1 The Marion County Commission sat in regular session pursuant to its adjournment on Wednesday, April 8 th, Present were President Elliott, Commissioner Garcia and Commissioner VanGilder. The proceedings of Wednesday, April 8 th, 2015, together with those had and done under the supervision of Janice Cosco, Clerk and Recorder for the Marion County Commission on April 9 th, 10 th, 13 th and 14 th, 2015 were approved as submitted and signed. Reverend Janice Smith of the Barrackville United Methodist Church led the Court with a prayer. Thomas F. Antulov, deputy county clerk led the Court with the Pledge of Allegiance. President Elliott called the meeting to order. Commissioner VanGilder moved to dispense with the reading of the minutes of Wednesday, April 8 th, 2015 and accept them as presented. Commissioner Garcia seconded. President Elliott concurred. For the record, note James Priester, Assessor presented to the County Commission the following Exonerations for approval. Dated April 15, 2015 Nos. # through # Pursuant to the recommendation of James Priester, Assessor and approval of Patrick Wilson, Prosecuting Attorney; Commissioner VanGilder moved that the President sign Nos. # through # Commissioner Garcia seconded. President Elliott concurred. The Commission received an Order of Probate of Wills from the County Clerk s Office for the month of March, Kris Cinalli stated that this Order is a list of Estates in which have been admitted to Probate in the County Clerk s Office, in vacation of the Commission, from March 1, 2015 through March 31, 2015 pursuant to West Virginia Code , as amended. 1

3 Commissioner VanGilder moved that the Commission sign the Order. Commissioner Garcia seconded. President Elliott concurred. This day came David A Glance, Fiduciary Supervisor for Marion County, West Virginia, and presented to the Commission His Report of Claims and First and Final Settlement Reports for the following estates which reports he has filed in the Office of the County Clerk of the County Commission, pending confirmation. There being no further objections received to these reports and no errors appearing, the Report of Claims and First and Final Settlement Reports are hereby ratified, confirmed and approved. At a Regular Session of the County Commission of Marion County, West Virginia, continued and held April 15 th,

Glance, Fiduciary Supervisor for Marion County, and presented to the County Commission the Waivers and Applications for Short Form Settlements, Proposed Settlements and Annual Settlement Reports filed by the personal representatives of the following estates, which he has reviewed and approved and which are the same estates which were advertised for proposed settlement in the April 6, 2015, issue of the Fairmont Times West Virginian, all in accordance with West Virginia Code 44-3A-19. 4

5 Commissioner VanGilder moved that the Commission sign the Order. Commissioner Garcia seconded. President Elliott concurred. For the record, note the Commission received the Grant Adjustment Notice for West Virginia Community Corrections Grant Program. (15-CC-10) County Administrator Kris Cinalli stated that this adjustment was for the change of authorizing official from Butch Tennant to Randy Elliott. 5

8 Commissioner VanGilder moved that the Commission sign the Contract. Commissioner Garcia seconded. President Elliott concurred. For the record, note the Commission received from American Bituminous Power Partners, L. P. Permit # S , their Revision #2, for public review. For the record, note the Commission received from Greater Marion Public Service District Independent Auditor s Report and Related Financial Statements for the Years Ended June 30, 2014 and

9 For the record, note the Commission received from Paw Paw Route 19 Public Service District Independent Auditor s Report and Related Financial Statements for the Years Ended June 30, 2013 and Sabrina Haught from 911 Center stated that this is tele-communicator s week and she added that she is very proud of all of the Center s dispatchers and the job each performs. She also thanked the Commission for all of their support over the years. Charlie Reese stated that the bids will be awarded on Friday at 10:00 a.m. and work will begin on Monday. He and Thrasher Engineering are reviewing Phase II of 2015 and those plans are progressing at this time. Belinda Biafore stated that April 23 rd, 2015 will be the next Mayors on the Move Meeting. She also added that she assisted in obtaining a grant with the City for upgrading their shooting range which will be also used by the local municipalities for qualifications. She added that the First Responders Event is coming up soon. The zip line is installed and ready. There will be fire fighter demonstrations and events. Commissioner VanGilder held the Court attention as he told a story/study that wound up being a joke; which was very funny. President Elliott wanted to inform the public that there will be a Spring into Action Event on Monroe Street in Fairmont sponsored by Leadership Marion and the funds raised at the Event will be donated to a series of non-profits. There being no further business to come before the County Commission, it is ordered that this Commission do now recess until, Wednesday, April 22 nd, 2015 at 10:00 a.m. for the next scheduled County Commission Meeting.
