12 CITY OF PROSSER WASHINGTON 601 7TH STREET CITY COUNCIL CHAMBERS TRANSPORTATION BENEFIT DISTRICT MEETING TUESDAY, OCTOBER 3, 2017 CALL TO ORDER Chairman Siemens called the Regular Meeting of the Transportation Benefit District (TBD) to order at 6:30 p.m. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was recited. ROLL CALL Board Members Aubrey, Becken, Everett, and Edwards, were present. Board Members Elder and Groom were absent. Others in attendance were Secretary Shaw, Treasurer Yost and City Administrator Stockdale. [Secretary Note: Board Member Elder arrived at 6:31 p.m. Board Member Groom arrived at 6:32 p.m.] BOARD REPORTS AND COMMENTS (None) CONSENT AGENDA A motion was made by Board Member Edwards, seconded by Board Member Elder, to approve Consent Agenda Items A and B. Motion passed 7 YES, 0 NO, 0 ABSENT. a) Consider approval of the August 2017 Financial Statement. b) Approve September 5, 2017 TBD Meeting Minutes. PUBLIC HEARING 2018 Budget Hearing #2 At 6:33 p.m., Chairman Siemens recessed the Regular Meeting of the Transportation Benefit District to conduct a Public Hearing regarding the 2018 Budget. Chairman Siemens called for public comment, with none being offered. At 6:34 p.m., Chairman Siemens closed the Public Hearing and reconvened the Regular Meeting. BOARD DISCUSSION 2018 Proposed Budget Treasurer Yost provided the Board with an overview of the 2018 Proposed Budget. There was discussion regarding the current fees collected and what revenue could be collected for future projects if the Board were to increase the fee. Board Member Aubrey disagreed with raising the fee at all. Chairman Siemens inquired as to the status of the Eyman Initiative. Page 12 of 21

13 Treasurer Yost advised the Eyman Initiative is not yet final. Board Member Everett said with the conditions of the roads, the Board needs to consider increasing the fee as it is a substantial source of revenue. Board Member Groom agreed with Board Member Everett and further stated the Board needs to budget for maintenance so the roads are not in such bad condition. Board Member Elder stated he agreed with Board Members Everett and Groom that the fee needed to be increased. Treasurer Yost advised as a point of clarification the TBD funds could not be utilized for maintenance but congestion relief only. City Administrator Stockdale advised the Legislature recently changed the rules to allow cities who have an active TBD in place for three years, to increase the fee amount without having to take it to the voters. Board Member Elder said he would like to consider increasing the imposed fee amount to from $20 to $30. Council Member Becken said he too would like to consider increasing the imposed fee amount to from $20 to $30. Treasurer Yost advised the Board on the requirements for Public Hearings at both the TBD and the City Council meetings and stated staff would work on drafting a Public Hearing notice for the November meeting. Board Member Aubrey advised the crackseal project is not complete on Wine Country Road. [Secretary Note: Board Member Edwards arrived at 6:49 p.m.] BOARD REPORTS AND COMMENTS (None) CONSENT AGENDA A motion was made by Board Member Becken, seconded by Board Member Aubrey, to approve Consent Agenda Items "A-C." Motion passed 5 YES, 0 NO, 2 ABSENT (Edwards, Siemens). a) Approval of Amended August 1, 2017 TBD Meeting Minutes. b) Approve the Financial Statement for October c) Approval of a reimbursement request for the City of Prosser in the amount of $2, for chip seal and administrative expenses. PUBLIC HEARING 2018 TBD Proposed Rate Increase Treasurer Yost explained that due to an error in publication by the City's official newspaper the Public Hearing would have to be held at a later date. It was determined there would be a special meeting of the Transportation Benefit District on December 5, 2017, for the Public Hearing regarding proposed rate increases to fees. There was discussion regarding the information that needed to be included in the published hearing notice. BOARD DISCUSSION 2018 TBD Proposed Rate Increase Board Member Becken advised he was previously in favor of increasing the fees, however after careful consideration after staff s proposal to fund building a new City Hall, he will not support a fee increase for the TBD. 15 Board Member Everett stated he will not support a new City Hall either, however the Board does need to consider raising the fees to at least $30 since the current rate has not been increased since 2009 when the Board was created. Inflation and gas tax has not been covered. Board Member Groom said she would like to see a better road improvement plan. Board Member Aubrey said he would like to look at cutting something else in the budget rather than increasing the fees. Board Member Elder said the Board needs to increase the fee to at least $30, if not, the conditions of the streets are only going to worsen. PUBLIC HEARING 2018 Final Budget Hearing At 6:49 p.m., Vice Chairman Elder recessed the Regular Meeting of the Prosser Transportation Benefit District to conduct a Public Hearing regarding the 2018 Final Budget. Vice Chairman Elder called for public comment, with none being offered. At 6:49 p.m., Vice Chairman Elder closed the Public Hearing and reconvened the Regular Meeting. BOARD ACTION CONSIDERATION OF ORDINANCE 17-TBD-15 APPROVING THE 2018 BUDGET A motion was made by Board Member Everett, seconded by Board Member Edwards to adopt Ordinance No. 17-TBD-15 adopting the 2018 Budget. Motion passed 6 YES, 0 NO, 1 ABSENT (Siemens). TBD Ordinance 17 - Summary Statement: On October 25th and November 7th the Prosser TBD held public hearings to receive citizen comment regarding a possible change to the vehicle tab fee of $20. In separate action, the Prosser City Council, adopted ordinance allowing the TBD to change the vehicle tab fee from $20 to any amount allowable under the RCW. The proposed ordinance attached, increases the current vehicle tab fee from $20 to $40. If approved, additional action will be necessary to update the service agreement with the State of Washington. Additionally, you will note the fee change is effective July 1, This provides the State the time required to update their system and prepare the billings. 19 PROSSER TRANSPORTATION BENEFIT DISTRICT ORDINANCE NO. 17-TBD- AN ORDINANCE OF THE PROSSER TRANSPORTATION BENEFIT DISTRICT INCREASING THE VEHICLE LICENSE FEE AUTHORIZED BY RCW AND RCW TO $40 EFFECTIVE JULY 1, THE FEES ALLOWED BY ORDINANCE 09-TBD-02 SHALL CONTINUE IN FULL FORCE AND EFFECT FOR VEHICLES REQUIRED TO REGISTER BEFORE JULY 1, THE ORDINANCE ALSO MAKES THE PROVISIONS OF THE ORDINANCE SEVERABLE FROM ONE ANOTHER AND SETS FORTH THE EFFECTIVE DATE OF THE ORDINANCE. WHEREAS, On March 11, 2009, the Prosser City Council established the Prosser Transportation Benefit District (TBD); and WHEREAS, The Prosser TBD began collecting revenue of $20 per vehicle per year in 2009; and WHEREAS, in 2015, the Legislature changed the law to allow TBDs to increase their fee from $20 up to $40 by a majority vote of the TBD Board, provided the $20 had been in place for at least 24 months; NOW, THEREFORE, THE BOARD OF THE CITY OF PROSSER WASHINGTON TRANSPORTATION BENEFIT DISTRICT, DO ORDAIN AS FOLLOWS: Section 1. Annual vehicle fee. Effective July 1, 2018, the annual vehicle fee authorized by RCW and RCW in the amount of twenty dollars ($20.00) per vehicle per year by ordinance number 09-TBD-02 is increased to a total of forty dollars ($40.00) per vehicle per year, consistent with RCW and RCW , to be collected by the Washington Department of Licensing on qualifying vehicles, as set forth in RCW and chapters and RCW. Section 2. The fees allowed by ordinance 09-TBD-02 shall continue in full force and effect until the effective date of this Ordinance and such fees shall continue to apply to all vehicles required to register before July 1, Section 3. Severability The provisions of this ordinance are hereby declared to be severable. If any section, subsection, sentence, clause, or phrase of this ordinance or its application to any person or circumstance is for any reason held to be invalid or unconstitutional, the remainder of this ordinance shall not as a result of said section, subsection, sentence, clause, or phrase be held Page 19 of 21

20 unconstitutional or invalid. Section 4. Effective Date. This ordinance shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title.
