1 The Marion County Commission sat in regular session pursuant to its adjournment on Wednesday, October 7 th, Present were Commissioner Garcia, Commissioner VanGilder and President Elliott was excused. The proceedings of Wednesday, October 7 th, 2015, together with those had and done under the supervision of Janice Cosco, Clerk and Recorder for the Marion County Commission on October 8 th, 9 th, 13 th, 14 th, 15 th 16 th, 19 th, and 20 th, 2015 were approved as submitted and signed. Kathy Reed led the Court with a prayer. Jesse Corley led the Court with the Pledge of Allegiance. President Pro Tempore VanGilder called the meeting to order. Commissioner Garcia moved to dispense with the reading of the minutes of Wednesday, October 7 th, 2015 and accept them as presented. President Pro Tempore VanGilder seconded. Motion passed. For the record, note James Priester, Assessor presented to the County Commission the following Exonerations for approval. Dated October 21 st, 2015 Nos. # through # Pursuant to the recommendation of James Priester, Assessor and approval of Patrick Wilson, Prosecuting Attorney; Commissioner Garcia moved that the President sign Nos. # through # President Pro Tempore VanGilder seconded. Motion passed. This day came David A Glance, Fiduciary Supervisor for Marion County, West Virginia, and presented to the Commission His Report of Claims and First and Final Settlement Reports for the following estates which reports he has filed in the Office of the County Clerk of the County Commission, pending confirmation. There was an objection of the Estate of Alice Virginia Lester; and it has been removed from consideration in this matter. There being no further objections received to these reports and no errors appearing, the Report of Claims and First and Final Settlement Reports are hereby ratified, confirmed and approved. At a Regular Session of the County Commission of Marion County, West Virginia, continued and held October 14 th, This day came David A. Glance, Fiduciary Supervisor for Marion County, and presented to the County Commission the Waivers and Applications for Short Form Settlements, Proposed Settlements and Annual Settlement Reports filed by the personal representatives of the following estates, which he has reviewed and approved and which are the same estates which were advertised for proposed settlement in the October 6, 2015, issue of the Fairmont Times West Virginian, all in accordance with West Virginia Code 44-3A-19. 1

3 Commissioner Garcia stated that hearing no objections moved that the Commission sign the Order. President Pro Tempore VanGilder seconded. Motion passed. 3

4 The Commission received a request for Budget Revision from WVU Extension Office. County Administrator Kris Cinalli stated that this revision is in the amount of $2, Commissioner Garcia moved that the Commission approve the budget revision. President Pro Tempore VanGilder seconded. Motion passed. The Commission presented the Marion County Local Emergency Planning Committee By-Laws and Procedures County Administrator Kris Cinalli stated that an overview of this By-Laws and Procedures is as follows: PURPOSE OF THE MARION COUNTY LOCAL EMERGENCY PLANNING COMMITTEE 1) To address responsibilities as established related to the Emergency Planning and Community Right to Know Act of 1986 also known as Title III ; 2) Facilitate relationships and contact lists to assist in the delivery of a coordinated response to man-made or natural disasters; 3) Partner industry and government leaders for local survivability and continuity of operations; 4) Promote the meaningful sharing of information and expertise; 5) Foster awareness of critical infrastructure interdependencies, threat and vulnerabilities; 6) Encourage a prevention and protection operational framework for all activities; 7) Identify mutual needs for joint response and recovery procedures and assets; 8) Support emergency first responders by addressing necessary joint training and exercises. 9) Develop and implement a comprehensive emergency response plan in conjunction with Marion County Emergency Management President Pro Tempore VanGilder asked if there is a Countywide Emergency Plan in place. County Administrator Kris Cinalli replied that there was with Chris McIntire overseeing those issues. 4

5 Commissioner Garcia moved that the Commission sign the 2015 Marion County Local Emergency Planning Committee By-Laws and Procedures. President Pro Tempore VanGilder seconded. Motion passed. The Commission presented the Revised Monitoring and Emergency Action Plans for the Upper Buffalo dam, Site #4, ID #04927; Marion County. County Administrator Kris Cinalli stated that as follows: Commissioner Garcia moved that the Commission President Pro Tempore sign the document. President Pro Tempore VanGilder seconded. Motion passed. President Pro Tempore VanGilder made comments on hiring freeze that he raised in a meeting approximately three months ago. He continued that he is hopeful that the county government could do more with less in people. President Pro Tempore would like to gain a hiring freeze across the board. He also would like all elected officials to try to find some reductions in their budgets especially in the training and educational line items. The Commission received the request for the proposal to hire Case Aide for Day Report Center. President Pro Tempore VanGilder asked Brandi from the Day report Center if we are being reimbursed for the funds that are expended by the County that are to be reimburse to the County by the State from the grant program that we are working under. A short discussion ensued over the cost of hiring a new case worker part-time to do these upcoming drug tests. 5

6 Commissioner Garcia moved that the Commission table this agenda item until the November 4 th, 2015 Meeting. President Pro Tempore VanGilder seconded. Motion passed. The Commission presented the reappointment of Jesse Corley to the White Hall PSD. (Three Year Term) Commissioner Garcia moved that the Commission reappoint Jesse Corley to the White Hall PSD. President Pro Tempore VanGilder seconded. Motion passed. Jesse Corley wanted to thank the Commission for his reappointment and presented a short update on the Marion County Solid Waste process. The Commission received the request for funds from Northern Appalachian Coal Mining Heritage Association (NACMHA). 6

7 Commissioner Garcia moved that the Commission allocate $ to the Northern Appalachian Coal Mining Heritage Association (NACMHA) for their SWAP MEET and that those funds be appropriated from the Coal Severance Fund. President Pro Tempore VanGilder seconded. Motion passed. Laura Michael from the North Marion Track Boosters came before the County Commission to request funds for their new outdoor regulation tract site in Marion County. She added that this will be the only sanctioned tract in Marion County once it is up and running/operating. She continued that the new facility cost 1.9 million dollars. She stated that the Board of Education may not fund the equipment part of the facility. Laura Michael added that they have raised in the neighborhood of $30, She stated that they have contacted local businesses to obtain additional funds for the facility. She continued that there is still a short fall of funds needed to get the facility operating. 7

9 President Pro Tempore VanGilder stated that we would review and determine what the Commission could do to assist in this matter. Charlie Reese presented his update by stating that we are experiencing good weather and that there will be another concrete pour at the Park today walkway coming along very well. 9

10 President Pro Tempore VanGilder stated that he had a newspaper from the 1970 s and he read the businesses that are no longer with us and he added that the new tax of 1 percent passed by the City of Fairmont recently is a negative aspect on our local businesses. He continued that this should be reconsidered either by the City or the Legislature. There being no further business to come before the County Commission, it is ordered that this Commission do now recess until, Wednesday, November 4 th, 2015 at 10:00 a.m. for the next scheduled County Commission Meeting.
