1 The Marion County Commission sat in regular session pursuant to its adjournment on Wednesday, July 25 th, Present were Commissioner Elliott, Commissioner Garcia and Commissioner VanGilder was excused. Deputy County Clerk Thomas Antulov led the Court with a prayer. Mary Jo Thomas of the Board of Education led the Court with the Pledge of Allegiance. President Pro Tempore Elliott called the meeting to order. The proceedings of Wednesday, July 25 th, 2018 together with those had and done under the supervision of Janice Cosco, Clerk and Recorder for the Marion County Commission July 26 th, 27 th, 30 th, 31 st, August 1 st, 2 nd, 3 rd, 6 th and 7 th, 2018 were approved as submitted and signed. Commissioner Garcia moved to dispense with the reading of the minutes of Wednesday, July 25 th, 2018 and accept them as presented. President Pro Tempore Elliott seconded. Motion passed. For the record, notes Mark Trach, Assessor presented to the County Commission the following Exonerations for approval. Dated August 8 th, 2018 Nos. # through # Pursuant to the recommendation of Mark Trach, Assessor and approval of Jeffery Freeman, Prosecuting Attorney; Commissioner Garcia moved that the President sign Nos. # through # President Pro Tempore Elliott seconded. Motion passed. The Commission received an Order of Probate of Wills from the County Clerk s Office for the month of July, County Administrator Kris Cinalli stated that this Order is a list of Estates in which have been admitted to Probate in the County Clerk s Office, in vacation of the Commission, from July 1, 2018 through July 31, 2018 pursuant to West Virginia Code , as amended. 1

4 Commissioner Garcia stated that hearing no objection moved that the Commission sign the Order. President Pro Tempore Elliott seconded. Motion passed. For the record, note the Commission received the Marion County Sheriff s Settlement for June 30, For the record, note the Commission presented the Resolutions for the Revision of the Levy Estimate (Budget); Coal Severance Fund and the General Fund. 4

9 The Marion County Commission presented the Order and Notice of the Election for an additional County Levy to the Voters of Marion County for the 2018 General Election: Fire Levy. 9

11 The Commission received a request for advice and consent from James C. Riffle, Sheriff, to hire Michael Waitman Stewart as a Deputy Sheriff, full time with benefits, to be effective Monday, August 20, Commissioner Garcia moved that the Commission grant its advice and consent to hire Michael Waitman Stewart as a Deputy Sheriff, fulltime with benefits, to be effective Monday, August 20, President Pro Tempore Elliott seconded. Motion passed. The Commission received a request for advice and consent from Rhonda Starn, Circuit Clerk, to hire Christopher Brown, full time with benefits, to be effective Monday, August 13,
12 Commissioner Garcia moved that the Commission grant its advice and consent to hire Christopher Brown, fulltime with benefits, to be effective Monday, August 13, President Pro Tempore Elliott seconded. Motion passed. The Commission received a request for advice and consent from Chris McIntire, Director, to hire Julia Tomago, Sheryl Chickerell, and Rebecca Clayton, as 911 dispatchers (replacements), full time with benefits, to be effective Monday, August 27,
13 Commissioner Garcia moved that the Commission grant its advice and consent to hire Julia Tomago, Sheryl Chickerell, and Rebecca Clayton, as 911 dispatchers (replacements), fulltime with benefits, to be effective Monday, August 27, President Pro Tempore Elliott seconded. Motion passed. The Commission received a series of internal budget revision for the end of the fiscal year to clean up negative in all department lines. Commissioner Garcia moved that the Commission approve the internal budget revisions. President Pro Tempore Elliott seconded. Motion passed. For the record, note the Commission received the Grant Adjustment Notice from the Division of Justice and Community Services for the de-obligation of Project Number 18-CC-11(Marion County Day Report Center). 13
14 For the record, note the Commission received the Valley Falls Public Service District Reconciliation Summary for Period Ending , and Mary Jo Thomas of the Marion County Board of Education Member thanked the Commission for their support for the Rhododendron Girl State Francesca Aloi and Jordan Payton came before the Commission and thanked the Commission and gave a brief presentation of the programs they attended. Chris McIntire stated that the FEMA buyout program is in its final phase of this project. All those involved were satisfied with the results and have new homes. 14
15 Chris McIntire and the Sheriff Jim Riffle and Kris Cinalli the County Administrator stated that the new Record Management System should be up and running in December of this year with the records going on-line with the new database. Lauren Prinzo of the West Virginia University Extension Service thanked the Commission for its support of the Bright Futures project. She introduced Pam Mullin the North Central West Virginia Head Start Coordinator who presented a brief set of comments on their program Pre-School Nutrition Program. Deputy County Clerk Thomas Antulov stated that we have received the Excess Levy from the Board of Education that will be running on the 2018 General Election Ballot this fall. It will be a for the record agenda item at the next meeting. 15
16 The Commission received a Presentation from State Auditor s office. The State Auditor John B. McCuskey made the presentation of placing all of the County s budgetary information on the web viewable by the public for transparency of how the County utilizes tax dollars. The State of West Virginia is online at OPENGOV.COM. Mr. McCuskey stated that Monongalia County has gone online with this program. He stated that the cost is one-time setup fee of $3, with a yearly maintenance fee ranging from $1,500 to 1, per year. The State has purchased enough licenses that the County will not be responsible for that cost. Mr. McCuskey added that the State of West Virginia is the first state in the country to go strictly EFT payments. He is also presenting or adjusting the audit standards for the County s which should lower the costs of their audits. There being no further business to come before the County Commission, it is ordered that this Commission do now recess for ten minutes to come back into session for an Estate Hearing. President Pro Tempore Elliott called the Estate Hearing to order. He then turned it over to Attorney David Glance the Fiduciary Supervisor to present the Matter of the Estate of Marilyn B. Cutright. Fiduciary Attorney David Glance stated that in this Matter there was: no will to probate there are only two heirs; brother and sister: Alan G. Sawitski and Debra Miller in this case the real estate goes to the heirs at the time of death issue with bank over failure of payment bank would not speak to Debra Miller, due to not being Administrator, even though she was owner-court overturned foreclosure of property Mr. Glance stated that it is his opinion that Mr. Sawitski needs to be removed from his office of Administrator. President Pro Tempore Elliott moved that an Order be prepared to remove Alan G. Sawitski as Administrator from the Estate of Marilyn B. Cutright and that Attorney David Glance prepared the document. Commissioner Garcia seconded. Motion passed. There being no further business to come before the County Commission, it is ordered that this Commission do now recess until, Wednesday, August 22 nd, 2018 at 10:00 a.m. for the next scheduled County Commission Meeting.
