1 MINUTES BE IT remembered that on the 21st day of March 2016, at 9:00 A.M., the Board of Supervisors of Hinds County met in the Chancery Court Building, Board of Supervisors Room, Jackson, Mississippi; pursuant to the provisions of Mississippi Code 1972, Annotated, Section and resolution heretofore adopted by the Board. A notice posted pursuant to statute. INVOCATION PRESIDENT MCQUIRTER called the meeting to order at 9:05 A.M. County Administrator Carmen Davis offered the invocation. PLEDGE OF ALLEGIANCE PRESIDENT MCQUIRTER requested those in attendance to stand and join in reciting the Pledge of Allegiance. BID OPENING LSBP-25 (47) Gore Road Bridge Replacement Mr. Dan Tolar, Office of State Aid Road Construction, advised the Board that the engineering estimate for this project $217, He opened four bids for this project. UPON A motion of Robert Graham and a second by Mike Morgan, Peggy Hobson Calhoun voting aye, Bobby McGowan absent not voting, Darrel McQuirter voting aye, it Page 1 of 17

2 RESOLVED to approve to take under advisement the bids for LSBP-25(47) Gore Road Bridge Replacement. Document affixed hereto and incorporated herein. Volunteer Fire Grading Districts PUBLIC HEARING RESOLVED to approve opening the Public Hearing. The Public Hearing opened at 9:15 a.m. Assistant Emergency Management Director Joseph Perkins discussed the process going forward for the Fire Grating Districts and the benefits to county residents. There no other public comment. RESOLVED to approve closing the Public Hearing. The Public Hearing opened at 9:20 a.m. SERVICE PINS COUNTY ADMINISTRATOR Carmen Davis presented service award pins to the following Hinds County employees. Lillie Woods, Budget & Finance George Jones, Central Repair Shirley M. Harper, Justice Court Allison O. Kelly, Public Defender Latoya R. Dente, Sheriff s Department Donna M. Washington, Sheriff s Department Albert C. Shurden Jr., Sheriff s Department Crystal N. Allen, Youth Court 15 years of service 10 years of service 15 years of service 5 years of service 15 years of service 5 years of service 5 years of service 20 years of service ELECTED OFFICIALS Constables request for Board to Match State Retirement Constable Jerry Moore requested the Board to contribute the employer portion of the State Retirement match for the Constables. He stated that State statute allows the Board to pay the match portion of the Constable s State Retirement match. Attorney Teeuwissen requested time to review this request and asked the Supervisors to table this request. Page 2 of 17

3 Approve Purchase of Tasers for Certified Trained Constables Constable Jerry Moore requested Supervisors purchase Tasers for Constables. Attorney Teeuwissen requested the record to reflect that Tasers are not a non-lethal weapon. He stated that currently there are two litigation matters regarding Tasers. Attorney Teeuwissen requested that Constables provide proof of Certification and for those Constables not certified be required to participate in the Certification Program. UPON A motion of Robert Graham and a second by Mike Morgan, Peggy Hobson Calhoun voting aye, Darrel McQuirter voting aye, Bobby McGowan voting aye, it RESOLVED to approve purchasing Tasers at a cost up to $1,400 per Certified Trained Constable to be paid from unappropriated surplus. SHERIFF S DEPARTMENT Major Pete Luke, Sheriff s Department introduced Attorney Clara Barker as the Sheriff s Legal Counsel. APPROVAL OF MINUTES UPON A motion of Robert Graham and a second by Mike Morgan, Peggy Hobson Calhoun voting aye, Darrel McQuirter voting aye, Bobby McGowan voting aye, it RESOLVED to approve the Minutes of March 7, ELECTED OFFICIALS Tax Collector Request for 2 Additional Tag Investigators Tax Collector Eddie Fair requested two additional employees as Tag Investigators. A motion made by Supervisor Graham to approve two additional Tag Investigators. The motion seconded by Supervisor McGowan. Supervisor Morgan requested additional information from Mr. Fair. He advised the Board that he recently spent a day with the Tag Investigator. UPON A substitute motion of Mike Morgan and a second by Peggy Hobson Calhoun, Robert Graham voting aye, Bobby McGowan voting aye, Darrel McQuirter voting aye, it RESOLVED to approve hiring one additional Tag Investigator for the Tax Collector s office. ELECTED OFFICIALS Request for Office Furniture and Security System Circuit Clerk Zach Wallace requested the Board pay the cost for furniture and security cameras for the Circuit Clerks office. He advised that previous Clerk Barbara Dunn would turn over excess funds from 2015 of approximately thirty thousand dollars. He requested the Board allow these funds to cover the cost of a security system for the Circuit Clerk s office. Supervisor Calhoun suggested that the Board look at a comprehensive plan for security. A motion made Supervisor Graham to approve up Page 3 of 17

4 to $7,000 for a security system for the Circuit Clerk s office. The motion seconded by Supervisor Morgan. Supervisor Calhoun proposed a substitute motion to look for a comprehensive plan. Supervisor McQuirter seconded the substitute motion, with Supervisor Calhoun voting aye, Supervisor Graham voting nay, Supervisor McGowan voting nay, Supervisor McQuirter voting aye, Supervisor Morgan voting nay. The substitute motion failed. UPON THE original motion of Robert Graham and a second by Mike Morgan, Peggy Hobson Calhoun voting aye, Bobby McGowan voting aye, Darrel McQuirter voting aye, it RESOLVED to approve allocating up to $7,000 for a Security System for the Circuit Clerk s office. APPROVE BIDS LSBP-25(47) Gore Road Bridge Replacement Mr. Dan Tolar, Office of State Aid Road Construction, advised that the low bid from Oddee Smith approximately 3% below the estimate. He recommended the Board approve the bid from Oddee Smith. UPON A motion of Robert Graham and a second by Peggy Hobson Calhoun, Bobby McGowan voting aye, Darrel McQuirter voting aye, Mike Morgan voting aye, it RESOLVED to approve the low bid from Oddee Smith Construction, Inc., in the amount of $210, and approve an order of the Hinds County Board of Supervisors awarding contract and establishing project fund for LSBP-25(47), Gore Road Bridge Replacement. Honoring Dr. John Perkins RESOLUTION UPON A motion of Peggy Hobson Calhoun and a second by Robert Graham, Bobby McGowan voting aye, Darrel McQuirter voting aye, Mike Morgan voting aye, it RESOLVED to approve a Resolution of the Board of Supervisors of Hinds County, Mississippi honoring the invaluable contributions of Dr. John Perkins, an exemplary Public Servant, who continuously works to improve the quality of life for his fellow citizens. USE OF COUNTY PROPERTY Raymond Courthouse Use for City of Raymond Annual Country Fair UPON A motion of Robert Graham and a second by Bobby McGowan, Peggy Hobson Calhoun voting aye, Darrel McQuirter voting aye, Mike Morgan voting aye, it RESOLVED to authorize the County Administrator to approve the use of Hinds County Grounds through December 31, 2016 as requested pursuant to procedures in place. Hinds County Health Fair PERSONNEL Personnel Director Mickie Parker advised the Board that the County Health Fair scheduled for April 13 and 14, Additionally, the County would hold at 5k Walk/Run on April 16, CONTRACTS Inmate Food Services ABL Management, Inc. RESOLVED to approve extending the ABL Management contract on a month to month basis. ADVERTISEMENTS Request For Qualification Public Information Officer / Professional Consultant UPON A motion of Darrel McQuirter and a second by Peggy Hobson Calhoun, Robert Graham voting aye, Bobby McGowan voting aye, Mike Morgan voting aye, it RESOLVED to approve advertising for Requests for Qualifications for a Public Information Officer and a Professional Consultant. U-1763 Davis Mayfield PERMIT AND ZONING UPON A motion of Bobby McGowan and a second by Robert Graham, Peggy Hobson Calhoun voting aye, Darrel McQuirter voting aye, Mike Morgan voting aye, it RESOLVED to approve Petitioner s request for Dimensional Variance to construct a 1200 square foot accessory building on agricultural zone property. The planned use of the accessory building is to store camper, boar and antique truck. The property is located at 1482 Green Gable Drive, off Green Gable Road in District 5. HUMAN CAPITAL DEVELOPMENT Request for Funding of Six Officers/Sheriff s Deputies after 3 rd year of COPS Grant UPON A motion of Peggy Hobson Calhoun and a second by Robert Graham, Bobby McGowan voting aye, Darrel McQuirter voting aye, Mike Morgan voting aye, it RESOLVED to approve the 25% match for the COPS Grant for the first three years and to approve a 100% match for the fourth year to continue funding the COPS UHP Grant. The current expectation for funding the fourth year is $195, PURCHASING Reject Claim and Authorize Department to Obtain Court Order to Pay UPON A motion of Peggy Hobson Calhoun and a second by Robert Graham, Bobby McGowan absent not voting, Darrel McQuirter voting aye, Mike Morgan absent not voting, it RESOLVED to reject two invoices from Coast to Coast Solutions totaling $1, and to authorize the Purchasing Department to obtain a Court Order authorizing payment. 7 BUDGET & FINANCE Budget Amendments UPON A motion of Mike Morgan and a second by Robert Graham, Peggy Hobson Calhoun voting aye, Bobby McGowan voting aye, Darrel McQuirter voting aye, it RESOLVED to approve Budget Amendments representing Departmental requests to transfer between line items with the explanations provided with each amendment in compliance with GASB-34. There are several amendments that impact the General Fund unappropriated surplus totaling $54, Documents affixed hereto and incorporated herein. MINUTE INSERTIONS Carmen Davis, County Administrator, presented the following as minute insertions: A. Department of Public Works Completed Work Schedule for the month of February 2016 for Central Office, North, Southeast, and Southwest Maintenance Crews. B. Department of Public Works Tentative Work Schedule for the month of April 2016 for Central Office, North, Southeast, and Southwest Maintenance Crews. AMR Consolidated Agreement BOARD ATTORNEY Board Attorney Pieter Teeuwissen proposed a Consolidated Agreement with AMR in order to bring all the terms of various Agreements and Amendments under one umbrella. He stated that no new terms are included in this Consolidated Agreement. UPON A motion of Robert Graham and a second by Mike Morgan, Peggy Hobson Calhoun voting aye, Bobby McGowan voting aye, Darrel McQuirter voting aye, it RESOLVED to approve a Consolidated Agreement with AMR for Ambulance Services within Hinds County. Interlocal Agreement for Byram-Clinton Corridor Water Pipe Relocation RESOLVED to approve an Interlocal Agreement with the City of Jackson for the relocation of water pipes along the Byram-Clinton Corridor, with all costs to be borne by the county. Approve Supplemental Agreement No. 1 for MPO Project UPON A motion of Peggy Hobson Calhoun and a second by Robert Graham, Mike Morgan voting aye, Bobby McGowan voting aye, Darrel McQuirter voting aye, it RESOLVED to approve Supplemental Agreement Number 1 for Project No. STP (074) LPA/ for the Metropolitan Planning Organization Project for Vehicle Loops. 8 Tax Matter Parcel # (2012), Jesse Properties LLC Special Legal Counsel Scherrie Prince advised that parcel sold to the State of Mississippi at a Tax Sale, however the taxes for this parcel were received and need to be applied to the taxes owed. RESOLVED to approve Cancelling the Tax Sale for parcel # for 2012 taxes and to use the taxes previously paid as payment for these taxes. Risk Management MASIT Insurance Renewal RESOLVED to approve the Mississippi Association of Supervisors Property and Casualty Insurance Trust (MASIT) Insurance quote for the period April 1, 2016 through April 1, UPON A motion of Peggy Hobson Calhoun and a second by Robert Graham, Bobby McGowan voting aye, Darrel McQuirter voting aye, Mike Morgan voting aye, it RESOLVED to approve Porter s Insurance Agency and Fortson Insurance Agency as Agents of Record for the Mississippi Association of Supervisors Property and Casualty Insurance Trust (MASIT) insurance policy. Capital Hotel Associates Requisition #23 UPON A motion of Robert Graham and a second by Darrel McQuirter, Peggy Hobson Calhoun voting aye, Bobby McGowan voting aye, Mike Morgan voting aye, it RESOLVED to approve Capital Hotel Associates, LLC, Requisition No. 23 in the amount of $1,134,352.99, to be paid from the MDA $20,000, loan. Byram-Clinton Corridor Wastewater District / Southern Area UPON A motion of Peggy Hobson Calhoun and a second by Darrel McQuirter, Robert Graham not voting, Bobby McGowan voting aye, Mike Morgan voting aye, it RESOLVED to approve entering into an Interlocal Agreement or other Agreement for Wastewater Services from Highway 18 South to Terry, MS, including Byram, Terry or other political subdivision with the City of Jackson. There discussion of rural certificated water/tewater authorities. Attorney Teeuwissen advised that anyone who wants to join can, but the County is not taking away any authority from other providers. 9 Fuelman Card for Economic Development Authority Employee RESOLVED to approve and authorize the County Administrator to issue a Fuelman Card to Curnis Upkins of the Economic Development Authority General Obligation Bond Resolution RESOLVED to approve a Resolution of the Board of Supervisors of Hinds County, Mississippi authorizing and directing the issuance of not to exceed $7,000,000 Hinds County Mississippi General Obligation Refunding Bonds, Series 2016 A and not to exceed $2,600,000 Hinds County Mississippi Taxable General Obligation Refunding Bonds Series 2016 B for the purpose of refunding and/or restructuring certain outstanding debt of Hinds County, Mississippi and the Mississippi Development Bank; prescribing the form and details of said bonds; directing the preparation, execution and delivery of said bonds; providing certain covenants of said county in connection with said bonds; authorizing the negotiated sale of said bonds; approving the form of and the execution and delivery of a Bond Purchase agreement in connection with the sale of said bonds; approving the form of and the preparation and distribution of a preliminary official statement in connection with said bonds; directing the preparation and distribution of a final official statement in connection with said bonds; approving the form of and the execution and delivery of a continuing disclosure agreement in connection with said bonds; approving the form of and the execution and delivery of an Escrow Trust Agreement in connection with said bonds and said outstanding debt; and for related purposes. Litigation Update-Peter Green, Jr. v. Hinds County, MS, et al. for an amount to be paid by the insurance company in exchange for a full, complete and absolute release of all claims Litigation Update- Carl Frelix v.
