1 ORDNANCE NO An ordnance amendng Secton of the Los Angeles Muncpal Code by amendng the Zonng map. THE PEOPLE OF THE CTY OF LOS ANGELES DO ORDAN AS FOLLOWS: Secton 1. Secton of the Los Angeles Muncpal Code s hereby amended by changng the zone and zone boundares shown upon a porton of the zone map attached thereto and made a part of Artcle 2, Chapter 1 of the Los Angeles Muncpal Code, so that such porton of the zonng map shall be as follows:

3 QUALFED CONDTONS OF APPROVAL Pursuant to Secton G of the Los Angeles Muncpal Code (LAMC), the followng lmtatons are hereby mposed upon the use of the subject property, subject to the Q Qualfed classfcaton. A. Development Condtons: 1. Use. The property shall comply wth the use, restrctons/lmtatons, and area provsons of the RAS3 Zone, pursuant to LAMC Secton , unless modfed by heren condtons or subsequent acton. 2. Densty. A maxmum of twelve (12) Small Lot homes. 3. Heght. No buldng or structure shall exceed 32 feet, 9 3/8 nches n heght, as defned by Secton of the LAMC, and as shown on the project plans dated August 18, 2017, and labeled Exhbt A, attached to the subject case fle Ste Development. Plot/Ste Plan. Pror to the ssuance of any buldng permts for the subject project, detaled development plans, ncludng ste and elevaton plans, and ncludng complete landscape and rrgaton plans prepared by a lcensed landscape archtect or archtect, shall be submtted for revew and approval by the Department of Cty Plannng for verfcaton of complance wth the mposed condtons. The plans submtted to the Department of Buldng and Safety shall be revsed n conformance wth ths approval, and shall be n substantal conformance wth the plans dated August 18, 2017, and labeled Exhbt A, attached to the subject case fle. Mnor devatons may be allowed n order to comply wth provsons of the Muncpal Code, the subject condtons, and the ntent of the subject permt authorzaton. Off-street Parkng. Automoble and bcycle parkng shall be provded on-ste as requred by L.A.M.C. Sectons A.4 and A.16, respectvely. Four (4) guest automoble parkng spaces shall be provded, n accordance wth the requrement mposed by Vestng Tentatve Tract No. VTT SL. Landscapng (Open Areas). All open areas not used for buldngs, drveways, parkng areas, recreatonal facltes or walks shall be attractvely landscaped, ncludng an automatc rrgaton system, and mantaned n accordance wth a landscape plan prepared by a lcensed landscape archtect or lcensed archtect, and submtted for approval to the Department of Cty Plannng. The front, sde, and rear yard landscapng shall be provded as dentfed on Sheet L1 of the Plan set labeled Exhbt A and dated August 18, Lvng Roof. A landscaped lvng roof shall be provded on the roof deck of each Small Lot home, as dentfed on Sheet L2 of the Plan set labeled Exhbt A and dated August 18, 2017.

Locate the prmary entrance of the Small Lot homes located on lots 6 and 12 facng the street (Colfax Avenue), and provde a pedestran access gate and walkway leadng from the publc rght-of-way along Colfax Avenue to each home frontng along Colfax Avenue. Place entrances for all Small Lot homes at grade level, or slghtly above, and provde a porch for each entrance. 9. Access. Resdent and guest vehcular access (.e., automoble) shall be prohbted from Colfax Avenue, and shall be provded only off the alley at the rear (west sde) of the subject property. Vehcular access (.e., automoble) off of Colfax Avenue shall be lmted to Fre Department emergency vehcles only, va a crash gate equpped wth a knox box, and shall be provded to the satsfacton of the Fre Department. n the event the Fre Department does not requre a curb cut along Colefax Avenue, none shall be provded. 10. Archtectural Treatments. Archtectural treatments shall nclude the use of smooth, hard-panel sdng wth reveals, horzontal wood ralng, anodzed bronze alumnum wndow moldngs, staned wood lap sdng, wood garage doors, standng seam metal roof, wood entry doors wth steel pulls, overhangs wth metal fasca and tongue-and-groove wood, as shown on Sheet AO.3 of the Plan set dated August 18, Guest Parkng. Locate guest parkng toward the rear of the ste, adjacent to the alley. 12. Pedestran Paths. Provde dstngushable pedestran paths havng a mnmum wdth of 2 feet 6 nches and delneated by contrastng pavng materals to connect the guest parkng area adjacent to the alley, and the sdewalk along Colfax Avenue, to each ndvdual home. The pedestran walkways may be located wthn the 20- foot wde common access drveway. 13. Permeable Pavers. Permeable pavers shall be used for all pedestran pathways and drveways, n leu of concrete or asphalt. 14. Front Yard Fence Heght. The heght of the front yard fence along Colfax Avenue shall not exceed 3.5 feet. 15. Guard Ralng Setback. The guard ralng located on the rooftop decks of the Small Lot homes closest to the alley (lots 1 and 7) shall be located at least 25 feet 2 5/8 nches from the westerly property lnes. The guard ralng located on the rooftop decks of the Small Lot homes on lots 1-6 shall be located a mnmum of eght (8) feet 6 nches from the northerly property lnes. The guard ralng located on the rooftop decks of the Small Lot homes on lots 7-12 shall be located a mnmum of eght (8) feet 6 nches from the southerly property lnes.

5 APCSV ZC-SPPA-SPP Q Pror to submttng fnal plans to Buldng and Safety, revsed plans shall be submtted to the Plannng Department for approval demonstratng complance wth the followng: a. Lghtng. All guest parkng areas and pedestran walkways shall be llumnated wth ornamental low-level lghtng. b. Lghtng Fxtures. Lghtng fxtures shall be nstalled to accent and complement the Small Lot homes archtectural detals at nght, utlzng unform, and glare-free lghtng, such as dark-sky complant fxtures, to avod uneven lght dstrbuton, harsh shadows, and lght spllage. c. Walls. Vnes shall be planted to screen walls along the northerly and southerly property lnes. Walls shall be decoratve and nclude a change n color, materal and texture. d. Pedestran Access. n addton to the front yard access gates provded for the Small Lot homes located on lots 6 and 12, provde a separate pedestran access gate (adjacent to the Fre Department crash gate) for pedestrans accessng the development from Colfax Avenue. e. Decoratve Gates. Establsh a contnuous vsual presence at the street level by provdng decoratve gates for sde yard and pedestran access along the Colfax Avenue frontage. f. Utlty Locaton. Utltes such as gas, electrc, and water meters shall be placed n sde yard setbacks or n landscaped areas and out of the lneofsght from or sdewalks. Utltes such as power lnes and transformers shall be placed underground, or on rooftops approprately screened by a parapet. 9- Mechancal/Electrcal Equpment. Mechancal or electrcal equpment not located wthn a buldng shall be buffered by plantng materals. h. Rooftop Equpment. Rooftop equpment such as ar condtonng unts, antennas and communcaton equpment, mechancal equpment, and vents shall be screened from the publc rght-of-way.. J- Trash Enclosures. Trash enclosures shall be screened usng vne pockets planted along walls facng guest parkng spaces, desgned to be consstent wth the archtectural character of the Small Lot homes, and located adjacent to the alley so that they are out of the lne-of-sght from sdewalks. Wndows. Wndows shall ether project, or be nset from the exteror buldng walls. B. Envronmental Condtons (ENV MND):

6 APCSV ZC-SPPA-SPP Q Aesthetc (Lght) Outdoor lghtng shall be desgned and nstalled wth sheldng, such that the lght source cannot be seen from adjacent resdental propertes, the publc rght-of-way, nor from above. 18. Tree Removal (Non-Protected Trees) Pror to the ssuance of any permt, a plot plan shall be prepared ndcatng the locaton, sze, type and general condton of all exstng trees on the ste and wthn the adjacent publc rght(s)-of-way. -Removal or plantng of any tree n the publc rght-of-way requres approval of the Board of Publc Works. Contact Urban Forestry Dvson at: All trees n the publc rght-of-way shall be provded per the current standards of the Urban Forestry Dvson, Bureau of Street Servces, Department of Publc Works. 19. Green House Gas Emssons Low and non-voc contanng pants, sealants, adhesves, solvents, asphalt prmer, and archtectural coatngs (where used), or pre-fabrcated archtectural panels shall be used n the constructon of the Project to reduce VOC emssons to the maxmum extent practcable. 20. ncreased Nose Levels (Demolton, Gradng and Constructon Actvtes) Constructon and demolton shall be restrcted to the hours of 7:00 am and 6:00 pm, Monday through Frday, and 8:00 am to 6:00 pm on Saturday. Demolton and constructon actvtes shall be scheduled so as to avod operatng several peces of equpment smultaneously, whch causes hgh nose levels. The project contractor shall use power constructon equpment wth state-of-theart nose sheldng and mufflng devces. 21. Severe Nose Levels (Resdental Frontng on Major or Secondary Hghway, or adjacent to a Freeway) All exteror wndows havng a lne of sght of a Major Secondary Hghway shall be constructed wth double-pane glass and use exteror wall constructon whch provdes a Sound Transmsson Class (STC) value of 50, as determned n accordance wth ASTM E90 and ASTM E413, or any amendment thereto. The applcant, as an alternatve means of sound nsulaton suffcent to mtgate nteror nose levels below a CNEL of 45 dba n any habtable room.

7 APCSV ZC-SPPA-SPP Q Publc Servces (Fre) The followng recommendatons of the Fre Department relatve to fre safety shall be ncorporated nto the buldng plans, whch ncludes the submttal of a plot plan for approval by the Fre Department ether pror to the recordaton of a fnal map or the approval of a buldng permt. The plot plan shall nclude the followng mnmum desgn features: fre lanes, where requred, shall be a mnmum of 20 feet n wdth; all structures must be wthn 300 feet of an approved fre hydrant, and entrances to any dwellng unt or guest room shall not be more than 150 feet n dstance n horzontal travel from the edge of the roadway of an mproved street or approved fre lane. 23. Publc Servce (Polce - Demolton / Constructon Stes) Temporary constructon fencng shall be placed along the perphery of the actve constructon areas to screen as much of the constructon actvty from vew at the local street level and to keep unpermtted persons from enterng the constructon area. 24. Publc Servces (Polce) The plans shall ncorporate the desgn gudelnes relatve to securty, sem-publc and prvate spaces, whch may nclude but not be lmted to access control to buldng, secured parkng facltes, walls/fences wth key systems, well-llumnated publc and sem-publc space desgned wth a mnmum of dead space to elmnate areas of concealment, locaton of tolet facltes or buldng entrances n hgh-foot traffc areas, and provson of securty guard patrol throughout the project ste f needed. Please refer to Desgn Out Crme Gudelnes: Crme Preventon Through Envronmental Desgn, publshed by the Los Angeles Polce Department, Contact the Communty Relatons Dvson, located at 100 W. 1st Street, #250, Los Angeles, CA 90012; (213) These measures shall be approved by the Polce Department pror to the ssuance of buldng permts. 25. Publc Servces (Constructon Actvty Near School) The developer shall nstall approprate traffc sgns around the ste to ensure pedestran and vehcle safety. There shall be no stagng or parkng of constructon vehcles, ncludng vehcles to transport workers on any of the streets adjacent to the school. Due to nose mpacts on the schools, no constructon vehcles or haul trucks shall be staged or dled on these streets adjacent to the school hours. The developer and contractors shall mantan ongong contact wth the admnstrator of North Hollywood Hgh School. The admnstratve offces shall be contacted when demolton, gradng and constructon actvty begn on the project

8 APCSV ZC-SPPA-SPP Q-6 ste so that students and ther parents wll know when such actvtes are to occur. The developer shall obtan school walk and bus routes to the schools from ether the admnstrators or from the LAUSD s Transportaton Branch (323) and guarantee that safe and convenent pedestran and bus routes to the school be mantaned. 26. Safety Hazards The developer shall nstall approprate traffc sgns around the ste to ensure pedestran, bcycle, and vehcle safety. The applcant shall submt a parkng and drveway plan that ncorporates desgn features that reduce accdents, to the Bureau of Engneerng and the Department of Transportaton for approval. 27. Transportaton/Traffc Applcant shall plan constructon and constructon and constructon stagng as to mantan pedestran access on adjacent sdewalks throughout all constructon phases. Ths requres the applcant to mantan adequate and safe pedestran protecton, ncludng physcal separaton (ncludng utlzaton of barrers such as K-Rals of scaffoldng, etc.) from work space and vehcular traffc and overhead protecton, due to sdewalk closure or blockage, at all tmes. Temporary pedestran facltes should be adjacent to the project ste and provde safe, accessble routes that replcate as nearly as practcal the most desrable characterstcs of the exstng faclty. Covered walkways shall be provded where pedestrans are exposed to potental njury from fallng objects. Applcant shall keep sdewalk open durng constructon untl only when t s absolutely requred to close or block sdewalk for constructon stagng. Sdewalk shall be reopened as soon as reasonably feasble takng constructon and constructon stagng nto account. 28. Trbal Cultural Resources mpacts to cultural resources from the proposed project shall be mtgated through the salvage and dsposton of trbal resources that result from all ground-dsturbng actvtes. Ground-dsturbng actvtes nclude, but are not lmted to, drllng, excavaton, and trenchng. The applcant shall retan one Natve Amercan Montor who shall be present durng all ground-dsturbng actvtes. Should a trbal cultural resource be encountered, a qualfed archeologst shall be contacted to assess the fnd. C. Admnstratve Condtons:

Copes of any approvals, guarantees or verfcaton of consultatons, revew or approval, plans, etc., as may be requred by the subject condtons, shall be provded to the Department of Cty Plannng for placement n the subject fle. 30. Code Complance. The area, heght and use regulatons of the (T)(Q)RAS3-1VL zone classfcaton of the subject property shall be compled wth, except where condtons heren are more restrctve. 31. Covenant. Pror to the ssuance of any permts relatve to ths matter, an agreement concernng all the nformaton contaned n these condtons shall be recorded n the County Recorder s Offce. The agreement shall run wth the land and shall be bndng on any subsequent property owners, hers or assgn. The agreement must be submtted to the Department of Cty Plannng for approval before beng recorded. After recordaton, a copy bearng the Recorder s number and date shall be provded to the Department of Cty Plannng for attachment to the fle. 32. Defnton. Any agences, publc offcals or legslaton referenced n these condtons shall mean those agences, publc offcals, legslaton or ther successors, desgnees or amendment to any legslaton. 33. Enforcement. Complance wth these condtons and the ntent of these condtons shall be to the satsfacton of the Department of Cty Plannng and any desgnated agency, or the agency s successor and n accordance wth any stated laws or regulatons, or any amendments thereto. 34. Buldng Plans. Page 1 of the grant and all the condtons of approval shall be prnted on the buldng plans submtted to the Cty Plannng Department and the Department of Buldng and Safety. 35. ndemnfcaton. Applcant shall do all of the followng: a. b. Defend, ndemnfy and hold harmless the Cty from any and all actons aganst the Cty relatng to or arsng out of the Cty s processng and approval of ths enttlement, ncludng but not lmted to, an acton to attack, challenge, set asde, vod or otherwse modfy or annul the approval of the enttlement, the envronmental revew of the enttlement, or the approval of subsequent permt decsons or to clam personal property damage, ncludng from nverse condemnaton or any other consttutonal clam. Remburse the Cty for any and all costs ncurred n defense of an acton related to or arsng out of the Cty s processng and approval of the enttlement, ncludng but not lmted to payment of all court costs and

10 APCSV ZC-SPPA-SPP Q-8 attorney s fees, costs of any judgments or awards aganst the Cty (ncludng an award of attorney s fees), damages and/or settlement costs. c. d. e. Submt an ntal depost for the Cty s ltgaton costs to the Cty wthn 10 days notce of the Cty tenderng defense to the Applcant and requestng a depost. The ntal depost shall be n an amount set by the Cty Attorney s Offce, n ts sole dscreton, based on the nature and scope of acton, but n no event shall the ntal depost be less than $50,000. The Cty s falure to notce or collect the depost does not releve the Applcant from responsblty to remburse the Cty pursuant to the requrement n paragraph (b). Submt supplemental deposts upon notce by the Cty. Supplemental deposts may be requred n an ncreased amount from the ntal depost f found necessary by the Cty to protect the Cty s nterests. The Cty s falure to notce or collect the depost does not releve the Applcant from responsblty to remburse the Cty pursuant to the requrement (b). f the Cty determnes t necessary to protect the Cty s nterests, execute an ndemnty and rembursement agreement wth the Cty under terms consstent wth the requrements of ths condton. The Cty shall notfy the applcant wthn a reasonable perod of tme of ts recept of any acton and the Cty shall cooperate n the defense. f the Cty fals to notfy the applcant of any clam, acton or proceedng n a reasonable tme, or f the Cty fals to reasonably cooperate n the defense, the applcant shall not thereafter be responsble to defend, ndemnfy or hold harmless the Cty. The Cty shall have the sole rght to choose ts counsel, ncludng the Cty Attorney s offce or outsde counsel. At ts sole dscreton, the Cty may partcpate at ts own expense n the defense of any acton, but such partcpaton shall not releve the applcant of any oblgaton mposed by ths condton. n the event the Applcant fals to comply wth ths condton, n whole or n part, the Cty may wthdraw ts defense of the acton, vod ts approval of the enttlement, or take any other acton. The Cty retans the rght to make all decsons wth respect to ts representatons n any legal proceedng, ncludng ts nherent rght to abandon or settle ltgaton. For purposes of ths condton, the followng defntons apply: Cty shall be defned to nclude the Cty, ts agents, offcers, boards, commsson, commttees, employees and volunteers. Acton shall be defned to nclude suts, proceedngs (ncludng those held under alternatve dspute resoluton procedures), clams or lawsuts. Actons ncludes actons, as defned heren, allegng falure to comply wth any federal, state or local law.

11 APCSV ZC-SPPA-SPP Q-9 Nothng n the defntons ncluded n ths paragraph are ntended to lmt the rghts of the Cty or the oblgatons of the Applcant otherwse created by ths condton. 36. Mtgaton Montorng. The applcant shall dentfy mtgaton montors who shall provde perodc status reports on the mplementaton of the Envronmental Condtons specfed heren, as to area of responsblty, and phase of nterventon (pre-constructon, constructon, post-constructon/mantenance) to ensure contnued mplementaton of the Envronmental Condtons.

The Cty Clerk shall certfy to the passage of ths ordnance and have t publshed n accordance wth Councl polcy, ether n a daly newspaper crculated n the Cty of Los Angeles or by postng for ten days n three publc places n the Cty of Los Angeles: one copy on the bulletn board located at the Man Street entrance to the Los Angeles Cty Hall; one copy on the bulletn board located at the Man Street entrance to the Los Angeles Cty Hall East; and one copy on the bulletn board located at the Temple Street entrance to the Los Angeles County Hall of Records. Pursuant to Secton 558 of the Cty Charter, the South Valley Area Plannng Commsson on recommends ths ordnance BE ADOPTED by the Cty Councl.
