcatons and terms of ths RFQ and the response thereto. Any contract awarded as a result of ths RFQ shall be for a perod of three (3) years, begnnng on or about July 1, 2018, and termnatng on June 30, One contract renewal for a perod of up to three (3) addtonal years may be allowed upon the mutual consent of the contractor(s) and the Court. The renewal opton shall be exercsed only f the work of the contractor s satsfactory to the Court and all orgnal contract terms, condtons, and prces reman the same. 3. As an ndependent contractor, the awarded contractor(s) shall pay any and all applcable taxes requred by law; shall comply wth all pertnent Federal, State, and local laws, ncludng, but not lmted to, the Far Labor Standards Act, The Amercans wth Dsabltes Act, the Federal Page 10 of 15

11 Cvl Rghts Act, and any and all relevant employment laws. The contractor(s) shall be responsble for all ncome taxes, FICA, and any other wthholdngs from ts employees, or subcontractor s wages or salares. Frnge benefts, f applcable, shall be the responsblty of the contractor(s), ncludng, but not lmted to, health and lfe nsurance, mandatory socal securty, retrement, lablty/rsk management coverage, and workers and unemployment compensaton. 4. Any resultant contract, among other thngs, wll be bound by the current Florda State Courts System General Contract Condtons for Servces, ncorporated heren as f fully rected n ths RFQ, whch can be found at 5. The Crmnal Justce Informaton Servces (CJIS) Securty Polcy, found at s ncorporated heren as f fully rected n ths RFQ. Pror to commencng work, the successful Respondent(s) wll be requred to: 1) revew and complete the requrements set forth n the polcy, whch ncludes, but s not lmted to, onlne tranng and a fngerprnt background check, and 2) provde a lst of all staff that wll be provdng servces under the contract (the lst must be updated wth any changes n staff employment status). 6. The contractor(s) shall not be exclusvely bound to the Court and may provde court reportng servces to other prvate and publc enttes as long as there s no conflct of nterest. 7. The Florda State Courts System Fraud Polcy, found at s ncorporated heren as f fully rected n ths RFQ. 8. Offce space for purposes of managng contract servces or otherwse fulfllng dutes pursuant to the scope of work wll not be provded by the Court. Offce furnshngs, supples, or other equpment wll not be provded by the Court. Nether wll the Court pay for any tranng, contnung educaton expenses, or professonal assocaton dues on behalf of the contractor(s). SUBMITTAL INSTRUCTIONS AND REQUIREMENTS FOR RESPONSE: 1. Instructons: A. Responses must be typed on whte letter-sze paper and each element of the RFQ shall be addressed n a clear, concse manner. Each element shall be labeled and ndexed. RFQ shall be ndvdually bound. B. One (1) orgnal, marked ORIGINAL, and four (4) copes, each marked COPY, are requred of each RFQ. Any RFQ receved after 5:00 p.m. EST, on June 7, 2018, wll not be consdered for award. 2. Materals: Respondent s must submt the followng nformaton s n a response to ths RFQ: A. Respondent Informaton: Respondent shall submt a bref ntroducton ndcatng your nterest n provdng stenographc court reportng servces for one or more countes wthn the Crcut, along wth the followng: Respondent s offcal busness name; address (physcal and malng); telephone and fax numbers; e-mal address; type of busness, such as sole propretorshp, partnershp, or corporaton, ncludng the State of ncorporaton; Name of owner; FEID number or socal securty number (SSN #); v Length of tme n busness; v Locaton(s) of busness operatons; v Qualfcatons and experence of corporate offcer(s) and/or key personnel; v Number of court reporter staff; v Descrpton of support staff; and x Current fnancal statement. B. Professonal Résumé: Respondent shall submt a bref résumé that ncludes a lst of Respondent s court reportng experence. C. Statements: Statement of Project Understandng: Respondent shall submt a statement ndcatng an understandng of the project and the requrements thereof. Page 12 of 15

13 Respondent Qualfcatons Statement: Respondent shall submt a statement ndcatng that Respondent and ts staff meet the mnmum qualfcatons outlned n the Mnmum Qualfcatons Secton heren. Respondent must attach to the statement all supportng documentaton and evdence of meetng the qualfcatons requrements set forth heren. Compensaton Statement: Respondent shall submt a statement ndcatng that Respondent understands and agrees to be compensated as set forth n the Compensaton Secton of ths RFQ. D. Technology Plan: Respondent shall submt a descrpton of CAT and other computer equpment that would be used n the performance of dutes, ncludng hardware, software, and backup and support servces. E. Grevance Plan: Respondent shall submt a descrpton of how complants concernng fees, errors, tardness, etc. aganst ndvdual reporters or the frm are handled by the frm. F. Qualty Assurance: Respondent shall submt the followng: the frm s statement of commtment to qualty assurance; the frm s capablty and plan to guarantee the appearance of court reporters for proceedngs; the frms plan(s) for hrng, tranng, contnung educaton, and performance evaluatons of employees. G. Staff Roster: Respondent shall submt a completed Staff Roster (attached and ncorporated heren as Attachment A ) lstng of all Respondent s staff members that would potentally be provdng court reportng servces.
