3 THAT Council hear from the applicants for Temporary Use Permit TP (Pellett). Ryan and Lindsay Pellett, Owners and Applicants Mr. Pellett noted he is flattered at how large the issue around the application has become in the community. They are simply looking to store 25 to 30 boats on the property for friends and neighbours and make good use of the existing building located on the property. In response to comments from Council Mr. Pellett noted the access onto Carr's Landing Road does not pose any issues. A 30-foot trailer can make the corner no problem with no blind spots. In addition there should be no use of the driveway other than by the owners. In response to the sprinkler system the Pelletts are aware of the Fire Chief's concerns but stated they are meeting and/or exceeding all of the National Fire Code requirements for indoor storage with no ignition sources and no stacked boats. Mr. Pellet stated the pictures taken October 4th are not related to the business operations and only show his personal materials. Both himself and his wife are full time parents and have full time jobs so the business will not be a large operation. They are happy to accommodate Council's recommendations and asked for consideration to approve the application. The Mayor asked if there were any other comments from the gallery. Sean Mewby, Owner of Seca Surf and Marine Mr. Mewby requested that Council deny the application. He noted that Seca Marine operates in Lake Country and followed all the proper guidelines and zoning processes to open and operate a business in the community. He noted that permitting the business to operate on a residential property without going through proper processes does not prove a level playing field for businesses in the community. The Mayor asked if there were any further comments from the gallery a first, second and third time. Brittaney Yeast, Owner and Operator Ms. Yeast noted she was unfamiliar with the process and believed that the inter-community business licence from Kelowna was sufficient for operating a business in the Okanagan. 4 being advised by the Bylaw Officer that the property was not zoned properly for operating a business, Ms. Yeast noted she is willing to take all necessary steps to ensure her business can continue to operate at the location. She said she is aware the School District owns the property and she will have to relocate. She has recently joined the Lake Country Chamber of Commerce and is fully insured at the site THAT Temporary Use Permit TP for Bottom Wood Lake Road, legally described as Lot 2 Section 10 Township 20 Osoyoos Division Yale District Plan 4073 Except Plan and Plan EPP17253, be approved for a term of 3 years. i Temporary Use Permit TP REN (Deschutter) Lot 1 Sec 21 Twp 20 ODYD Plan 17479; Pretty Road; The Mayor asked if there were any comments from the gallery a first, second and third time. There were none THAT Temporary Use Permit TP REN (Deschutter) for Pretty Road, legally described as Lot 1 Section 21 Township 20 ODYD Plan 17479, to allow for a daycare, preschool and out of school care facility, be approved subject to the conditions of the permit. iv) Development Variance Permit DVP (McMillan) Lot 13 Sec 8 Twp 14 ODYD Plan 22222; Whiskey Cove Road; Roll: The Mayor asked if there were any comments from the gallery a first, second and third time. There were none THAT Development Variance Permit DVP (McMillan) for Lot 13 Section 8 Township 14 Osoyoos Division Yale District Plan to allow for the installation of a U shaped dock be approved. OPPOSED: Councillor Gambell v) Development Permit DP with variance (Donhauser) Lot 13 Sec 22 Twp 20 ODYD Plan KAP55082; Middleton Road; Roll: The Mayor asked if there were any comments from the gallery, a first, second and third time. Vicki Topping Owner s Architect Ms. Topping noted the results of the geotechnical reports required the soil to be removed; therefore it was more feasible to build a double garage. He also announced Oyama s two Halloween events: Sunday, October 30 from 1:00-3:00pm for crafts, music and treats upstairs in the Community Hall and on Halloween evening there will be hot chocolate and a treat stop at the rear of the building. Councillor Ireland announced an Okanagan Centre Hall Pub Night will be held Friday, November 11.
