1 COUNTY COURT The Marion County Commission sat in regular session pursuant to its adjournment on Wednesday, July 25 th, Present were Commissioner Elliott, Commissioner Ward and President Tennant. The proceedings of Wednesday, July 25 th, 2012, together with those had and done under the supervision of Janice Cosco, Clerk and Recorder for the Marion County Commission on July 26 th, 27 th, 30 th and 31 st, 2012 were approved as submitted and signed. President Tennant called the meeting to order. George Batten, Director of the union mission led the Court with a prayer. Joseph Manchin IV led the Court with the Pledge of Allegiance. Commissioner Elliott moved to dispense with the reading of the minutes of Wednesday, July 25 th, 2012 and accept them as presented. Commissioner Ward seconded. President Tennant concurred. For the record note, James Priester, Assessor presented to the County Commission the following Exonerations for approval. Dated August 1, 2012 Nos. # through # Pursuant to the recommendation of James Priester, Assessor and approval of Patrick Wilson, Prosecuting Attorney; Commissioner Elliott moved the Commissioner President to sign Nos. # through # Commissioner Ward seconded. President Tennant concurred. The Commission presented a Resolution to keep Upper Mon River Locks open. Commissioner Ward comments were as follows: that the closing of the Hildebrand and Opekiska Locks would be detrimental to the future of river commerce for Marion County. Lana Smith was present to thank the Commission for its quick support in this matter in that the Marion County Commission was the first governing body to approve a Resolution is support of keeping the Locks opens. President Tennant asked what would happen with the flood control portion of the locks. Lane Smith replied that they will; be controlled remotely. Commissioner Ward commented that he hoped the commercial traffic will come back in the future. Commissioner Elliott supports the keeping of the Locks open for the potential of commercial river traffic for future development as well as the recreational usage as well. Commissioner Elliott continued that Fairmont is the last navigable portion of the Mon River and it would be detrimental for future success to lose on this issue.

4 PAGE 4 Commissioner Elliott moved that the Commission sign the Resolution to keep the Upper Mon River Locks Open. Commissioner Ward seconded. President Tennant concurred. The Commission received a Depository Agreement packet between First Exchange Bank and the Marion County Commission to be in effect from July 1, 2012 through June 30, 2013 and presented an Order to that effect.

7 PAGE 7 Commissioner Elliott moved that the Commission sign the Depository Agreement packet between First Exchange Bank and the Marion County Commission. Commissioner Ward seconded. President Tennant concurred. The Commission presented a Budget Revision request in the Coal Severance Development Budget. County Administrator Kris Cinalli stated that this budget revision is in the amount of $62, for our Economic Development Line. Charlie Reese stated for the record that we have submitted the Industrial Access Road Fund Application has been submitted in the amount of $115,000.00; Charlie thanked Kris Cinalli and Paulette Debolt for assisting in the completion of that application. Charlie added that it has been sent to Charleston and has been approved by the Development Office and has been forwarded to the Department of Highways.

8 PAGE 8 Charlie also stated that we have begun the LED, Lead Economic Development Grant for Marion County which is in the amount of $31, which will take to complete and submit to the lead agency in Charleston for approval. Commissioner Elliott moved that the Commission sign the budget revision in the Coal Severance Development Budget. Commissioner Ward seconded. President Tennant concurred. The Commission received an Internal Budget Revision Request from Patrick Wilson, Prosecuting Attorney. County Administrator Kris Cinalli stated that this internal revision is in the amount of $5, for their Lexis Nexis subscription as well as vehicle repair.

9 PAGE 9 Commissioner Elliott moved that the Commission sign the internal budget revision from Patrick Wilson our Prosecuting Attorney. Commissioner Ward seconded. President Tennant concurred. The Commission received a request for advice and consent from Prosecuting Attorney for the hiring of a part time employee, no benefits position to aid in drug forfeiture proceedings and criminal cases. County Administrator Kris Cinalli added that this position will pay $25, with no benefits which will be affective by August 6, 2012 if approved.

10 PAGE 10 Commissioner Elliott moved that the Commission does grant its advice and consent to our Prosecuting Attorney Pat Wilson for the hiring of a part time employee, with no benefits to a position to aid in drug forfeiture proceedings and criminal cases. Commissioner Ward seconded. President Tennant concurred.

11 PAGE 11 The Commission received a request for assistance from the Pleasant Valley Elementary School PTO for the installation of handicapped accessible ramp to facilitate access to playground. Jennifer Weist the current President of the PTO and Julie Albertson, a first grade teacher came before the Commission to present the request of a new access to the playground and answer any questions that the Commission would have. The ladies stated that they need approximately $15, to complete this play ground project at the Pleasant Valley Elementary School. They would appreciate any funds that the Commission could donate to the completion of their project. They explained the scope of their project and indicated those other entities that they have approached to request funds. Commissioner Elliott stated that he had no issue in assisting your group. He then asked that the County Attorney Chuck Shields to review this request to see if the Commission is able to contribute to the endeavor. Commissioner Ward stated that he believed that this request would fall under the Hotel/Motel Tax. Chuck indicated that he would review that issue. Commissioner Elliott moved that this item be tabled until the next meeting. Commissioner Ward seconded. President Tennant concurred. For the record, note the Commission received notice from Comcast of the opening of new Customer Service Center in Glenmark Center, Morgantown, West Virginia.

12 PAGE 12 Commissioner Elliott asked County Administrator Kris Cinalli to see if they would open an office in the Fairmont area to assist our citizens with their service. Kris Cinalli stated that he would follow up with that request. For the record, note the Commission received notice from Comcast of channel changes, effective August 15, 2012.

13 PAGE 13 William Bill Bickerstaff came before the Commission to seek funding for their 2 nd Annual First Responders Softball Tournament which will be held on Saturday, August 18 th, 2012 at Windmill Park. Mr. Bickerstaff stated that all of the proceeds from this year s tournament will go to the Wounded Warrior Project. He also added that last year s proceeds went to the Relay-for-Life. Mr. Bickerstaff stated that they would be requesting funds in the amount of $ for next weeks meeting. Dennis Basnett spoke about a letter in bad test that was left on the bulletin board, where he found a letter advocating extreme things that was also in the local newspaper. The letter demonizes people on public assistance and advocates sterilization. It states that people want to be on it because they do not want to work. It finally advocates the denial of those individuals the right to vote. Mr. Basnett stated that we are a better people than that in Marion County. There being no further business to come before the County Commission, it is ordered that this Commission do now recess until, Wednesday, August 8 th, 2012 at 10:00 a.m. for the next scheduled County Commission Meeting.
