1 Planning Commission ANNUAL REPORT TO THE BOARD OF SUPERVISORS FOR 2014 MEETINGS/MEMBERS Organizational Meeting The Planning Commission held its Organizational Meeting on February 4, Jerry Craig was elected Chairman and Tommy Scott was elected Vice-Chairman. Tim Wilson, Director of Community Development, was appointed to serve as Secretary for the Commission. The Planning Commission welcomed two new members: Harold Brown representing District 3 and Josiah Tillett representing District 4. Meetings The Planning Commission held 17 meetings in One of the meetings was held jointly on with the Board of Supervisors and was scheduled outside of the Commission s regular monthly meeting dates. One other regular monthly meeting was cancelled due to inclement weather. Eight other meetings were cancelled due to various reasons. Joint meeting with Board of Supervisors (BOS) The Planning Commission passed a motion recommending text amendments to Article IV Design and Use Standards, Sec Commercial Feedlots (Confined Animal Feeding Operations) of the Zoning Ordinance on A joint public hearing with the Board of Supervisors was conducted on with the Planning Commission voting 5-2 in favor of the proposed changes as amended by the Board of Supervisors. Work Sessions The Planning Commission held three work sessions in 2014 covering the following: Initial review of Citizen Advisory Committee (CAC) recommendations on the draft Comprehensive Plan 2025 update Review and discussion regarding the Future Land Use Map (FLUM) Review and discussion regarding the following uses in the Permitted Use Table: Agricultural subdivisions, alternative discharging sewage systems, commercial indoor amusement, commercial indoor entertainment, commercial stable, pawn shop, private stable, tattoo parlor, two-family dwelling (duplex), accessory structure, garden center, sawmills and accessory structures. Micro farming (pigs/goats or other animals in non-agricultural zoning districts was also discussed. The Commission requested staff provide additional information on the latter. 2 COMPREHENSIVE PLANNING Comprehensive Plan In 2014 work continued with the five-year review of the Plan as required by the Code of Virginia. The Commission devoted numerous meetings to reviewing the revised chapters of the Plan as well as the Future Land Use Map (FLUM), as presented by the Planning staff. In April 2014 the Commission began their review of the recommendations from the Citizen s Advisory Committee established in 2013 composed of 14 citizens, two from each district. The following sections of the Comprehensive Plan were discussed at work sessions or meetings listed below: Review and discussion of Chapter 10, Education Re-review and discussion of Chapter 6, Transportation and review of Chapter 12, Parks &Recreation Review and discussion of Chapter 13, Solid Waste Review and discussion of the Citizens Advisory Committee (CAC) comments from their review of the draft Comprehensive Plan 2025 update Review and discussion of the Citizens Advisory Committee (CAC) comments from their review of the draft Comprehensive Plan 2025 update Review and discussion of the Citizens Advisory Committee (CAC) comments from their review of the draft Comprehensive Plan 2025 update Planning Commission passed a motion with a vote of 3-2 to remove Chapter 14 Urban Development Areas (UDAs) from the draft Comprehensive Plan 2025 update Discussion of Future Land Use Map (FLUM) review process Discussion of Future Land Use Map Discussion of Future Land Use Map Discussion of removal of Chapter 14 UDAs and transportation funding Discussions of the remaining chapters of the draft plan were held in Bedford County Planning Commission Annual Report
3 SPECIAL REVIEW PROJECTS Three Special Review Projects were presented to the Planning Commission for action (Virginia Code ). SRP SRP SRP Determination if four projects are in substantial accord with the Comprehensive Plan: (1) Establish a new regional water treatment plat at former Moneta Adult Detention Center High Point Road; (2) alternate water treatment plan expansion in High Point subdivision; (3) upgrade existing raw water intake in High Point subdivision; and (4) construct 3 miles of raw waterline from intake location to new regional water treatment plant. Election District 2 Determination if five waterline projects from Smith Mountain Lake (SML) to Town of Bedford and Forest are in substantial accord with the Comprehensive Plan: (1) SML to Bedford interconnect Rt. 122; (2) Bedford Forest interconnect Rt. 460; (3) Bedford Forest interconnect Rt. 221; (4) SML to Bedford Rt. 122 bypass; and (5) White House Road loop. Election Districts 2, 3 and 7. Determination if the construction of a sewer line to serve Moneta Elementary school is in substantial accord with the Comprehensive Plan. 4 AMENDMENTS TO ZONING AND/OR SUBDIVISION ORDINANCES Text Amendments The Planning Commission reviewed and made recommendations to the Board of Supervisors on text amendments to both the Zoning and Subdivision ordinances as reflected below: Initiated by Amendment Recommendation Board of Supervisors R Board of Supervisors R Planning Commission Planning Commission from request of Board of Supervisors Planning Commission Planning Staff Amendments to Article 8, Waivers & Appeals of the Subdivision Ordinance. The amendment provides the Board of Supervisors the authority to grant waivers for the use of private streets in proposed subdivisions under specific circumstances and pursuant to additional permitting standards. Amendments to Article IV Use and Design Standards, Sec , Off Street Parking of the Zoning Ordinance to provide for a shorter and more generic listing of minimum parking requirements by use that would additionally provide the Zoning Administrator the authority to waive or modify general parking requirements on a case-by-case basis, and to further lessen or rescind other select general parking criteria, specifications and limitations. Amendments to Article IV Use & Design Standards, Sec Commercial Feedlots (Confined Animal Feeding Operations) of the Zoning Ordinance. Amendments to Sec Allowances of the Subdivision Ordinance Subdivision lots located in I-1, I-2 and PID zoning district shall be allowed to front on a private street. Private streets allowed under this subsection shall meet minimum VDOT right-of-way width and curve alignment standards in effect at the time of subdivision application submittal. Amendments to Article II - Definitions, Article III Permitted Use Table and Article V Development Standards of the Zoning Ordinance regarding agricultural subdivisions, alternative discharging sewage systems, commercial indoor amusement, commercial indoor entertainment, commercial stable, pawn shop, private stable, tattoo parlor, two family dwelling (duplex), and industry type II and III. Amendments to Article II Definitions, Article III Permitted Use Table and Article V Development Standards regarding flea markets and yard sales. Amendments to Article II Definitions and Article III Permitted Use Table regarding sawmills. 5 Map Amendments The Planning Commission held public hearings on four rezoning applications. RZ Gene R. Saunders & Marie Batten RZ Spencer & Susan Tinsley Gladys Meador Hoover RZ Maria Freire agent for Del Ankers Living Trust RZ Constantine Rosko Reclassification of 7 parcels PD-1 (Planned Development District) to R-1 (Low Density Residential District) & 13 parcels PD-1 (Planned Development District) to R-2 (Medium Density Residential District). The purpose is for the reversion of these parcels back to the original zoning designations approved under RZ Election District 2. Reclassification of acres among 3 parcels C-2 (General Commercial District) to AP (Agricultural/Rural Preserve District) to remove nonconforming status or split-zoning. Election District 2. Reclassification of one acre parcel from I- 2 (Higher-Intensity Industrial District) to AV (Agricultural Village District) and one acre parcel from AR/I-2 (Agricultural Residential District Higher-Intensity Industrial District) to AV (Agricultural Village District). There are no proposed uses for the properties being reclassified. Election District 7. Removal of 3 proffers applied to previously approved reclassification request RZ The proffers apply to the second phase of the development. Election District 7. 03/18/14 Approval 6-1 Approval /05/14 REVISIONS TO MASTER PLANS The Commission received one request for a Master Plan amendment. RZ Amendment to master plan for Thomas Change determined VC Enterprises, LLC Jefferson Crossing, shown as Commercial to be minor Area Five in the Concept Plan approved in Approval 5-0 the rezoning. This area is indicated as being 05/20/14 General Office. The amendment requested that the permitted use Residence above 1 st Floor Retail in Commercial Areas One through Nine, be amended to allow for a residence above 1 st Floor Office. 6 SPECIAL USE PERMITS The Planning Commission held public hearings on ten Special Use Permit applications. SU Curtis R., Jr. & Dara Farrar Reconsideration of SU approved by Planning Commission on to (1) increase the size of the stable, and (2) the location of the stable. Election District 5. Approval /07/14 SU William & Annelise Piatt SU Gary L. Hannabass Meeting Hall SU Kirk L. Hicks (Craft Collission Center) SU Roy Reaves SU Halesford Harbor LLC Tom Buck SU SU SU Southside Electric Cooperative SU David & Marianne Hardey Bed & Breakfast. Election District 2 02/18/14 Establish a Meeting Hall. The building will be used for public or private assembly for weddings or other special events. Election District 1. A change of use of an existing structure to Automobile Repair Services, Major. Election District 2. Establish an Industry, Type I use. The use will consist of a collection point for the processing and distribution of yard materials consisting of wood chips, brush, leaves and grass clippings. The yard materials will be processed and shipped by tractor-trailer to local plants to be utilized as fuel. Election District 4. 02/18/14 03/18/14 Expansion of an existing campground to consist of 23 park model sites and 7 recreational vehicle sites. Election District 2. Expand an existing Utility Services, Major use by more than 50 percent. The proposal is to construct a 1,100 square foot water intake pump station to replace the existing 100 square foot water intake pump station in the High Point Subdivision. Election District 2. 08/19/14 Construct a 30,000 square foot water treatment plant (Utility Services, Major use). Election District 2. Construct a 160 foot Wireless Communication Facility, Class 4. The proposed monopole will allow a new microwave radio link to communicate with equipment in the adjacent electrical substation. Election District 1. Use existing property and structures (home/lodge, cabin and barn) for a Conference Center use (wedding venue). 7 RECOMMENDATIONS TO THE BZA As required by the Code of Virginia, the Zoning Administrator forwarded one variance application to be heard by the Board of Zoning Appeals to the Planning Commission for review and possible recommendation. VP A variance to reduce the minimum required Approval 5-0 front and side yard setbacks along with an increase in the maximum lot coverage requirement of the R-2 (Medium Density Residential District). Additionally a variance from a general standard for the Utility Services, Major use that requires a major utility to be a minimum of 100 feet from an existing residence. Election District 2. FIELD TRIP Commissioners Burdett, Craig and Tillett along with County Planner Brad Robinson conducted a tour of 3 swine and poultry intensive livestock facilities on The farms were located at 1610 Alton Post Office Road, Alton, Va., 4031 Marion Road, Chatham, Va. and 2880 Climax Road, Chatham, Va. APPOINTMENTS - DEPARTURES New Planning Commissioners Harold Brown (District 3) and Josiah Tillett (District 4) made motions to appoint individuals to fill seats they previously held on the Citizens Advisory Committee (CAC). Mr. Mark Martin was nominated to fill Commissioner Brown s seat and Mr. John Moisa was nominated to fill Commissioner Tillett s seat. Each motion passed on with votes of 7-0. County Administrator Mark K. Reeter was appointed as Secretary to the Planning Commission on The appointment followed the resignation of the previous Secretary, Timothy L. Wilson. The new Director of Community Development, Gregg Zody was appointed as Secretary of the Planning Commission on Chairman Jerry Craig resigned from the Planning Commission on after accepting the position of Director of Tourism for Bedford County. Vice Chairman Tommy Scott will act as Chairman until elections are held at the annual organization meeting in February The Planning Commission honored two former members for their service. On January 14, 2014 Mr. Steve Wilkerson was recognized for 19 years of service on the Commission. On March 4, 2014 Mr. Fred Fralick was recognized for 10 years of service on the Commission.
