1 Minutes of the Board of Ward County Commissioners July 16, 2013 The regular meeting of the Ward County Commission was called to order by Chairman Nybakken at 9:00 a.m. with Comm. Gruenberg, Fjeldahl, and Weppler present. Also present were Department Heads; Dana Larsen, Devra Smestad, Betty Braun, Amber Turnquest, Amanda Schooling, Roza Larson, Pam Axtman, Steve Kukowski, Mark Schrader, Leona Lochthowe and Penny Erickson. Moved by Comm. Weppler, seconded by Comm. Fjeldahl to approve the agenda with additions. Roll call: all voted yes; motion carried. Moved by Comm. Gruenberg, seconded by Comm. Weppler to approve the minutes from the special meeting on July 1, 2013 and the regular Commission meeting on July 2, Roll call: all voted yes; motion carried. Smestad then presented the bills with the removal of one bill for further clarification. Moved by Comm. Weppler, seconded by Comm. Highway Engineer Dana Larsen appeared. Total Road Bills $ 1,356, GRAND TOTAL $ 1,582, Larsen presented a progress report on the 2013 emergency relief sites of projects on Federal Highway system roads. All sites have progressed at the construction phase despite rain conditions and the Foxholm Bridge has been completed and is open. Moved by Comm. Gruenberg, seconded by Comm. Weppler to award the emergency grade raise on County Road 11 for site #8 to Hanson s Excavating Inc. for $137,771.75, to award the emergency grade raise on County Road 20 site #13 to Hanson s Excavating, Inc. for $161,319 and award the emergency grade raise on County Road 14 site #14 to Sundre Sand and Gravel for $216,045 and authorize the Chairman to sign the contracts. Roll call: all voted yes; motion carried. Moved by Comm. Gruenberg, seconded by Comm. Fjeldahl to authorize the Highway Department to advertise for bids from engineer companies for the permanent repair work for the emergency relief road project sites. Roll call: all voted yes; motion carried. The Highway Department has been working on the FEMA road sites that are not inundated with water. Until FEMA inspectors arrive, which is expected to be within the next two weeks, no solid plans have been placed. Moved by Comm. Gruenberg, seconded by Comm. Fjeldahl to authorize the Highway Department to advertise for bids on two bridge replacements; the Meadowbrook Bridge and the Kenmare Bridge by County Road 1. Roll call: all voted yes; motion carried. Emergency Management Amanda Schooling appeared. A Memorandum of Understanding (MOU) between Minot City Transit and Ward County on emergency evacuation was presented. The MOU provides guidance and documents understandings related to aspects involved with Minot City Transit support for Ward County evacuation procedures. Moved by Comm. Gruenberg, seconded by Comm. Weppler to authorize the Chairman to sign the MOU with Minot City Transit. Roll call: all voted yes; motion carried. A Community Development Block Grant meeting was held and the committee was informed of 21 private owned vacant lots that are under or on the wet side of the proposed levee. Moved by Comm. Weppler, seconded by Comm. Fjeldahl to send out offer letters to the 21 property owners to acquire their property pending state funding. Roll call: all voted yes; motion carried.
5 Bobbi Ripplinger appeared on behalf of Swanson & Warcup. Currently there are three property owners that are delaying the closing of the property acquisitions by the County. Moved by Comm. Weppler, seconded by Comm. Fjeldahl that the deadline to close is August 15, Roll call: all voted yes; motion carried. Director of Tax Equalization Pam Axtman appeared. Moved by Comm. Gruenberg, seconded by Comm. Sheriff Steve Kukowski appeared. Kukowski received two bid proposals for the Ward County Jail meal services. The bid costs were figured at 100 inmates per day for 365 days per year. Moved by Comm. Weppler, seconded by Comm. Fjeldahl to award the inmate food service and management of kitchen contract to CBM Managed Services with a base cost of $6.84 per inmate per day effective November 1, Roll call: all voted yes, motion carried. A Memorandum of Understanding (MOU) between the City of Minot and Ward County regarding the FY 2013 Edward Byrne Memorial Justice Assistance Grant was presented. The grant will be shared with the Minot Police Department and the Ward County Sheriff s office to fund the purchase of necessary equipment and systems. Moved by Comm. Weppler, seconded by Comm. Gruenberg to accept the grant of $20,399 and that it be divided equally amongst the County and the City and authorize the Chairman to sign. Roll call: all voted yes; motion carried. Kukowski informed the Commission that if an entity has an emergency clause, you can apply for funds offered by the Legislature out of the Statewide Sheriff Fund. Kukowski applied for $10,000 to cover overtime costs and $65,000 for a transport driver for one year. Currently the request is pending. Rice Lake Recreation District representative Michael Braun appeared. The office of the State Engineer of ND authorized a six month extension to continue pumping water from Rice Lake to an area NE of Rice Lake owned by Ward County. The extension is to expire on January 3, Braun requested that the Commission continue to assist them with pumping onto Ward County s property for that six month period until a permanent solution is in place. Comm. Fjeldahl stressed that the lease with the current tenant of the land owned by Ward County is expiring October 21, 2013 and believes that the condition of the land will make it unfeasible to re-lease the land. Moved by Comm. Weppler, seconded by Comm. Gruenberg to approve the continuation of the pumping of water approved by the ND State Engineer until October 21, 2013, when the lease expires, and that a committee be established immediately to discuss the options of the land owned by the County thereafter. Roll call: Comm. Weppler and Comm. Gruenberg voted yes; Comm. Fjeldahl and Chariman Nybakken voted no. Motion tied. At 10:30 a.m. the discussion was tabled for research on the tied vote. Auditor/Treasurer Devra Smestad appeared. Moved by Comm. Weppler, seconded by Comm. Fjeldahl to receive and file the following correspondences: City of Minot Annexations & Rezoning; Enbridge Safety & Maintenance work in our area; Chamber of Commerce Economy at a Glance; Swanson & Warcup Schall Property; Crowley Fleck Enbridge 10 year plan; Garrison Diversion Recreation Grant Program; State of ND 6 month extension for Rice Lake Recreation Service District; NDDOT response to US 83 Bypass and US HWY s 2 & 52; State of ND Minot to Velva path project; FEMA response & updates; Risk Map Project Revising Maps. 7 Moved by Comm. Fjeldahl, seconded by Comm. Gruenberg to receive and file the monthly reports, including the financial report. Roll call: all voted yes; motion carried. The Commission reviewed the recommendations from the Personnel Committee. Moved by Comm. Weppler, seconded by Comm. Gruenberg that a file clerk position be considered in the 2014 budget for the State s Attorney office. Roll call: all voted yes; motion carried. The Commission reviewed the recommendations from the Liaison Committee. Moved by Comm. Weppler, seconded by Chairman Nybakken to hire a full-time 911 Coordinator as part of the Emergency Management Office with the salary and benefits not to exceed the high end of a County Grade 23 ($72,398). Roll call: all voted yes; except Comm. Fjeldahl who voted no; motion carried. Moved by Comm. Weppler, seconded by Comm. Gruenberg to approve the 2014 wired/wireless 911 preliminary budget. Roll call: all voted yes; except Comm. Fjeldahl who voted no; motion carried. Moved by Comm. Fjeldahl, seconded by Comm. Weppler to approve the Minot Gun Club Raffle Permit. Roll call: all voted yes; motion carried. Moved by Comm. Fjeldahl, seconded by Comm. Weppler that the following payroll amendments be approved: Michael Connole Correctional Officer Sheriff Department (Level 18); Rachel K. Simmons Social Worker III Social Services (Level 21); Kristin Sowitch Eligibility Worker I Social Services (Level 17); Sandra J. Richter Human Service Program Administrator IV Social Services (Level 28); Ismael Liriano Juvenile Detention Officer Juvenile Detention (Level 18). Roll call: all voted yes; motion carried. Smestad informed the Commission the State increased Per Diem rates for employee travel reimbursement on meals. Moved by Comm. Weppler, seconded by Comm. Gruenberg to accept and approve a breakfast reimbursement at $7, a lunch reimbursement at $10.50 and a supper reimbursement at $17.50 effective August 1, Roll call: all voted yes; motion carried. States Attorney Roza Larson appeared to re-open the tabled discussion concerning the tied motion on Rice Lake pumping. Larson stated a tied motion is considered dead and advised a new motion be put forth. Moved by Comm. Nybakken, seconded by Comm. Gruenberg to allow Rice Lake Water District to continue pumping under the current lease agreement with the tenant of Ward County s land until October 21, 2013, at which time Rice Lake must have a renewal lease agreement with the County and either the current tenant or a new tenant. Roll call: all voted yes; except Comm. Fjeldahl who voted no; motion carried. Additionally, Chairman Nybakken requested that Rice Lake Recreation District form a committee to discuss and determine options before the current lease expires. Comm. Fjeldahl volunteered to be on the committee. Chairman Nybakken reminded the Commission of the building space needs meeting with the Citizens Committee on July 17, 2013 at 9 a.m. At 11:08 a.m., with no further business, the meeting was adjourned. At 11:12 a.m., the meeting was re-convened. Emergency Management Amanda Schooling and Highway Engineer Dana Larson appeared to discuss the response from FEMA and the Department of Emergency Services (DES). Numerous questions were asked as what to do with the inundated roads within Ward County. The response from FEMA and the DES had no clarification of the roads and why funding is repeatedly being denied. Schooling would like to draft a separate letter to clarify questions concerning Township funding and Larsen offered to draft an additional letter to request a better explanation on county road grade raises. Letters will be sent to DES for further clarification. At 11:25 a.m., with no further business, the meeting was adjourned.
