1 CITY OF LEON REGULAR COUNCIL MEETING THURSDAY, JUNE 11, :00 p.m. The Leon City Council met in Regular Session on Thursday, June 11, 2015 at Leon City Hall. Mayor Simmonds called the meeting to order at 7:00 p.m., with roll call being taken and the following Council Members in attendance: Troy Armstrong, Sharon South, Sue Kelly and Joe Stephens. Absent: Elmer Armstrong. Others in attendance for all or a portion of the meeting included: Gregory Crocker, Leah Price, Heath Housclen and Ashley Greene. Motion Armstrong/South for approval of the Regular Agenda. Roll call. Ayes: Armstrong, South, Kelly, Stephens. Motion carried. Motion South/Armstrong for approval of the Consent Agenda items as listed: May 27, 2015 Regular Meeting Minutes, Claims, Financial Reports, Transfers to Water and Sewer Reserve Funds and Department Reports. Roll call. Ayes: Armstrong, South, Kelly and Stephens. Motion carried. City Administrator Crocker informed the Council that the damaged police car has been repaired and is back in service. Crocker also advised that the park and pool board had met and held a brief orientation with this year s pool staff. Administrator Crocker informed the Council that he and Council member South have agreed to serve on an ad-hoc committee in an effort to address the problems and issues with the meal site. Leah Price and Heath Housclen were in attendance representing the Optimist Club of Leon. They informed the Council about the Avenue of Flags program they would like permission to begin in the City of Leon. Motion South/Stephens to approve the Optimist Club of Leon s request to proceed with the Avenue of Flags program. Roll call. Ayes: Armstrong, South, Kelly, Stephens. Motion carried. Administrator Crocker put forth a resolution stating that the City of Leon would join the Southwest Iowa Safety and Support Group for safety training for City employees. Motion Armstrong/Kelly to approve Resolution A Resolution Agreeing to Become a Member Of the Southwest Iowa Safety and Support Group for the City of Leon, Iowa Roll Call. Ayes: 1

2 RESOLUTION NO A RESOLUTION AGREEING TO BECOME A MEMBER OF THE SOUTHWEST IOWA SAFETY AND SUPPORT GROUP FOR THE CITY OF LEON, IOWA WHEREAS, The City of Leon desires to provide safe working conditions for its employees, minimizing accidents and reducing risks and losses; and WHEREAS, a comprehensive safety program, including written policies of the City are a necessary part of providing safe working conditions and minimizing accidents, risks and losses; and WHEREAS, a written plan for the formation of the Southwest Iowa Safety and Support has been prepared; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF LEON, IOWA: 1. That management is hereby authorized to participate in the Southwest Iowa Safety and Support (SWISS). 2. Gregory B. Crocker is appointed as the delegate to SWISS. 3. Lorrie Scrivner is appointed as the alternate to SWISS. 4. The City Administrator/Clerk is also authorized to replace delegates as needed. PASSED AND APPROVED THIS 11th DAY OF June City Administrator Crocker briefed the Council regarding the negotiations with the Chief of Police candidate pertaining to salary. Crocker informed the Council that the previously approved salary of $45,000/year was not acceptable to the candidate. Crocker stressed the qualifications of the candidate and the numerous challenges of the positon. Motion Kelly/Stephens to approve a salary range of $55,000-$60,000/year for the Chief of Police. Roll call. Ayes: Armstrong, South, Kelly, Stephens. Motion carried. Administrator Crocker presented an employment agreement with Frederick Smith to accept the position of Chief of Police with the City of Leon, Iowa. Motion Kelly/South. Roll call. Ayes: As directed by the Council at the May 27, 2015 meeting, Administrator Crocker presented Resolution Early Retirement Program to the Council for consideration. Motion Kelly/South to approve Resolution pending approval of legal counsel. Roll call. Ayes: 2

3 RESOLUTION CITY OF LEON EARLY RETIREMENT PROGRAM WHEREAS, state and federal law permit the adoption of early retirement programs to encourage employees to retire; and WHEREAS, it is the City of Leon s intent to provide financial advantages for those who are near retirement and to enable the City of Leon to maintain staffing, as it deems necessary, without disrupting the careers of other employees who wish to stay with the City of Leon; and WHEREAS, the early retirement program is designed as a one-time voluntary incentive window to allow the City of Leon flexibility to meet its strategic goals and human resource needs, while offering economic benefits to the employees that participate in the retirement program. THEREFORE, BE IT RESOLVED by the City Council of the City of Leon, Iowa that the following early retirement program be established and implemented for those qualified employees submitting early retirement applications to the City Administrator by 4:00 p.m. on July 15, The program shall be implemented as follows: 1. The following eligibility criteria must be met in order for an employee to be eligible for early retirement incentive: a. An employee must have reached the age of sixty (60) and have completed twentyfive years of continuous service with the City of Leon, Iowa as of July 1, Employees eligible to retire in accordance with the criteria set forth herein will be provided a supplemental cash incentive payment equal to three hundred percent (300%) of the yearly current cost of a single person health premium under the City s current health plan. 3. The retirement incentive will be paid in three (3) installments between August 1, 2015, and another installment every twelve months thereafter for the final installment. 4. The payments will be made in the name of the employee. In the event of the death of the retiring employee prior to the completion of the installment payments provided herein, the remaining installments shall be paid to the devisees, heirs or successors in interest of the deceased retiring employee on the same basis that the employee survived. 5. Employees participating in the supplemental retirement incentive program will have an effective retirement date of September 1, Retirement benefits offered to City of Leon employees shall be made to early retirement employees under this program under the same terms and conditions provided to employees retiring under normal conditions. 7. Payment of the early retirement incentive is made solely as an inducement for and consequences of retirement and is not remuneration for employment and is not a continuation of the person s salary and is not to be construed as wages as defined by state and federal law. 3

Early retirement applications may be submitted beginning at 8:00a.m.on July 1, 2015, and must be submitted no later than July 15, Applications received after 4:00 p.m. on July 15, 2015, will not be eligible for early retirement incentives. The retirement application must be accompanied with a letter of resignation designating the employee s retirement date of September 1, The City of Leon reserves the right to limit the number of applicants approved for early retirement incentive. Application considerations will be based upon the date and time of receipt at City Hall. Applications will be acted upon in the order they are received, on a first-come, first-served basis. In the event that two retirement applications are received on the same date, a blind drawing will be held to determine the order in which the applications will be processed. 10. The City of Leon is the sole interpreter of all issues of interpretation arising under this policy regarding the early retirement program, including but not limited to issues of eligibility, timing of application and benefit calculation. PASSED AND APPROVED this 11th day of June, 2015 Administrator Crocker presented Ordinance An Ordinance Changing the Dates of City Council Meetings. Motion Kelly/South to approve the first reading of Ordinance Roll call. Ayes: Administrator Crocker informed the Council of a citizen that has asked that an alley near his property be vacated. The alley is located between South Main and Southeast Idaho Streets on the 200 block. The City crew has looked at the alley and no City utilities are located there. Motion Kelly/South to approve the beginning of the vacating process. Roll call. Ayes: Armstrong, South, Kelly, Stephens. Motion carried. As there was no further business to come before the Council, Motion Armstrong/South to adjourn at 7:18 p.m. Roll call.
