The NDLC Board Meeting will take place December 4 th ; Biennial Workshop December 5 th ; Military Affairs Committee, December 6 th ; Parks & Recreation Merger Public Input Meeting, December 10 th ; Employee Awards Event, December 12; MADC Board Meeting, December 13 th ; Chamber Board Meeting, December 18 th. He also reminded, City Offices will be closed December 24 th, 25 th and January 1 st. He moved on to discuss updates on construction projects, which are winding down for the season. The Broadway Bridge project is complete and a ribbon cutting ceremony took place November 15 th. The project upgraded 50 year old infrastructure, widened the pedestrian paths, and installed better lighting. The NW Water Tower is on schedule to be online this month. The tower drastically improves water flow and capacity for much of NW Minot. The first year of the Flood Control project has been successful so far. Work on MI-1 has concluded for the season but MI-2 work on the pump station continues this winter. Mr. Barry thanked the Souris River Joint Board for their efforts on the project. The U.S. 83 Bypass project has completed Phase 1. The State has recommitted funding for the remaining stretch of the Bypass and should be completed by the end of next year. The project improves traffic flow and safety for truck, local and military traffic. The Water Treatment Plant is finishing year one of the two year project. In is part of the Northwest Area Water Supply Project and will double the daily capacity at Minot s Water Treatment Plant. Upsizing of the sanitary sewer lines that push water from the aeration pond to the lagoon cells is on schedule. It will be online by the end of Mr. Barry then reviewed some statistics related to City employment. He welcomed the new recruits to the Fire Department and congratulated those members promoted. A swearing in ceremony took place the previous week. He then explained the cost of turnover for the City. Prior to the 4th Quarter of 2017 the turnover rate was projected to be 10.4% based on termination trends and anticipated retirements. After passing of the 2018 Budget the turnover rate took a drastic climb to 14.87% when an additional 16 people unexpectedly left employment. Since implementing the Comprehensive Workforce Improvement Plan, we have reduced the turnover rate by 2.31% essentially saving money for the City while still paying for better benefits. He also noted, the Police Department is now fully staffed, Fire Department is within 3 of being fully staffed, Engineering is fully staffed for the first time in two years and we are still working to fill positions in the Planning Department. There has also been an improvement in the quality and number of applicants, a noticeable increase in morale and we are on track to continue lowering the turnover statistics and saving money. The City Manager provided updates on NDR. He said, the NDR team is pushing awareness of the Gap Financing Program by circulating post cards to nearly 3,100 homes in the valley. He reminded, only LMI households qualify. He said, the Technical Amendment was approved, which will allow affordable housing in several builds, expand affordable housing to existing and rehabilitated homes, clarify which developers are eligible and clarified that the housing market has changed to avoid creating new resilient neighborhoods. The location for the Downtown Gathering Space has been cleared by SHPO to move forward. We are currently waiting for a Finding of No Significant Impact and staff is collecting and responding to comments. The City was awarded $3 million for relocation of City Hall, however, HUD will not allow use before meeting Page 8

9 the vulnerable population needs first. A HUD Waiver was submitted last year but we are still waiting on an answer, which they assure we should have by the end of the year. The draft of the Legislative issue papers should be done by December 7 th, at which point staff will finalize and distribute. He provided important dates to remember including, the Organizational Session, December 3 rd ; the State of the State January 3 rd, and the start of the Legislative Session January 3 rd. Mr. Barry mentioned some notable accomplishments for the City over the past year. There was an extensive list of projects assigned by the Council which is about 85% complete. He described the first quarter focus in the areas of financials, customers, employees, operations, and strategy. He reminded everyone, the State of the City, Focus Forward, will take place January 31, The City Manager then welcomed Fire Chief Kronschnabel and Community Ambulance Director Anderson to present the American Heart Association Heartsaver Hero award. Recipients from the Fire Department were Capt. Devin Walter, Senior Firefighters Philip Anderson and Travis Elich and Firefighter Jason West. Community Ambulance employees receiving the award were Christopher South, Carter Gage and Shayanne Tescher. CITY ATTORNEY S REPORT The City Attorney submitted a written report. Alderman Podrygula expressed his disappointment with the Committee of the Whole process and said he had hoped to be able to discuss issues informally. He explained, the timing of the applications is provided in state statute and they met the deadlines to file for abatement. He said, every taxpayer has the right to apply for this process and it is not fair to penalize their client because other taxpayers did not take that opportunity. The City and County are not required to reassess all other properties if the value of the applicant s properties is reduced. Mr. Doerr also explained the discrepancy between the amount requested on the application and the amount supported by their documentation. He said, the application requests the lowest amount the Page 12

13 Council is able to approve but they are allowed to deviate upwards. Their client submitted the application before performing the legwork that resulted in their more accurate requested value. He emphasized, the Council is tasked to review the true and full value of the properties and they are able to determine a value between the amount on the application and the assessed value. Mr. Doerr provided additional information about the first property for discussion. He distributed copies of s showing contact between Drew Likness, of Chase Realty and potential buyers. He said, the conversations included a price list and confirms the trend of reducing prices during that time. The City Assessor, Mr. Ternes, said, there is a difference in opinion in what can be used to determine the value. He said, his office has not been able to find the price listing that Mr. Doerr is referring to. He explained, assessments are based on market trends up to February first and data after that date will impact the next year s value. A time analysis could be conducted by a licensed appraiser which may or may not verify their results but that is not the method they used. There were actual sales at that time confirming the City s assessment of the property. Vacant lot assessments were calibrated to the market at that time, using a state approved process. Mr. Doerr clarified, he is not suggesting the Assessor should have used their data for the initial assessment but it can be considered now to confirm the market trends that existed at the time. Alderman Pitner moved the City Council deny the request by C & K Consulting, LLC for an abatement to reduce the 2016 True and Full Value for 16 vacant lots owned by C & K Consulting on or near Mulberry Loop and Olive Tree Circle. Motion seconded by Alderman Straight. Alderman Wolsky said, he does not see the establishment of value in the documentation provided between the realtor and potential buyers. He explained that they combined the assessed values of th Street NE and th Street NE because they operate as one property, and used ratios to determine the individual property values. Using the income approach, they calculated a value of $4,283, for th Street NE. He stated, the income approach makes sense for an apartment building and they used actual data to find the true and full value. Mr. Ternes brought up issues concerning their calculation method and problems relating to determining the land value. He shared his qualifications for understanding the income approach and explained that their model is oversimplified. He said, their vacancy rate study was miscalculated, the rental rate was too low and the capitalization rate was inaccurate. He stated, they have taken a good approach but simplified it. He said, he believes they would arrive at the same value as the City if they used corrected information in their model. Mr. Ternes also clarified, after the Committee of the Whole meeting, staff verified the buildings have one and two bedroom units, not three bedroom as originally assumed. Mr. Ternes spoke again about the discrepancy with the land value. He also said, the vacancy rate cannot be determined by one day s vacancy but rather a calculation spread over a larger time period. Alderman Wolsky moved the City Council deny the request by Stonebridge Villas II, LLC (3241 8th Street NE) for a reduction of the 2016 Property taxes Motion seconded by Alderman Jantzer and carried by the following roll call vote: ayes: Jantzer, Olson, Pitner, Podrygula, DENIAL OF APPLICATION FOR ABATEMENT OR REFUND OF TAXES FOR TH ST NE APPROVED Mr. Doerr explained, the income approach was used to calculate the value of the 68-unit apartment building. He said, it contains two bedroom units. He described the decrease in income between 2014 and 2016 and said they based their reduction in value on those factors. Mr. Ternes said, the City has not been able to gain access to the apartments despite their requests. They recognize that prices have dropped in recent years and have adjusted values on all apartment buildings in Minot. Alderman Jantzer moved the City Council deny the request by Stonebridge Villas LLC (3343 8th Street NE) for a reduction of the 2016 Property taxes on a 68 unit apartment complex. DENIAL OF APPLICATION FOR ABATEMENT OR REFUND OF TAXES FOR 46 TOWNHOMES OWNED BY TOWNHOMES AT STONEBRIDGE APPROVED Mr. Doerr explained, there is a disagreement on the 46 townhomes because they are occupied as rental units but the City appraises them individually. He said, they believe the highest and best use of the properties are as rentals. They provided an appraisal that was conducted for the purpose of financing and have requested a minor reduction of $500,000 from the total value. Mr. Ternes stated, the townhomes are located on separate parcels that could be sold off individually therefore, are appraised individually. They are different sizes and have different values for each townhome. He also mentioned that if they were assessed as commercial properties, they would use the commercial tax rate which is 10% higher that residential. Alderman Straight moved the City Council deny the request by Townhomes at Stonebridge for a reduction of the 2016 Property taxes on 46 Townhomes along 7th Street NE. Motion seconded by Alderman Olson and carried by the following roll call vote: ayes: Jantzer, Olson, Pitner, Podrygula, DENIAL OF APPLICATION FOR ABATEMENT OR REFUND OF TAXES FOR 58 VACANT LOTS OWNED BY STONEBRIDGE DEVELOPMENT COMPANY ON OR NEAR MULBERRY LOOP NE, OLIVE TREE CIRCLE NE, AND 34TH AVENUE NE APPROVED Mr. Doerr stated, the same argument was made for the vacant lots that were previously discussed.
