1 Minutes of the Board of Ward County Commissioners June 4, 2013 The regular meeting of the Ward County Commission was called to order by Chairman Nybakken at 11:00 a.m. with Comm. Gruenberg, Fjeldahl, Walter, and Weppler present. 4 Minutes June 4, 2013 Cont d Gruenberg, seconded by Comm. Fjeldahl to authorize the Highway Department to sell the equipment and advertise. The Highway Department has been using GIS since 2000 for mapping and data management. Larsen would like to use Houston Engineering to develop and implement a GIS map view for Ward County. Houston Engineering is a current approved vender through the ND OMB and has developed the ND GIS map view. Larsen presented a proposal to create the flood mapping and parcel viewer for Ward County. The total cost to launch the GIS Web Site would be around $62,000 to $64,000. Larsen will submit an application to the State Water Commission to cost share up to 50%. Moved by Comm. Walter, seconded by Comm. Weppler to authorize up to $32,000 of Oil Production Funds to be used to develop and implement an ArcGIS flood mapping and parcel viewer. Roll call: all voted yes; motion carried. Moved be Comm. Weppler, seconded by Comm. Fjeldahl to authorize the Highway Department to sign a proposal with Houston Engineering, not to exceed $53,000 to develop and implement an ArcGIS Flood Mapping and Parcel Viewer, and authorize the Highway Department to purchase one copy of ArcGIS Server for $9,500 and rent space on an Amazon Cloud Server for around $1,500 per year. The Highway Department is currently in need of a Road Superintendent. Larsen would like to advertise for the position with a midpoint range salary. Moved by Comm. Weppler, seconded by Comm. Gruenberg to allow the Highway Department to advertise for the Road Superintendent position at a salary range of minimum to midpoint ($58,989 to $73,736) based on applicants experience and education. Quotes were submitted for repairs on CR 5 by Dig It Up and Hanson s Excavating. After reviewing the quantities, scope and time frame, the Highway Department would like to team-up the companies on the project to complete repairs in a faster timeline. Both companies agreed to this approach. Comm. Fjeldahl pointed out that bonding should be completed appropriately in the instance something should go wrong. Larsen stated the project will be divided up accordingly. Moved by Comm. Walter, seconded by Comm. Fjeldahl to award the repairs to sites 28, 29, 29A, 29B, 30 and 24C on County Road 5 to Dig It Up and Hanson s Excavating. The City of Minot will be replacing the water line in front of the Highway Department. When reviewing the proposed water line replacement plans, the existing water line does not meet the needs for the building. Larsen presented two quotes from contractors. Moved by Comm. Gruenberg, seconded by Comm. Weppler to approve the quote for $23,950 to bore in the 4 water line to Dig it Up. Larsen presented a map of the May 2013 road status of Ward County roads. Many road grade raises have been needed since 2011 and FEMA has been not been compliant with funding thus far. Additional funding from the State Water Commission has yet to be approved or received. Many roads are still under water and culverts are full or separating. Comm. Fjeldahl stated the issues of the Ward County Roads need to be brought to State level. The Highway Committee Meeting will meet in the Commissioner room on June 11, at 9 a.m. to discuss plans of action. A special meeting of the Commission will then be held after the Highway Committee Meeting on June 11, at 11 a.m. to review and take action on the plans. Highway Assistant Engineer Travis Schmit appeared. The CDBG Committee met and discussed the disconnection of water service for the properties that the county owns and plans on demolishing. States Attorney Roza Larson drafted a letter of opinion for the West River Water District (WRWD) Disconnection Fee. The WRWD is requesting Ward County s newly acquired property to purchase a disconnect permit fee of $2,500 to have services disconnected. Larson recommended denying that fee, for the policy was adopted May 18, 2013 and Ward County was never connected to the services. Per purchase agreements with the prior owners, there was a connection fee to get water and sewer services. Moved by Comm. Walter, seconded by Comm. Fjeldahl to agree with States Attorney Roza Larson s letter of opinion and deny the disconnect permit fee of $2,500 by the WRWD. Roll call: all voted yes; except Comm. Weppler who abstained; motion carried. Currently, the demolition contract is written to disconnect the water service between the curb stop and the main. This will eliminate curb stop leaking at the curb stop, but would not eliminate the source of a leak at the main. Water service companies would like the service disconnected at the water main located beneath paved roadways, which would increase the demolition significantly. Moved by Comm. Walter, seconded by Comm. Fjeldahl to bid to disconnect the water service at the curb stop with an alternative to disconnect the water service at the main. Bid specifications for the demolition and site restoration project are ready for bid. The winning bidder(s) will provide all labor, material, and equipment required to demolish approximately 33 structures; remove, transport, and dispose of debris; and restore the sites, in accordance with HUD guidelines. The project will include removal of basements, foundations, and other flatwork. Restoration will include back fill and compaction of excavations, seeding and general site work. Moved by Comm. Gruenberg to allow the 2013 Ward County Structure Demolition and Site Restoration Project to go out for bid, with the successful bidders being required to complete all demolition and restoration activities no later than October 15, Roll call: all voted yes; motion carried. 440

Building Inspector Mike Larson appeared and stated three individuals bought homes/garages that are to be moved into Ward County and are in compliance with all zoning regulations. Sheriff Steve Kukowski appeared for comment. Steve and Kacey Dupre appeared for comment. Having no other appearances, moved by Comm. Fjeldahl, seconded by Comm. Walter to close the public hearing at 12:21 p.m. Moved by Comm. Fjeldahl, seconded by Comm. Weppler to approve Steve Dupre to move one house and two garages from Robinwood Estates to OLT 18 of Gov Lot 4 Sec N-85W, Harrison Township; Robert Haugland to move one garage from Robinwood Estates to OLT 3 of SE Sec , Willis Township; and Lief Anderson/Bluestone Construction Inc. to move one house from Robinwood Estates to OLT 3 of SE Sec , Willis Township. Roll call: Chairman Nybakken voted yes; Comm. Gruenberg and Comm. Walter voted no; motion carried. Emergency Manager Amanda Schooling appeared. A flood emergency was declared on April 25, 2013 due to the quick snow melt within Ward County. The federal disaster incident period ended on May 8, 2013 according to ND Department of Emergency Management. Moved by Comm. Gruenberg, seconded by Comm. Weppler to suspend the emergency declaration for flooding that was signed on April 25, 2013 to end on May 16, Roll call: all voted yes; motion carried. With the consistent rainfall in Ward County, Schooling recommended opening another Flood Emergency Declaration. Moved by Comm. Walter, seconded by Comm. Blowers presented the Commission a Term Discount Pricing Agreement from SRT Communications for the Ward County Courthouse and Jail. The current three year contract is expiring and will need to be renewed. Moved by Comm. Fjeldahl, seconded by Comm. Walter to renew the SRT Communications Contract for $3,392 per month. After extensive interviews with website vendors, Blowers along with individuals from various departments recommend CivicPlus. CivicPlus demonstrated that they can meet and exceed Ward County expectations in government website design as well as aid the public in finding information easily. To defray the redesign costs, CivicPlus has given Ward County the option to pay over a 4 year period. Moved by Comm. Weppler, seconded by Comm. Walter to award CivicPlus the redesign of the Ward County website. Roll call: all voted yes; except Comm. Fjeldahl who voted no; motion carried. States Attorney Roza Larson appeared. A food truck service was proposed earlier in the year. After review, Larson recommended not taking on liability for a food truck service. Larson believes this will create bigger issues than necessary and too many factors such as licensing, utilities, garbage, lease agreements and limited parking would 442

Walter to approve the resolution of road and bridge levy as follows: Resolution WHEREAS, Section N.D.C.C. provides that 20% of the tax levy made by the County for road and bridge purposes on properties assessed and taxed within the boundaries of incorporated cities shall be remitted to the respective city treasuries; and WHEREAS, tax collections never reach the 100% level because of discounts granted for early payments and also because of abatements and permanent delinquencies and result in approximately a 95% collection; and WHEREAS, the 2012 County levy for road and bridge purposes is.25 mills and the cities 95% share of the 20% would be $5,986.85; and WHEREAS, it would be helpful for the cities to get their shares in a lump-sum payment and the remittance of such lump-sum payment would not create an undue burden on the County to make such an advance at this time, and such a payment would cut down on the administration of accomplishing the intent of the law; NOW, THEREFORE, BE IT RESOLVED, that the County Auditor be authorized and directed to remit 95% of the calculated 20% share of the county road and bridge levy in each City to each City Auditor, as follows: Minot City Auditor $5, Kenmare City Auditor $80.15 Berthold City Auditor $46.95 Burlington City Auditor $90.38 Sawyer City Auditor $25.95 Surrey City Auditor $ TOTAL $ Moved by Comm. Weppler to approve a grade change effective January 2014, for three clerical positions in the Sheriff s office; approve the States Attorney s Office to add two new positions: Victim Witness Coordinator and Assistant State s Attorney in the 2014 budget; and add a 10% increase to Interim Director Devra Smestad s salary with the funds from the Tax Equalization Budget retroactive to May 7, 2013 when Mr. Hagen resigned. Walter to offer the position to Pamela Axtman at an annual salary of $58,427. At 1:25 p.m., with no further business, the meeting was adjourned.
