PATRICIA BLOCHOWIAK MS. PAMELA MCCLARIN 1. RESOLUTION TO AUTHORIZE A CONTRACT WITH AND PAYMENT TO TOSHIBA BUSINESS SOLUTIONS 94/13 WHEREAS, the is party to an agreement with Xerox for the provision of certain copier equipment (including addenda thereto), whereby the District pays a minimum of $21,787 per month; and, WHEREAS, Toshiba Business Solutions has offered to enter a new five year Equipment Lease-Purchase Agreement with the for the provision of replacement copier equipment to the District at a reduced rate of $18,989 per month, which equates to a total annual expenditure of $227,868; and, WHEREAS, Toshiba Business Solutions has agreed to reimburse the District $130,722 (representing the remaining six months of payments through August, 2013 owed by the District to Xerox under the District s current agreement with Xerox) to facilitate an immediate transition to Toshiba; and, WHEREAS, on February 26, 2013, the Board took action at a special meeting to authorize the Superintendent to sign the Equipment Lease-Purchase Agreement and associated documentation with Toshiba Business Solutions for the provision of replacement copier equipment, and to take all necessary actions to effectuate the terms of the Agreement. NOW, THEREFORE, BE IT RESOLVED, by the of the East Cleveland City School District, Cuyahoga County, Ohio, that: 4

5 Section 1. The hereby approves the Equipment Lease-Purchase Agreement and associated documentation with Toshiba Business Solutions for the provision of replacement copier equipment, a copy of which is attached hereto as Exhibit A (hereinafter, the Agreement ) retroactive to February 26, 2013 the Board of Education further authorizes the Superintendent to sign the Agreement, and to take all necessary actions to effectuate the terms of the Agreement. Section 2. It is found and determined that all formal actions of this Board concerning and relating to the adoption of this Resolution were adopted in an open meeting of this Board, and that all deliberations of this Board and of any of its committees that resulted in these formal actions were in meetings open to the public and in compliance with the law. RESOLUTION TO AUTHORIZE A CONTRACT WITH AND PAYMENT TO THE FREDRICK MOODIE 95/13 WHEREAS, the will contract with Fredrick Moodie to introduce basic steps and movement of tap dance to students in the East Cleveland City Schools Cultural Arts Program for the school year, therefore, be it RESOLVED, that this Board authorizes the Treasurer to encumber and pay an amount not to exceed $3, for said services from the General Fund-001. RESOLUTION TO AUTHORIZE A CONTRACT WITH AND PAYMENT TO DONTAVE COWSETTE SR. 96/13 WHEREAS, the will contract with Dontave Cowsette to provide sound and lighting for the production of the play Coming Home held on May 17, 2013 at Shaw High School at a cost of $200.00; therefore, be it RESOLVED, that this Board authorizes the Treasurer to encumber and pay an amount not to exceed $ for said services from the Instructional Music Fund-001. Ayes: Ms. Westbrooks, Ms. McClarin, Dr. Keenon, and Dr. Blochowiak. 3. RESOLUTION TO AUTHORIZE A CONTRACT WITH AND PAYMENT TO WALTER SCRUTCHINGS 98/13 WHEREAS, the will contract with Walter Scrutchings to perform as the accompanist for Shaw s 2013 graduation rehearsal and performance at Cleveland State University Wolstein Center on May 31, 2013 at a cost of $200.00; therefore, be it RESOLVED, that this Board authorizes the Treasurer to encumber and pay an amount not to exceed $ for said services from Shaw High School s Instruction and Music Supplies Fund-001. Ayes: Ms. Westbrooks, Dr. Blochowiak, Dr. Keenon, and Ms. McClarin. 5. RESOLUTION TO AUTHORIZE A CONTRACT WITH AND PAYMENT TO JAMES MCMANUS 99/13 WHEREAS, the will contract with James McManus to perform as disc jockey for the JROTC Military Ball at a cost of $185.00; therefore, be it RESOLVED, that this Board authorizes the Treasurer to encumber and pay an amount not to exceed $ for said services from the Shaw JROTC Fund-001. RESOLUTION TO AUTHORIZE A CONTRACT WITH AND PAYMENT TO IDEASTREAM/WVIZ 100/13 WHEREAS, the will contract with Ideastream/WVIZ PBS 90.3 to provide a teacherline course for East Cleveland City School District teachers for the school year at a cost of $6,000.00; therefore, be it RESOLVED, that this Board authorizes the Treasurer to encumber and pay an amount not to exceed $6, for said services from the SIG Fund-537. Ayes: Ms. Westbrooks, Dr. Blochowiak, Dr. Keenon, and Ms. McClarin. 8

9 Committee Meeting held May 9, 2013 VI. REPORTS OF COMMITTEES C. FINANCE MS. PAMELA MCCLARIN MS. EVE LYNN WESTBROOKS 1. RESOLUTION TO AUTHORIZE A CONTRACT WITH AND PAYMENT TO K12 SCHOOL CONSULTANTS, L.L.C. 101/13 WHEREAS, the has contracted with K12 School Consultants, LLC to verify the residency of students and provide follow up investigation services, and WHEREAS, K12 has provided SOES Verification Services with the Ohio Department of Education, and WHEREAS, K12 Consultants will identify more students than the original contract, not to exceed $17,000.00; therefore it be RESOLVED, that this Board authorizes the Treasurer to encumber and pay an amount not to exceed $17, for said services, from the General Fund/Business Contracted Services Fund-001. Ayes: Ms. McClarin, Ms. Westbrooks, Dr. Keenon and Dr. Blochowiak. 9

RESOLUTION TO AMEND THE PERMANENT APPROPRIATION 102/13 WHEREAS, it is necessary to amend the permanent appropriation for the East Cleveland City School District for the year ending June 30th, 2013 and file it with the Cuyahoga County Auditor, therefore be it RESOLVED, that the appropriation is within the parameters of the estimated revenues and carry-over balances, also to be filed with the Cuyahoga County Auditor s office, and further be it RESOLVED, that this authorizes the Treasurer of the East Cleveland City School District to make any adjustments as necessary to bring the appropriation into balance and file such appropriation amendment with the Cuyahoga County Auditor. (See exhibit #1.) Ayes: Ms. McClarin, Ms. Westbrooks, Dr. Keenon and Dr. Blochowiak. 10

11 3. RESOLUTION TO APPROVE A TEACHER PROFESSIONAL ORGANIZATION AGREEMENT 103/13 WHEREAS, In accordance with Article V of the Board/ECEA Agreement, the Board agrees to appoint and employ the Teacher (Mary Alice Conkey) to perform and carry out duties as President of the North Eastern Ohio Education Association. This Agreement is for a term of one year, September 1, 2012 to August 31, 2013, with the inclusive dates as shown, said Agreement being subject to all provisions of law. In consideration of the services rendered by the Teacher, the Board agrees to pay the Teacher the salary as set forth in this contract. The salary shall be paid in the installments 1 st pay in March 2013 and 1 st pay in June 2013, and WHEREAS, the terms and conditions that NEOEA will submit reimbursement for this stipend ($7,943) and all associated fringe benefit costs ($1,271) to the East Cleveland in two installments: the 1 st of March 2013 and 1 st of June Should fringe benefit costs change, the reimbursement will change accordingly. The East Cleveland will invoice NEOEA no less than fourteen days before each of these installments, and WHEREAS, Teacher agrees to comply with all applicable law and reasonable rules and regulations adopted by the Board, and WHEREAS, this Agreement is subject to all existing agreements negotiated, or subsequently negotiated, between East Cleveland Education Association and the Board, the terms and conditions of which are incorporated herein by reference, therefore be it RESOLVED, that this authorizes the Treasurer of the East Cleveland City School District to pay said stipend following adoption by the Board of Education. (See exhibit #3.) Ayes: Ms. McClarin, Dr. Blochowiak, Dr. Keenon and Ms. Westbrooks. 11

RESOLUTION TO REVERT STALE CHECKS TO THE GENERAL FUND IN ACCORDANCE WITH ORC SECTION 9.39 AND AUDITOR OF STATE BULLETIN /13 WHEREAS, payroll checks in the amount of $71, and warrants in the amount of $183, are over five years old and may revert to the General Fund of the in accordance with ORC Section 9.39 and Auditor of State Bulletin 91-11, and WHEREAS, subsequent to this action, if the rightful owner claims the unpaid money, a warrant/check will be paid from the General Fund, therefore be it RESOLVED, that the of the East Cleveland City School District acknowledges the aforementioned administrative process for the disposition of stale checks and authorizes the Treasurer to take necessary action. Ayes: Ms. McClarin, Ms. Westbrooks, Dr. Keenon and Dr. Blochowiak. 5. RESOLUTION TO DEPOSIT STALE CHECKS INTO THE UNCLAIMED MONIES FUND #022 IN ACCORDANCE WITH ORC SECTION 9.39 AND AUDITOR OF STATE BULLETIN /13 WHEREAS, payroll checks in the amount of $10, and warrants in the amount of $35, between one and five years old are being carried as outstanding on records, and WHEREAS, in accordance with ORC Section 9.39 and Auditor of State Bulletin 91-11, these checks should be deposited into the Unclaimed Monies Fund #022, therefore be it RESOLVED, that the of the acknowledges the aforementioned administrative process for the deposit of stale checks from one to five years old and authorizes the Treasurer to take necessary action.
