PROCLAMATION a) Special Olympics British Columbia letter dated May 11, 2018 Request for a proclamation to declare July 21, 2018 as the Global Day of Inclusion in the Village of Keremeos. 106/2018: Moved/Seconded WHEREAS, 2018 marks the 50 th Anniversary of the global Special Olympics movement, with the first International Special Olympics Games being held on 20 July 1968 at Soldier Field in Chicago, Illinois, USA; and WHEREAS, Special Olympics vision for a more inclusive world has grown over 50 years to become a global movement for change and social justice that uses sport, health, and education to empower people with and without intellectual disabilities around the world; and WHEREAS, Special Olympics is the global leader with more than five million participants in more than 170 countries in providing continuing opportunities through sports for people with intellectual disabilities to realize their potential, develop physical fitness, demonstrate courage, and experience joy and friendship; and WHEREAS, Special Olympics builds communities of understanding, inclusion, and respect; and WHEREAS, Special Olympics goal for the next 50 years is to end discrimination against people with intellectual disabilities; and WHEREAS, in July of 2018, Special Olympics will kick off a one-year 50 th anniversary; and WHEREAS, Special Olympics is calling for people around the world to commit to making their communities more inclusive by joining in a Global Day of Inclusion on July 21, 2018; THEREFORE BE IT RESOLVED THAT I, Manfred Bauer of the Village of Keremeos, do hereby proclaim our support of Special Olympics British Columbia and declare July 21, 2018 as a Global Day of Inclusion in the Village of Keremeos. 23 ADMINISTRATIVE REPORT TO: FROM: Mayor Bauer and Council Coordinator of Community & Corporate Services DATE: July 16, 2018 RE: 2018 First Half Bylaw Enforcement Report ISSUE/PURPOSE To provide Council with a report of Bylaw Enforcement numbers to June 30, RECOMMENDATION THAT the 2018 First Half Bylaw Enforcement report dated July 16, 2018 be received for information. DISCUSSION 2017 In the first half of 2017 the Village received 49 bylaw enforcement complaints broken down as follows: 1 dog 36 property maintenance 2 zoning 3 traffic violation 0 burning 0 noise 7 other There was 1 dog impounded and 2 municipal tickets issued In the first half of 2018 the Village received 41 bylaw enforcement complaints broken down as follows: 0 dog 32 property maintenance 1 zoning 3 traffic violation 0 burning 4 noise 1 other Page 19 of 41

24 2018 First Half Bylaw Enforcement Report Page 2 July 16, 2018 There was 1 dog impounded and 2 municipal tickets issued for Failure to Comply and Dog Running at Large. Neither of the municipal tickets issued this half have yet to be paid in full. RECOMMENDATION THAT Council receive the Referral Comments report for information prior to consideration of Temporary Use Permit No BACKGROUND INFORMATION On June 20, 2018, the Village issued requests for feedback from regulatory and other stakeholders in regard to the proposed Temporary Use Permit to allow for automotive or trailer repair, service and storage (M2 Zone use) on M1 Zoned property. Referral comments on this proposal have been received from the Village of Keremeos Chief Administrative Officer, Chief Financial Officer, Public Works Department and Building Inspector; Keremeos Irrigation District (KID), Keremeos & District Volunteer Fire Department and Ministry of Transportation and Infrastructure (MoTI). All agencies contacted provided a response for this proposal. The comments received generally indicate that interests are unaffected by the Temporary Use Permit application. Council may wish to note the concerns expressed by the Village of Keremeos Building Inspector, who indicates that a two hour fire separation must be installed within the unit prior to commencement of the proposed M2 Zone use at this property. 35 PLANNING CONSULTANT S REPORT TO: FROM: Mayor & Council Christopher Garrish MCIP, RPP DATE: July 16, 2018 RE: Temporary Use Permit Application Lot 1, Plan KAP48837, District Lot 174, SDYD PID Veterans Avenue Roll PURPOSE: This application is seeking temporary approval for a automotive or trailer repair, service and storage, which is defined as meaning: a business premises or building, where the repair or assembly of vehicles and related machinery (including painting); tire sales and repair; metalworking; and storage are provided. The applicant has described the use as being primarily a cosmetic restoration business, with a focus on the Mazda Miata and other Mazda products Much of our work consists of convertible tops, interior/exterior restoration, electronics (stereo/alarm etc), and general custom and detailing type work. We do not do body repair or paint work, this is subcontracted out. We are not a standard automotive repair facility as one might picture. We are fanatically neat and tidy, do not store items or vehicles outside, and do not generate inordinate noise, fumes, or any other such emission, and pride ourselves on professional presentation and cleanliness. The applicant has also indicated that they will likely seek a rezoning at the end of the TUP (which is being applied for a three year period). OPTIONS: 1. THAT Council approve Temporary Use Permit No ; or 2. THAT Council deny Temporary Use Permit No BACKGROUND INFORMATION: Site Context: The current boundaries of the subject property date to a plan of subdivision deposited in the Land Titles Office at Kamloops on January 14, The property is approximately 3,110 m 2 in area and is situated at the south-west corner of the intersection of Veterans Avenue and 7 th Street. The property presently comprises a single, 4-unit industrial building. Regulatory Provisions: Under the Village s Zoning Bylaw, the General Industrial (M2) zone includes automotive or trailer repair, service and storage as a permitted principal use, but does not define this use. Importantly, the automotive or trailer repair, service and storage use is not listed in the M1 Zone, so is not seen to be permitted hence this application for a temporary use approval. Page 31 of 41

36 Temporary Use Permit Application No Page 2 July 16, 2018 Under the Official Community Plan (OCP) Bylaw, the property has been designated as Low Impact Industrial (LI), an objective of which is the encouragement and support for clean and environmentally friendly light industrial development that provides local employment opportunities and economic diversity in the LI designation. The OCP provides assessment criteria to consider when evaluating a TUP application, these include: the use must be clearly temporary or seasonal in nature; compatibility of the proposal with adjacent uses; impact on natural environment and any remedial measures to mitigate environmental damage; intensity of the proposed use; inability to conduct the proposed use on land elsewhere in the community. REFERRALS: Referral comments were received from the Village s Chief Administrative Officer (CAO), Chief Financial Officer (CFO), Public Works Foreman and Building Official as well as the Ministry of Transportation and Infrastructure (MoTI), Keremeos Irrigation District (KID) and Keremeos Volunteer Fire Department and are included as a separate Agenda item. PUBLIC PROCESS: Adjacent property owners will have received notification of this application with written comments regarding the proposal being accepted until the commencement of the Council meeting on July 16, DISCUSSION: In reviewing this proposal against the assessment criteria provided in the OCP Bylaw, staff note despite the use not being temporary in nature, the applicant has indicated that if the business is successful at this location they will be submitting a rezoning application to formalise the use. This is consistent with the OCP direction that TUP s be used to provide for temporary approval of transitional uses, or uses where uncertainty exists respecting appropriateness or viability of the use, and where it is premature to decide upon rezoning and long-term land use rights. With regard to the compatibility with adjacent uses, staff note that the applicant s business is industrial in nature and will be compatible with other industrial uses in this area. Similarly, due to the industrial nature of this area, staff are not anticipating any negative environmental impacts as a result of this use or the need for remedial actions to mitigate environmental damage. In their application material, the applicant has indicated that there will be no outdoor storage of materials and that the use will be occurring within the fourth unit of the existing industrial building on the site. This is not seen to be represent an overly intensive use of the site and the applicant has indicated that there are limited options in the M2 Zone in which to locate their business. On this latter point, staff understands that the intent of the M1 Zone is to generally allow low impact industrial uses related to wholesale and warehousing with no exterior storage. Despite this, the zone also includes manufacturing plants, which alters the range of uses and makes the exclusion of vehicle repair businesses unusual. Council may wish to give consideration to the range of uses permitted in each of the industrial zones next time the zoning bylaw is reviewed. Page 32 of 41
