1 COUNTY COURT The Marion County Commission sat in regular session pursuant to its adjournment on Wednesday, December 21 st, Present were Commissioner Elliott and President Tennant. The proceedings of December 21 st, 2011, together with those had and done under the supervision of Janice Cosco, Clerk and Recorder for the Marion County Commission on December 22 nd, 23 rd, and 27 th, 2011 were approved as submitted and signed. President Tennant called the meeting to order. Retired Reverend D. D. Meighen led the Court with a prayer. D. D. Meighen led the Court with the Pledge of Allegiance. Commissioner Elliott moved to dispense with the reading of the minutes of December 21 st, 2011 and except them as presented. President Tennant seconded. Motion passed. For the record note, James Priester, Assessor presented to the County Commission the following Exonerations for approval. Dated December 28, 2011 Nos. # through # Pursuant to the recommendation of James Priester, Assessor and approval of Patrick Wilson, Prosecuting Attorney; Commissioner Elliott moved the Commissioner President to sign Nos. # through # President Tennant seconded. Motion passed. The Commission received an Order Confirming and Ratifying Fiduciary Supervisor s Report of Claims and Settlement Reports, Order #321. ORDER NUMBER _321 ORDER CONFIRMING AND RATIFYING FIDUCIARY SUPERVISOR'S REPORT OF CLAIMS AND SETTLEMENT REPORTS At a regular Session of the County Commission of Marion County, West Virginia, continued and held for the County in the J. Harper Meredith Building on the 28 th day of December, This day came David A. Glance, Fiduciary Supervisor for Marion County, West Virginia, and presented to the Commission his Report of Claims and First and Final Settlement Reports for the following estates which reports he has filed in the Office of the Clerk of the County Commission, pending confirmation. There being no objections received to these reports and no errors appearing, the Report of Claims and First and Final Settlement Reports are hereby ratified, confirmed and approved.

3 PAGE 3 Commissioner Elliott moved that the Commission approve and sign the Order Confirming and Ratifying Fiduciary Supervisor s Report of Claims and Settlement Reports, Order #321. President Tennant seconded. Motion passed. The Commission received a request for advice and consent for Mike Kraley to replace Jeff Tuttle on the Marion County GIS Committee, effective immediately. Commissioner Elliott moved that the Commission appoint for Mike Kraley to replace Jeff Tuttle on the Marion County GIS Committee, effective immediately. President Tennant seconded. Motion passed.

4 PAGE 4 The Commission presented the re-appointment of Thomas Antulov to the Marion County Planning Commission Board. Commissioner Elliott moved that the Commission re-appoint Thomas Antulov to the Marion County Planning Commission Board for a full term running from January 1, 2012 through December 31, President Tennant seconded. Motion passed. For the record, note the Commission received from Valley Falls Public Service District Reconciliation their Summary for Period Ending 10/30/11 and 11/30/11. For the record, note the Commission received a notice of new prices from Comcast, to be effective February 1, 2012.

5 PAGE 5 Norman Kronjaeger spoke to the Commission thanking them for the work they contracted out to him this year. He also stated that Richard Walton the County Planner should be commended for all of the grants that he obtains for the County. Norman does not think Richard Walton receives enough credit for the work he does. Commissioner Elliott thanked Norman for all of the work he has done for the County and he also thanked him for his kinds comments about Richard Walton and Commissioner Elliott also commended Richard on all that he has done for the County. There being no further business to come before the County Commission, it is ordered that this Commission do now recess until, Wednesday, January 11 th, 2012 at 10:00 a.m. for its next Commission Meeting. There will be NO Commission Meeting on Wednesday, January 4, 2012 due to a lack of a quorum. The Commission will also be holding a Special Meeting on Friday, January 13, 2012 at 10:00 a.m. to fill unexpired term of Commissioner Wayne Stutler, who had passed away in December, Burley Butch Tennant, President
