8 APPROVAL OF PAYROLL DECEMBER 13, 2015 THROUGH DECEMBER 26, 2015 APPROVED Alderman Hatlelid moved the City Council approve the payroll for the period of December 13, 2015 through December 26, 2015 in the amount of $2,621, Motion seconded by Alderman Lehner and carried by the following roll call vote: ayes: Berg, Frantsvog, Frey, Hatlelid, PUBLIC HEARING BUILDING RELOCATION RICHARD WILSON TH AVE SW APPROVED The City Council held a public hearing to consider the request from Richard Wilson to move a 1965 year built, 1,464 square foot single family residence from 606 Forest Rd to th Ave SW also known as Napa Valley 16th Addition, Lot 4 subject to the following conditions: A $10,000 completion bond must be posted with the City of Minot prior to issuance of any permits for this work. Building permits for all proposed construction. An approved foundation design in compliance with City of Minot building codes. The plumbing, electrical and HVAC systems must be brought into compliance with current code requirements of the City of Minot. All work at the new location must be in compliance with the City of Minot building codes and zoning ordinances. Egress windows must be installed in the basement and all sleeping rooms. Smoke detectors must be installed in the basement, in each bedroom, and in areas immediately outside bedrooms. There must be fire resistive wall and door between the house and attached garage. The exterior of the structure must be one consistent color or scheme of colors and relocation. Applicant must obtain all necessary permits, and coordinate all relocation activities with public utilities and traffic authorities. The property must be provided with proper drainage, and must be landscaped in a manner similar to surrounding properties. All work must begin within 30 days of issuance of moving and building permits and completed within ten months of start date and generally in accordance with the following schedule. 1. Foundation complete within two months. 2. Structure relocated within four months. 3. Work required for code compliance complete within six months. 4. All proposed construction and final clean up complete within ten months. 5. City of Minot Zoning Ordinance, Section 23-1 states that All off-street parking spaces and all driveways on private property leading to such parking areas shall be all-weather hard surface material. Acceptable surfacing materials include asphalt, concrete, brick, cement pavers or similar materials installed and maintained according to industry standards. Richard Wilson of th Ave SW appeared before the Council. He stated he has listened to the protests made by citizens at the Committee meeting but believes the facts do not support the objections. The condition of the home meets the qualifications and the value of the home is within the proper range according to City Assessor s opinion. Alderman Seymour questioned why he would want to move a house from one previously flooded area to another previously flooded area, to which he replied, it is his mother in law s home and she wants to stay in that area. Upon questioning by Alderman Jantzer over whether or not Mr. Wilson owns the lot, he responded, without getting into financial details, he is in the process of purchasing it. Alderman Jantzer questioned if the purchase was contingent on approval of the building relocation, to which he replied, yes and his mother in law is in a hurry to get the process completed. Alderman Schuler asked if there would be a basement in the new location, to which Mr. Wilson responded there would be. Alderman Schuler showed concern about a basement in a previously flooded area specifically how that affects insurance rates and how feasible it is for an elderly woman.

9 Sandra Larson of th St SW stated she is passionate about the area she lives in and wants her neighborhood to maintain its value and the caliber of house she lives around. She referred to the application from the assessor s department, which stated three mains concerns in the proposed location of the property. The house in question is much older than the rest of the neighborhood. It was built in 1965 whereas all of the other homes were built between 2006 and It has a two car garage but a majority of homes in the area have a three stall garage. The current assessment of the subject is $239,000 but the range of appraisals for the proposed location vary between $265,000 and $492,000. She concluded by saying there is too much of a difference and the house does not fit in the neighborhood. Joe Zieska of th St SW came forward to second the comments brought to the Council by Ms. Larson. He stated he has worked hard to find a nice home and the proposed house is not at the caliber of the rest of the neighborhood. He is worried the house will drop the value of the other homes and urged Council to consider their concerns. Pearl Gillespie of th Ave SW also stated her concerns about the property value. She cited the assessor s report which certifies the house is compatible with the area but would like more assurance that it will not decrease the value of other homes. Alderman Shomento called upon the City Assessor to respond to the citizen concerns. The City Assessor stated that before the 2011 flood there was a house to the west of where the subject currently sits. It was assessed at twice the value of the subject and was not affected by the value of that house. He stated he has not seen data to indicate the house proposed to be moved would decrease surrounding values. Alderman Seymour asked what they consider to be the age of the house to which the City Assessor stated that since the frame was built in 1965, it is a 1965 built house even though everything else was replaced after Joe Zieska asked what the average home price for the past four years was in his neighborhood. The City Assessor stated he would need a formal request but could do some research and find that information for him. Alderman Hatlelid moved the public hearing be closed and the building relocation from 606 Forest Road to th Ave SW be approved. 10 PERSONAL APPEARANCES Shaun Sipma, of th Ave NW representing the MakeMinot Committee came before the Council. He stated they published an open letter to the City Council to suggest a compromise to their previous petition after taking into consideration some of the feedback from citizens. They still wish to encourage a competitive election with a vote at large rather than using the ward system. They wrote a resolution requesting a Council initiated change in form of government to a seven member modern council comprised of six elected at large council members and a voting mayor. They also made a compromise on the timeframe and suggested the transition take approximately one year after voter approval. Josh Wolsky of 1340 S. Main St. stated he is responsible for the written communication for MakeMinot. They are asking for an endorsement of the petition process. He explained the history of the MakeMinot Committee and stated the citizens signed the petition to assert their right to choose whether it be the plan MakeMinot laid out or another idea. He stated they want a resolution on record that the Council will honor the petition process and hold a vote where the people can choose their form of local government. Shannon Straight of nd Ave SE appeared before the Council and stated the petition is not meant to be personal. They collected 2800 signatures in an effort to seek out Minot s best interests. He said according to the City ordinance it is required to have a vote by the end of March. Once the election is held on March 1 st, the City Council will have the authority to make changes to the form of government. He concluded by stating they want to hear a vote of support by Council to confirm that there will be an election of the people and the spirit of their petition will be considered. Scott Louser of 1718 Birch Place SW explained some of the changes they have decided on since the original petition last fall. They suggested a compromise to the timeframe to make the transition and increased their proposed number of Council members from five to seven. He stated the citizens need the chance to vote up or down on the changes. Alderman Miller addressed Mr. Sipma by asking if they could wait to get the results of the March 1 st election before adopting resolutions on proposed changes. Mr. Sipma stated they are looking for assurance from Council to endorse the petition process, not necessarily their opinions on the petition itself. They want a guarantee their compromises will be pushed forward to an election. If they are given assurance that there will be an election that holds the same spirit as their petition, all 6 of the sponsors of the petition will withdrawal it from consideration. Allen Westereng of th Ave NE came forward to assert his discontent toward the current Council. He stated he wants aldermen he can talk to which are elected at large to represent him. Michael Carswell of th Ave NE stated he was not a supporter until the meeting on December 17 th. He claimed the actions of the Council appear to be stonewalling the petition. There is a perception by the public that the Council is trying to preserve itself. Tyrone Langager of th St SW stated he signed the petition because Council is too large. He emphasized it should be brought to the people to decide. Lianne Zeltinger of th St NW asked about the petition process. Since the original petition requested the change to five council members and now they are increasing it to seven, do they need to start over with a new petition? Mayor Barney replied that MakeMinot offered to withdrawl their petition if their new resolution is adopted with the proposed changes being Council initiated rather than petition initiated. Alderman Hatlelid asked the City Attorney for her interpretation of the proposed resolution. The City Attorney replied that it is referred to as a resolution of intent but the language used throughout the resolution has a more strict meaning. She continued by saying, at this time Council does not have the authority to initiate a change in the form of government to a modern Council. If the Home Rule Charter amendment passes then Council can initiate a change. At this point they can pass a motion of support but as the resolution is worded right now it would bind the Council to measures they do not have the authority to make.

11 Alderman Lehner stated the Council may be too big but raised the question, what if the citizens want to keep the ward system? He asked the City Attorney if it is possible to offer different options on the ballot. He also questioned if by endorsing the resolution brought forward by MakeMinot, does it mean they cannot endorse a different system? The City Attorney stated she was not at the December 17 th Special City Council meeting but understands that during the discussion with the Attorney General s Office it was determined they could not have competing measures on the ballot at the same time. Alderman Hedberg asked the City attorney if they needed to act within 120 days of the petition. She explained City ordinance requires Council to take action by adopting an ordinance or resolution supporting the proposed petition within 60 days from the date the petition has been certified by the City Clerk, which in this case would be the end of January. She said, however, since the Council does not currently have the power to adopt the requested changes, they would be creating an ineffective ordinance that would be put forward to the people for a vote. Mr. Wolsky stated that since the resolution is contingent upon the election on March 1 st, they can change the language to show their intent rather than phrasing it in a binding manner. They are looking for a public show of support and want to protect the rights of the petition process. Alderman Lehner stated that he needs the endorsement of the City Attorney before approving the resolution put before them and since the wording is too strict would like to postpone approving the resolution until the February 1 st meeting when they can have the resolution rephrased. Alderman Miller stated it was his understanding this was taken care of at the December 17 th meeting, to which Mr. Wolsky replied that nothing was put on the record regarding the subsequent election after the proposed changes to the Home Rule Charter. The meeting in December addressed an election to take place on March 1 st regarding amendments to the Home Rule Charter but now they are looking for something in writing stating their measure would be considered at the June Primary election. The Mayor voiced his support for the petition process and commended the MakeMinot group on accumulating 2800 signatures. He continued by saying the people deserve a chance to vote at the June election and assured them it will be on the ballot. He stated, it is clear this community would like to decrease the size of the Council and he can assure the public, without a resolution, that this will be brought forth for consideration. Alderman Lehner suggested making changes to the resolution to show support for the petition process without binding the Council to anything they are not authorized to do. Alderman Jantzer moved the City Council table the proposed resolution until the next meeting on February 1, 2016, in order to make the appropriate changes to the language that would be acceptable for the City Attorney. Shannon Straight made a brief announcement to show support for the Vista Volunteers who are committing a year of service to improving our community. He said they are going with the Chief Resilience Officer to Washington D.C. for meetings. Alderman Hatlelid requested a recess. Mayor Barney called a brief recess at 8:10pm. 12 MAYOR S REPORT The Mayor stated there were a couple of employee s who recently retired including JD Karhoff from the Airport, Carleen Larson from the IT department and Fire Chief Craven. He said they had a meeting with Senator Hoeven regarding an update on flood protection which was included in the spending bill and met with the U.S. Army Corps of Engineers to discuss a start to the project. Aldermen Jantzer and Frey returned at 8:15 The Mayor then asked Police Chief Olson to come forward to present an award for exceptional performance of duty to Erik Laudenschlager and K-9 Lois for their excellent achievement as first responders. CITY MANAGER REPORT The City Manager briefly reviewed each of the City departments. He stated the water treatment plant flood protection began construction, the Public Works building expansion is progressing nicely. The first of the parking structures should be completed February 11 th with the second finishing up in April. Afterwards they will begin commercial construction on the upper levels. There were issues with the 6 th St Underpass which has delayed progress but they are being resolved. He stated Police calls are up by 32% with a minimal increase in staff and commended them on their excellent work. The Assessor s office is continuing their 2016 assessments. The Airport is 95% completed and they are preparing for an open house on February 20 th. The Resilience Americorps staff is working with the Chief Resilience Officer and they are about to head to Washington D.C. Chief Craven recently retired from the Fire Department and Chief Kelly Flermoen has taken over. He concluded by stating he will be working on developing a guide to outline Council, Committee and Commission procedures.
