Mayor's Remarks Mayor Frances Smith thanked Deputy Mayor Brent Cameron for the past years service. Mayor Smith attended the Seniors Housing Committee meeting. Santa Claus parades were held this past weekend and the floats were excellent, both parades went well. The Festival of Trees was also well attended Mayor Smith announced that the Land O'Lakes Tourist Association held a meeting yesterday and dissolved the Association. Delegations/Presentations Hinchinbrooke Community Centre Committee A presentation was received from the Hinchinbrooke Community Centre Committee Motion #: Moved By: Seconded By: Victor Heese Jamie Riddell WHEREAS, the Township of Central Frontenac has been awarded a grant in the amount of $2,597 from the Community Foundation for Kingston and Area; AND WHEREAS, the grant combined with the $2,000 Council approved on September 12, 2017, will allow the Committee to proceed with building a business plan to develop the former Hinchinbrooke Public School into a recreation and cultural centre for the entire community. AND WHEREAS the Committee received two quotes, one from Queen s Business Consulting in the amount of $4,000 (which was a verbal quote only); and the second was from Social Focus Consulting in the amount of $5,000; AND WHEREAS the committee is recommending to Council to hire Social Focus Consulting, headed by John Paul desilva; NOW THEREFORE, Council hire Social Focus Consulting in the amount of $5,000 to complete a business plan for the former Hinchinbrooke Public School as recommended by the Community Centre Committee. 10. 12 EASTERN ONTARIO TRAILS ALLIANCE Thursday, December 14 th, 2017 at 10:00 AM Minutes from Board Meeting DRAFT In Attendance: Cindy Cassidy-EOTA, Erica Graham-EOTA, Dave Gerow-Havelock Belmont Methuen, Graham Blair- Hastings County, Dan Hughey-Carlow-Mayo, Wayne Wiggins-Town of Bancroft, Rick English-Mun. of Trent Hills, Robert Sararas-Centre Hastings, Jen Bennett-Marmora and Lake, Brian Campbell-Lanark County, Alex Walder- Hastings Highlands Absent: Tom Dewey- Central Frontenac, Joan Barton Mun. Highlands East, Bill Blenkinsop- OFSC, Andy Anderson- Addington Highlands, Jeremy Solmes- Stirling-Rawdon Welcome and Introductions: Chair, Dave Gerow, welcomed everyone and called the meeting to order. Minutes: A spelling mistake was shown on page 2 under correspondence. This will be fixed by EOTA. Motion to approve minutes made by Robert, seconded by Graham, carried. Business Arising: No response from OTC on membership fee. Dan Hughey to request an update at next meeting. Financials: Anticipated budget for December 2017-December 2018 was provided by Cindy. The Financial Statement for 2016 was also provided in the package. Everyone agreed to take the information away and review, and will discuss at January board meeting. Cindy will be applying for a $150,000 grant from North Hastings Community Features by Monday December 18 th, Cindy to look into staff pay for cost of living increase as requested by Dave. Alex questioned why a surplus in 2016 would not be put into a reserve. Bert and Cindy explained that as a Not-for-Profit organization, the EOTA reserves should be put into the next year budget. Cindy advised she is also working to have the Trans-Canada trail provide more funding. Motion to receive the financials made by Dan, seconded by Graham, carried. Correspondence: Motion passed in September for license from Municipality of Centre Hastings, Dave signed and it will be returned. Lanark County asked for letter of support for RED funding, which Cindy provided. Letter from the Campbellford Hospital for the councillor that passed away was read. There was also a letter of thanks from the family for the donation made by the EOTA. Municipality of Centre Hastings has received $25,000 from the Commuter Cycling Program and has added into their budget another $184,000 for their bridge project. Recreational Cycling funding should be coming through in Renfrew County has also received some funding for trials. Trent Hills has donated money for special projects for the fire department. Old Hastings Snow Riders sent letter regarding brushing for the main trail to Coe Hill. Cindy has advised there is no funding available at this time for that, but RED funding will be used in the spring for grading and other projects in that area. A newsletter was handed out to each board member, prepared by Erica Graham. Dave requested the newsletter also be ed out to all municipalities with a Thank You from the EOTA for appointing representatives for their council to the EOTA board. Cindy advised she would handle sending out the . Motion to approve correspondence made by Rick, seconded by Graham, carried. 13 EOTA Board Meeting Thursday December 14 th, 2017 Page 2 Map: The new map was shown to the group. Cindy advised everyone to have a look and any changes that need to be made to be sent to her by . Lanark County advised that Council has provided another $20,000. A 5 KM stretch has been cleared and culverts put in, this was finished up last Friday. A formal report will be provided at January meeting with photos. New signage will also be put up in the spring. A request has been made that Cindy attend in the spring to view the changes. Website and Special Events Presentation: Erica Graham presented a look at the new website, and also a list of events and other advertising things she would be working on during her employment with the EOTA. Other: A couple councillors advised they have received s regarding the interactive map on the website not working. The EOTA has also received an regarding this. Testing has been done by staff and everything has testing as working fine. Cindy has requested that any s regarding this be sent to the EOTA as soon as possible so it can be looked into. January meeting has been set for 2 nd week of January, Thursday January 11 th, 2018 at 10:00 AM at the EOTA office. EOTA manages a growing, high-quality trail network, targeting a diverse group of outdoor recreation activities. EOTA trail network is a regional tourism destination that supports local business and communitie s within its area of service. EOTA s diversified funding model is designed to support the trail network on an ongoing basis. All EOTA activities are actively supported by partners within the service area, and EOTA supports provincial advocacy efforts. 18 Frontenac Heritage Festival Committee Meeting November 14, 2017 Present: Sam Jarvis, Janet Barr, Joan Hollywood, Rob Moore, Mike Procter, Ronda Noble Absent: Cindy Kelsey The meeting was chaired by Mike Procter. Ronda Noble submitted the Minutes of the previous meeting, which were approved. Items Covered: Signage: Mike talked to Roger McMunn. He will drop the signs down to this location. Roger suggested Bill Young take over to do the sign installations. He thought there were more flags out there and perhaps some in Crow Lake. Fund Raising Letter: Rob Moore indicated he would take over the responsibility of the fundraising. He submitted a letter for approval and indicated he would be personally delivering all the letters. Ronda will try to obtain a pamphlet of the businesses in the Arden area for Rob. Tax Insert for Brochure: The costs for 5000 brochures were $ to make them up, plus $ for one half page advertising and the Thank You in the newspaper another $ Janet Barr will look into getting the insert to the township to put in with the tax mailing. It was decided that we would not have the lottery this year. Contact Participants: Janet Barr will contact Paddy O Connor to see if he will do the Opening Ceremony. It was suggested that we would have the Young Choristers would also appear at the opening night at the school and Rob Moore will contact Christina Witherspoon, their leader, to enquire. Sam Jarvis also mentioned that he has a neighbor who plays bagpipes and maybe we could incorporate that in to the program as well. Venues: Sam Jarvis has booked the Oso Hall, Ronda Noble has booked the Kennebec Hall and Rob Moore has booked the foyer of the High School as well as the auditorium. Waivers: Still working on this issue. Liaise with Township Staff: Rob has been in contact with Sam Arraj of Seeds & Company. He has volunteered himself and his staff to reach out and work on the financials. Ronda will ask Cindy Kelsey to try to see if she would request a $ donation from Township Council and Ronda will also send an to Janet Gutowski to see where the monies are kept, either in an account or kept by someone at the Township Office. It was further stated that we have a number of ways to advertise without using the newspaper. We can use Facebook as a way to advertise; there are a number of different websites to get our message out. We will provide Sam with the various ways to advertise. Sam has requested that we send him something specific within the next 2 weeks where we want something advertised for the Festival. 19 Janet Barr volunteered to contact the schools and let them know there is a colouring contest. The theme of which is Winter at Home. Those schools are GREC, St. James, Land O Lakes, Clarendon and Verona. She will meet with the staff to discuss the various age categories and prizes. The Photo Contest theme will be Winter in the Frontenacs. Other Events: Joan Hollywood touched base with the Chairperson of the Rec 4 committee from Parham who let her know they will be having Bavarian Curling at the Tichborne Rink at 11:00 am. He has stated that is what they would like to do but will confirm closer to Christmas. Joan also contacted Lesley at Rec 3. She indicated to Joan he was interested in some kind of snow event which would happen at the ball field. She thought perhaps late morning on the Monday and she would contact James Kelly at the Child Care Center to get snowshoes. There was also some talk of broom ball. The other event that came up was possibly having a family movie on the Sunday later in the afternoon where we could announce the winners of the Colouring Contest. She will make contact with the Child Centre to see if they are going to do something for the children and let us know at the next meeting. Camping: Mike Procter said there is an article to go in the paper outlining that they are going camping. He said he can accommodate 8-10 people and the overnight will be on the Sunday night. Sam indicated he knows an individual who has recently moved in to our area, Kirk Chabot, who would be willing to help Sam in any way he needed him. Rob has Brian Roche, Sherry Whan and Mike Procter to do the judging. The canteen is procured. Jeff Simon will do the lights. The event will take place from 7-9 pm on Friday night at GREC. Kim from the Food Bank and some other volunteers from the Food Bank will work at the door. Janet Barr reported that the Polar Bear Plunge will have a Canteen like last year. Rob will ask staff and provide coffee. Sam needs all information in for posters by the end of December. For the brochure, the second week of January would be the deadline. Changing to a 3-hour at regular time on-call regime will prove to be cost prohibitive. We request that the Government of Ontario provide an exemption from article s for all municipal employees who are required to be on-call to provide statutorily mandated public safety services. 36 THE CORPORATION OF THE TOWNSHIP OF CENTRAL FRONTENAC BY-LAW # Being a by-law to authorize borrowing from time to time to meet current expenditures during the fiscal year ending December 31, 2018 WHEREAS pursuant to Section 8 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act; AND WHEREAS pursuant to Section 5(3) of the Municipal Act, 2001, S.O. 2001, c25 as amended, a municipal power, including a municipalities capacity, rights, powers and privileges under Section 8, shall be exercised by by-law unless the municipality is specifically authorized to do otherwise; AND WHEREAS Section 407 of the Municipal Act, 2001, S.O. 2001, c25 as amended provides authority to borrow from time to time such sums considered necessary to meet, until taxes are collected and other revenues are received, the current expenditures of the Corporation for the year, and AND WHEREAS the total amount which may be borrowed from all sources at any one time to meet the current expenditures of the Corporation, except with the approval of the Municipal Board, is limited by Section 407 (2) of the Municipal Act. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF CENTRAL FRONTENAC ENACTS AS FOLLOWS: 1) The head of Council and the Treasurer are hereby authorized to borrow from time to time by way of promissory note or bankers acceptance during the year 2018 (hereinafter referred to as the current year) such sums as may be necessary to meet, until the taxes are collected and other revenues are received, the current Expenditures of the Corporation and the other amounts that are set Out in Subsection 407 of the Municipal Act. 2) A promissory note of bankers acceptance made under Section 1 shall be signed by the head of Council or such other person as is authorized by bylaw to sign it and by the Treasurer. 3) The lenders from whom amounts may be borrowed under authority of this by-law shall be the Royal Bank of Canada and such other lender(s) and reserve funds of the municipality as may be determined from time to time by resolution of the Council 4) The total amount which may be borrowed at any one time under this by-law, together with the total of any similar borrowings that have not been repaid, shall not exceed from, January 1 st until September 30 th of the current year, 50 percent of the total of the estimated revenues of the Corporation as set out in the budget adopted for the year. Such borrowing shall not exceed, from October 1 st until December 31 st of the current year, 25 percent of the said estimated revenues of the Corporation as set out in the budget adopted for that year. Until the budget is adopted in a year, the limits upon borrowing shall temporarily be calculated using the estimated revenues of the municipality set out in the budget adopted for the previous year. For purposes of this by-law, the estimated revenues of the Corporation shall not include revenues derivable or derived from (a) borrowings or issues of debentures, or (b) a surplus, including arrears of taxes, fees or charge, or (c) a transfer from the capital fund, reserve funds or reserves. 37 5) The Treasurer shall, at the time when any amount is borrowed under this by-law, ensure that the lender is or has been furnished with a certified copy of this by-law, a certified copy of the resolution mentioned in Section 3 determining the lender if applicable and a certified copy of the estimates of the Corporation adopted for the current year and also showing the total of any other amounts borrowed from any and all sources under authority of Section 407 of the Municipal Act that have not been repaid. 6) That the Treasurer is hereby authorized to temporarily borrow from the reserve(s)/reserve funds of the Corporation sums as may be necessary to meet the current operating expenditures of the Corporation. 7) This by-law shall come into force on the passing thereof. 38 AGENDA ITEM #b) THE CORPORATION OF THE TOWNSHIP OF CENTRAL FRONTENAC BY-LAW # A By-law to provide for an interim Tax Levy and to provide for the payment of taxes and to provide for penalty and interest of 1.25% per month. WHEREAS Section 317(1) of the Municipal Act, 2001, S.O. 2001, c 25, as amended, provides that the Council of a local municipality, before the adoption of the estimates for the Year 2018, may pass a by-law levying amounts on the assessment of property in the local municipality ratable for local municipality purposes; and, AND WHEREAS Section 317(3)(1) of the Municipal Act, 2001, S.O. 2001, c25, as amended, provides that the amount levied on a property shall not exceed the prescribed percentage, or 50 per cent if no percentage is prescribed, of the total amount of taxes for municipal and school purposes levied on the property for the previous year; AND WHEREAS Section 345 of the Municipal Act, 2001, S.O. 2001, c25, as amended provides that penalty and interest, not to exceed 1¼ % of the taxes due and unpaid may be charged; NOW THEREFORE THE CORPORATION OF THE TOWNSHIP OF CENTRAL FRONTENAC HEREBY ENACTS AS FOLLOWS: 1. That an interim tax levy for all property classes within the Township of Central Frontenac is hereby imposed at a rate of 50% of the 2017 taxes levied. 2. That an interim tax levy be imposed on all capped properties at 50% of the property s 2017 final adjusted taxes. 3. That the said interim tax levy shall become due and payable in installments as follows: Fifty percent of the interim levy rounded upwards to the next whole dollar shall become due and payable on the 22 nd day of February, 2018 and the balance of the interim levy shall become due and payable on the 19 th day of April 2018 and nonpayment of the amount on the date stated in accordance with this section shall constitute default. 4. That a penalty of one and one-quarter percent (1.25%) per month shall be imposed on the first day of each month following default of payment. 5. That interest of one and one quarter percent (1.25%) per month shall be imposed on the first day of each month following the end of the year for which the taxes were levied. 6. That penalties and interest added on all taxes of the interim tax levy in default shall become due and payable and shall be collected forthwith as if the same had originally been imposed and formed part of such unpaid interim tax levy. 7. That the collector may mail a written or printed notice specifying the amount of taxes payable, or cause the same to be mailed to the residence or place of business of such person indicated on the last revised assessment roll, unless the taxpayer directs the Treasurer in writing to send the bill to another address. 8. That the taxes are payable in Canadian Funds only to the Township of Central Frontenac Municipal Office, Sharbot Lake, Ontario through telebanking, Internet banking, Virtual municipal office, at any Canadian bank, or by Preauthorized Payment. 9. This by-law shall come into force upon its passing. 39 AGENDA ITEM #c) THE CORPORATION OF THE TOWNSHIP OF CENTRAL FRONTENAC BY-LAW NO BEING A BY-LAW TO APPOINT A COMMITTEE OF ADJUSTMENT WHEREAS, Section 44 of the Planning Act, Chapter P13, R.S.O. 1990, as amended, authorizes the Municipal Council to pass a by-law to constitute and appoint a Committee of Adjustment for the Township of Central Frontenac. AND WHEREAS, the Committee shall be composed of not fewer than three. THEREFORE, the Municipal Council of the Township of Central Frontenac enacts as follows: 1. That the Committee of Adjustment shall consist of all elected officials of Council. 2. That the Committee shall elect one of themselves as chair, and when the chair is absent through illness or otherwise, the Committee may appoint another member to act as acting chair. 3. That the Development Services Assistant be the Secretary-Treasurer of the Committee of Adjustment, with the Clerk Administrator as the Assistant Secretary-Treasurer. The Secretary-Treasurer shall keep on file minutes and records of all applications and the decisions thereon and of all other official business of the Committee. 4. That, in addition to complying with the requirements of the Planning Act, the Committee shall comply with such rules of procedure as are prescribed. 5. That the Committee of Adjustment, upon the application of the owner of any land, building or structure affected by any by-law that is passed under Section 34 or 38 of the Planning Act or a predecessor of such sections, or any person authorized in writing by the owner, may despite any other Act, authorize such minor variance from the provisions of the by-law in respect of the land, building or structure or the use thereof, as in its opinion is desirable for the appropriate development or use of the land, building or structure, if in the opinion of the Committee the general intent and purpose of the by-law and of the Official Plan, are maintained. 7. Pursuant to section 54 (2) of the Planning Act R.S.O. 1990, the authority to grant consent shall be delegated to the Committee of Adjustment. 8. This by-law shall repeal By-law # and become effective upon its passing.
