PUBLIC HEARING BUILDING RELOCATION AMY JENKINS SINGLE FAMILY HOME FROM ND ST SE TO 834 UNIVERSITY AVE W APPROVED The City Council held a public hearing to consider the request from Amy Jenkins to move a single family dwelling from S2S2SENE & N2N2NESE S also known as nd St SE to North Minot Addition S/D of block 14, lot 10 block 2 also known as 834 University Ave W under the following conditions: A $10,000 completion bond must be posted with the City of Minot prior to issuance of any permits for this work. Building permits for all proposed construction An approved foundation design in compliance with City of Minot building codes. The plumbing and electrical systems must be brought into compliance with current code requirements of the City of Minot. All work at the new location must be in compliance with the City of Minot building codes and zoning ordinances. Egress windows must be installed in the basement and all sleeping rooms. Smoke detectors must be installed in the basement, in each bedroom, and in areas immediately outside bedrooms. There must be fire resistive wall and door between the house and attached garage. The exterior of the structure must be one consistent color or scheme of colors and relocation. Applicant must obtain all necessary permits, and coordinate all relocation activities with public utilities and traffic authorities. The property must be provided with proper drainage, and must be landscaped in a manner similar to surrounding properties.
6 All work must begin within 30 days of issuance of moving and building permits and completed within ten months of start date and generally in accordance with the following schedule. 1. Foundation complete within two months. 2. Structure relocated within four months. 3. Work required for code compliance complete within six months. 4. All proposed construction and final clean up complete within ten months. 5. City of Minot Zoning Ordinance, Section 23-1 states that All off-street parking spaces and all driveways on private property leading to such parking areas shall be all-weather hard surface material. Acceptable surfacing materials include asphalt, concrete, brick, cement pavers or similar materials installed and maintained according to industry standards. Whereupon Alderman Lehner moved the public hearing be closed and the Council approve the request to move the single family dwelling from S2S2SENE & N2N2NESE S also known as nd St SE to North Minot Addition S/D of block 14, lot 10 block 2 also known as 834 University Ave W Motion seconded by Alderman Frey and carried by the following roll call vote: ayes: Berg, Connole, Frantsvog, Frey, SHANE GOETTLE NORTH DAKOTA 2015 LEGISLATIVE UPDATE Shane Goettle, Special Assistant City Attorney for Minot gave a presentation to Council on the outcome of the 2015 legislative session as it relates to funding for the City. He stated work was done behind the scenes by the Mayor, City Manager, and Finance Director with other oil impacted communities that resulted in $32 million in surge funding approval by the legislature. Mr. Goettle gave an overview of the four sources of funding being received by Minot. The source of the funds are: 1. Surge Funding 2. Gross Production Tax Distribution for Hub cities 3. Gross Production Tax Distribution for Political Subdivisions 4. Extraction Tax Distribution. He estimated biennium funding for Minot using NYMEX futures as of May 2015 with new oil and gas employment percentage of 13%: 1. Surge Bill- $32 million 2. GPT 1/5 Hub City- $9,750, GPT 4/5 Political Subdivision- $4,870, Extraction Tax Bucket Distribution- $1,080,132 Total Funding- $47,700,418 Mr. Goettle stated, Minot is also expected to be eligible for up to $40 million in water project funding. Other funding is in the form of property tax relief for residents through various distribution forms. MAYOR S REPORT Mayor Barney mentioned the morning meeting with Senator s Hoeven and Heitkamp, Congressman Cramer, Major General Wehr and Lt. Governor Wrigley, which provided the US Army Corps with an update on flood projects. He said Ryan Ackerman gave a very good presentation recapping issues prior to, during and after the 2011 flood. CITY MANAGER REPORT The City Manager gave a brief overview of priorities for the City referencing the downtown parking structures, FEMA flood mapping and flood insurance and HUD Resiliency Phase II as critical issues that will be emphasized in the coming months. He stated the deadline for Phase II of the HUD Resiliency Competition is October 27, This part of the competition will require a lot of specificity to be successful. There is also a 30 day public notification requirement prior to the submission deadline. Mr. Staab briefly discussed current happenings in various departments including the Public Works Phase II Flood Information meeting which happened at Perkett School, the upcoming retirement of Capt. Strandberg in the Police Department and an aggressive revenue plan that is being reviewed for the 2016 Airport budget to support the operation of the new terminal. PROPOSED REALLOCATION OF THE TOURIST PROMOTION TAXES CITY OF MINOT CODE OF ORDINANCES DENIED Alderman Frantsvog moved the City Council deny the reallocation of the Tourist Promotion Tax Section 28 ½ Article II. Motion seconded by Alderman Lehner. Alderman Connole explained the reason for this request by stating All Seasons has received a great deal from the lodging and hospitality tax. His main criticism is the facility does not market any of its events. This is done by and paid for by Visit Minot. Renae Korslien, the manager of ND State Fair and All Seasons Arena, stated All Seasons Arena is advertised and marketed with State Fair Funds. The facility has received an increased amount in taxes over years which has allowed for the HVAC and lighting to be replaced and will provide needed dollars to repair the roof and the entire facility. She concluded that if the facility loses the hotel tax the Arena will lose homegrown events and people who pay the tax.
16 David Reiten of th Ave SE, appeared before the Council, representing the Norsk Hostfest and KX Sports Shows which are the largest events held at the All Seasons Arena. He emphasized the need to have a first class facility to attract entertainment. He stated Minot is in competition with Bismarck Event Center which has been upgraded. John Fjeldahl of rural Berthold, Chairman of the All Seasons Arena Board, stated All Seasons also has funds that come from the County. He said there is a need to update the facility to bring in new attractions. Karen Krebsbach of th St NW, explained that it is good for the state to see the City and County contribute to the state fair property. This facility is important to the many who participate in the fair from around the state. She said the State Fair brings people to stay in hotels for a 9 day stretch and Hostfest for 5 days.
