Enactng Clause Pursuant to the authorty conferred by Artcle 16 of the Towr Law and Artcles 2 "and 3 of Muncpal Home Rle Law of the State of New York, the Town Board of the Town of Venna hereby adopts and enacts the followng law. The purposes of ths zonng law are to provde for orderly growth n accordance wth a comprehensve plan; to lessen congeston n the streets; to secure safety from fre, flood and other dangers; to provde adequate lght and ar; to make provson for, so far as condtons may permt, the accommodaton of altematve energy systems; to prevent the overcrowdng of land; to avod undue concentraton of populaton; to facltate the adequate provson of transportaton, water, sewerage, schools, jparks and other publc requrements; and to promote the health, safety, and general welfare of the publc, Ths zonng law has been made wth reasonable consderaton, among other thngs, as to the character of each zone and ts pecular sutablty for partcular uses, and wth a vew to conservng the Value of buldngs and encouragng the most approprate use of land throughout the Town of Venna. Secton 140. Applcablty

9 Ths law shall apply on ts effectve date to all uses whch have not been substantally commenced, and structures whch have not been substantally constructed, regardless of the status of permts or certfcates of occupancy ssued pursuant to the New York State Unform Fre Preventon and Buldng Code. Secton 150. Replaced, Superseded and Repealed Laws and Ordnances ' ' j' > A. The House Traler and Traler Park Ordnance of the Town of Venna, adopted on Aprl 22, 1959, as amended, s hereby replaced and superseded by ths local law. B. The Basc Buldng Permt Ordnance of the Town of Venna,-! adopted on June 11, 1975, as amended, s hereby replaced and superseded by ths local law. C. The Freshwater Wetlands Ordnance of the Town of Venna, a!dopted on August 30, 1976, as, amended, s hereby rejpealed. I' D. The Sewage Dsposal Ordnance for the Town of Venna, adopted on July 5, 1978, as amended, s hereby replaced and superseded by ths local law. E. The Junk Storage Law of the Town of Venna adopted on June 3, 1987 as amended, s hereby replaced and superseded by ths local law., ' Secton 160. Assocated Laws [ A. Local Law #3 (Effectve November 21, 1984) Admnstraton and Enforcement of the NY State Unform Fre Preventon and Buldng Code shall not be superseded by ths law or any provsons heren. B. The Town of Vetma Hawkers, Peddlers and Solctors Ordnance adopted Aprl 6, 1994, Local Law #3 of ' C. Local Law #2 of 1999 for Flood Damage Preventon (FEMA). ' D. General ^ A. Except where specfcally defned heren, all words used n ths law shall carry ther customary meanngs. Words n the present tense nclude the future, words jn the sngular nclude the plural and the plural the sngular, and the word "shall" s ntended to be mandatory. B. Any queston as to the precse meanng of any word used n ths law may be appealed to the Zonng Board of Appeals and clarfed under ther powers of nterpretaton.

10 Secton 220. Specfc Defntons Specfcally defned words are as follows: ; ' j. Accessory Apartment: An apartment assocated wth a sngle-famly dwellng that s ncdental and ; subordnate to the prmary use of the dwellng as a resdence for a sngle famly. Accessory Buldng: A buldng whch s an accessory structure.! Accessory Structure: A structure ncdental and subordnate to the prncpal structure and located on the same lot wth such prncpal structure. Where an accessory structure s attached t6 the prncpal structure n a substantal manner, as by a wall or roof, such accessory structure shall be consdered part of the man structure. Accessory Use: A use ncdental and subordnate to the prncpal use and Iocated on the same lot wth such prncpal use. I l ' ' ; I I Acre: A measure of land area contanng 43,560 square feet.! ' ; I Adult Entertanment Use: An establshment of busness whether retal or wholesale, havng as a ; substantal or sgnfcant porton of ts stock n trade, ncludng, but not Umted to books, sexual paraphernala, magaznes and/or other perodcals, flms or vewng materals for sale or vewng on premses, whch are dstngushed or characterzed by ther emphass on matter depctng, descrbng or relatng to specfed sexual actvtes or specfed anatomcal areas, and whch establshment s customarly anc usually not open to the publc generally, but excludes any mnor by reason of age. Agrcultural Structure, Large: A structure used for agrcultural purposes of greater than 2,000 square feet of ground coverage. Agrcultural Structure, Medum: A structure used for agrcultural purposes o^ between 500 ard 2,000 square feet of ground coverage.. ' ; Agrcultural Structure, Small: A structure used for agrcultural purposes of less than 500 square feet of jgfpund coverage. r Arstrp: Land or area that s used for the landng and takeoff of arcraft of any type. Also ncludes a rurway or landng pad. Antenna, Accessory Faclty: An accessory faclty servng a telecommuncatons tower, subordnate n area, extent and purpose to the telecommuncaton tower, and located on the same lot as the tower. Examples of such facltes nclude transmsson equpment ard storage sheds. Apartment, Accessory: See Accessory Apartment j l ' '! ' Bulk Storage: The storage of chemcals, petroleum products and other materals n contaners such as tank farms for subsequent dstrbuton or resale to dstrbutors or retal dealers or outlets. Campground: Land on whch three or more campstes are located, establshed, or mantaned for occupancy by campng unts as temporary lvng quarters for recreaton, educaton or vacaton purposes., 't I, Campng Unt: Any tent, lean-to, cabn or smlar stmcture, houseboat, jor recreatonal campng vehcle, excludng moble homes, establshed or mantaned and operated n a campground as temporary lvng quarters for recreaton, educaton or vaca.ton purposes. j, ' Campste: Any area of land wthn a campground ntended for the exclusve occupancy of a sngle campng unt. Certfcate of Complance: A certfcaton by the Zonng Offcer that a lpt, structure, or use of land has been developed n conformty wth an approved zonng permt or specal use permt and/or comples wth the provsons of ths law, and may be occuped and used for the purposes specfed n such zonng permt and/or certfcate of complance. ;. Chld Care Faclty: A commercal establshment for care, supervson a!nd other servces to chldren and where fees, tuton or other forms of compensaton are charged and where such care s provded on a regular bass by someone other than a parent, step-parent, guardan or relatve wthn the thrd degree of consangunty of the parents of the chld as regulated by New York State. Classfed Stream: A stream protected under Artcle 15 of the Envronmertal Conservaton Law. Classfed Waterbody: A waterbody protected under Artcle 15 of the Envronmental Conservaton Law. ^Cluster Development: A form of development for sngle-famly resdental subdvsons that permts a reducton n lot area requrements, provded there s no ncrease n the number of lots permtted under a conventonal subdvson and the resultant land area s devoted to open space. Commercal Faclty: Retal sales and servce ncludng sales and servce for new and used automobles, tmcks, moble homes, boats, recreatonal vehcles, farm mplements, tree nurseres and other large tems stored outdoors for retal sales; busness or nsttutons provdng ovemght accommodatons; nsttutonal resdences or care or confnement facltes; and storage and parkng facltes. Ths defnton shall not nclude Retal Sales and Servce, Large and Retal Sales and Servce, Small.
