22 Ordnance No. AN ORDNANCE OF THE VLLAGE OF EAST DUNDEE, COOK AND KANE COUNTES, LLNOS AMENDNG THE BUSNESS LCENSE REGULATONS WHEREAS, the Vllage of East Dundee (the Vllage ) s a duly organzed and valdly exstng home-rule muncpalty created n accordance wth the Consttuton of the State of llnos of 1970 and the laws of the State; and, WHEREAS, the Vllage pursuant to ts home rule powers has the authorty to exercse any power and perform any functon pertanng to ts government and affars ncludng the power to regulate for the protecton of the publc health, safety and welfare and to establsh general lcense regulatons for all commercal busnesses n the Vllage; and, WHEREAS, the Vllage hereby adopts ths ordnance pursuant to ts home rule authorty. That the Code of the Vllage of East Dundee, as amended, be and s hereby amended by deletng Chapter 110 enttled GENERAL LCENSNG PROVSONS and replacng t wth the followng: CHAPTER 110 GENERAL LCENSNG REGULATONS PURPOSE Because each commercal establshment located n the vllage s a basc part of and affects the physcal and economc well-beng of the vllage necesstatng servces from the vllage n the form of buldng, health, fre, and polce nspectons and other servces, such commercal establshments shall n all respects be n full complance wth the provsons contaned n ths chapter. Ths chapter s desgned to provde for the means whereby the vllage may render the necessary nspectons and servces to commercal establshments and commercal actvtes n order to promote, protect, and safeguard the publc health, safety, and welfare of the resdents and consumers of the vllage and to enable the effectng of an accurate record of commercal establshments located and carryng on commercal actvtes or commerce wthn the vllage DEFNTONS For the purpose of ths chapter, the followng defntons, whether captalzed or not, shall apply unless the context clearly ndcates or requres a dfferent meanng. 1

23 ENGAGNG N BUSNESS. Persons operatng, conductng, dong, carryng on, causng to be carred on or pursung any busness actvty, professon, occupaton, trade, pursut or actvty for the purpose of proft. "Busness actvty" ncludes but s not lmted to the followng actvtes of commerce or commercal actvty located n the Vllage: 1. "Food establshment" means a buldng or premses or a porton thereof, the prncpal use of whch s for the sale, dspensng, dstrbuton, servng or storage of food, foodstuff or drnk for consumpton on or off the premses. 2. "Retal and wholesale sales establshment" means a buldng or premses or porton thereof, the prncpal use of whch s for the sale or dstrbuton of merchandse, goods or chattel for a prce or fee by a seller to a consumer or by one busness to another busness. 3. "Servce establshment" means a buldng or premses or a porton thereof, the prncpal use of whch s for the renderng of personal or materal servces for a prce or fee whether or not a commodty or materal good s worked upon or exchanged. 4. "ndustral establshment" means a buldng or premses or a porton thereof, the prncpal use of whch s for manufacturng, ncludng assembly, processng, fabrcaton, storage or warehousng, ncludng scentfc or manufacturng research, engneerng and development. PERSON. Any ndvdual, male or female, estate, trust, recever, cooperatve assocaton, club, corporaton, company, frm, partnershp, jont venture, syndcate, or other entty engagng n a busness, professon, occupaton, trade, pursut, or actvty. PLACE OF BUSNESS. The buldng or premses or porton thereof the prncpal use of whch s, temporary or otherwse, for the retal sale or dstrbuton of merchandse, goods or food renderng of personal or materal servces to consumers for proft. n the event there s no such locaton, but the busness s transacted at the locaton of the buyer, then the general sales area shall be consdered a place of busness. Unless a constructon contractor has at least one permanent locaton wthn the vllage, a place of busness ncludes a constructon ste located theren. Place of busness shall not nclude a busness conducted at a personal resdence LCENSE REQURED No person shall engage n, conduct, mantan, operate or carry on any busness, occupaton, actvty or establshment, ether by hmself or tself, or through an agent, employee or partner, wthout frst havng obtaned a lcense for such busness, occupaton, actvty or establshment APPLCATONS A. Applcatons for lcenses shall be fled wth the vllage clerk n wrtng on a form provded for that purpose, except as otherwse provded. B. f the applcant s an ndvdual or sole propretorshp, the applcaton shall contan hs name, date of brth, busness name, f any, busness and resdence addresses and busness and resdence telephone numbers. f the applcant s a partnershp or other noncorporate busness entty, the applcaton shall contan the busness names, f any, address and telephone number of the partnershp or other entty, and the names, dates of brth and resdence addresses and resdence telephone numbers of each partner or member thereof. f the applcant s a corporaton, the applcaton shall contan the name of the corporaton and ts address and telephone number and 2

24 the names, resdence addresses and resdence telephone numbers of each offcer and drector thereof, and f a majorty n nterest of the stock of such corporaton s owned by one person or hs nomnee or nomnees, the applcaton shall also contan the name, date of brth, resdence address and resdence telephone number of such person. C. Each applcaton shall also contan: (1) A desgnaton of the type or knd of lcense desred; (2) The locaton or proposed locaton of the place of busness, occupaton, actvty or establshment; (3) The applcable fee to be pad as provded by any vllage ordnance; (4) The number of the certfcate of regstraton requred under the llnos Statutes relatng to retaler's occupaton tax, servce occupaton tax, and/or use tax, f applcable; and (5) Such addtonal nformaton as may be needed by vllage offcals n evaluatng such applcaton, ncludng evdence of any nsurance polcy or bond requred by any vllage ordnance NSPECTON OR NVESTGATON Upon recept of an applcaton for a lcense, f an nspecton or nvestgaton s requre before the ssuance of such lcense, the vllage clerk shall promptly refer such applcaton to the vllage offcal who s responsble for makng such nspecton or nvestgaton. Such vllage offcal shall make such nspecton or nvestgaton and delver a wrtten report to the vllage clerk wthn ten days after recevng the applcaton or a copy thereof wth a recommendaton for the approval or dsapproval thereof SSUANCE OF LCENSE All applcatons and nspecton and/or nvestgaton reports, f applcable, shall be promptly delvered to the vllage clerk for revew and approval or dsapproval. f approved, the lcense shall be sgned by the vllage presdent, attested by the vllage clerk and ssued. f dsapproved, the vllage clerk shall ndcate the reasons therefore n wrtng on the applcaton and the applcant shall be notfed by the vllage clerk FEES A. All fees and/or charges for lcenses shall be deposted wth the vllage clerk at the tme the applcaton s fled. Fees shall not be prorated for busness conducted for a porton of a year. B. The annual fee shall be ffty dollars ($50.00) EXPRATON AND RENEWAL Unless otherwse provded, all lcenses shall expre on the last day of December each year. Such lcenses shall be ressued upon the flng and approval of a new applcaton and the depost of the fee wth the vllage clerk. Pror to approvng such new applcaton, the vllage clerk may request a renspecton and/or renvestgaton n cases n whch the clerk deems t approprate. No lcense 3

25 shall be renewed or ressued f the lcensee, applcant, busness, actvty or establshment owes any mones to the vllage for fees, penaltes, fnes, or charges n connecton wth the busness, actvty, occupaton or establshment BULDNG AND PREMSES No lcense shall be ssued for any busness, occupaton, actvty or establshment unless the buldng and premses to be used fully comply wth all ordnances, codes, rules and regulatons of the vllage and the statutes of the State of llnos NUSANCES PROHBTED No busness, occupaton, actvty or establshment, whether or not a lcense has been ssued therefore, shall be conducted, operated, mantaned or carred on so as to consttute a nusance NSPECTONS AND ANALYSS A. nspectons at reasonable tmes may be made by authorzed vllage offcals or employees of any buldng or premses used for or n connecton wth the operaton of a busness, occupaton, actvty or establshment for whch a lcense has been appled, or when ssued, and the lcensee or the person n charge of the buldng or premses shall allow such an nspecton. B. Whenever an analyss of any commodty or materal s reasonably necessary to assure complance wth the provsons of any vllage ordnance, code, rules or regulatons, or to detect volatons thereof, the lcensee or the person n charge of the buldng or premses shall furnsh any authorzed vllage offcal or employee suffcent samples of such materal or commodty for such analyss upon request REVOCATON AND SUSPENSON A. Suspenson of busness operatons. (1) When the conduct or operaton of any commercal establshment or actvty, whether lcensed or unlcensed, shall consttute a nusance n fact and a clear and present danger to the publc health, safety, or general welfare, the vllage admnstrator shall be authorzed to summarly order the cessaton of busness and the closng of the premses for a perod not to exceed ten days. (2) Unless () waved by the affected busness; or () the nusance s substantally abated n the opnon of the vllage admnstrator and the busness s allowed to resume and reopen, wthn eght days after a lcense s suspended, the vllage presdent shall call a hearng as provded n subsecton (d) of ths secton for the purpose of determnng whether or not the lcense should be revoked or further suspended. B. Revocaton of lcense. (1) Lcenses ssued by the vllage may be suspended for up to 30 days or revoked n addton to any fne mposed by the vllage presdent after notce and hearng as provded n subsecton (d) of ths secton for any of the followng causes: 4

26 a. Any fraud, msrepresentaton, or false statement contaned n the applcaton for the lcense; b. Falure by the applcant to comply wth any provson of ths Code or any statutes of the State relatng to the busness, occupaton, or actvty of the lcense; c. Convcton of the applcant of any felony or of a msdemeanor where such convcton ndcates ther nablty to operate a safe, honest, and legtmate busness operaton wthn the vllage; d. Falure of the lcensee to pay any fne, penalty, or charge owed to the vllage; e. Any deceptve trade practces as defned by state or federal law or regulaton and shall comply wth all applcable laws and regulatons regardng consumer protecton and deceptve trade practces; f. Complance wth all vllage zonng, buldng, fre and health codes, and ordnances, as well as all other applcable vllage codes, ordnances, rules, and regulatons and the premses shall be mantaned n good repar, free of ltter and debrs and kept n a safe condton for employees, customers, and other persons present theren or thereon; g. Any other volaton of any vllage ordnance, resoluton, or regulaton; or h. Refusal to permt an nspecton or samplng or any nterference wth a duly authorzed vllage offcer or employee whle n the reasonable performance of hs dutes n makng such nspectons. C. Such revocaton, f ordered, shall not preclude prosecuton and mposton of any other penaltes provded for the volaton of other applcable provsons of ths chapter or other ordnances of the vllage. No person whose lcense has been revoked shall be elgble for a new lcense durng the perod for whch the orgnal lcense was orgnally ssued. D. Hearng procedures. (1) Notce. a. Notce of a hearng shall set forth specfcally the grounds of the complant and the tme and place of the hearng. b. Such notce shall be served by certfed mal (return recept requested) to the lcensee at hs last known resdence or busness address, at least fve days pror to the date set for the hearng or personally served on the lcensee at least three days pror to the date set for the hearng. c. f the lcensee shall request a contnuance n the date of the hearng, any suspenson n effect shall be contnued untl the contnued hearng date. d. All pleadngs, motons, notces, and orders shall be fled wth the vllage clerk. (2) Procedural rules. a. Pror to the begnnng of any hearng, the vllage presdent may adopt addtonal procedural rules as may be necessary for that hearng. b. At the hearng, the lcensee shall be permtted counsel and shall have the rght to respond, present evdence, and cross-examne wtnesses. c. All proceedngs shall be stenographcally or electroncally recorded. d. rrelevant, mmateral, or unduly repettous evdence shall be excluded. The rules of evdence as appled n cvl cases n the crcut courts of the State shall be followed. Evdence not admssble under those rules of evdence may be admtted, however, f t s 5

27 of a type commonly reled upon by reasonably prudent men n the conduct of ther affars. Objectons to evdentary offers may be made and shall be noted n the record. e. No dscovery procedure shall be used pror to a hearng except by leave of the vllage presdent who shall supervse all or any part of any dscovery procedure. f. The standard for proof for hearngs shall be by the preponderance of the evdence. g. The vllage presdent shall presde and render the decson wthn a reasonable tme after the concluson of the hearng, but not later than 30 days after such concluson. The decson shall be n wrtng and shall summarze the evdence and state the reasons for the decson. (3) Hearng costs. a. Any lcensee whose lcense s suspended or revoked, or a busness that operates wthout a lcense shall pay to the vllage the costs of the hearng before the vllage presdent. The vllage presdent shall determne the costs ncurred by the vllage for sad hearng, ncludng, but not lmted to, court reporter fees, the costs of transcrpts or records, attorneys' fees, the cost of preparng the malng notces and orders, and all other mscellaneous expenses ncurred by the vllage or such lesser sum as the vllage presdent may allow. b. The lcensee shall pay sad costs to the vllage wthn 30 days of notfcaton of the costs by the vllage presdent. Falure to pay sad costs wthn 30 days of notfcaton s a volaton of ths secton and may be cause for lcense suspenson or revocaton, or the levy of a fne LCENSE TO BE POSTED DESTRUCTON OR REMOVAL PROHBTED UNLESS AUTHORZED A. All lcensees shall keep the lcense certfcate, plate, tag, badge or stcker posted at all tmes n a conspcuous place on the buldng or premses used for the busness, occupaton, actvty or establshment for whch such lcense s ssued. B. No person shall destroy, oblterate, take, remove or carry away wthout the consent of the lcensee any certfcate, plate, tag, badge or stcker whch has been ssued by the vllage except when such certfcate, plate, tag, badge or stcker has expred or been revoked or suspended or the buldng or premses for whch the lcense s ssued has been abandoned. C. n the event that a lcense s revoked or suspended, an authorzed vllage offcal or employee may remove the certfcate, plate, tag, badge or stcker relatng thereto from the buldng or premses on whch t s posted f the lcensee fals or refuses to forthwth surrender t upon recevng notce of the revocaton or suspenson LCENSES NOT ASSGNABLE UNLAWFUL USE No lcense may be assgned, sold, loaned, transferred, used as collateral or otherwse encumbered. No person, frm or corporaton shall use or dsplay any lcense certfcate, plate, tag, badge or stcker whch has been mproperly acqured. No person, frm or corporaton shall alter, deface, forge or counterfet any lcense certfcate, plate, tag, badge or stcker ssued by the vllage SEPARATE LCENSES REQURED FOR EACH LOCATON 6

28 No lcense for a busness, occupaton, actvty or establshment n the vllage shall be construed to permt ts operaton n more than one locaton n the vllage; a separate lcense shall be requred for each locaton. For the purpose of ths ordnance, the exstence of a sngle locaton shall be evdenced by the fact that all buldngs and premses contanng the prncpal and accessory uses shall be: A. connected or stuated on the same or adjonng lots or parcels, and B. owned or leased by the same person, frm or corporaton. Unless otherwse provded, the locaton of any such busness, occupaton, actvty or establshment may be changed upon wrtten notfcaton to the vllage clerk and the payment of a ten-dollar ($10.00) transfer fee SEPARATE LCENSES REQURED FOR EACH BUSNESS Unless otherwse provded n ths chapter or another ordnance, any person who conducts, engages n, mantans, operates or carres on more than one busness, occupaton, actvty or establshment for whch a lcense s requred, regardless of whether or not they are operated out of the same buldng or premses, shall apply for and obtan a separate lcense for each such busness, occupaton, actvty and establshment ENFORCEMENT Whenever a person neglects or refuses to apply for and obtan any lcense requred by ths chapter or any other vllage ordnance, or otherwse volates the provsons of ths chapter, the vllage may also cause approprate legal acton and proceedngs, n law or equty, to be nsttuted and mantaned to enforce the lcense requrement. Chapter 30 of the Vllage of East Dundee Code of Ordnances s hereby amended by deletng sectons through and ncludng and replacng sad Sectons wth the followng: Secton MEETNGS. RULES OF ORDER AND PROCEDURE (A) Regular meetngs of the Board of Trustees shall be held at Vllage Hall Annex, unless otherwse specfed, on the frst and thrd Mondays of each month. The meetngs shall begn at 6:00 p.m. unless otherwse ordered at a regular meetng. (B) n every case where the regular meetng falls on a legal holday, the regular meetng may be held on the day followng such holday. (C) Specal meetngs or Work Shop meetngs may be held at any tme on call of the Presdent or of any three (3) Trustees. Such call shall be made n wrtng, duly sgned, and shall be presented to the Vllage Clerk at least ffty (50) hours pror to the tme specfed for such meetng. Nothng n ths secton shall deprve an Actng Presdent or Presdent Pro Tem from votng n hs/her capacty as Trustee, but he/she shall not be enttled to another vote n hs/her capacty as Actng Presdent or Presdent Pro Tem. (B) The Presdent shall nomnate one (1) Trustee at the commencement of each fscal year to act as the presdng offcer of the meetng n the absence of the Presdent, and one (1) alternate n the event of the unavalablty of the apponted Trustee, whch Trustee shall perform the dutes of the Presdent as presdng offcer. (C) The presdng offcer shall preserve order and decorum. The presdng offcer may speak to a subject before the Board of Trustees wthout relnqushng the char. The presdng offcer shall decde all questons of order, subject to appeal to the Board of Trustees. When two (2) or more Trustees request the floor, the presdng offcer shall name the order n whch they are to be heard. n case of any dsturbance or dsorderly conduct, the presdng offcer shall have the power to have the chamber cleared of any or all vstors. Secton DUTES OF MEMBERS OF THE VLLAGE BOARD. (A) Whle the presdng offcer s puttng the queston or whle busness s beng transacted, no Trustee shall leave the Board of Trustees chamber except by consent of the presdng offcer. No Trustee shall speak or offer a moton wthout frst addressng the char and beng recognzed. (B) n speakng durng the dscusson of any queston, members of the Board of Trustees shall confne ther remarks to the queston under debate, avodng personaltes and refranng from mpugnng the motves of any other member of the Board or the staff. Members of the Board of Trustees shall not speak more than once upon any subject untl other members of the Board who wsh to speak shall have relnqushed the floor. 2

32 (C) A Trustee, when called to order by the presdng offcer, shall thereupon dscontnue speakng on the order of the presdng offcer, whch order shall be bndng and conclusve, subject only to rght of appeal as provded n Secton (D) Every Trustee present when a queston s stated shall vote thereon, unless excused by the Board, or unless he or she has a personal nterest n the queston. Secton STANDNG COMMTTEES. (A) Standng commttees of the Board of Trustees shall be as follows: (1) Fnance (2) Streets (3) Publc Safety (4) General Vllage Commttee (5) Communty Events Commttee (B) Except for the Commttee of the Whole, each standng Commttee shall consst of three (3) Trustees wth the Presdent as an Ex-Offco member. The Presdent shall assgn Trustees to each Commttee each fscal year but no later than at the frst regular meetng n June each year. Each Commttee shall enlst such assstance from other Trustees as the Commttee may fnd desrable. No Commttee shall oblgate the Vllage for the expendture of any money n connecton wth ts operaton except wth pror and proper authorzaton of the Board of Trustees. The Commttee shall keep the Presdent aware of the Commttee actvtes and wll report any polcy matters to the Presdent before any acton, publcty or opnons are presented to the publc. (C) Assgnments to the Standng Commttees shall be made by the Vllage Presdent. (D) Commttee Procedures. (1) All Commttees shall hold meetngs n accordance wth the Open Meetngs Act. (2) A copy of the agenda of each Commttee meetng shall be delvered to the Presdent along wth a copy of the mnutes of the meetng. (3) The Commttee shall report on all matters under dscusson upon request of the Presdent at any regular Board of Trustees meetng. Upon the request of any two (2) Trustees present, any report of a Commttee shall be 3

33 deferred, for fnal acton thereon, to the next regular meetng of the Board after the report s made. (4) Any person who requests to address the Commttee shall be lmted to two (2) mnutes, unless otherwse drected by the Commttee Charperson. Secton VSTORS. Except durng the tme allotted for audence and vstors comments as provded n Secton 10.07, no person other than a member of the Board of Trustees shall address that body, except wth the consent of the presdng offcer. Secton CONDUCT OF MEETNGS. (A) Quorum. Four (4) members of the Board of Trustees shall consttute a quorum and the affrmatve vote of a majorty of Trustees holdng offce shall be necessary to adopt any moton, resoluton, or ordnance, unless a greater number s requred by law. f a quorum s not present, the meetng shall thereby stand adjourned and there may be no further dscusson by the Trustees present. A smaller number, however, may adjourn from tme to tme and may compel the attendance of absentees, under penaltes (ncludng a fne for falure to attend) as set forth by ordnance as may be amended from tme to tme. (B) Agendas. The Vllage Presdent shall have the fnal authorty concernng the preparaton, placement, or removal of all tems for the agenda for all meetngs of the Board of Trustees. The Vllage Clerk shall dstrbute the prnted agenda wth all supportng documents not later than forty-eght (48) hours before the meetng. Prorty of busness shall follow the prnted agenda unless changed by the presdng offcer, subject to appeal of the Board of Trustees. (C) The current edton of Robert s Rules of Order shall govern the proceedngs of the Board of Trustees where these Rules of Order and Procedure are slent, and when not n conflct wth statutes or ordnances. (D) Publc Comment on agenda tems only shall be permtted after the meetng has been called to order, roll call taken and the Pledge of Allegance rected. No person recognzed by the presdng offcer may speak more than once or speak longer than fve (5) mnutes. All other publc comments shall be heard after concluson of all busness and pror to adjournment. (A) No moton shall be debated unless t has been seconded. f any moton or queston contans two (2) or more dstnct propostons, the presdng offcer may have the same dvded wth the consent of Board. (B) After a moton or resoluton s stated by the presdng offcer, t may be wthdrawn from consderaton by the maker and the seconder wth the consent of majorty of the Board. (C) A moton to reconsder may be ntroduced by any member of the Board on the prevalng sde of the queston at the same meetng at whch the queston was voted upon or at the next regular meetng of the Board. A moton to reconsder may only be presented at a Specal Meetng at whch there are present at least as many members of the Board as were present when the orgnal vote was taken. A moton for reconsderaton once havng been made and decded n the negatve, shall not be renewed nor shall a moton to reconsder be reconsdered. A moton to reconsder need not be seconded. Secton ORDNANCES AND RESOLUTONS. (A) All ordnances and resolutons shall be ntroduced to the Board n prnted or wrtten form. (B) Any proposed ordnances may be prepared or revewed by the Vllage Attorney as drected by the Vllage Presdent, Vllage Board, or Vllage Admnstrator. (C) The Vllage Clerk shall prepare copes of all proposed ordnances and resolutons, together wth copes of the attachments and shall dstrbute these to the Board. Secton ORDER OF BUSNESS. At every meetng of the Board of Trustees, the order of busness shall be as follows: (A) Call to order; (B) (C) (D) Roll call; Pledge of Allegance; Publc comment or agenda tems only; 5

35 (E) Consent agenda: (F) Correspondence; (1) Contans all routne tems such as, but not lmted to: (a) Approval of past mnutes; (b) Approval of clams; (c) Annual standard type resolutons; (d) Department reports; (e) Treasurer s report; and, (f) Others. (2) The followng rule apples to the consent agenda: (a) Any member of the Vllage Board may, by request, have any tem removed from the consent agenda. That tem would be dscussed mmedately after approval of the remanng tems. (b) The remanng tems are approved by moton. (G) Bd awards, all compettve bd awards that requre Vllage Board approval; (H) Old busness, ths secton of the agenda ncludes tems prevously dscussed at a Board meetng; () New busness, ths secton of the agenda ncludes all tems of a general nature, ncludng resolutons and ordnances beng put before the Board for the frst tme; (J) Reports: (1) Vllage Presdent; (2) Trustee/Commttee; (3) Vllage Admnstrator; (4) Vllage Attorney; (5) Vllage Engneer; (6) Chef of Polce; (7) Drector of Publc Works; and, (8) Buldng Offcal. (K) Executve sesson, ths secton may be held only after a vote of the Vllage Board and only for those reasons outlned and contaned n the Open Meetngs Act; (L) Mscellaneous/announcements, such as next meetng of the Board; 6

36 (M) Publc Comment on other than agenda tems; and, (N) Adjournment. Secton PRVLEGES OF THE FLOOR. (A) No persons, other than the presdng offcer, the Trustees, Vllage Offcals or persons nvted by the presdng offcer, shall have the prvlege of the floor. (B) Persons other than the presdng offcer, Trustees and Vllage Offcals shall not be permtted to address the Board except upon ntroducton by the presdng offcer or durng the audence porton of the meetng. (C) No person recognzed by the presdng offcer durng the publc comment porton may address the Board more than once or speak for longer than fve (5) mnutes, except wth the unanmous consent of all Board members present, ncludng the Vllage Presdent. (D) The presdng offcer may have any person dsruptng the meetng or speakng when not recognzed removed from the meetng. Dsrupted behavor shall nclude, but not be lmted to, use of profane language or slanderous language. Secton SUSPENSON OF RULES. Any provson of these Rules not governed by the llnos statutes or Vllage Ordnances may be temporarly suspended at any meetng of the Board, by affrmatve vote of four (4) of the members of the Board present. Secton APPEAL FROM DECSONS OF THE PRESDNG OFFCER. Any Trustee may appeal to the Board from a rulng of the presdng offcer. f the appeal s seconded, the Trustee makng the appeal may make a bref statement of the reasons for the appeal, and the presdng offcer may explan the rulng brefly, but there shall be no debate on appeal and no other Trustee shall partcpate n the dscusson. The presdng offcer shall then put the queston, Shall the decson of the presdng offcer be sustaned? f the majorty of the Trustees present vote Aye, the rulng of the presdng offcer s sustaned, otherwse t s overruled. 7
