Call to Order The Agriculture Advisory Committee was called to order by the acting Chair at 3:02 p.m. 2. Adoption of Agenda It was MOVED and SECONDED THAT the Agriculture Advisory Committee adopt the agenda for the meeting held on March 18, 2019 as amended to include items 5.5. and 5.6. CARRIED UNANIMOUSLY 3. Adoption of Minutes It was MOVED and SECONDED THAT the Agriculture Advisory Committee adopt the minutes of the March 2, 2018 meeting as circulated. CARRIED UNANIMOUSLY
3 Business Arising from Prior Meetings 5. New Business 5.1 Committee Orientation and Election of Chair The Director of Corporate Services provided an overview of an advisory committee, the process and requirements for electing a chair as well as the definition of quorum and the process for taking minutes. Discussion regarding the process for bringing items forward to Council ensued. The Director of Corporate Services left the meeting at 3:30 p.m. 5.2 Official Community Plan Update The Manager of Special Projects provided an overview off the Official Community Plan (OCP) to be adopted this year by Council. The current OCP was explained as well as the new key components, including policies and goals. The agriculture section was presented in detail which included the next steps. Members at large asked staff to provide an overview of the percentage of ALR land in the City and the percentage on zoning in the City. Discussion also ensued on how to encourage development for agriculture and what percentage of the ALR is grapes compared to farming as well as what the future of the ALR will look like. The Committee asked staff to provide an overview of the percentage of ALR land in the City and the percentage on zoning in the City. A member at large discussed how having a Penticton Indian Band representative on the Committee would be beneficial. 5.3 Agriculture Land Commission Act Changes The Planning Manager provided an overview of the Agriculture Land Commission Act Changes which include Bill 52 that was adopted on February 22, 2019 and Bill 15 that could be regulated this year. The Committee was notified that there is potential for an ALC representative to attend a future Committee meeting, however, this will be discussed at a future meeting. 5.4 Future Meeting Dates The Committee discussed future meeting dates and it was decided that a doodle poll will be sent out to secure a date in early April. 4 Appointment of Agriculture Advisory Committee Chair and Vice Chair A member at large nominated Rod King as Chair and he accepted. It was MOVED and Seconded THAT the Agriculture Advisory Committee elect Rod King as Chair. CARRIED UNANIMOUSLY The Committee deferred the nomination and election of the Vice-Chair to the next meeting. 5.6 Penticton Indian Band Representative It was MOVED and SECONDED THAT the Agriculture Advisory Committee recommends to Council to explore the possibility of inviting a Penticton Indian Band member to sit in on the Agriculture Advisory Committee in an advisory capacity role. 6. Council Outcome CARRIED UNANIMOUSLY 7. Next Meeting The next scheduled meeting of the Agriculture Advisory Committee to be determined. 8. 5 - 4 - Memo to Committee Date: April 5, 2019 File No: 2019 PRJ-056 To: Agriculture Advisory Committee From: Randy Houle, Planner I Address: 856 Carder Road Subject: Zoning Amendment PL Staff Recommendation THAT the Agriculture Advisory Committee recommends that Council support RZ PL , being a bylaw to add the following section to the A (Agriculture) zone: Section In the case of Lot B, DL 187, SDYD, Plan 38091, located at 856 Carder Road, agri-tourism accommodation shall be permitted. Background The subject property (Attachment A) is currently zoned A (Agriculture) and is within the Agricultural Land Reserve. The size of the property is acres and features a cherry orchard along with a single family dwelling and farm buildings. Photos of the site are included as Attachment D. The property is located along the Naramata bench, adjacent to the KVR. The applicant is proposing to construct four, 600ft 2 cabins on the NE corner of the property to be used for agri-tourism accommodation. The cabins are bachelor-type units, with a wet bar and small bathroom. Although this use is permitted in the ALR, the use is not permitted in the A (Agriculture) zone of the City s bylaw. Therefore, a site-specific zoning amendment is required. Technical Planning Committee The application was reviewed by the City s Technical Planning Committee, comprised of members from the building, engineering, public works, fire and planning departments. Several items were discussed, including fire response, servicing upgrades and electrical requirements. These items will be addressed through the building permit stage. Analysis Support Application According to ALC regulation, agri-tourism accommodation is permitted, without needing to bring an application to the ALC, if all of the following apply: The land is classified as a farm under the Assessment Act, which is the case here.
6 The total developed area for structures, landscaping and access is less than 5% of the parcel. The proposal is for approximately 2.3%. The accommodation is limited to 10 sleeping units in total. Sleeping units include bedrooms in a cabins, trailers, tents, etc. Dwellings with kitchens are not permitted. The current proposal is for four cabins with one sleeping unit in each. If the accommodations prove successful, the applicant would like to have the ability to add two additional cabins for a total of six. Accommodation is seasonal and on a short term basis (less than 30 consecutive days). The applicant intends on doing seasonal short-term rentals. The accommodation is in relation to an agri-tourism activity occurring on the farm, such as: o Agricultural heritage exhibit o Tour of the agricultural land, educational active on farm operations. o Cart, sleigh and tractor rides. o Activities that promote or market livestock raised or kept on the land. o Petting zoo s. o Dog trials o Harvest festivals o Corn maze. The applicant is intending on doing daily tours of the farm as well as u-pick cherries. The applicant has submitted a plan to the ALC, and the ALC has advised that the proposed cabins meet the provisions for agri-tourism accommodation with the ALR. The City s OCP speaks to supporting accessory uses on farms, such as country inns, and bed and breakfast operations that increase the viability of farm operations, support agriculture and generally support the regional agricultural industry. The proposed cabins will help to provide supplementary income to the applicants. The proximity to the KVR could facilitate winery tours via bicycle or car which could result in positive economic spinoffs for the surrounding farming properties. Given the above, Staff are recommending that the Agriculture Advisory Committee provide positive support to Council for the proposed application. Deny Support for Application The Agricultural Advisory Committee may feel that the proposed use is not suitable in an agricultural area or that it may hinder farming activities. The AG Committee may also feel that although the ALC allows up to 10 sleeping units, a maximum of 4 sleeping units shall be permitted. If this is the case, the AG Committee should either deny support or place additional conditions on the application. Alternate Recommendations 1. THAT the Agriculture Advisory Committee recommends that Council deny RZ PL THAT the Agriculture Advisory Committee recommends that Council approve RZ PL with a condition that a maximum of four sleeping units is permitted Zoning Amendment 856 Carder Road Page 2 of 10
