3 Committee Reports 1.0 Minutes Committee of the Whole meeting CW#12-17 held on September 5, 2017 Pages 33 to 44 The Committee of the Whole presents its Report for meeting CW#12-17 held on September 5, 2017 and respectfully recommends that the minutes be adopted as circulated and the following recommendations be approved: and Committee Meeting Schedule (Staff Report SRCFS ) (Item 2) Recommendation 1 That the 2018 and Committee meeting schedule, as set out in Appendix A to Staff Report SRCFS , be approved Status Report of the Richmond Hill Accessibility Plan (Staff Report SRCFS ) (Item 3) Recommendation 2 a) That staff report SRCFS regarding the 2016 Status Report of the Richmond Hill Accessibility Plan, attached as Appendix A to Staff Report SRCFS , be received; b) That the 2016 Status Report of the Richmond Hill Accessibility Plan be posted on the Town s website as required by the Accessibility for Ontarians with Disabilities Act, Richmond Hill Mobility Accessibility Foundation Grant Request (Staff Report SRCFS ) (Item 4) Recommendation 3 a) That the Richmond Hill Mobility Accessibility Foundation grand request, as set out in Appendix A to Staff Report SRCFS , be received; b) That a grant in the amount of $50,000 be allocated from the Disabled Parking Reserve. 1
4 1.4 Proposed Municipal Asset Management Planning Regulation (Staff Report SREIS ) - (Item 5) Recommendation 4 a) That endorse staff report SREIS and the Town s July 24, 2017 submission to the Province of Ontario (EBR Registry Number ) (Attachment 1) for its consideration in the review of regulations for the Infrastructure for Jobs and Prosperity Act, 2015 (Attachments 2-5); b) That a copy of staff report SREIS and all comments from be sent to the Ministry of Economic Development, Employment and Infrastructure, the Association of Municipalities of Ontario, York Region and all municipalities in York Region. 1.5 Update to Blackmore Avenue Temporary Parking Regulation (Staff Report SRPRS ) (Item 6) Recommendation 5 a) That the temporary parking restrictions introduced in SRPRS for Blackmore Avenue during the construction of the Ed Sackfield Arena Twinning and David Hamilton Park Revitalization Project be adjusted as follows: 1. Remove the temporary parking prohibition introduced on the east side of Blackmore Avenue, between the southern driveway of Doncrest Public School to Ronald Avenue. 2. Revise the parking prohibition hours on the east side of Blackmore Avenue, between the northern and southern driveways of Doncrest Public School to indicate no parking from 8:00 a.m. to 9:00 a.m., Monday to Friday, except July and August. 3. Permit short-term (10 minute) parking for pick-up activities on the east side of Blackmore Avenue, between the northern and southern driveways of Doncrest Public School from 3:00 p.m. to 4:00 p.m., Monday to Friday, except July and August. b) That Chapter 1116, Schedule A (Parking Prohibited Signs Displayed) of the Municipal Code be amended to reflect above recommendations (a) 1 and (a) 2 revising the item pertaining to Blackmore Avenue as follows: 2
5 (The table below sets out the revised parking prohibitions) Highway Side From and To Prohibited Time of Day Blackmore Avenue East South limit of westerly leg to a point 184 m thereof 8:00 a.m. 9:00 a.m. Mon Fri July and August exempt c) That Chapter 1116, Schedule G (Permitted Parking) of Municipal Code be amended to reflect recommendation (a) 3 by adding the following: (The table below sets out the revised parking prohibitions) Highway Side From and To Blackmore Avenue East South limit of westerly leg to a point 184 m thereof Maximum Period Permitted 10 minutes Time / Day(s) 3:00 p.m. 4:00 p.m. Mon Fri July and August exempt d) That upon completion of the Ed Sackfield Arena Twinning and David Hamilton Park Revitalization Project, the Municipal Code with respect to recommendations in staff report SRPRS and the previous staff report (SRPRS ) be amended to revert back to the condition prior to the construction and all signage with respect to recommendation be reinstated back to reflect the municipal code accordingly; and e) That the delegated authority given to the Commissioner of Planning and Regulatory Services include the authorization to extend the implementation date of Recommendation (d) to accommodate any unforeseen construction delays. 3
6 1.6 Request for Approval Zoning By-law Amendment Application Zaid and Tarik Toma 252 Sunset Beach Road File Number D Related File D (Staff Report SRPRS ) (Item 7) Recommendation 6 That the Zoning By-law Amendment application submitted by Zaid and Tarik Toma for the lands known as Part of Lot 5, Plan 163 (Municipal address: 252 Sunset Beach Road), File: D , be approved, subject to the following: a) that the subject lands be rezoned from Residential Third Density (R3) Zone under Zoning By-law 1703, as amended, to Single Detached Six (R6) Zone under Zoning By-law , as amended, as outlined in Staff Report SRPRS ; b) that the draft Zoning By-law Amendment as set out in Appendix B to SRPRS , be approved; c) that all comments concerning the related Site Plan application, File Number D , be referred back to staff. 1.7 Proposed Resolution of Official Plan Appeals by Appellant #21 (Rice Commercial Group and Major Mac Realty Inc.) related to Sections (Streets and Rights-of-Way) and (Functional Street Classification) - OMB File Number PL (Staff Report SRPRS ) (Item 8) Recommendation 7 a) That staff report SRPRS regarding the Proposed Resolution of Official Plan Appeals by Appellant #21 (Rice Commercial Group and Major Mac Realty Inc.) related to Sections (Streets and Rights-of-Way) and (Functional Street Classification), OMB File Number PL110189, be received; b) That the Ontario Municipal Board be advised that the modifications to the Richmond Hill Official Plan described in Appendix 1 to staff report SRPRS are supported by the Town and are recommended for approval on a Town-wide basis by the Ontario Municipal Board for the reasons set out in SRPRS ; c) That appropriate Town staff be directed to appear at the Ontario Municipal Board hearing in support of s position concerning the proposed settlement. 4
7 1.8 Award of Contract RFQ Supply, Delivery, Removal and Installation of Permanent and Seasonal Waste and Recycling Receptacles (Staff Report SRCS.17.19) (Item 12) Recommendation 8 a) That additional funding in the amount of $138,242 (excluding taxes) funding from the Federal Gas Tax Reserve Fund, be allocated to the approved 2017 capital budget for the supply, delivery, removal and installation of permanent and seasonal waste and recycling receptacles and be awarded to Hawkins Contracting Services Limited pursuant to RFQ-71-17; b) That the Commissioner of Community Services be authorized to execute any necessary documentation to affect the contract. 1.9 lor Chan - Application for National Historic Site designation for the David Dunlap Observatory (Item 11) Recommendation 9 Whereas the Historic Sites and Monuments Board of Canada has the mandate to recommend to the Minister responsible for Parks Canada on the designation of nationally significant places, persons and events on the marking of these subjects to enhance awareness, appreciation and understanding of Canada s history; Whereas the David Dunlap Observatory (DDO) was at the forefront of Canadian astronomical research since its opening in 1935 where a 74- inch (1.88m) reflector telescope, the largest in Canada is housed, and the first direct evidence that the energetic galactic X-ray source in the constellation Cygnus X-1 was a black hole was provided; Whereas adopted Designation By-law to designate the complete DDO property at 123 Hillsview Drive, Richmond Hill as a "property of cultural heritage value or interest" under Ontario Heritage Act on September 29, 2009; Whereas approved Designation By-law at the Special Meeting on June 6, 2017 to amend Designation By-law to reflect the new extent of the protected area, including the land and buildings that have been transferred to the ownership of the Town of Richmond Hill on March 21, 2017; and Whereas the Town of Richmond Hill, as the owner of the DDO property, can apply for the Historic Sites and Monuments Board of Canada s consideration of the DDO property as a National Historic Site; 5
8 Therefore Be It Resolved that direct staff to report back on an application for designation of the DDO property identified under the Designation By-law as a National Historic Site by the end of 2017 for consideration by the Historic Sites and Monuments Board of Canada. By-Laws No By-laws to be considered. 6
