1 TUESDAY JULY 18, 2006 The Board of Supervisors met at 9:00 Tuesday the 18th day of July 2006, in the Supervisors' Room at the County Courthouse, Town of Poplarville, Mississippi with the following members of said Board and officers of said County present, to-wit: President, Danny Wise, member from District No. Two; Vice-President, Bettye Stockstill, member from District No. Five; Anthony Hales, member from District No. One; Larry Davis, member from District No. Three; Robert Thigpen, member from District No. Four; Nova Carroll, County Attorney; Adrain Lumpkin, County Administrator; David Earl Johnson, Chancery Clerk and Joe Stuart, Sheriff. The following proceedings were had and entered of record towit:

2 ORDER AUTHORIZING PERSONNEL CHANGES IN SHERIFF'S DEPARTMENT There came on this day to be considered by the Board of Supervisors of Pearl River County, Mississippi, the matter of authorizing personnel changes in Sheriff's Department. Upon motion made by Anthony Hales and seconded by Bettye Stockstill, the following order was adopted, to-wit: Be It Ordered by the Pearl River County Board of Supervisors to authorize personnel changes in the Sheriff's Department as follows: Termination of Corrections Officer Kristopher Molley effective Transfer Matt Pacyniak to Corrections Officer effective immediately. Hire Dana Odom as Custodian and office Clerk effective immediately. Move Felicia Dedeaux to Jail Records Department effective immediately. Move Christy Smith to Corrections Officer effective immediately. Hire Jennifer Fore as part-time Dispatcher and Kenneth Day as part-time Corrections effective immediately. Voting AYE: Anthony Hales, Danny Wise, Larry Davis, Robert Thigpen and Bettye Stockstill.

3 ORDER TO ADD PUBLIC DEFENDER SECRETARY TO COUNTY INSURANCE There came on this day to be considered by the Board of Supervisors of Pearl River County, Mississippi, the matter to add Public Defender secretary to County Insurance. Upon motion made by Anthony Hales and seconded by Larry Davis, the following order was adopted, to-wit: BE IT ORDERED by the Pearl River County Board of Supervisors to add Public Defender secretary to County Insurance. Voting AYE: Anthony Hales, Danny Wise, Larry Davis, and Bettye Stockstill. Voting NAY: Robert Thigpen.

4 ORDER TO APPROVE CIRCUIT COURT ORDER INCREASING SALARY OF COURT ADMINISTRATORS There came on this day to be considered by the Board of Supervisors of Pearl River County, Mississippi, the matter to approve Circuit Court Order Increasing Salary Of Court Administrators. Upon motion made by Anthony Hales and seconded by Bettye Stockstill, the following order was adopted, to-wit: Be It Ordered by the Pearl River County Board of Supervisors to approve Circuit Court Order Increasing Salary Of Court Administrators. Voting AYE: Anthony Hales, Danny Wise, Larry Davis, and Bettye Stockstill.

ORDER TO APPROVE NON-BINDING LOCAL OPTION 1% SALES TAX WITH MODIFICATION There came on this day to be considered by the Board of Supervisors of Pearl River County, Mississippi, the matter to approve Non-Binding Local Option 1% Sales Tax with modification. Upon motion made by Bettye Stockstill and seconded by Robert Thigpen, the following order was adopted, to-wit: Be It Ordered by the Pearl River County Board of Supervisors to approve Non-Binding Local Option 1% Sales Tax with modification.

ORDER TO ACCEPT PROPERTY DESCRIPTIONS AS RECOMMENDED BY LES DUNGAN There came on this day to be considered by the Board of Supervisors of Pearl River County, Mississippi, the matter to accept property descriptions as recommended by Les Dungan. Upon motion made by Bettye Stockstill and seconded by Larry Davis, the following order was adopted, to-wit:

7 Be It Ordered by the Pearl River County Board of Supervisors to accept descriptions as recommended by Les Dungan of property located in Industrial Park. Be It Further Ordered to direct County Attorney to prepare deeds and appraisals regarding the above mentioned descriptions for property swap between Pearl River County and The City of Poplarville. Voting AYE: Anthony Hales, Danny Wise, Larry Davis, Robert Thigpen and Bettye Stockstill. ORDER THAT PEARL RIVER COUNTY WILL COVER COST OF THE REQUIRED 1% FOR DEBRIS REMOVAL AFTER JUNE 30, 2006 There came on this day to be considered by the Board of Supervisors of Pearl River County, Mississippi, the matter that

8 Pearl River County will cover cost of the required 1% for debris removal after June 30, Upon motion made by Robert Thigpen and seconded by Bettye Stockstill, the following order was adopted, to-wit: Be It Ordered by the Pearl River County Board of Supervisors that Pearl River County will cover cost of the required 1%, not to exceed $10,000.00, for debris removal after June 30, Voting AYE: Anthony Hales, Danny Wise, Larry Davis, Robert Thigpen and Bettye Stockstill.

9 ORDER TO DIRECT COUNTY ENGINEER TO PREPARE RESOLUTION PRIORITIZING FUNDING FOR WIDENING HIGHWAY 11 THROUGHOUT PEARL RIVER COUNTY There came on this day to be considered by the Board of Supervisors of Pearl River County, Mississippi, the matter to direct County Engineer to prepare resolution prioritizing funding for widening highway 11 throughout Pearl River County. Upon motion made by Robert Thigpen and seconded by Bettye Stockstill, the following order was adopted, to-wit: Be It Ordered by the Pearl River County Board of Supervisors to direct County Engineer to prepare a resolution prioritizing funding for widening Highway 11 throughout Pearl River County. Voting AYE: Anthony Hales, Danny Wise, Larry Davis, Robert Thigpen and Bettye Stockstill.

10 ORDER TO ACCEPT INVOICES FOR DEBRIS REMOVAL There came on this day to be considered by the Board of Supervisors of Pearl River County, Mississippi, the matter to accept invoices for Debris Removal. Upon motion made by Anthony Hales and seconded by Bettye Stockstill, the following order was adopted, to-wit: Be It Ordered by the Pearl River County Board of Supervisors to accept invoice No. 15 from Dungan Engineering in amount of $34, for Debris Removal Monitoring Services DE Project No 1715C253 and Invoice 20 in amount of $187, DE Project No 1715C247 to be paid as funds become available. Voting AYE: Anthony Hales, Danny Wise, Larry Davis, Robert Thigpen and Bettye Stockstill.

11 ORDER TO APPROVE APPLICATION FOR FINAL PLAT APPROVAL OF NORTH HILL SUBDIVISION PHASE IV There came on this day to be considered by the Board of Supervisors of Pearl River County, Mississippi, the matter to approve application for final plat approval of North Hill Subdivision Phase IV. Upon motion made by Anthony Hales and seconded by Robert Thigpen, the following order was adopted, to-wit: Be It Ordered by the Pearl River County Board of Supervisors to approve with conditions 06S-14 Application for Final Plat Approval of North Hill Subdivision Phase IV, applicant and property owner, Legacy Ventures, LLC as recommended by the Planning Director. Voting AYE: Anthony Hales, Danny Wise, Larry Davis, Robert Thigpen and Bettye Stockstill.

12 ORDER TO DIRECT COUNTY ATTORNEY TO REQUEST AG OPINION REGARDING USE OF 911 FUNDS There came on this day to be considered by the Board of Supervisors of Pearl River County, Mississippi, the matter to direct County Attorney to request AG Opinion regarding use of 911 Funds. Upon motion made by Anthony Hales and seconded by Bettye Stockstill, the following order was adopted, to-wit: Be It Ordered by the Pearl River County Board of Supervisors to direct County Attorney to request an Attorney General Opinion regarding the use of 911 Funds to purchase a backup communication system for the county. Voting AYE: Anthony Hales, Danny Wise, Larry Davis, Robert Thigpen and Bettye Stockstill.

13 ORDER TO CONTINUE AGREEMENT WITH HIGHLAND COMMUNITY HOSPITAL'S WELLNESSWORKS PROGRAM There came on this day to be considered by the Board of Supervisors of Pearl River County, Mississippi, the matter to continue agreement with Highland Community Hospital's Wellnessworks Program. Upon motion made by Anthony Hales and seconded by Robert Thigpen, the following order was adopted, to-wit: Be It Ordered by the Pearl River County Board of Supervisors to continue agreement with Highland Community Hospital's Wellnessworks Program providing occupational health and wellness needs for County employees. Voting AYE: Anthony Hales, Danny Wise, Larry Davis, Robert Thigpen and Bettye Stockstill.

14 ORDER TO PURCHASE SEVEN BULLET PROOF VESTS FOR SHERIFF'S DEPARTMENT There came on this day to be considered by the Board of Supervisors of Pearl River County, Mississippi, the matter to purchase seven bullet proof vests for Sheriff's Department. Upon motion made by Robert Thigpen and seconded by Anthony Hales, the following order was adopted, to-wit: Be It Ordered by the Pearl River County Board of Supervisors to purchase seven bullet proof vests for Sheriff's Department. Voting AYE: Anthony Hales, Danny Wise, Larry Davis, Robert Thigpen and Bettye Stockstill.

15 ORDER TO AUTHORIZE PRESIDENT TO SIGN HAZARD MITIGATION GRANTS QUARTERLY REPORTS There came on this day to be considered by the Board of Supervisors of Pearl River County, Mississippi, the matter to authorize President to sign hazard Mitigation Grants Quarterly Reports. Upon motion made by Bettye Stockstill and seconded by Robert Thigpen, the following order was adopted, to-wit: Be It Ordered by the Pearl River County Board of Supervisors to authorize President to sign Hazard Mitigation Grants Quarterly Reports. INVOICE There came on this day to be considered by the Board of Supervisors of Pearl River County, Mississippi, the matter to approve Camp, Dresser & McKee, Inc. invoice. Upon motion made by Robert Thigpen and seconded by Bettye Stockstill, the following order was adopted, to-wit: Be It Ordered by the Pearl River County Board of Supervisors to approve to pay on docket Invoice in amount of $27, from Camp, Dresser & McKee, Inc. 17 ORDER TO ACKNOWLEDGE GRANT EXTENSION EMA 2004 CA 5027 There came on this day to be considered by the Board of Supervisors of Pearl River County, Mississippi, the matter to acknowledge Grant Extension EMS 2004 CA Upon motion made by Robert Thigpen and seconded by Bettye Stockstill, the following order was adopted, to-wit: Be It Ordered by the Pearl River County Board of Supervisors to acknowledge Grant Extension EMA 2004 CA 5027, which approves changes in the Statement of Work and extends the Period of Performance to June 30, Voting AYE: Anthony Hales, Danny Wise, Robert Thigpen and Bettye Stockstill.

BOARD OF SUPERVISORS MINUTES JULY TERM, 2006 ORDER TO APPROVE APPLICATION FOR PRELIMINARY PLAT APPROVAL FOR FLINT FARMS SUBDIVISION PHASE I There came on this day to be considered by the Board of Supervisors of Pearl River County, Mississippi, the matter to approve application for preliminary plat approval for Flint Farms Subdivision Phase I. Upon motion made by Bettye Stockstill and seconded by Robert Thigpen, the following order was adopted, to-wit: Be It Ordered by the Pearl River County Board of Supervisors to approve 05S-19 Application for Preliminary Plat Approval of Flint Farms Subdivision Phase I,

19 applicant and property owner, S. Douglas Flint, as recommended by the Planning Director. Upon motion made by Anthony Hales and seconded by Bettye Stockstill, the following order was adopted, to-wit: BE IT ORDERED by the Board of Supervisors that this Board do now return to regular session of the Board and to open said meeting to the general public. ORDER APPROVING PERSONNEL CHANGE IN E-911 DEPARTMENT There came on this day to be considered by the Board of Supervisors of Pearl River County, Mississippi, the matter of approving personnel changes in E-911 Department. Upon motion made by Bettye Stockstill and seconded by Anthony Hales, the following order was adopted, to-wit:

23 ORDER TO AUTHORIZE COUNTY ADMINISTRATOR TO SIGN MEMA ACKNOWLEDGMENT RECEIPT LETTER There came on this day to be considered by the Board of Supervisors of Pearl River County, Mississippi, the matter to authorize County Administrator to sign MEMA Acknowledgment Reciept Letter. Upon motion made by Bettye Stockstill and seconded by Robert Thigpen, the following order was adopted, to-wit: Be It Ordered by the Pearl River County Board of Supervisors to authorize County Administrator to sign MEMA Acknowledgment Reciept Letter for Reimbursement Payment #16 and #17 in amount of $140, Voting AYE: Danny Wise, Larry Davis, Robert Thigpen and Bettye Stockstill. 24 ORDER TO HOLD MEMA REIMBURSEMENT TO COUNTY VFD'S UNTIL BOARD REQUEST FOR DEPARTMENT INVENTORIES AND POLLING PRECINCT KEYS ARE SUBMITTED There came on this day to be considered by the Board of Supervisors of Pearl River County, Mississippi, the matter to hold MEMA reimbursement to County VFD's until Board request for department inventories and polling precincts keys are submitted. Upon motion made by Bettye Stockstill and seconded by Robert Thigpen, the following order was adopted, to-wit: Be It Ordered by the Pearl River County Board of Supervisors to hold MEMA reimbursement to County VFD's untill the department inventories and polling precincts keys are submitted to the County Administrator as previously requested by the Board on March 17, Voting AYE: Danny Wise, Larry Davis, Robert Thigpen and Bettye Stockstill. There came on this day to be considered by the Board of Supervisors of Pearl River County, Mississippi, the matter to authorize digital map copy of current tax map and landroll to TAB Map Co., Inc. Upon motion made by Robert Thigpen and seconded by Bettye Stockstill, the following order was adopted, to-wit: BE IT ORDERED by the Pearl River County Board of Supervisors to authorize digital map of current tax map and landroll to TAB Map Co., Inc. in exchange of 10 copies of the finished map from TAB Map Co., Inc. 29 ORDER TO MAKE PERSONNEL CHANGES IN TAX DEPARTMENT PART OF THE MINUTES There came on this day to be considered by the Board of Supervisors of Pearl River County, Mississippi, the matter to make personnel changes in Tax Department part of the minutes. Upon motion made by Larry Davis and seconded by Robert Thigpen, the following order was adopted, to-wit: BE IT ORDERED by the Pearl River County Board of Supervisors to make the following personnel changes in the Tax Department a part of the minutes: Accept resignation from Sylvia Stewart effective June 8, Voting AYE: Danny Wise, Larry Davis, Robert Thigpen and Bettye Stockstill. 30 ORDER TO DIRECT COUNTY ADMINISTRATOR AND COUNTY ATTORNEY TO WRITE RESOLUTION FOR YEARS OF SERVICE There came on this day to be considered by the Board of Supervisors of Pearl River County, Mississippi, the matter to direct County Administrator and County Attorney to write resolution for years of service. Upon motion made by Robert Thigpen and seconded by Anthony Hales, the following order was adopted, to-wit: BE IT ORDERED by the Pearl River County Board of Supervisors to direct County Administrator and County Attorney to write resolution for Sylvia Stewart regarding her years of serivce to the County. Voting AYE: Anthony Hales, Danny Wise, Larry Davis, Robert Thigpen and Bettye Stockstill.

31 ORDER OF THE BOARD OF SUPERVISORS RE: REAL AND PERSONAL PROPERTY ASSESSMENT ROLLSThis day came on to be considered by the Board of Supervisors of Pearl River County, the matter of the assessment of personal property for the year 2006 and of real property for the year 2006 and it appearing affirmatively to the Board that Gary Beach, Tax Assessor of said County, has completed the assessment of both real and personal property for the said year; that the said assessor filed the real and personal property assessment rolls with the clerk of this Board of Supervisors on or before the 3rd of July, 2006 as provided by law; and that said assessor made an affidavit and appended it to each of said rolls; that said affidavit showed that he has faithfully endeavored to ascertain and assess all the persons and property in said county; that he did not omit any person or thing, and did not place upon, or accept, an under- valuation of any property, through fear, favor or partiality; that he required every taxpayer to make the oath required to be taken by the person rendering a list of his taxable property, wherever possible; that the said assessor filed with the rolls, under oath, a list showing the name of every taxpayer who failed or refused to make oath to his tax list; that this Board of Supervisor, immediately at its July 10, 2006 meeting proceeded to equalize the said rolls, and has completed such equalization at least ten days before its August 7, 2006 meeting; That said Tax Assessor attended the meeting of this Board of Supervisors, while it was considering said assessments of persons and property, form day to day, and that he rendered all assistance which his knowledge and information enabled him to give; and that at the said meeting, this Board of Supervisors did then and there cause to be assessed all persons and things, found to be omitted from said rolls, and caused to be correctly valued all property found to be under-valued; that this Board carefully examined the land roll and saw that it embraced all the land in said county, and that it represented said lands as being the property of individuals, or the State, or the United States, according to the face; that it was taxable or not taxable according to law; that all such property is correctly described so as to be identified with certainty; that there are no double assessments; that all land improperly omitted from the real property rolls has been added thereto by this Board of Supervisors, or under it direction; that all land incorrectly and insufficiently described has been properly described; that all land which was no classed correctly or was under-valued has been classified and valued properly; that all corrections have been made in said rolls; and that all things required by law, have been done; IT IS THEREFORE, ORDERED by the Board of Supervisors of the said County, that the said assessment rolls, and the assessments therein contained, be, and they are hereby approved, with corrections, subject to the right of parties in interest to be heard on all objections hereafter made by them, and subject to further changes and corrections by this Board, as Authorized by law. It is further ordered by this Board of Supervisors that a notice be posted at the Courthouse, or Courthouses, in said County, and be published in

32 The Picayune Item, a newspaper published at Picayune, Mississippi, notifying the public and the taxpayers of said county: 1. That the said assessment rolls, so equalized, are ready for inspection and examination, and, 2. This Board will be in session for the purpose of hearing objections to the said assessments which may be filed, at the Courthouse in the town of Poplarville, Mississippi,said County and State, on the 7th day of August, 2006 and, 3. This Board will remain in session from day to day until all objections, lawfully filed, shall have been disposed of, and all proper corrections made in the roll. It is further ordered by the Board that notice shall be given to the public and to the taxpayers of said county in the following form: "PUBLIC NOTICE" "TO THE PUBLIC AND TO THE TAXPAYERS OF PEARL RIVER COUNTY, MISSISSIPPI: "You are hereby notified that the real and personal property assessment rolls of the above named county, for the year 2006 have been equalized according to law, and that said rolls are ready for inspection and examination and that any objections to said rolls or any assessment therein contained, shall be made in writing and filed with the clerk of the Board of Supervisors of said County, on or before the 7th of August,2006 at his office in the Courthouse of said county, and that all assessments to which objection is made, and which may be corrected and properly determined by this Board, will be made final by this Board of Supervisors, and that said rolls and the assessments contained therein will be approved by this Board of Supervisors; and that, "1. This Board will be in session, for the purpose of hearing objections to the said assessments which may be filed, at the courthouse in the town of Poplarville, Mississippi,said County and State on the 7th day of August, "2. This Board of Supervisors will remain in session from day to day until all objections, lawfully filed, shall have been disposed of and all proper corrections made in the said rolls. "Witness the signature and seal of the said Board of Supervisors the 18th day of July, 2006, and,

34 ORDER TO ADVERTISE FOR BIDS TO ROOF THE COURTHOUSE There came on this day to be considered by the Board of Supervisors of Pearl River County, Mississippi, the matter to advertise for bids to roof the Courthouse. Upon motion made by Larry Davis and seconded by Bettye Stockstill, the following order was adopted, to-wit: BE IT ORDERED by the Pearl River County Board of Supervisors to advertise for bids to roof the Courthouse. 35 ORDER TO APPROVE FINANCING THROUGH HANCOCK BANK FOR BUILDING CODES DIVISION There came on this day to be considered by the Board of Supervisors of Pearl River County, Mississippi, the matter to approve financing through Hancock Bank for Building Codes Division.
