1 The Marion County Commission sat in regular session pursuant to its adjournment on Wednesday, February 1 st, Present were Commissioner Elliott, Commissioner Garcia, Commissioner VanGilder were in attendance Sabrina Haught led the Court with a prayer. Jesse Corley led the Court with the Pledge of Allegiance. President VanGilder called the meeting to order. The proceedings of Wednesday February 1 st, 2017, together with those had and done under the supervision of Janice Cosco, Clerk and Recorder for the Marion County Commission February 2 nd, 3 rd, 6 th, 7 th, 8 th, 9 th, 10 th, 13 th, 14 th, 15 th, 16 th, 17 th and 21 st, 2017 were approved as submitted and signed. Commissioner Elliott moved to dispense with the reading of the minutes of Wednesday, February 1 st, 2017 and accept them as presented. Commissioner Garcia seconded. President VanGilder concurred. For the record, notes Mark Trach, Assessor presented to the County Commission the following Exonerations for approval. Dated February 22 nd, 2017 Nos. # through # Pursuant to the recommendation of Mark Trach, Assessor and approval of Patrick Wilson, Prosecuting Attorney; Commissioner Elliott moved that the President sign Nos. # through # Commissioner Garcia seconded. President VanGilder concurred. The Commission received an Order of Probate of Wills from the County Clerk s Office for the month of January, County Administrator Kris Cinalli stated that this Order is a list of Estates in which have been admitted to Probate in the County Clerk s Office, in vacation of the Commission, from January 1, 2017 through January 31, 2017 pursuant to West Virginia Code , as amended. 1

4 Commissioner Elliott stated that hearing no objection moved that the Commission sign the Order. Commissioner Garcia seconded. President VanGilder concurred. This day came David A Glance, Fiduciary Supervisor for Marion County, West Virginia, and presented to the Commission His Report of Claims and First and Final Settlement Reports for the following estates which reports he has filed in the Office of the County Clerk of the County Commission, pending confirmation. There being no further objections received to these reports and no errors appearing, the Report of Claims and First and Final Settlement Reports are hereby ratified, confirmed and approved. 4

5 At a Regular Session of the County Commission of Marion County, West Virginia, continued and held February 15 th, This day came David A. Glance, Fiduciary Supervisor for Marion County, and presented to the County Commission the Waivers and Applications for Short Form Settlements, Proposed Settlements and Annual Settlement Reports filed by the personal representatives of the following estates, which he has reviewed and approved and which are the same estates which were advertised for proposed settlement in the February 7 th, 2017, issue of the Fairmont Times West Virginian, all in accordance with West Virginia Code 44-3A. 5

The Commission received a request for advice and consent from James C. Riffle, Sherriff, to hire Jack O. Flint, III as Deputy, full time with benefits, to be effective February 21,

President VanGilder concurred. The Commission received a request for advice and consent to hire Loretta Gillespie to fill dispatch position vacated by Chris Griffith, effective February 6,

9 Commissioner Elliott moved that the Commission grant its advice and consent to hire Loretta Gillespie to fill dispatch position vacated by Chris Griffith, effective February 6, Commissioner Garcia seconded. President VanGilder concurred. The Commission presented the appointment of Zana Nesselrotte to the NCWVCAA Board. Commissioner Elliott moved that the Commission appoint Zana Nesselrotte to the NCWVCAA Board. Commissioner Garcia seconded. President VanGilder concurred. For the record, note the Commission received the Grant Adjustment Notice from the West Virginia Community Corrections Grant Program; (17-CC-10) our Day Report Program to change three employees to be funded by grant funds. 9

11 The Commission received a request for funding for the Veteran s Appreciation Day Tuesday, June 6, 2017 at Palatine Park. Commissioner Elliott moved that the Commission appropriate $1, from the Hotel/Motel Fund. Commissioner Garcia seconded. President VanGilder concurred. The Commission received the Results of Bright Futures for Marion County Students field trip day. Lauren Prinzo came before the Commission and presented a short detail of the events that took place at the Bright Futures field trip. 11

12 For the Record, note the Marion County Commission received from the West Virginia State Auditor s Office the Marion County FY Certified Apportion values of the Public Utility Property located in Marion County. The Commission presented the Opening of proposals for sliding door entrances. The Commission received 4 bids to be opened and was by the Commissioners; the bids are as follows: Company Bid Amount May Contracting $36, Stanley Access Technologies $35, Automated Entrance System Inc. $39, Allegheny Entrance $32,

13 President VanGilder asked for a review of the submitted bids to compare each that all companies are bidding on the same equipment and plans. Commissioner Elliott moved that the Commission refer the bids to the County Administrator Kris Cinalli and County Attorney Chuck Shields to see if they meet all the requirements of bid package. Commissioner Garcia seconded. President VanGilder concurred. George Belloni wanted to thank the Commission for their support of Veteran s Appreciation Day Tuesday, June 6, 2017 at Palatine Park. He added that Bob Evans is assisting by donating a percentage of day s sales on two occasions in March and April to the event. Mr. Belloni stated that any leftover funds will be donated to the Korean War Memorial. Jesse Corley presented an update on the Marion County Solid Waste and thanked the Commission for all of their support. He added that the Brownfield Representative is coming in to see what type of development can occur on the property they own which is approximately 300 plus acres. Chris McIntire spoke on the funding for the 911 Center in that they receive from the phone company $2.25 per land line in the County. He added that those phone lines are decreasing rapidly; therefore, their revenue is down. He along with others Centers throughout the State are proposing legislation this session in Charleston to change the fee from the phone companies to electric companies. He continued that they have been in contact with the Power Companies and there does not seem to be an issue transferring to them. He added that the y will also receive the 3% handling fee that the phone companies receive in processing the 911 Fee. Chris added that Belinda Biafore has been a great asset in this process along with Mike Caputo and Bob Beach. He added that without this change there will be a growing shortfall in revenue that will fall back to the Commission for funding. The Commissioners were supportive of this endeavor and are in favor of seeing and assisting in this matter. Frank Jarman from the Family Resource Network presented a handout on a community meeting at White Hall Municipal Building to cover among other topics prevention prosecution of drug related issues. He asked that the Commissioners attend for their support. He also stated that there will be a Hero Awards Dinner on April the 2 nd in which the Commissioners are asked to attend honoring such as Tim Manchin, Natalie Tennant and Mary Jo Thomas. 13

14 Warren Hilsbos spoke to the Commission about community revitalization and wants to work with local leaders in order to make our community a better place to live. President VanGilder stated that he like his statement that local solutions are the best remedy to local problems. He and Commissioner Elliott informed him to get in touch with Nancy Bickerstaff in order to have a local contact that makes a difference in what she is involved. They added that she can show you how to get things accomplished. Bob Gribben stated that he is pleased that someone of his age wants to get involved in community service. Tom Antulov a deputy county clerk wanted to thank Jeff Biafore and his department for making shelves in Jacob s Building that would allow the Clerk s Office to store some of their records. Lauren Prinzo also wanted to thank Jeff and his department for all that they do. She added that all you have to do is to call them and whatever it is repaired. 14
