1 THE CORPORATON OF THE MUNCPALTY OF LEAMNGTON BY-LAW Beng a by-law to permt the Muncpalty to exercse ts powers under ts "waste management" sphere of jursdcton n the Corporaton of the Muncpalty of Leamngton WHEREAS pursuant to Secton 74 of the Muncpal Act, S.O. 200'1, c. 25, the Muncpalty may exercse ts powers under ts "waste management" sphere of jursdcton n the Muncpalty; AND WHEREAS pursuant to Secton 127 of the Muncpal Act, S.O., 2001, c. 25 a local Muncpalty may requre the owner or occupant of land to clean and clear the land or to clear refuse or debrs from the land; AND WHEREAS pursuant to Secton 425(1) of the Muncpal Act, S.O. 2001, c.25 the Muncpalty may provde that a person who contravenes the by-law s gulty of an offence and s lable to a fne; AND WHEREAS pursuant to Secton 446 (3) of the Muncpal Act, 2001, S.O c.25, the Muncpalty may recover the costs of dong a matter or thng under subsecton 446 (1) from the person drected or requred to do t by acton or by addng the costs to the tax roll and collectng them n the same manner as property taxes; NOW THEREFORE THE CORPORATON OF THE MUNCPALTY OF LEAMNGTON BY TS COUNCL ENACTS AS FOLLOWS: DEFNTONS: 1. n ths by-law, "Ashes" means the resdue from the burnng of coal, coke and wood, generated at a dwellng on resdental premses and ncludes soot, or other cleanngs from chmneys or outdoor barbeques, but shall not nclude ashes whch are generated as a result of buldng constructon or demolton. "Collectble Waste" means household garbage, household trash, compostable yard waste and household whte goods that have been generated on resdental premses wthn the geographcal lmts of the Muncpalty. "Compostable Yard Waste" shall mean grass cuttngs, garden refuse, bushes and leaves, generated on resdental premses. "Dwellng or Dwellng Unt" means a sute of rooms occuped as an ndependent and separate housekeepng unt n whch separate ktchen, sleepng and santary facltes are provded for the exclusve use of the occupants.

2 By-law Page 2 "Hazardous Waste" means waste that poses a present or potental danger to human bengs or other organsms because t s toxc, explosve, reactve, corrosve, radoactve, pathologcal or otherwse poses substantal rsk to human lfe and ncludes, but s not lmted to: (a) (b) (c) tres, pant, batteres, automotve parts, nsectcdes, herbcdes, acds, caustcs, nfected materals, and any substance whch may be classed as a "desgnated substance" pursuant to the Occupatonal Health and Safety Act, R.S.O, 1990 c. 0.1, as amended. "Hghway" shall have the same meanng as provded n the Muncpal Act, R.S.O., c. MA5. "Household Garbage" means all ktchen and table waste, of anmal or vegetable orgn, resultng from the preparaton or consumpton of food n a dwellng on resdental premses, ashes, broken crockery and non-recyclable paper and glassware, and such other dscarded materals whch are generated at a dwellng or resdental premses but shall not nclude household trash. "Household Trash" ncludes weghty or bulky materals such as mattresses, furnture, boxes, used Chrstmas trees and any other large dscarded materals whch are generated on resdental premses but shall not nclude whte goods, trade waste or any trash accumulated from a place of busness or other non-collectble wastes as defned n ths by-law. "Muncpalty" means The Corporaton of the Muncpalty of Leamngton. "Muncpal Councl" means the councl of the Muncpalty. "Muncpal Engneer" means the Engneer employed by the Muncpalty. "Non-collectble Waste" shall mean any waste that s not collectble waste and shall nclude but not be lmted to: (a) (b) (c) (d) (e) (f) Plaster, or other waste resultng from buldng, alteraton or demolton operatons; Swll, lqud waste, or organc matter whch has not been draned and wrapped n accordance wth the provsons of ths by-law; Dressngs, bandages, or other nfected materals from hosptals, surgeres, or offces of physcans, surgeons, dentsts or veternarans; Feces of any dog, cat or fowl unless t s securely wrapped n paper, a plastc bag, or contaner; Carcasses or part thereof, of any dog, cat, fowl or any other creature wth the excepton of bonafde ktchen waste; Transent waste;

3 By-law Page 3 (g) (h) () U) (k) () (m) (n) collectble waste whch has not been put out for collecton n conformty wth the provsons of ths by-law; Trade waste; Recyclable refuse; Natural sol, earth, sand, clay, gravel, loam, stones, rocks or other smlar materal; Any materal whch has become frozen to the receptacle and cannot be removed by shakng; Septc tank pumpngs, raw sewage sludge and ndustral process sludge; Hazardous waste; Trees or tree stumps, wth the excepton of used Chrstmas trees. "Owner" means the regstered owner, occupant, tenant, or person n charge of the property, or the person for the tme beng managng or recevng the rent for the property whether on hs or her account or on the account of an agent or trustee or an any other person. "Place of Busness" means any place, other than resdental premses and ncludes any hotel, motel, restaurant, shop, store, shoppng centre, plaza, servce staton, commercal or ndustral offce, ndustral plant other commercal establshment, school, nsttuton and publc buldng, or any buldng contanng more than 5 dwellng unts. "Publc Lane" means any lane or alley accepted by by-law of the Muncpalty as a publc thoroughfare, and whch has been adjudged to be of suffcent wdth and condton for use by vehcles used for the collecton of all collectble wastes as defned n ths by-law. "Recyclable Refuse" means newspaper, uncontamnated cardboard, non-returnable glass bottles or jars, ferrous and alumnum cans, motor ol and polyethylene terephthlate beverage contaners. "Resdental Premses" means an ndvdual property that contans at least one dwellng and no more than 5 dwellngs. "Trade Waste" ncludes ashes, garbage and refuse whch are generated at a place of busness. "Transent Waste" means any refuse, trash or waste carred nto the Muncpalty from outsde ts boundares by any person. "Whte Goods" means all household metal tems and ncludes washers, dryers, stoves, refrgerators, hot water tanks, ar condtoners and furnaces. ADMNSTRATON 2. The Muncpalty shall operate a system for the collecton, removal and dsposal of collectble waste n accordance wth the provsons of ths by-law.

4 By-law Page 4 CONTANERS OR RECEPTACLES 3. (1 ) Collectble waste shall be placed n a household type contaner, bundle or non-returnable plastc bag. (2) A household type contaner shall comply wth the followng specfcatons: (a) (b) (c) (d) (e) The heght shall not be more than zero pont seven (0.7 M) metres; The dameter shall not be more than zero pont four (0.4 M) metres; t shall be constructed of materal whch have an equvalent durablty to number 28 gauge metal; t shall have a water-tght ld and two (2) handles; and Each household-type contaner when full shall wegh not more than twenty-two (22 kg) klograms. (3) Bundles shall be compacted and ted to the followng specfcatons: (a) (b) (c) (d) The length shall not be more than zero pont sx (0.6 M) metres; The dameter shall not be more than zero pont sx zero (0.6 M) metres; The weght shall not exceed twenty-two (22 kg) klograms; and When ted, the cord, twne or strng, shall be of suffcent strength to permt the lftng and loadng of the bundle nto the collecton vehcle. Wre shall not be used to te the bundle. (4) A non-returnable plastc bag shall be: (a) (b) (c) Of a capacty of not more than zero pont eght (0.8M3) cubc metres and not less than zero pont sx (0.6M3) cubc metres; Composed of materal of not les than 1-1/2 ml gauge materal capable of carryng twenty-two (22 kg) klograms of contents wthout tearng; and Securely ted when put out for collecton. (5) Household type contaners, bundles and non-returnable plastc bags not n complance wth secton 3.(2), (3) and (4) hereof and water soaked or broken contaners wll not be collected.

5 By-law Page 5 PREPARATON OF WASTE 4. (1) Collectble waste shall be draned and ether placed n a non-returnable plastc bag or wrapped and placed n a household contaner. (2) Ashes, when put out for collecton, shall be cold and placed n a sealed nonreturnable plastc bag, and the total weght of whch shall not exceed twenty-two (22) klograms. (3) Any sharp objects or broken glass shall be secured wth materals so that any sharp object or broken glass shall not perce the wrapper and no uncollectble waste or rubbsh shall be placed theren. (4) Any collectble waste, ashes or sharp objects or broken glass not n accordance wth the provsons of secton 4 hereof shall not be collected. LOCATON OF COLLECTBLE WASTE TO BE COLLECTED 5. (1 ) No person shall place collectble waste out for collecton except n accordance wth ths secton. (2) No person shall place collectble waste, except n approved receptacles placed n a locaton whch s not a nusance to any neghbour. (3) Collectble waste shall be placed for collecton n accordance wth the followng: (a) (b) (c) Hghways wth concrete curbs or n the Downtown Busness mprovement Area. Hghways wth concrete sdewalks tghtly abuttng the curb except n the Downtown Busness mprovement Area Hghways wth boulevards between sdewalks and curbs garbage to be placed drectly behnd the curb garbage to be placed drectly behnd the sdewalk on property on owner's sde garbage to be placed drectly behnd the curb (d) (e) Hghways wth gravel road shoulders Where garbage collecton s provded n publc lane or alleyway garbage to be placed on the edge of the road shoulder of the hghway furthest from the paved area garbage to be placed as close as possble to the edge of the land or Alleyway (4) No person shall place garbage so as to mpede or obstruct pedestran or vehcular traffc or mantenance operatons.

(5) Where, for any reason, collecton of garbage and refuse cannot be made from the locaton specfed n ths Part, tems to be collected pursuant to ths by-law shall be placed at locatons desgnated by the Muncpal Engneer and hs decson shall be fnal. SETTNG OUT GARBAGE COLLECTON 6. Durng normal daytme collecton, collectble waste shall be put out between the hours of 10:00 p.m. on the day before collecton and 7:30 a.m. on the day of collecton. DETERMNNG COLLECTON DAYS 7. For the purpose of the collecton of household garbage, household trash, compostable waste, and whte goods, the Muncpal Engneer may drect that the Muncpalty be dvded nto as many collecton zones or dstrcts as may be deemed necessary and may fx a day or days on whch each shall be collected. A publc notce and map wll be publshed annually n the local newspaper(s) or a calendar shall be made avalable at no cost to every resdent and property owner n the Muncpalty ndcatng the aforementoned collecton zones and days. MONTHLY RATE 8. (1 ) A monthly rate shall be charged to the owner of each resdental premses on a per dwellng unt bass. (2) The monthly rate shall be establshed by by-law and reman n effect untl amended. (3) The monthly rate shall be payable by the owner sem-annually to the Muncpalty n June and October, and shall be due on the same date that the June and October nstallment of realty taxes are due n each year and may be collected or recovered n the same manner as muncpal taxes. WASTE STORAGE ON PROPERTY 9. No collectble waste or non-collectble waste shall be placed on any property other than that upon whch t s generated or so located on the owner's property as to cause a publc nusance or nusance to the adjonng property owner. MANTAN PASSAGEWAY 10. A passageway affordng a convenent and unmpeded means of access to the tems to be collected pursuant to ths by-law shall be mantaned and the passageway shall be of suffcent dmensons to enable the employees of the Muncpalty or of ts contractors, servants, workmen and agents to load the tems to be collected pursuant to ths by-law on the collecton vehcles.

7 By-law Page 7 MANTENANCE OF GARBAGE STORAGE BULDNGS 11. (1 ) The owner of property shall ensure all bns, structures or buldngs for the storage of waste shall at all tmes be mantaned n a clean and santary condton and constructed so as to prevent entry of rodents and nsects. (2) The owner of property shall ensure all areas adjacent to bns, structures or buldngs for the storage of waste shall at all tmes be mantaned n a clean and santary condton and constructed so as to prevent entry of rodents and nsects. (3) Where any property s not mantaned n accordance wth the requrements of secton 11 (1) and (2) of the by-law the Muncpal Law Enforcement Offcer may order the owner of the property, by ssung a Notce to Comply, to brng the property nto conformty wth the provsons of ths by-law wthn the tme set out n the Notce. (4) The Notce wll specfy the tme for brngng the property nto conformty but n no event shall at tmes specfy n the Notce be sooner than seventy-two (72) hours after the gvng of the Notce. (5) The Notce shall be served upon the owner ether: (a) (b) Personally; or By prepad frst class mal or regstered mal to the last known address noted on the tax assessment roll. Servce by prepad frst class mal or regstered mal shall be deemed to be effectve on the seventh day after the Notce s maled. (6) f there s evdence that the person n possesson of the property s not the regstered owner of the property then the Notce shall be served on both the regstered owner of the property and the person n possesson of the land. (7) When an owner, havng been served wth a Notce under secton 11 (5) fals to comply wth the Notce wthn the tmeframe prescrbed, a Muncpal Law Enforcement Offcer or the Muncpalty's employees or any authorzed agents actng on behalf of the Muncpalty may enter onto the property at a reasonable tme and carry out the work requred to brng the property n complance wth the provsons of a Notce as set out n ths by-law. UNSAFE PREMSES 12. Collecton of collectble waste may be refused for any premses whch n the opnon of the Muncpal Engneer present an unsafe stuaton for Muncpal employees or agents. WASTE REMOVAL 13. (1) A muncpalty may remove and dspose of any garbage or other waste that has been deposted on a hghway or other land owned by the Muncpalty n contraventon of ths by-law.

8 By-law Page 8 (2) Any costs ncurred by the Muncpalty pursuant to Secton 3 (1) of ths by-law may be charged aganst the premses upon wth the garbage was generated or orgnated and collected or recovered n the same manner as muncpal taxes. DSPOSAL OF NON-COLLECTBLE WASTE 14. Every owner shall provde for the proper storage, collecton and dsposal of noncollectble waste generated on the property of the owner. GENERAL PROHBTONS 15. No person shall depost or permt the depost of non-collectble waste upon a publc hghway unless that person has provded for the proper storage, collecton and dsposal of the non-collectble waste n some manner other than collecton by the Muncpalty. 16. No person shall remove or permt the removal of non-collectble waste from the property upon whch t was generated unless arrangements have been made for the fnal dsposal of the waste on a ste approved by the Mnstry of the Envronment for such waste n some method other than collecton by the Muncpalty. 17. No person shall remove or permt the removal of collectble waste from the property upon whch t was generated unless the waste s placed for collecton by the Muncpalty n accordance wth all of the provsons of ths by-law. 18. No person shall depost or permt the depost of trade waste upon a hghway unless: (a) (b) (c) Arrangements have been made for the collecton of the trade waste n some method other than collecton by the Muncpalty; and The trade waste s placed on the hghway no earler than 6:00 a.m. on the day arranged for collecton and removed by 10:00 a.m. on the same day; and The trade waste s placed n a non-returnable plastc bag whch shall be: () () () of a capacty of not more than zero pont eght (0.8) cubc metres and not than less zero pont sx (0.6) cubc metres; composed of materal of not less than ml gauge materal capable of carryng twenty-two (22 kg) klograms of contents wthout tearng; and securely ted when put out for collecton 19. No person shall depost or permt the depost of trade waste from 8 place of busness on a hghway for collecton on more than 3 days on any week. 20. No person, unless authorzed by Muncpal Councl, shall pck over, nterfere wth, remove or scatter any collectble waste, recyclable refuse or trade waste after the same has been put out for collecton. 21. No person shall transport any type of garbage, refuse or waste unless the vehcle has an enclosed body or a coverng securely fastened to the body of the vehcle or, n the case of packer type vehcle, wth hopper doors closed to prevent the scatterng of the waste materals.

9 By-law Page (1 ) No owner or occupant of property shall cause or permt waste to be located on any property other than n accordance wth the provsons of ths by-law. (2) Where any property s not mantaned n accordance wth the requrements of ths by-law, any Muncpal Law Enforcement Offcer may order the owner of the property, by ssung a Notce to Comply, to brng the property nto conformty wth the provsons of ths by-law wthn the tme set out n the Notce. (3) The Notce shall specfy the tme allowed for brngng the property nto conformty but n no event shall the tme specfed n the Notce be sooner than seventy-two (72) hours after the gvng of the Notce. (4) The Notce shall be served upon the ether: (a) (b) Personally; or By prepad frst class mal or regstered mal at the last known address noted on the tax assessment roll. Servce by prepad frst class mal or regstered mal shall be deemed to be effectve on the seventh day after the Notce s maled. (5) f there s evdence that the person n possesson of the property s not the regstered owner of the property then the Notce shall be served on both the regstered owner of the property and the person n possesson of the land. RECOVERY OF COSTS 23. When the Muncpalty, ts employees or authorzed agents has performed the work requred to brng the lands nto complance wth ths by-law, the expenses ncurred by the Muncpalty n dong the work shall be deemed to be taxes and may be collected by acton or the cost may be added to the tax roll for the lands and collected n the same manner as taxes. PENALTES 24. Every person who contravenes any of the provsons of ths by-law or who obstructs or attempts to obstruct the Muncpal Law Enforcement Offcer or employee or agent of the Muncpalty n carryng out hs or her dutes under ths by-law s gulty of an offence and s lable, upon convcton, to a maxmum fne as establshed pursuant to the Provncal Offences Act, R.S.O c. P.33. SEVERABLTY 25. Where a Court of competent jursdcton declares any secton or part of a secton of ths by-law nvald, the remander of ths by-law shall contnue n force unless the Court makes an order to the contrary.
