1 3MINOT CITY COUNCIL SCHEDULED MEETING July 10, 2017 AT 6:30 P.M. ROLL CALL City Council President Jantzer presiding. PLEDGE OF ALLEGIANCE Members Present: Jantzer, Olson, Podrygula, Sipma, Straight, Wolsky Members Absent: Barney City Council President Jantzer led the City Council in the Pledge of Allegiance. APPROVAL OF MINUTES Alderman Olson moved the City Council approve the minutes of the June 5, 2017 Regular City Council meeting and June 27, 2017 Special City Council meeting. Motion seconded by Alderman Sipma. Alderman Straight made a correction to the June 5, 2017 minutes to reflect that his motion for a declaration on flood control included the entire Souris Valley basin-wide flood protection plan be built to the 2011 flood of record. He listed some benefits of pet snakes and asked why stores are allowed to sell them in City limits but residents are not allowed to keep them. He said he is willing to provide further information if the Council requested it. President Jantzer said he would ask City staff to review the ordinance and provide the pros and cons. Alderman Wolsky moved the City Council direct staff to submit a report for the next Committee of the Whole meeting. Motion seconded by Alderman Straight and carried by the following roll call vote: ayes: Jantzer, Olson, Podrygula, Sipma, PERSONAL APPEARANCES DiAnn Briggs, of th Ave SW, came forward in reference to a letter she submitted to the City. She said she is a member of the rainbow gardens and has noticed problems with an increasing number of deer in the area. She explained how fencing does not prevent the deer from entering gardens and they have destroyed most of the plants. She said she understands there are a lot of people who love the deer but there are too many in town. She added, it can be dangerous for residents who confront the wild animals and they are also involved in vehicle accidents. She sated, she spoke to North Dakota Game and Fish Department, who help control the deer population in Fargo, Bismarck and Mandan. They said they would be willing to help in Minot but need authorization by the City Council. Alderman Sipma said, he believes there is an open bow season in Fargo which may be worth discussing in Minot. He said it would be a contentious issue since so many people consider the deer as pets. He added, as long as there is no burden placed on the taxpayers or the budget, he believes it is something to look into. Alderman Podrygula said he understands deer can be a nuisance and would also like to discuss turkeys with the Game and Fish Department. Page 7

8 Alderman Jantzer thanked Ms. Briggs for her input and said he would direct staff to organize a set of options and have information available for the next Committee of the Whole meeting. Alderman Wolsky suggested the Committee hear directly from the Game and Fish Department on how they deal with these issues. PERSONAL APPEARANCES Michael Carswell, of th Ave NE, requested the Council address the issues surrounding firework usage in city limits. Even though there are ordinances in place, there is a plague of fireworks twice a year. He is a Veteran who suffers from PTSD and has called 911 repeatedly but they cannot help. He said, something needs to be done and suggested setting up a location where fireworks can be used safely. Upon questioning by Alderman Wolsky, the Police Chief stated, he has seen an increase in firework usage in the last five years. This season the department received 75 calls. There is a fine of $150 in place but officers typically give a warning before issuing a citation. Portable signs are set up to notify residents about firework usage. He said the department could step up enforcement but that could involve additional costs in overtime. They could also change the practice of providing warnings and go straight to issuing citations. He explained, the ordinance bans possession in city limits but it is understood that people own them. He said, he has met with the Fire Chief who has also had conversations with Fire Chiefs across the state and they are discussing ways to address the issue, possibly through the legislature. Alderman Jantzer stated, since the ordinance does not produce the result we are looking for, staff can work on the issue going forward. MAYOR S REPORT President Jantzer recognized Boy Scout Troop 416 who was in attendance earning their citizenship badge. APPOINTMENTS AND REAPPOINTMENTS APPROVED Alderman Sipma moved the City Council approve the following Mayoral appointments: Minot Library Board Christine Kramer appointed to replace Susan Gessner with a term to expire June Mayor s Committee on Addiction Lisa Clute First District Health Unit CITY MANAGER S REPORT The City Manager listed important dates for the month of July and beginning of August including the Souris River Joint Board meeting, July 13 th, the City of Minot 130 th Birthday celebration, July 16 th, FEMA Risk Map CCO meeting, July 17 th, Floodplain map Open House, July 19 th, Community Development Committee meeting, July 20 th, the Developer s Forum, July 24 th and the standing committees August 1 st and 2 nd. He continued by giving updates on the construction taking place around the City. The Broadway Bridge has demolition 90% completed and crews are working on tying infrastructure at Broadway and Central. One block has opened on 1 st Ave SW on the Downtown Infrastructure project. Several more will be opened throughout July and he reminded those in attendance that downtown is open for business throughout the construction season. The 83 Bypass has crews working on the water main on 21 st Ave NW and the Bypass expansion is progressing just west of the current highway. Crews poured the first concrete section at 9 th Street on the Burdick Expressway Reconstruction project. The intersection is expected to be open by July 18 th Page 8

9 in time for the State Fair Parade. He also mentioned the detours through Valley Street and said the Zoo s entrance has been rerouted to 11 th St and remains open. The City Manager described the FEMA Preliminary Risk Maps and said there has been an expansion of the 100 year floodplain to include approximately 3,200 additional parcels. The new maps will mandate flood insurance for any property with a federally backed loan and will take effect summer Links to the maps can be found on the City website and there will be a meeting with the Consultation Coordination Officer on July 17 th. Flood Control and Protection measures are underway as the design of phases 1-3 of the flood protection project are progressing. The City is participating in the Community Rating System which currently offers a 10% discount on premiums and staff is working diligently to increase the discount. Mr. Barry encouraged everyone to attend the next public meeting which will take place on July 19 th where FEMA, the State Water Commission, County and City Officials will be present to answer citizen questions. Mr. Barry described the training that is taking place on the Water Treatment Plant Hazard Mitigation closures. Over 30 employees were involved and took more than two hours to complete. He said, there will be over 20 closures to attend to throughout the valley in preparation for a flood event. Each closure takes about 2-4 hours and there will be another training session on July 17 th. The City was awarded close to $1 Million from the State Water Commission to update the existing levees. The U.S. Army Corp identified areas of improvements which will cost a total of roughly $2 Million. Plans and specifications for Phases 1-3 of the Flood Protection Project will come through City Council in August and will be out to bid in the fall of The Mayor met with Cypress Development representative, Steve Larson, on June 27 th. Unfortunately the two parties are too far apart on many issues. The City is now evaluating available options and advancing the project closeout for both of the ramps. The punch list items and removal of the cranes are moving forward. The City expects to receive a proposal from Cypress in the next week or two regarding an ownership restructuring offer. The City Manager said he would communicate more information when it is available. The NDR projects are progressing nicely. Buyouts and Acquisitions are still underway with demolition and reseeding taking place. There is about $9 Million remaining out of the $20 Million for the program. The Downtown gather space is proceeding. Staff is also trying to get funding for the Brownfield Advisory Board to assess various sites downtown and determine if contamination exists on those sites. The Program Manager will meet with the vulnerable population groups to help to refine and improve the Family Shelter RFP before it is published. The HUD required environmental review for the Affordable Housing project will be done on August 15 th. After that, the developer agreement is expected to be executed in order to start the project. The City Manager discussed the implementation of automated trash collection which will begin July 17 th. He stated, the collection schedule remains unchanged. There will be six trucks in operation and the cans include RFID tags to identify the address to which the can belongs. He stated, the program will save the City $500,000 annually. Training and communication has been taking place since late May and citizens can find a list of frequently asked question on the website. Mr. Barry said, City staff is working with Minot Association of Builder s to talk about development in the City of Minot. The goals are to improve relationships between the developers and City staff, build understanding and think creatively about some of the challenges going on, improve processes and outcomes to create more streamlined projects going forward. He said, the Forum will take place July 24 th from 2:30-4:30 at the Auditorium. He gave a quick preview of the City s budget, by saying this will be a particularly difficult budget year. He showed a graph of sales tax revenues and emphasized how, in the past, the City has used variable revenues, in the form of sales tax, to offset fixed costs. When that source of revenue does not do well, the fixed costs need to be covered by other sources. He showed examples of the impacts the decrease in revenue has had and explained there is a gap of about $7.8 Million or 41 mills in the general fund. That gap comes from a combination of factors including property tax valuation reductions, general fund revenue reductions, emergency fund replenishment from snow removal this past year, unfunded pension liability, and potentially enhancing snow removal in the next budget. A preliminary review of utility rates shows we don t expect rate increases in storm sewer, sanitation or water but a possible increase of sewer by 5-8%. Page 9

10 In order to advance the budget under these conditions, the City will reduce available staff positions, reduce capital purchases, delay capital projects and reduce operating costs. All of the details will be discussed during the budget deliberations. The challenges going forward will be maintaining current service levels, flood control, NAWS and other projects to be discussed at the budget meeting. The City Manager continued by describing the Community Facilities Fund Applications which will be discussed at the meeting on Thursday, July 20 th. He said, the total of all nine submitted requests is $11.9 Million but he added, some applications may not meet eligibility requirements and would be removed from consideration. He gave some updates on improving communication through social media and the City newsletter. The Facebook page has 7,666 followers and posts average between 2,500 and 7,500 views. The Newsletter has 1,120 subscribers with an open rate of 45.3% which is above the industry average of 30.2%. The Police Chief came forward to present an award to Officer Josh Noyes. He said, Officer Noyes responded to a shooting incident in January where he assessed the situation and provided first aid to the victim with the help of citizen, David Wiley. Captain John Klug, Vice President of the North Dakota Peace Officers Association presented awards for lifesaving to Officer Noyes and Mr. Wiley. Mr. Barry then discussed the upcoming 130 th Birthday Celebration which will take place on Sunday, July 16 th. Thanks to the generous support of some sponsors including the Park District, MACA, Minot City Band, SpartanNash, and Pepsi, the City was able to put together a birthday party to be held in conjunction with Arts in the Park. He said there will be a variety of entertainment, free food and a 13 decade history display. He invited everyone to attend. He concluded by talking about a recent contest in which the employees of City Hall decorated their office doors for the chance to win a prize. Alderman Sipma reemphasized the importance of the meeting taking place on July 19 th. He encouraged the community to attend especially if they are located in the floodway and need to find out the new rules regarding what s allowed for construction. Alderman Straight asked if there are other ways to reach people who may not be aware of the upcoming flood map changes. The City Manager said, he wants to reach as many people as possible which is why he held a press release the week before. He said FEMA is also helping to get the word out along with the Public Information Officer, the use of social media and newsletters and support by City staff. He stressed the importance of the meeting to the community. SUBDIVISION OF CENTERFIELD ADDITION, LOTS 1 & 2 APPROVED Alderman Olson moved the City Council subdivide Outlot 3 less Sublot A, SW¼ & Outlot 11, Section , into two lots to be known as Centerfield Addition, Lots 1 & 2. The growing facilities would likely be very large and would be used to manufacture and process large quantities.
