1 Minutes of the Board of Ward County Commissioners June 18, 2013 The regular meeting of the Ward County Commission was called to order by Chairman Nybakken at 9:18 a.m. with Comm. Gruenberg, Fjeldahl, Walter, and Weppler present. Also present were Department Heads; Dana Larsen, Devra Smestad, Betty Braun, Amanda Schooling, Dale Braun, Mark Schrader and Steve Kukowski. Additionally, the Commission welcomed Family and Consumer Science Extension Agent Ellen Bjelland and the new Building Supervisor Leona Lochthowe to the County. Highway Engineer Dana Larsen appeared. Larsen introduced Safety Director Max Schriock who appeared on behalf of Aggregate Construction. Aggregate Construction is requesting permission for a weight variance on County Road 6 as a haul road. Moved by Comm. Fjeldahl, seconded by Comm. Walter to sign County Road 6 from State Highway 28, east 0.6 miles to the access to Outlot 8 as a 105,500 lb. road subject to inclusion of a bonded warranty to be renewed annually at $100,000 from Aggregate Construction to cover damages to County Road 6. Roll call: all voted yes; except Comm. Weppler who voted no; motion carried. The Highway Department would like to purchase a Freightliner truck. Quotes were submitted from both Westlie Motors and Wallworks. Moved by Comm. Weppler, seconded by Comm. Gruenberg to authorize the Highway Department to enter into a 3 year lease purchase of a 2012 Freightliner 122 SD Truck from Westlie Motor Company with 3 equal payments of $39, per year. The Highway Department has selected KLJ Engineering to complete damage assessments on Federal Aid Roads and begin on plans for emergency repair. The top two priorities are to reopen County Road (CR) 14, just west of CR 9, and to repair and reopen the Foxholm Bridge. 452

5 The Highway Department met with Department of Emergency Services (DES) on June 13 to look at two sites that were sole access and were verbally notified by the DES that they could proceed with getting quotes to complete emergency grade raises. Moved by Comm. Fjeldahl, seconded by Comm. Walter to award the emergency grade raise on County Road 18 for sites 28A and 28B to Meyer Construction for $62,654. Roll call: all voted yes; motion carried. Moved by Comm. Fjeldahl, seconded by Comm. Weppler to award the emergency grade raise on Rushville Township Road for sites 1A, 1B and 2 to Dig It Up Backhoe Service for $90,427, contingent on written approval from Department of Emergency Services. Weppler to approve the Resolution for the dangerous intersection at US Highway 83 and Highway s 2 & 52 Bypass as follows: RESOLUTION Ward County, North Dakota Interchange at US Highway 83 Bypass & US Highway s 2&52 Bypass Intersection WHEREAS, traffic has increased significantly at this intersection since 2008 through 2012; and WHEREAS, traffic has increased 57% since 2008 on Highway s 2&52 west of the intersection with Highway 83 Bypass; and WHEREAS, traffic has increased 27% since 2008 on Highway s 2&52 east of the intersection with Highway 83 Bypass; and WHEREAS, traffic has increased 67% on Highway 83 Bypass north of the intersection with Highway s 2&52; and WHEREAS, a recent death at the intersection was caused by the poorly functioning intersection; now 453

6 THEREFORE, BE IT RESOLVED, that the Ward County Board of Commissioners calls for an interchange to be constructed at the intersection of US Highway 83 Bypass and US Highway s 2&52 Bypass; BE IT FURTHER RESOLVED, that an interchange is the responsibility of the North Dakota Department of Transportation and the Federal Highway Administration on three Federal Highways; BE IT STILL FURTHER RESOLVED, that both the North Dakota Department of Transportation and the Federal Highway Administration act on this resolution as quickly as possible to remove the danger from our County. IT Administrator Jason Blowers appeared. At the last Commission meeting it was approved to award CivicPlus the redesign of the Ward County Website. In the spring of 2012, CivicPlus held a contest to submit a story of why your community needs a website makeover. Blowers submitted a story of the 2011 flood devastation and the rapidly expanding population growth within Ward County. CivicPlus awarded Ward County the 2 nd place prize of $5,000 towards a website package. Blowers announced that CivicPlus agreed to apply that amount to the existing contract total and add an additional 50 web pages to be constructed on the new website. Moved by Comm. Gruenberg, seconded by Comm. Fjeldahl to receive and file the monthly reports, including the financial report. Moved by Comm. Walter, seconded by Comm. Weppler to re-appoint Nancy Neshem and Ernest Medalen to the Ward County Reorganization Board. Moved by Comm. Walter, seconded by Comm. Weppler to accept the CDBG amendment that designates $2,700,000 in additional CDBG Flood Disaster funds for the Burlington Yale Property project. Roll call: all voted yes; motion carried. The Commission reviewed the recommendations from the Taskforce Committee. Moved by Comm. Weppler, seconded by Comm. Fjeldahl to incorporate a Deputy Director position to be considered in the 2014 budget for the Tax Equalization office. Moved by Comm. Walter, seconded by Comm. Fjeldahl to approve the 10% increase for Auditor/Treasurer Devra Smestad to remain in place until December 31, 2013, to assist with the transition of duties with the new Tax Director. The Commission reviewed the Personnel Committee Recommendations. Moved by Comm. Walter, seconded by Comm. Weppler to include AFLAC as another source of benefits to the employees of Ward County. The State Legislation approved a 2% increase for PERS retirement for 2014 and 10.2% increase for health insurance. Moved by Comm. Walter, seconded by Comm. Weppler to approve a 5% COLA increase and the 2% retirement increase be covered by Ward County and not split with the employees. Roll call: all voted yes; except Comm. Fjeldahl who voted no; motion carried. Moved by Comm. Walter, seconded by Comm. Weppler to approve an additional assessor position for the Tax Equalization office to begin in 2013 allotted within the 2013 budget; and additionally add the position to the 2014 budget. Roll call: all voted yes; except Comm. Fjeldahl who voted no; motion carried. Moved by Comm. Walter, seconded by Comm. Gruenberg to approve a Transport Officer be included in the 2014 budget for the Sheriff office. Moved by Comm. Gruenberg, seconded by Comm. Walter to approve a Social Worker III position for the Child Neglect and Abuse Division, to begin in 2013 and to be added to the 2014 budget for Social Services. All other position requests that were requested by Social Services will be discussed after review of statistics at the next Personnel Committee meeting. Moved by Comm. Weppler, seconded by Comm. 7 appeared to add an additional payroll amendment. Leona Lochthowe was hired as the new Building Supervisor. Houmann requested Building Maintenance John Roll have an additional 10% salary raise for one month to assist in the training of the new Building Supervisor. Chairman Nybakken reminded the Commission of the Building Space Needs meeting June 19, 2013 at 9 a.m. and the Special meeting with General Sprynczynatyk on July 1, 2013 at 2 p.m. Sheriff Steve Kukowski stated the Federal Grant request with the US Marshal Service for funding was denied. Kukowski believes this is an appropriate time to request funding through grants established by State Legislators. Discussion was held concerning the Rice Lake Summons that was received from the Rice Lake Recreation Service District to obtain an easement on Defendant s properties for a pipeline to control the flooding conditions. The Commission will discuss a course of action with the State s Attorney concerning the lawsuit. At 11:35 a.m., with no further business, the meeting was adjourned.
