1 The Marion County Commission sat in regular session pursuant to its adjournment on Wednesday, June 17 th, Present were Commissioner Garcia and President Pro Tempore VanGilder, President Elliott was excused. The proceedings of Wednesday, June 17 th, 2015, together with those had and done under the supervision of Janice Cosco, Clerk and Recorder for the Marion County Commission on June 18 th, 22 nd and 23 rd, 2015 were approved as submitted and signed. D. D. Meighen led the Court with a prayer. Robert Gribben led the Court with the Pledge of Allegiance. President Pro Tempore VanGilder called the meeting to order. Commissioner Garcia moved to dispense with the reading of the minutes of Wednesday, June 17 th, 2015 and accept them as presented. President Pro Tempore VanGilder seconded. Motion passed. For the record, note James Priester, Assessor presented to the County Commission the following Exonerations for approval. Dated June 24, 2015 Nos. # through # Pursuant to the recommendation of James Priester, Assessor and approval of Patrick Wilson, Prosecuting Attorney; Commissioner Garcia moved that the President sign Nos. # through # President Pro Tempore VanGilder seconded. Motion passed. The Commission received an Order of Probate of Wills from the County Clerk s Office for the month of May, Charlie Reese stated that this Order is a list of Estates in which have been admitted to Probate in the County Clerk s Office, in vacation of the Commission, from May 1, 2015 through May 31, 2015 pursuant to West Virginia Code , as amended. 1

3 Commissioner Garcia moved that the Commission sign the Order. Pro Tempore VanGilder seconded. Motion passed. President The Commission received the Order Confirming and Ratifying Fiduciary Supervisor s Report of Claims and Settlement Report; Order #363. At a Regular Session of the County Commission of Marion County, West Virginia, continued and held for this County at their offices in the J. Harper Meredith Building on the 24 th, day of June,

4 This day came David A. Glance, Fiduciary Supervisor for Marion County, West Virginia, and presented to the Commission his Report of Claims and First and Final Settlement Reports for the following estates which reports he has filed in the Office of the Clerk of the County Commission, pending confirmation. There being no objections received to these reports and no errors appearing, the Report of Claims and First and Final Settlement Reports are hereby ratified, confirmed and approved. Commissioner Garcia moved that the Commission sign the Order; Order #363. President Pro Tempore VanGilder seconded. Motion passed. 4

5 The Commission presented the Resolution of Approval in the revision of the Levy Estimate (Budget) of the General Fund for the County of Marion. 5

10 The Commission presented a Resolution to Accept Conditions of the Contract for West Virginia Community Participation Program Funds and to Authorize Signature by the Marion County Commission on behalf of the Marion County Commission. County Administrator Kris Cinalli stated that this is in the amount of $5, and that those funds will be utilized for any purpose at Palatine Park. Commissioner Garcia moved that the Commission sign the Resolution and the President Pro Tempore sign the contract. President Pro Tempore VanGilder seconded. Motion passed. 10

11 The Commission received a request for advice and consent from Janice Cosco, County Clerk, to accept the resignation of Crystal Redmond, to be effective Friday, June 19, Commissioner Garcia moved that the Commission accept the resignation of Crystal Redmond, of the County Clerk s Office to be effective Friday, June 19, President Pro Tempore VanGilder seconded. Motion passed. Russell Garrett came before the Commission to present an issue of the cat and dog population in the Sallyfield Estates area of the City of Fairmont. He stated that there are some residents who put out pounds of food for the cats and what they don t eat the possums, raccoons and deer eat which leads to damage of property and other issues. He asked if there could be a leash law for cats by ordinance voted on by the Commission and passed. President Pro Tempore VanGilder stated that he was pleased that not only did you present the problem but you also presented a remedy for the situation. County Administrator Kris Cinalli stated that there is no leash law for cats by State Code; which would make it very difficult to pass an ordinance with any force behind it. However; the Commission and Administrator stated that they would review this issue to see if there is anything that can be done. Columbus Carpenter asked the Commission if they could rename a Park within the County as a Veterans Park. There is none located within the County and all surrounding Counties have parks named as Veteran Parks. Mr. Carpenter also added that the City of Fairmont through their Mayor Straight donated $1, to the Memorial. Mr. Carpenter also thanked everyone for their prayers for his wife who was ill and has recovered. President Pro Tempore VanGilder thanked the City of Fairmont for their donation for the Memorial. Rebecca Moran presented her Art in the Park, Community Action Program for the Youth of Marion County. She stated that it will take place throughout the summer at various parks throughout the County with the mural being placed on the Masonic Temple wall viewable from Wesbanco Bank. She made this request for funds for assistance in completing this project. President Pro Tempore VanGilder stated that this request would need to be in writing and placed on our agenda for consideration. Rebecca Moran stated that she would make the request in writing and thanked the Commission for their time in this matter. 11

Charlie Reese updated the Commission on the Park by stating that the BASS Tournament was a great success and he thanked all for the assistance and participation.

Charlie added that Phase 2015 design by Doug Fortney is going very well; plans should be completed in 1 to 2 weeks with it going to bid and taking bids for 1 to 2 weeks. Charlie continued that by mid-august should begin construction. Charlie added that by then the kids will be in school and the construction phase will not taking place around the kids. Charlie also stated that Belinda will be preparing some fund raisers to pay for some of these costs. Charlie added that the next big event at the Park is Red, White & Boom on July 4 th with bands playing and a fire work show with vendors selling items and food. Charlie added that this event will be free for the public. 15

16 A discussion of between the Commission, Charlie Reese and Joe DeBellis of jobs and what tracts are available in the Industrial Park near Manley Chapel occurred and what could be coming to the area. All are hopeful for development of the Oil and Gas Industry supplies and equipment which could be made and developed here in Marion County instead of being transported into our County from other areas. President Pro Tempore VanGilder added that he is concerned for the loss of mining jobs in the area and the effect it will have on our local economy. He also presented the option of having the Commission Meeting every other week so that the agendas can be full with more to discuss and consider. There being no further business to come before the County Commission, it is ordered that this Commission do now recess until, Wednesday, July 1 st, 2015 at 10:00 a.m. for the next scheduled County Commission Meeting.
