1 Bad Axe, Michigan Tuesday, The regular board meeting of the Huron County Board of Commissioners was held on Tuesday,, commencing at 9:00 a.m. in the Board of Commissioners office, Third Floor, Huron County Building, Bad Axe, Michigan. PRAYER AND PLEDGE: The meeting was called to order by Chairman Khoury with The Lord s Prayer and Pledge to the Flag of the United States of America. ROLL CALL: Commissioners present: Chairman Khoury, Dave Peruski, John Nugent, John Bodis, Ron Wruble, Todd Talaski, and Steve Vaughan. AGENDA: The agenda was reviewed. Commissioner Nugent will present a revised resolution for NB #3. Commissioner Bodis moved consent action #6 to NB #5. Motion by Vaughan, seconded by Talaski to approve the agenda as amended. Motion carried. Agenda approved. APPROVAL OF MINUTES: Motion by Bodis, seconded by Talaski to approve the Committee of the Whole minutes of October 10, 2018, the Regular Board minutes of October 10, 2018 and the Committee of the Whole minutes of October 16, Motion carried. Motion by Bodis, seconded by Wruble to approve the Closed Session minutes of October 10, Motion carried. COMMUNICATIONS: A letter from Kelly Walters, Child Care Fund Reimbursement Unit, informing the Board that the annual plan and budget for Child Care Fund expenditures is approved for 50% state reimbursement. An from Mimi Herrington, Director for the Bad Axe Area District Library, requesting to the Board of Commissioners that the Bad Axe Rotary be allowed to install a Little Free Library on the lawn of the courthouse. From the Alger County Board of Commissioner s their resolution # supporting the development and the funding of the twinning of the Poe Lock, resolution # opposing the legalization of marijuana for general use, and resolution # opposing proposed changes to the statewide septic code. ANNOUNCEMENTS: None at this time. PUBLIC COMMENT: (Limit of 3 minutes per person): Robert Gaffke expressed his opinion regarding ABD and the sound study. Debbie Bourgois is running for the 25 th District State Senate. Ms. Bourgois introduced herself and gave a history of her background. Ms. Bourgois asked for everyone s support on the November 6 th election. 9:13 a.m. Walt Schlichting presented the 2018 Apportionment report. Motion by Vaughan, seconded by Bodis to accept Apportionment report. Motion carried. Recess 9:17 a.m. 9:21 a.m. Jerry Johnson, MSUE District 10 Coordinator, and Patti Errer, 4-H Director, presented the annual report. Mr. Johnson talked about how the program is a delivery system for education of many
2 Page 2 types in the county. They have four major areas that include health and nutrition, children and youth, agriculture and agribusiness and Greening Michigan, which has to do with economic development. The county allocates part of the funds for some other programs they offer. Ms. Errer talked about the 4-H program, with 5,517 youth in Huron County, 1,029 participate in 4-H clubs or activities. Ms. Errer said there is one area, near Caseville, where they are looking to expand chapters because of low numbers participating currently in that area. They have been serving Huron County for 100 years. Mr. Johnson said they also have their FIT program or First Impressions Tourism program that has been utilized in Elkton and Sebewaing. Both talked about the benefits their programs can have on local children. 9:57 a.m. CONSENT ACTION: Motion by Wruble, seconded by Bodis to approve the resolutions on the Consent Actions. NEW BUSINESS: RESOLUTION BY PERSONNEL COMMITTEE: # WE, the PERSONNEL COMMITTEE, respectfully beg leave to submit the following resolution for your WHEREAS, there is a need to hire a casual employee to assist with clerical functions in the Public Guardian office; and WHEREAS, Julie Adams has applied for said position in the Public Guardian office; and WHEREAS, Public Guardian Stephen J. Allen has recommended to the Personnel Committee that Julie Adams be hired to fill said position at a rate of $14.48 per hour; now THEREFORE, BE IT RESOLVED that Julie Adams shall be employed effective October 24, 2018 as a casual employee to assist in the Public Guardian office, in accordance with the pay, terms, and conditions of the Huron County Employee Handbook as established periodically by the Huron County Board of Commissioners. 8 Page 8 RESOLUTION BY PERSONNEL COMMITTEE: # WE, the PERSONNEL COMMITTEE, respectfully beg leave to submit the following resolution for your WHEREAS, there is a need to hire a regular part time custodian in the Maintenance Department to fill in when the remaining custodial staff is on vacation, off sick, on leave, etc.; and WHEREAS, Kristi L. Niemiec has applied for said position in the Maintenance Department; and WHEREAS, Peg Booms, Facilities Manager, has recommended to the Personnel Committee that Kristi L. Niemiec be hired to fill said position at a rate of $13.47 per hour, increasing per the following: to $13.68 per hour on January 1, 2019 to $13.89 per hour on April 24, 2019 to $14.10 per hour on October 24, 2019 to $14.31 per hour on January 1, 2020 to $14.76 per hour on October 24, 2020 to $14.98 per hour on January 1, 2021 to $15.45 per hour on October 24, 2021 to $15.68 per hour on January 1, 2022 to $16.17 per hour on October 24, 2022; and WHEREAS, any future wage increases will be determined based on the progression established above; now THEREFORE, BE IT RESOLVED that Kristi L. Niemiec shall be employed effective October 24, 2018 as a part time employee in the Maintenance Department, in accordance with the pay, terms, and conditions of the AFSCME General County Unit I collective bargaining agreement, as negotiated periodically with the Huron County Board of Commissioners. RESOLUTION BY PERSONNEL COMMITTEE: # WE, the PERSONNEL COMMITTEE, respectfully beg leave to submit the following resolution for your WHEREAS, there is a need to amend the Pay Determination process for Appendices A-1, A-2, and A-3 of the Huron County Employee Handbook, specifically as it pertains to the determination of an employee s step on the Salary Progression Schedule following a grade increase; and WHEREAS, it is the recommendation of the Personnel Committee that the sliding scale method be replaced with a step to step method; and WHEREAS, the Personnel Committee also recommends that the step to step method be implemented immediately for all future grade increases; and WHEREAS, the Personnel Committee also recommends that any current employee that received a grade increase and had their step determined pursuant to the sliding scale method and has pending steps at this time, the step for these employees be re-determined and adjusted pursuant to the step to step method (see attached schedule); now THEREFORE, BE IT RESOLVED that the Pay Determination process for Appendices A-1, A-2, and A-3 of the Huron County Employee Handbook be amended by replacing the sliding scale method with a step to step method; and BE IT FURTHER RESOLVED that the pay adjustments of those non-union employees listed on the attached schedule be effective ; and BE IT FURTHER RESOLVED that the pay adjustments of those union employees listed on the attached schedule shall be effective upon written acceptance to the Board of Commissioners office from the union.

RESOLUTION BY PERSONNEL COMMITTEE: # WE, the PERSONNEL COMMITTEE, respectfully beg leave to submit the following resolution for your WHEREAS, Matt Blaine, current Civil Process Server, has been re-assigned to the position Corrections Officer in the Huron County Sheriff s Office; and WHEREAS, Sheriff Kelly J. Hanson has requested that Matt Blaine hereby be compensated as a Corrections Officer at Grade 150, Step 8 with a salary of $46,158. Mr. Blaine will proceed to Step 9 on July 29, 2019; now THEREFORE, BE IT RESOLVED that Matt Blaine shall be transferred effective October 5, 2018 to the position Corrections Officer, in accordance with the pay, terms, and conditions of the POAM Sheriff s General Bargaining Unit collective bargaining agreement, as negotiated periodically by the Huron County Board of Commissioners and subject to the Huron County Office of the Sheriff Policy and Procedures book. RESOLUTION BY LEGISLATIVE COMMITTEE: # WE, the LEGISLATIVE COMMITTEE, respectfully beg leave to submit the following resolution for your WHEREAS, three (3) noise complaints pertaining to commercial wind turbines have been filed with the Huron County Building & Zoning department; and By Bodis WHEREAS, this Board feels it would be advantageous to conduct a noise study to determine whether or not the wind turbines indicated in the complaints are in compliance; and WHEREAS, the cooperation of the complainants during the noise study is imperative; and WHEREAS, a complaint will be deemed closed if a complainant does not cooperate during the noise study by allowing testing equipment and personnel on their property; and WHEREAS, the Building & Zoning Director shall issue a civil infraction for wind turbines found to not be in compliance; and WHEREAS, ABD Engineering & Design has submitted a proposal with a base cost not to exceed $24,500 to conduct a noise study (see attached); now THEREFORE, BE IT RESOLVED that the Huron County Board of Commissioners hereby authorizes ABD Engineering & Design to conduct a noise study as it pertains to commercial wind turbines indicated in the complaints on file in the Huron County Building & Zoning department at a base cost not to exceed $24,500, to be taken from line ; and BE IT FURTHER RESOLVED that this Board hereby authorizes the Chairman to sign the proposal as submitted by ABD Engineering & Design. Motion by Peruski, seconded by Vaughan to approve this resolution. Discussion followed. Roll call vote: Ayes Peruski, and Khoury. Nays Talaski, Vaughan, Bodis, Wruble, and Nugent. Motion by Talaski, seconded by Wruble to grant permission to the Bad Axe Area District Library to place a Little Free Library next to the kiosk on the lawn of the County Building. Motion carried. Oct. 2 nature Center Board meeting. APPROVAL OF BILLS: Motion by Wruble, seconded Bodis to approve monthly bills as submitted. Motion carried. Health Department $101, Board Bills Approved 54, Paid Without Presentation 673, Total $829, FINAL PUBLIC COMMENT: (Limit of 3 minutes per person): Robert Gaffke said the companies have deep pockets and the civil infraction would not do much. Mr. Gaffke again suggested the Board call Rob Rand, they have actually tested turbines for noise. Corporation Counsel Steve Allen defended the equipment used and ABD. FINAL BOARD COMMENT:
