1 The Marion County Commission sat in regular session pursuant to its adjournment on Wednesday, December 13 th, Present were Commissioner Elliott, Commissioner Garcia were in attendance and Commissioner VanGilder was present via Go to Meeting. D. D. Meighen led the Court with a prayer. Jesse Corley led the Court with the Pledge of Allegiance. President Pro Tempore Elliott called the meeting to order. The Commission presented the nomination of the Commission President and Commission President Pro Tempore. Commissioner Elliott moved that Ernest J. VanGilder be nominated and serve as President of the Commission through December 31, Commissioner Garcia seconded. President VanGilder concurred. Commissioner Garcia moved that Randall J. Elliott be nominated and serve as President Pro Tempore of the Commission through December 31, President VanGilder seconded. Commissioner Elliott concurred. Both President VanGilder and Commissioner Elliott thanked all for their support in nominating them once again for their current positions. The proceedings of Wednesday, December 13 th, 2017, together with those had and done under the supervision of Janice Cosco, Clerk and Recorder for the Marion County Commission December 14 th, 15 th, 18 th, 19 th, 20 th, 21 st, 22 nd, 26 th, 27 th, 28 th, 29 th, 2017 and January 2 nd, 2018 were approved as submitted and signed. Commissioner Elliott moved to dispense with the reading of the minutes of Wednesday, December 13 th, 2017 and accept them as presented. Commissioner Garcia seconded. President VanGilder concurred. For the record, notes Mark Trach, Assessor presented to the County Commission the following Exonerations for approval. Dated January 3 rd, 2018 Nos. # through # Pursuant to the recommendation of Mark Trach, Assessor and approval of Patrick Wilson, Prosecuting Attorney; Commissioner Elliott moved that the President sign Nos. # through # Commissioner Garcia seconded. President VanGilder concurred. The Commission received Order Confirming and Ratifying Fiduciary Supervisor s Report of Claims and Settlement Reports; Order # 393. At a Regular Session of the County Commission of Marion County, West Virginia, continued and held for this County at their offices in the J. Harper Meredith Building on the 27 th, day of December,
2 This day came David A. Glance, Fiduciary Supervisor for Marion County, West Virginia, and presented to the Commission his Report of Claims and First and Final Settlement Reports for the following estates which reports he has filed in the Office of the Clerk of the County Commission, pending confirmation. There being no objections received to these reports and no errors appearing, the Report of Claims and First and Final Settlement Reports are hereby ratified, confirmed and approved. 2
3 Commissioner Elliot stated that hearing no objection moved that the Commission sign the Order. Commissioner Garcia seconded. President VanGilder concurred. 3
4 The Commission presented the Authorization of Holiday Schedule for Commissioner Elliott moved that the Commission approve the authorization of the Holiday Schedule for Commissioner Garcia seconded. President VanGilder concurred. The Commission presented the Orders of Intent to Consolidate Precincts from the County Clerk. The ORDER OF INTENT TO CONSOLIDATE PRECINCTS 58 AND 56 TO BE KNOWN AS PRECINCT 56; Farmington Community Building located in the West Augusta Magisterial District; ORDER OF INTENT TO CONSOLIDATE PRECINCTS 62 AND 61 TO BE KNOWN AS PRECINCT 61; Downs Community Building, Rachel located in the West Augusta Magisterial District; ORDER OF INTENT TO CONSOLIDATE PRECINCTS 70 AND 72 TO BE KNOWN AS PRECINCT 72; Hough Park Community Building; located in the West Augusta Magisterial District. 4

17 The Commission presented the 2018 Marion County Overtime/Part-time Pay Schedule from County Clerk. Commissioner Elliott moved that the Commission approve the 2018 Marion County Overtime/Part-time Pay Schedule from County Clerk. Commissioner Garcia seconded. President VanGilder concurred. The Commission received a request for advice and consent from the County Clerk s office to hire Connor Haberland and Holly Amos as full time voter s registration employees with benefits, to be effective December 18, 2017 and January 1,

President VanGilder concurred. The Commission received a request for Advice and Consent from James C. Riffle, Sheriff, to hire Ryan Andrew Hall as a Deputy Sheriff, full time, with benefits, to be effective Monday, December 25, Commissioner Elliott moved that the Commission grant its advice and consent to James C. 19 The Commission received from the Division of Justice and Community Services Grant Adjustment Notice. (15-VA-132) Commissioner Elliott moved that the Commission approve the Division of Justice and Community Services Grant Adjustment Notice; (15-VA-132). Commissioner Garcia seconded. President VanGilder concurred. The Commission received a request for Advice and Consent to accept the resignation of John D. Vincent from the Kingmill Valley Public Service District, effective immediately. 19
20 Commissioner Elliott moved that the Commission accept the resignation of John D. Vincent from the Kingmill Valley Public Service District, effective immediately. Commissioner Garcia seconded. President VanGilder concurred. The Commission received a request for advice and consent to appoint James White (Terry) to the Kingmill Valley Public Service District, to serve out the term of Rosemary Fantasia (resigned) which expires June 1, 2022 Robert Perry to serve out the term of John Vincent (resigned), which expires Commissioner Elliott moved that the Commission appoint James White (Terry) to the Kingmill Valley Public Service District, to serve out the term of Rosemary Fantasia (resigned) which expires June 1, 2022 Robert Perry to serve out the term of John Vincent (resigned), which expires Commissioner Garcia seconded. 21 For the record, note the Commission received the Final Dispositional Order in the Matter of the Estate of Betty N. Sherbs. The Commission followed the conclusion of the Fiduciary Supervisor s legal opinion in this matter. 21

23 For the record, note the Commission received the notification from Charter Communication of upcoming changes. Jesse Corley gave an update on the Marion County Solid Waste Authority and expressed appreciation to the Commission for their continued support of the Recycling Program. Chris McIntire reported that reimbursement for last year s flooding should be received by February, as well as checks for homeowners living in a Flood Plain who have accepted buy-outs. Chris also expressed appreciation for the Commission s support of the Worthington Fire Department and also to Sabrina Haught and Jim Masturzo, who both recently retired from the Marion County 911 Center. 23
24 Belinda Biafore reported that a $60, grant was utilized to complete handicapped door repairs to the Courthouse and another $20, has been awarded. There being no further business to come before the County Commission, it is ordered that this Commission do now recess until, Wednesday, January 17 th, 2018 at 10:00 a.m. for the next scheduled County Commission Meeting.
