1 CITY OF PALMDALE REPORT to the Mayor and Members of the City Council from the City Manager DATE: May 7, 2014 SUBJECT: Proposed Ordinance No of the City of Palmdale amending the Palmdale Fire Code by repealing the adopted by reference Title 32, 2011 Fire Code of Los Angeles County, effective January 1, 2011 and adopting Title 32, 2014 Fire Code of Los Angeles County, effective June 7, 2014 which incorporates by reference the 2013 California Fire Code and adopting amendments to said Codes. ISSUING DEPARTMENT: Development Services-Building and Safety SUMMARY Issues: Shall the City Council adopt proposed Ordinance No and amend the Palmdale Fire Code as proposed? Recommendation: Hold public hearing and approve ordinance No adopting the City of Palmdale Fire Code and amendments. Therefore, it is recommended that the City Council approve the reading of Ordinance No. 1454, hold a public hearing on said Ordinance and after closing the public hearing adopt Ordinance No Fiscal Impact: None. BACKGROUND The proposed Ordinance 1454 will adopt Title 32 of the Los Angeles County Code as the Fire Code for the City of Palmdale. The County made several findings in support of amendments to the State Fire Code. Those findings are attached as exhibit 1. Proposed Ordinance 1454 would ratify their findings and adopt the Los Angeles County Fire Protection District Fire Code as the City's Fire Code. California law requires building standards adopted by local jurisdictions that are more restrictive

The California Health and Safety Code Section authorizes the Fire District to adopt such standards, but requires ratification by the legislative body where the standards will apply. 3 CITY OF PALMDALE COUNTY OF LOS ANGELES, CALIFORNIA ORDINANCE NO AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALMDALE ADOPTING BY REFERENCE TITLE 32 OF THE LOS ANGELES COUNTY CODE AS THE CITY OF PALMDALE'S FIRE CODE WHEREAS, The City of Palmdale has adopted Title 32 of the Los Angeles County Code as the City of Palmdale's Fire Code; and WHEREAS, On March 25, 2014, Los Angeles County adopted amendments to the Los Angeles County Code, Title 32 and adopted Ti 32 as the Fire Code for the Consolidated Fire Protection District of the County " ngeles; and WHEREAS, The amendments tot ngeles County Code, Title 32 contain more restrictive fire and life safety b ndards than those adopted by the State Fire Marshall and such more restricti andards are necessary to address the specific climatic, geological, and topographical conditions in the city of Palmdale and to protect the health, safety, and welfare of its citizens,; and WHEREAS, Pursuant to Section ?(c) of the California Health & Safety Code, the local amendments containing more restrictive building standards are not effective until ratified by the Palmdale City Council. THE CITY COUNCIL OF THE CITY OF PALMDALE DOES ORDAIN AS FOLLOWS: SECTION 1. The City Council finds that the more restrictive buildings standards contained in Title 32 of the Los Angeles County Code, as approved by the Los Angeles County Board of Supervisors on March 25, 2014, are reasonably necessary due to local climatic, geological, and topographical conditions in the city of Palmdale. SECTION 2. Title 32 of the Los Angeles County Code, as approved by the Los Angeles County Board of Supervisors on March 25, 2014, is hereby adopted as the City of Palmdale's Fire Code. SECTION 3. Section of the Palmdale Municipal Code is amended to read as follows:
4 Ordinance No Page 2 of Adoption of the Palmdale Fire Code. As amended, Title 32, Fire Code, of the Los Angeles County Code effective April 24, 2014, adopting with certain changes and amendments the 2013 Edition of the California Fire Code and 2012 edition of the International Fire Code is adopted and incorporated herein by reference and shall constitute, and may be cited as, the "Palmdale Fire Code." A copy of the Palmdale Fire Code has been deposited in the office of the City Clerk and is maintained for use and examination by the public. SECTION 4. Severabilitv. If any section, subsection, subdivision, paragraph, sentence, clause or phrase in this Ordinance or any part thereof is for any reason held to be unconstitutional or invalid or ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this Ordinance or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase thereof irrespective of the fact that any one ( 1) or more subsections, subdivisions, paragraphs, sentences, clauses or phrases be declared unconstitutional, or invalid, or ineffective, provided the basic purposes of this Ordinance and the benefits to the City and the public are not substantially impaired. SECTION 3. The City Clerk shall certify to the adoption of this ordinance and shall cause this ordinance to be published or posted as required by law.
