1 At the regular meeting held June 15, 2010 at Hutchinson Hall, Newark Valley at 7:00 P.M. the following were PRESENT: Stuart Yetter, Jr., Supervisor Donald Thomas, Councilman Ronald Graham, Councilman Joe Tomazin, Councilman Dan Cheresnowski, Councilman Also Present: Kevin Lewis; Levene, Gouldin & Thompson, Attorneys to the Town, Charles Meade; Highway Superintendent, Del Mock; DCO, Hans Peeters; Planning Board Chairman, Tom Larson; Code Enforcement, Charlie Morgan, Dominica Creeley, LuAnn Whirl; Tappan-Spaulding Library Director, Elsie Carrozza, Bob Whirl, Wendy Walsh from TING. Supervisor Yetter called the meeting to order at 7:00 P.M. Supervisor Yetter led all in the Pledge of Allegiance. Approval of Board Meeting Minutes for May 18, Resolution # Approval of Board Meeting Minutes On a motion, offered by Councilman Tomazin and seconded by Councilman Graham, the Board accepted the Meeting Minutes for May 18, 2010 as submitted. Councilman Thomas - AYE Privilege of the Floor - Public Comments LuAnn Whirl introduced herself as the Director of the Tappan-Spaulding Library. She apologized for not reporting to the Town Board. She stated that the Town actually got the Charter in She thanked the Board for their support. She said she would keep the Board informed. Ms. Whirl presented the Board with copies of the annual report for the years 2008 and She gave an overview about the circulation rates. She explained that the financial report is done by the treasurer and if the Town wanted to see those, they would need to contact the treasurer. She stated that there are summer reading programs for several age groups. She said that the Town population goes up but the Village s does not. They have an outreach for shut-ins, Councilman Thomas asked if the library gets involved with old textbooks from schools to other states. Ms. Whirl stated that no, it does not. There are several libraries they send books to from their book sale, some are donations from the community and some from the library sale. Councilman Cheresnowski asked Ms. Whirl if the addition on the back of the library is still being considered. She said it is still in the works - they are still getting funds for that and they are still working on grants. 1

2 Supervisor Yetter thanked Ms. Whirl for the update. Ms. Whirl said she would like to put some information in the town newsletter and Supervisor Yetter said that would be fine. Ms. Whirl is looking for fund raising ideas. TING Update Wendy Walsh from TING said they are looking at public impact from gas drilling. They plan to have a session to give the local municipalities information about what they can do to prepare themselves for gas drilling. This is an attempt to keep everyone informed about what is going on. On a weekly basis, planning will contact the towns and there will be some coordination with the gas companies when drilling starts. TING would like feedback when they do start drilling. TING is looking for improved communications and plan to a designated person to convey that information. There was discussion concerning chemicals and pipes being shipped by train through the village. Privilege of the Floor was closed. Highway Report June 15, 2010 #1. Gas Price: $ Diesel Price: $ #2. The large pipe is at Davis Hollow Rd. Now we are just waiting for good weather. I will post the closer of the road on WBNG TV and hopefully the Binghamton Press, and of course the Tioga County Sheriffs Office. #3. We are finishing up ditching and still have edges to cut, and patching is next. All stone is in for oil and stone. #4. Right now, we have 29 applications, I want to have interviews next week. Note: the Hwy councilmen need a date? #5. In the near future, we have to add gravel and clean the ditches to the Cemetery which is on Markham Rd. The road is off from Dodson Hill, which we have an agreement with the property owner of the Virginia Sheppard (Tull). I am notifying you of this because; it s in the agreement when any repair is done. When we will do it is the question But if we are in the area and have time we will do it then. #6. We have the truck from the Town of Binghamton. We had Paul s Sand Blasting do the frame and wheels, and Mill Street Body Shop, will be doing the Painting. We will be doing all the prep work before it goes there. Paul s Sand Blasting cost $ and Mill Street Body Shop cost is $ also. The Board discussed applications and interviews with Superintendent Meade.. New Business Supervisor s Financial Report There was discussion about CHIPS money. Everything is looking okay. Revenues are okay. Sales tax is still down. 2

3 Resolution # Supervisor s Financial Report On a motion offered by Councilman Tomazin and seconded by Councilman Cheresnowski, the Town Board accepts the Supervisor s Financial Report as submitted. Resolution # Budget Modifications On a motion offered by Councilman Graham and seconded by Councilman Cheresnowski, the Town Board authorizes the following Budget Transfers: $ from A Contingency to A1220.4Supervisor C.E. $4, from DA Equip. Budget RSV to DA Highway Equipment $9, from A Contingency to A Ambulance Service Old Business - Annexation Resolution Supervisor Yetter read the Annexation Resolution (attached). The Board discussed whether to adopt this resolution. Resolution # Annexation Resolution On a motion offered Councilman Thomas and seconded by Councilman Cheresnowski, the Town Board of the Town of Newark Valley adopts the Annexation Resolution as written by the Attorney to the Town. Open Burn Law There was discussion pertaining to the Open Burn Law. The Board decided to have the Public Hearing for this law July 20,

4 Resolution # Public Hearing for Local Law #1-Open Burn Law On a motion offered by Councilman Tomazin and seconded by Councilman Graham, the Town Board authorizes the Town Clerk to advertise in the official paper a Public Hearing for Local Law #1 to take place at 7:30 P.M, July 20, NYS Retirement Standard Work Day Resolution Supervisor Yetter read the information concerning the Standard Work Day Resolution. There was a short discussion about hours worked and who was in the retirement system Resolution # Standard Work Day Resolution On a motion offered by Councilman Cheresnowski and seconded by Councilman Graham, the Town Board of the Town of Newark Valley adopts the following resolution: Based on the work records submitted to the Town Supervisor, the standard work day is established for the following Town of Newark Valley employees: Dennis Liebe Fire Marshal 2.4 hours John Schaffer Justice 1.5 hours Elizabeth Olmstead Secretary 3 hours Yvonne Tuetken Court Clerk 1.5 hours Christina Raison Assessor 1.5 hours Cheryl Galluzzo Bookkeeper 2.25 hours Charles Meade Highway Superintendent 8 hours These positions are part time salaried and these hours are worked on an as needed basis to fulfill each positions requirements. The hours stated are an average per day per 5 day work week based on the logs submitted. 4

5 Department & Council Reports Code Enforcement/Fire Marshal There were two mobile home permits submitted for approval. Resolution # Mobile Home Permit Kwiatkowski On a motion offered by Councilman Tomazin and seconded by Councilman Graham the own Board granted a Mobile Home Permit to Paul Kwiatkowski for placement of a mobile home at 7000 State Route 38 in compliance with the Town Ordinance. Councilman Thomas AYE Supervisor Yetter AYE Resolution # Mobile Home Permit Burlingham On a motion offered by Councilman Cheresnowski and seconded by Councilman Tomazin the Town Board granted a Mobile Home Permit to Mary J. Burlingham for placement of a mobile home at 993 Dalton Hill Road in compliance with the Town Ordinance. Councilman Thomas AYE Supervisor Yetter AYE There was a discussion about mobile homes. George Gregory is applying for a site development plan for a gravel bed. Mr. Larson submitted a Multi- Phase Site Development Plan Review Procedure. The Board had a discussion with Mr. Larson about this issue. Mr. Lewis will review the law concerning this issue. The supervisor would like this as user friendly as possible. Mr. Larson submitted information about training. The Board authorized his attendance. Resolution # Training for Code Enforcement Officer On a motion offered by Councilman Tomazin and seconded by Councilman Graham, the Board authorizes the Code Enforcement Officer to attend two training sessions, at a cost of $ plus meals and mileage. 6 There was a discussion about trailers being legal and permits for pools. Mr. Larson took a picture of the Town Board for the website. Mr. Larson did not submit his monthly report for April. Dog Control Mr. Mock said there is a dangerous dog case coming up the 24 th of June. The attorney for the Town is handling this case because he will be better prepared to go up against the lawyer the dog owner has hired than Mr. Mock. Mr. Lewis told the Board that there may be an extra charge for this appearance. We usually have delinquent dog licenses per month, we now have only 2 or 3 for the last 3 months. Councilman Reports Assessor Supervisor Yetter told everyone Christina Raisen has resigned as assessor as of June 14, The Board discussed their options. Supervisor Yetter said he has received an from the assessor from the Town of Spencer. Supervisor Yetter talked with the Supervisor from Spencer and they are pleased with him. Supervisor Yetter said he would get in touch with him. Supervisor Yetter told the Board we have received a letter from BlueOX. They are lowering their cap price from $.50 to $.30. Councilman Thomas opened discussion about cell towers. Councilman Tomazin asked if his parents should be getting a bill for ambulance service. Supervisor Yetter said no one should be receiving a bill for ambulance service. There was a discussion about ambulance services. Planning Board Hans Peeters said the next meeting is Monday. They plan to discuss outdoor furnace laws. There was a discussion about outdoor furnaces. Supervisor Yetter said he had received a letter of resignation from Betty Thompson as Representative from Newark Valley for REAP. The Town needs to fill this position. Justice Report Justice John Schaffer reported for the month of May 2010, the following cases were disposed: 75 Traffic Tickets; 2 Criminal charges; 1 Dog cases; 0 Civil cases; 0 Econ case and 0 Town law cases. A total of $9, was sent to the NYS Comptroller s Office. Justice Todd Smith reported for the month of May 2010, the following cases disposed of: 35 Traffic Tickets; 3 Criminal Charges; 0 Dog Cases, 0 Civil Cases; 0 Econ Cases, 0 Town Law Cases. A total of $3, was sent to the NYS Comptroller s Office. 6

7 Town Clerk The Clerk informed the Board that the State is dropping the dog licensing system due to budget concerns. The Town Clerks will be totally without State help. This will be a lot more work for Clerks and much more time consuming. The Town Clerk submitted her monthly reports and they are on file in her office. Resolution # Highway Bills On a motion, offered by Councilman Tomazin and seconded by Councilman Graham, the Town Board authorizes the payment of Highway Bill Vouchers #H82 H101 inclusive in the amount for $39, Resolution # General Bills On a motion, offered by Councilman Cheresnowski and seconded by Councilman Thomas, the Town Board authorizes the payment of General Bill Vouchers, inclusive in the amount for $17, There was a motion to adjourn the meeting at 9:12 PM., offered by Councilman Cheresowski and seconded by Councilman Graham.
