6 PUBLIC HEARING TAXI LICENSE DENIAL JEROME HAYNES UPHELD The City Council held a public hearing to allow Jerome Haynes, an applicant for a taxi license, to appeal the decision made by the Police Chief to deny the application based on the qualifications and background examination. No one appeared on behalf of the applicant. Whereupon Alderman Jantzer moved the public hearing be closed and the decision by the Police Chief be upheld. Motion seconded by Alderman Sipma and carried by the following roll call vote: ayes: Barney, Jantzer, Olson, Sipma, Straight, Wolsky; nays: none. PUBLIC HEARING - BUILDING RELOCATION REQUEST TH AVENUE SE APPROVED The City Council held a public hearing to consider the request from Nicholas Schultz to relocate the 32 x 44 detached accessory building from st Ave NW, Parshall ND, also known as Township 153N89W-Sec 31, to th Ave SE, Minot, ND 58701, also known as E2SESESW S Nedrose-S4 A5, subject to the following conditions: 1. A ten-thousand dollar completion bond must be posted with the City of Minot prior to issuance of any permits for this work. 2. An approved approach permit assigned to th Ave SE, issued by Nedrose Township. 3. Application and approval of building permits for all proposed construction. 4. An approved foundation design in compliance with City of Minot building codes. 5. If required: plumbing, electrical and HVAC systems must be brought into compliance with current code requirements of the City of Minot. 6. All work at the new location must be in compliance with City of Minot building codes and zoning ordinances. 7. The exterior of the structure must be one consistent color arrangement of colors after relocation. 8. Applicant must obtain all necessary permits, and coordinate all relocation activities with public utilities and traffic authorities. 9. The property must be provided with proper site drainage, and must be landscaped in a manner similar to surrounding properties. Whereupon Alderman Straight moved the public hearing be closed and the building relocation be approved. Motion seconded by Alderman Olson and carried by the following roll call vote: ayes: Barney, Jantzer, Olson, Sipma, Straight, Wolsky; nays: none. PUBLIC HEARING - BUILDING RELOCATION REQUEST TH ST NW APPROVED The City Council held a public hearing to consider the request from Clay Burns to relocate the single family residence, and garage from st Ave SE, Minot ND, also known as Lenox Park Addition Lot 42, to th St NW, Minot, ND 58701, also known as Blaisdell Bird Addition Lot 7 Block 9, subject to the following conditions: 1. A ten-thousand dollar completion bond must be posted with the City of Minot prior to issuance of any permits for this work. 2. Application and approval of building permits for all proposed construction. 3. An approved foundation design in compliance with City of Minot building codes. 4. If required: plumbing, electrical and HVAC systems must be brought into compliance with current code requirements of the City of Minot. 5. All work at the new location must be in compliance with City of Minot building codes and zoning ordinances. 6. The exterior of the structure must be one consistent color arrangement of colors after relocation. 7. PUBLIC HEARING - BUILDING RELOCATION REQUEST TH AVE NW APPROVED The City Council held a public hearing to consider a request by Christopher Owen to relocate the single family residence from 103 4th Ave NW, Minot ND, also known as Oakland Park Addition Lot 8, Block 2, to 110 4th Ave NW, Minot, ND 58703, also known as Ramstad s Third Addition Lot 3, Block 1, subject to the following conditions: 1. A ten-thousand dollar completion bond must be posted with the City of Minot prior to issuance of any permits for this work. 2. Application and approval of building permits for all proposed construction. 3. An approved foundation design in compliance with City of Minot building codes. 4. If required: plumbing, electrical and HVAC systems must be brought into compliance with current code requirements of the City of Minot. 5. All work at the new location must be in compliance with City of Minot building codes and zoning ordinances. 6. The exterior of the structure must be one consistent color arrangement of colors after relocation. 7. PERSONAL APPEARANCES None MAYOR S REPORT Mayor Barney gave an update on the Mayor s Committee On Addiction. He said, on May 26 th, the chairmen of the subcommittees met to make revisions to the Committee s final report. He also attended a Planning Commission meeting that night, where a permit was issued to allow a sober living facility for women. On April 11 th, Minot Public Schools hosted an opioid meeting at Arvel Graving Theater. April 18 th, he sent a letter to the First Lady of North Dakota with a copy of the report. He then read the letter for those in the audience. He thanked Megan Laudenschlager for volunteering to craft the paperwork necessary to secure the $400,000 in grants, Paster Mark Freuh for his coordination with the Pastoral group and Kelly Matalka for taking the minutes and keeping the group organized. He stated, the next step is to release the document on the City s website for public review and comment. He then dissolved the Committee and encouraged the next Mayor to appoint action committees to continue the work and carry out the plan that was developed. He emphasized, this is not a solution to the opioid problem but it is a road map for recovery. He listed the other activities in which he participated including, the ground breaking for Flood Protection on March 28 th, spoke to DBPA regarding the Main Street Initiative on April 4 th, represented the City at MAFB Chief Elliott s retirement, April 13 th, represented the City at the Military Ball, April 14 th, judged Minot Public School student designs for the remodeling of City Hall on April 17 th, represented the City at the MSU Board of Regents meeting, April 20 th, and participated in a podcast with The Minotian, April 25 th. 8 On April 26 th, he represented the City at Minot Police Department s Memorial for Fallen Police Officers. He thanked Aaron Moss for organizing the event and presented him with the Mayor s coin. He continued by saying he represented the City at the Native American Pow Wow at the MSU Dome on April 27 th. He welcomed Boy Scout Troop 416 and Boy Scout Troop 425 who were in attendance at the meeting. He then recognized the Mayor for his leadership in the opioid committee and the outstanding work he did throughout the process. He listed the upcoming meeting dates including, a Park Board Forum on May 9 th, MADC Board meeting, May 10 th, Chamber Board meeting, May 15 th, Minot Public School Board Forum, May 16 th, MAGIC Fund meeting, May 18 th, City Council Forum May 23 rd, and a Mayoral Forum, May 24 th. Due to the Memorial Day holiday, the Planning Commission meeting will be May 29 th as well as the regular Committee of the Whole meeting. May 30 th will also be a Committee of the Whole meting and the City Council meeting will be on June 4 th. Mr. Barry then discussed the FEMA Risk Maps. He stated, a meeting took place last November between representatives of the City, County, U.S. Geological Survey, FEMA, State of ND, and the USACE. They talked about the preliminary maps developed by FEMA as they relate to the floodway and floodplain mapping. The City and County worked with Ackerman Estvold to submit comments to FEMA and the State and another meeting was held in April, to discuss the information. He said, they identified that guidance documents used to development of the preliminary maps were outdated. They petitioned for them to use the new guidance documents and apply the information to floodway mapping, which FEMA agreed to do. They discovered there are several revisions that need to be made and are in the process of revising the flood maps. This will result in improved, more accurate maps for Minot, and will delay the implementation of the maps which will allow us to build up CRS points and advance flood control projects. He still encouraged the community to purchase flood insurance to mitigate any potential flood risk. He then identified some differences between the maps developed June 9 th of last year and the revised maps. The revised maps would reduce the number of impacted structures by 35%. There would also be 167 acres removed from the floodway. A revised preliminary map is expected to come out in December, 2018 after which, a 90 day appeal period will begin around Page 8

9 March, The appeal comments should be provided by August 2019 and a letter of final determination should be available by September The map effective date should occur about six months later in March He emphasized that FEMA states, this is the earliest possible timeframe. He moved on to the High Watermark Initiative, which was created to ensure the community does not forget about the 2011 flood. The plan is to establish about signs in various locations to identify where the flood level was in They held a contest to determine what the signs would look like. Two finalists were chosen and an online poll determined the winner. There will be an unveiling ceremony on or around June 25 th. He briefly described some construction updates going on around town, starting with Phases 1-3 of Flood Control. He mentioned the changes that will affect the public including, relocation of the Bark Park to the temporary location on the north side of 7th Avenue SW. The path atop the existing levee has been closed and removed. There will be a temporary closure of Forest Road and intersection of 7th Avenue SW and 20th Street SW and permanent Road Closures 3rd Ave SW (east of 15th St SW) and Forest Road (west of 16th St). He continued with the Broadway Bridge Replacement. Demolition of the old bridge is 60% complete and construction of the new bridge is underway. The Contractor continues to coordinate with the Railroad and other impacted parties. He mentioned to drivers, there is no left turn on 4 th Ave going west. He also said, the project is currently on schedule for late fall completion. He spoke about the US 83 Bypass and Highway 2/52. He said, there will be major traffic impacts starting May 7, including head to head traffic going north and south on the Bypass, south bound onto US Hwy 2/52 will be just 1 lane: one southbound lane to turn right, left or go straight and only one westbound lane on US Hwy 2/52 at the intersection. The changes may result in some bottlenecked traffic but the work is estimated to take about three weeks. He continued by explaining the 83 Bypass and 4 th Ave NW changes that will take place sometime in May. There will be no through traffic on the overpass. North and south traffic will be head to head on the west on/off ramps. He apologized for the inconvenience. The City Manager went on to describe updates on the latest work for NDR projects. The City is proceeding with substantial amendment for the Gathering Place. Pending Council approval tonight, a public comment period will open tomorrow and the public can find details on the City webpage. The Gap Financing program launched in February and has 18 applicants. There will be a Q & A session on May 8th for the Downtown Multi-Family housing project RFPs. The RFQ for housing design book is being developed and goal is to present it at the June Council meeting. Work continues at Park South and the project should be completed this summer. He said, they are awaiting the proposal submission by the Family Shelter Advisory Group to move forward with the Family Shelter. Mr. Barry then discussed the Acquisition Program by saying, bids were opened and a contractor has been identified for 2018 demolition. The Home Sweet Home demolition will be scheduled following approval of contractor. He also gave an update on the remaining funding for acquisitions. He said, we are watching the funds dwindle quickly as we advance the flood control project. He showed a chart demonstrating NDR dollars spent and dollars remaining for Acquisitions, Relocation, and Demolition. We are looking to petition the State Legislature in the next biennium for more money to be used for acquisitions. We are short about $8-$10 Million for current acquisitions we will need for flood control. He mentioned, the more properties taken off the tax roll the more of a financial burden is put on the City. So far almost $40 Million in tax value have been removed by acquiring properties which places a bigger burden on the properties that remain. He showed a slide of information on the Parking Structures, which listed what work has been completed for the transition of ownership, the work in process, and what work is remaining. He thanked the staff including Lance Meyer and Dan Jonasson for their assistance in putting the transition plan together. He announced, the downtown will be included in the Governor s submission to the U.S. Treasury as a Census Tract Opportunity Zone. The Renaissance Zone program as well as the Opportunity zones make downtown an attractive location for investment. We continue to push to revitalize our downtown. City staff held a public meeting with members of the community affected by the Landfill expansion. There were about 100 residents in attendance and they participated in a discussion on the process moving forward. The City will make sure they identify the issues and respond to the concerns of the community. He stated, it may come as a surprise to a lot of the community but this has been a discussion topic for the past two decades. Documentation back to includes conversations during the Public Works and Safety Committee meetings entertaining an offer for the same property that was recently purchased. We have promised the community that we will look at all options, not only expansion but new siting Page 9

10 options as well. He said, staff appreciates the support of Council in approving a siting and cost comparative analysis. A focus group of community members is being created and additional meetings will take place. Mr. Barry then reported on the Budget Workshops which will take place June 14 th and 21 st from 4:00-6:30. The topics will include Revenue Streams & Expenses, Debt Load, Future Obligations, & Revenue Projections, Understanding Historical and Future Needs, and the Direction for the 2019 Budget. He said, last year focused on education behind the budget but this year will include more time for discussion on how to move forward with the budget. He addressed the summer street sweeping schedule by saying, the city has been divided into quadrants. April 30-May 11: northwest quadrant, May 21-June 1: southwest quadrant, June 4-June 15: southeast quadrant, and June 18-June 29: northeast quadrant. The information is also available on the website. He stated, the Household Hazardous Waste collection will take place Friday and Saturday, May 11 th and 12 th, at Public Works. Residents are encouraged to dispose of oil, paints, stains, old computers, printers, batteries, cellphones, etc. He then said, the Spring Cleanup Week is scheduled for May 14 th -18 th where residents who use City services can get rid of bulky household items such as appliances, furniture and other junk. The City Manager shared information on the Storm Ready Achievement designation that was received for work done in collaboration with Ward County. We are now recognized as a Storm Ready County & Community. In order to receive the achievement, staff had to establish a 24-hour warning point and emergency operations center, have more than one way to receive severe weather warnings and forecasts and to alert the public, create a system that monitors weather conditions locally, promote the importance of public readiness through community seminars, and develop a formal hazardous weather plan, which includes training severe weather spotters and holding emergency exercises. This applies to points on the Community Rating System to reduce the costs of flood insurance premiums. He pointed out that Minot International Airport, under the leadership of Rick Feltner and his team did an outstanding job two years in a row on their FAA Part 139 Certification Inspection. They did not have one single finding for the past two years which demonstrates excellence in operations and safety at the Minot Airport. He moved on to the Fire Department update by saying there are nine new recruits who will be graduating May 25 th at Fire Stations 1. He also announced the retirement of Dean Lenertz, Assistant Fire Chief, who has served 30 years in the Minot Fire Department. The Library, in collaboration with the Inspections Department, held workshops to inform residents in areas such as deck building and sink installation. Mr. Barry concluded his report by giving the Police Department an opportunity to announce some awards. Captain Klug, Vice President of the ND Peace Officers Association, presented the Life Saving Award to Kristian Shaide and Andy Mehlhoff, for saving the life of a woman suffering from an overdose on February 11, Mr. Barry then responded to questions from the Council. He said the ongoing construction this season will result frequent traffic changes so the best way to get that information will be on the City website where updates will be posted every Friday. He then gave an update on Trinity, by saying, all of their bonds were sold as of last year and they are planning for a June groundbreaking. Internal discussions have been taking place to coordinate plan reviews and construction and inspection related activities. He said, the City is not resourced for such a large construction project and therefore a consultant will be working on the project. Alderman Straight updated the Council on a recent trip he took to Rapid City where he was impressed by their Main Street Square, run by Destination Rapid City. He said it is a public gathering space similar to the space we are working on here. He also spoke about the budget and said he wants to make sure staff is compensated but the Council needs to prioritize the options that are available. Alderman Wolsky commented on the method in which street sweeping takes place and suggested the Council consider a policy change during the next Committee of the Whole meeting. Mr. Barry responded by saying, they focus on the major arterials first and they start work early to prevent the sediment runoff from getting into the storm systems. He said he will provide more information to Alderman Wolsky on the current process to see if he still recommends making and changes. Page 10
